1 PORTUGUESE WATER DOG CLUB OF AMERICA, INC BREEDER REFERRAL PROGAM & LITTER LISTING AGREEMENT Intrductin Dedicated, respnsible breeders f Prtuguese Water Dgs ( PWD ) adhere t a set f principles designed t prmte the welfare f the breed. The ultimate gal f respnsible breeders is t preserve and imprve the breed. The Prtuguese Water Dg Club f America, Inc. ( PWDCA ) endrses the fllwing guidelines fr PWD breeders. Enrllment in this prgram is pen t any PWDCA Vting Member ( Member ) in gd standing. (Refer t the PWDCA Bylaws fr a detailed explanatin f Vting membership.) Enrllment requires Member sign this Breeder Referral Prgram (BRP) Agreement ( Agreement ) and paying an annual enrllment fee. Members will be listed n the PWDCA Website ( under the Breeder Referral Prgram list. Members will be eligible t list their litters, as lng as they meet the requirements f the Agreement. Breeder Referral Prgram Fees Annual Enrllment Fee is $ Renewing Members enrlling prir t December 31 st will receive a reduced fee f $ After enrlling, Member may utilize the Breeder Referral Participants List ( List ) fr a 12-mnth perid, which runs frm January 1st thrugh December 31st ( prgram year ). If renewing Member enrlls in this prgram during the current prgram year (i.e. n r after January 1), Member must pay the full $50 listing fee. Breeder Referral Prgram Annual Listing Requirements Member agree t abide by and adhere t the PWDCA Cde f Ethics ( Member must fill ut an applicatin and submit electrnically t the BRP Crdinatr. The applicatin will becme part f this agreement. List f all litters wned r c-wned within the preceding calendar year. List f all dgs wned and c-wned alng with reprductive status. All dgs and litters must be listed in the Health & Litter Lg (HLL). Regardless f reprductin status, the PWDCA strngly recmmends that all dgs wned and c-wned have annual eye exams by a Bard Certified Ophthalmlgist up t 120 mnths. Member agrees t breed nly wned/c-wned dgs fllwing the PWDCA guidelines, wh are age tw years and lder and the breeding meets certain health requirements prir t breeding. This includes the Member ffering services f their Stud (wned r c-wned). 2 Member is expected t prvide truthful representatin f the health f all f their dgs and must advise ptential wners f any knwn health prblems that either sire r dam has r has prduced. Member must prvide wners, prir t transfer r sale, cpies f all health certificatins n the sire and dam. Member must ensure that puppies are eligible fr American Kennel Club (AKC) registratin. AKC papers shuld be supplied t the wner at the time f transfer r prvide a written bill f sale fllwing the AKC requirements under Chapter 4, Sectin 5, as may be amended frm time t time. In the event a purchaser must give up their dg and it cmes int the PWDCA Rescue and Relcatin prgram the Member will claim the dg. If the Member is unable r unwilling t claim the dg, the Member will pay in accrdance with the current fee schedules as utlined in the Plicy & Prcedure Manual. All litters bred r c-bred by Member must be input int the Health & Litter Lg within six (6) mnths frm date f birth. Stud dg wners will make best effrts t have litters prduced by their male included in the Health & Litter Lg. Member will maintain a recrd f all their breeding-related activities in accrdance with AKC s recrd-keeping requirements, including any necessary DNA requirements under AKC s current plicy. Member shall encurage each f their puppy buyers t apply fr assciate membership in the PWDCA inasmuch as the club, its members, and its publicatin(s) are a valuable surce f infrmatin fr PWD wners. Member Sales & Advertising Advertising, written r ral, shall be factual and nt misleading and shall be in cnfrmity with federal, state, and lcal cnsumer prtectin laws. PWDCA Litter Listing Guidelines Litters which are bred by the Member are eligible t be included in the PWDCA s Litter List f available puppies and dgs. C-bred litters are eligible t be listed as lng as the c-wner is a PWDCA Member (Vting, Assciate, Freign, Junir r Hnrary Member). All breeders f recrd must be in cnsent f the litter listing. Upn request, a written cnsent f the c-breeder(s) must be prvided. Failure t prvide cnsent will result in the remval f the litter listing. Listing will be under the BRP Member name nly and be fully respnsible fr all cmpliance under this agreement. If a dg is c-wned by tw r mre persns wh legally reside at the same address, wh are current PWDCA Members in gd standing and are in cmpliance with the BRP requirements, then each c-wner must sign this Agreement and n additinal enrllment fee shall be charged t that husehld. The prcedure fr listing a litter r lder dg parallels the PWDCA s current advertising guidelines utlined in The Curier and as utlined belw: Litter Listing Requirements: Prir t breeding, all health clearances must be cmpleted, current and entered int the Health & Litter Lg fr the bth the Sire and Dam. 3 Current (nrmal) OFA Eye Certificatin Registry (CAER) with passing rating fr Sire and Dam (up t the age f 120 mnths) Litters that are prduced frm frzen semen. a) If Sire is alive, the CAER must be current thrughut the litter listing perid except where the sire is ver 120 mnths f age r the CAER r a CERF (Canine Eye Registratin Fundatin) was current at such date. b) If the sire is deceased, the CAER r CERF exam status must have cmplied with the then current PWDCA health recmmendatins at the time f his death. Prgressive Retinal Atrphy (prcd-pra) Bth Sire and Dam are required t be tested with ne parent testing nrmal (nn-carrier). Labratry Clear Certificatin r certificatin f DNA parentage analysis via the Canine Health Infrmatin Center (CHIC) DNA parentage clear prgram. GM-1 Strage Disease (Ganglisisdsis) One parent, either Sire r Dam, testing nrmal (nn-carrier). Unaltered Dgs: Name, date f birth, disclsure f health testing results and sire / dam names. Testing nt cmpleted can be listed as Nt Tested. $15.00 payment made t the PWDCA. 