1 Oakleigh House, High Street, Thrapston Northamptonshire. NN14 4LJ Tel: Brian Pile SEPTEMBER PROFESSIONAL PONDERINGS Similarly to last year, the weather in August was rather catchy. The arable farmers amongst you would have been cursing the rain, but I suspect the livestock farmers were rather pleased to see it, as the grass was beginning to burn off and get short! Shortly after circulating last month s professional ponderings, DEFRA published further guidance in respect of the Basic Payment Scheme (BPS), namely The new Common Agricultural Policy schemes in England: August 2014 update. The publication provides an update generally, but principally concentrates on Greening and how it will work in practice. In our opinion, whilst the guidance does not provide chapter and verse on the new scheme, it does provide the most detailed information we have received to date. We understand that further information on greening will be available in October, by which time, it is likely to be too late for those that autumn drill. As such, we advise all arable farmers that intend to be drilling cereals at the end of this month to make sure that their cropping policy is compliant with the Greening requirements based upon what we know to date. It has been confirmed that some margins will count as Fallow land, so it may be that the Greening requirements are not as draconian as you first feared. An hour with one of the agricultural department will help you understand the rules. The agricultural department continue to be kept busy with a steady flow of clients instructing us to sell various parcels of land. Since last month s ponderings, we have brought onto the market for sale a small parcel of land between the villages of Orton and Loddington, which would ideally suit somebody looking for equestrian property or a small holding. We have two other parcels of land to bring onto the market for sale during September; the first parcel is circa 11 acres of pasture in Leicestershire and the second parcel is 125 acres of pasture in Northamptonshire. As expected, we have received plenty of interest in the arable land at Little Catworth, Cambridgeshire and also the arable land at Upwood, Cambridgeshire; it is likely that we will conclude both sales over the course of the next two weeks by best and final offers, so if you are interested, then please contact Nicola Clayton-Bailey or Anna Meynell. As always, please contact one of the agricultural department with your property requirements or to discuss the land market generally. Over the past few weeks, we been asked by landowners with O² or Vodafone telecoms mast(s) to provide advice in respect of correspondence received from their operator s Agent seeking variations to the lease including assigning the same to Cornerstone Telecommunication Infrastructure Ltd (CTIL). CTIL is a joint venture company set up by O² and Vodafone with the sole intention of reducing combined overheads/operating costs by sharing masts. We understand that the operators Agent has been appointed to assess sites which are geographically close to one another, and consequently provide a similar level of service. Correspondence we have seen ask for the Landlords consent to assign the Lease from O²/Vodafone to CTIL, or risk the lease being terminated as it is surplus to requirements. Where we have responded on behalf of clients rejecting or seeking to vary the proposed variations, the operators Agent has gone quiet, which suggests that they re looking to take the line of least resistance, i.e. those who do not take professional advice. As always, careful consideration is required before agreeing to any variation. Do not forget we have a machinery and implement sale at Millbrook, Bedfordshire on Saturday (6 th September 2014). In addition, we have a genuine farm dispersal sale in Bedford at the middle of next month further details to follow. Chris Templar Rural Surveyor 1