4 PWDCA Litter (and dg) Listing Prcedures Member must cmplete the required PWDCA Litter Listing Frm and submit it electrnically t the Breeder Referral Crdinatr n the PWDCA website. Litters: Listing perid may begin fur (4) weeks befre the expected whelp date and can cntinue up t 12 weeks after the whelping date. Adult Dgs: Listing perid is 16 weeks. Upn written request, the Member may request a fur (4) week extensin. Written requests shall be sent t the Breeder Referral Prgram Crdinatr. All health infrmatin is cmplete, current and can be validated in the Health & Litter Lg. All litters must be listed in the HLL. Within six mnths frm a litter s whelping date, the litter registratin number, gender, cat type and clratin must be entered in the HLL database by the Member. Additinal Terms The Member may participate in breedings that d nt cmply with the BRP agreement as utlined here within. In rder t avid disciplinary actin, the Member must make ntificatin t the Breeder Referral Prgram Crdinatr. Ntificatin must be made n later than six weeks pst breeding. The Member will vluntarily remve themselves frm the Breeder Referral Prgram and Litter Listing fr three mnths. Prcedure: Ntificatin made in writing. Brief explanatin describing reasn fr self-remval. Sire / Dam AKC names and registratin numbers alng with the AKC litter number is required if a litter was bred utside f the f the BRP minimum requirements. Self-remval perid three (3) mnths. Member may reapply t the BRP after the self-remval perid. If reapplicatin is within the calendar year, the fee is $ Renewal in a new calendar year, immediately fllwing the self-remval perid, the fee is $ BRP Crdinatr will keep ntificatin recrds f self-remval. After three self-remvals requests, the BRP Crdinatr will refer the renewal request fllwing the self-remval t the PWDCA Bard f Directrs Disciplinary actin will be taken if a Member is fund t prduce a litter that des nt meet the BRP agreement requirements and n ntificatin was made. The PWDCA strngly recmmends all puppies be examined by a Bard Certified Ophthalmlgist. The American Kennel Club (AKC) made a frmal recmmendatin t micrchip all dgs and puppies. Best practices wuld include an eye exam and micrchipping puppies prir t placement. Disciplinary Actin Educatin and cmmunicatin are the preferred methds f btaining cmpliance t this Agreement; hwever, flagrant, serius and/r repeated disregard f this Agreement may result in frmal charges brught befre the PWDCA Bard f Directrs by any PWDCA members under the terms and cnditins utlined in the Club s Bylaws. 5 Cntract vilatins, as well as slanderus r libelus allegatins, arising between the Member and/r buyers r sellers shall be adjudicated in a curt f law, and the PWDCA shall nt be part f such curt prceedings. Hwever, if cmplaints made by ptential buyer, buyers r ther members which indicate that the Member is nt in cmpliance with the PWDCA Cde f Ethics (which encmpasses fraud r fraudulent advertising) r this Agreement, the BRP Administratr will bring these cmplaints t the PWDCA Bard f Directrs. The cmplaints will be reviewed by the PWDCA Bard f Directrs in Executive Sessin. Discipline actin will fllw as listed belw. If Member is nt in cmpliance under the terms f this Agreement, upn written ntificatin t Member by the PWDCA Bard r its designee(s), Member will be suspended frm the Breeders Referral Prgram and Litter Listing fr a perid f: a) First Offense: Six (6) mnths fllwing date f suspensin. b) Secnd Offense: Twelve (12) mnths fllwing date f suspensin. c) Three r mre ffenses: Review will be cnducted by the PWDCA Bard. At the discretin f the PWDCA Bard, the Member will be subject t suspensin frm the BRP prgram and Litter Listing (including c-wned litters) and/ r be remved as a PWDCA Member in gd standing. The suspended Member will be listed in the PWDCA Bard Meeting minutes. N litter listing can be transferred by the Member during the suspensin. Nte: If suspended Member is listed as a c-breeder, all listings will be suspended. N listing will be changed t a nn-suspended Member s name withut dcumentatin that the suspended Member s name has been remved frm AKC individual dg and litter registratins. Suspended Members may reapply t the BRP fllwing the suspensin perid. Reapplicatin fee is $50.00 Applicatins f Member that have had three r mre suspensins frm the BRP will require PWDCA Bard apprval. The BRP Crdinatr will frward the applicatin t the PWDCA Bard. Rewards and Incentives Members wh sign this Breeder Referral Agreement and pay the initial $50 fee, and wh adhere t and cmply with all reprting bligatins withut any written r verbal reminders frm the Breeder Referral Prgram Crdinatr, are eligible fr a reduced renewal fee f $25 renewal fee upn re-signing the Agreement during the renewal perid. The renewal perid runs frm Nvember 1 st thrugh December 31 st. Venue Any and all matters in dispute between the parties t this agreement, whether arising frm r relating t the Agreement itself, r arising frm the alleged extra-cntractual fasts prir t, during r subsequent t the agreement shall be gverned by and enfrced in accrdance with the laws f Wiscnsin, regardless f the legal thery upn which such matter is asserted. Civil actins will be brught frward in the Curts f Wd Cunty, Wiscnsin. This Agreement is signed vluntarily and des nt cnstitute the PWDCA s endrsement f a breeder. Any infractin as utlined abve, r under the Club s and/r AKC s Bylaws, shall result in an immediate suspensin f participatin in this prgram until such time that Member is reinstated.
