3 NOTES VIEWING The poultry to be penned for viewing by 10.30AM. The Poultry may be viewed prior to the sale from 11AM. The Poultry area will be closed for judging from 11AM until 12Noon. DIRECTIONS From M5 Junction 24: (travelling North) take the first exit off of the roundabout, keep in left hand lane and take the first exit off the next roundabout onto the A38. The market entrance is located on the left hand side at the traffic lights. Continue along estate road to a statue of a bull, keep left. The market car park is found immediately beyond. For the loading bays keep left around the car park and follow to the rear of the market building. The poultry pennage will be found at the far end of the building. From M5 Junction 24: (travelling South) take the third exit and proceed as above. REFRESHMENTS Available at the Market Restaurant. PAYMENT Payment must be made in full to the Auctioneers on the sale day. No lots may be removed without an Auctioneer s pass confirming payment. Prospective purchasers who have not traded with the Auctioneers before are required to register. We are able to accept both debit and credit cards however credit cards will be subject to a 2% premium charge. BUYERS NUMBERS All prospective purchasers will be required to obtain a buyers number. These may be obtained from Greenslade Taylor Hunt market office. BUYERS PREMIUM The poultry will be sold in pounds sterling, to which a buyer s premium of 12.5% plus VAT will be added to all purchases. CONDITIONS OF SALE The sale will be conducted under Greenslade Taylor Hunt Conditions of Sale.

5 CONDITIONS OF SALE (Applicable to All Lots) (as amended at 1 st February 2012) 1. Subject to the reserve price (if any) being reached the highest bidder for any lot shall be the Purchaser and if any dispute should arise between two or more bidders the lot may be put up again at the highest undisputed bidding and resold: or the Auctioneers to bid on behalf of the vendor and may determine the dispute at their discretion their decision shall be final and conclusive. 2. The Auctioneers reserve to themselves the right of refusing any bidding they may deem it advisable to decline, and of withdrawing any lot or lots from the sale, and to sell in such order and combine lots as they may think fit. No bidding shall be retracted. 3. At the fall of the hammer, each Purchaser shall give to the Auctioneers his or her name and place of abode in writing (if required), and pay for any lots purchased by him at the close of the sale. 4. The Auctioneers describe the Lots to the best of their ability from information furnished by the Vendors, but undertake no liability whatever in respect of any faults, deficiencies and errors of description oral or printed. The Vendors who supply such statements are alone responsible for any errors or mis-statements which there may be. 5. In as much as the Auctioneers act only as Agents, they shall not be held personally liable for default on the part of either Vendor or Purchaser. 6. No Lot or Lots shall be removed from the premises until paid for, but each and every lot shall immediately at the fall of the hammer be considered as delivered, and be and remain in every aspect at the absolute risk of the respective Purchaser or Purchasers thereof, and shall be removed from the sale yard at the Purchase s expense and taken with all faults or errors save as hereinafter provided. 7. No undertaking of the Auctioneers or their servants to take charge of any lots after the sale or to forward them to the destination shall be held to impose upon the Auctioneers any legal, or equitable liability or obligation or vitiate any of these conditions. 8. Purchasers paying by cheque must be prepared if required to produce letter of credit from their bankers. 9. The Auctioneers may - at the request of the Purchaser - transfer goods to another Purchaser but the original Purchaser shall not cease to be responsible for the purchase money, and in the event of default may be sued for the same. 10.If any purchaser shall fail to comply with the above Conditions or any of them, the Auctioneers shall be at liberty to recover the full amount of purchase money of the lot

6 or lots bought by such Purchaser together with the interest thereon at the rate of, 15% per annum, costs, charges and expenses, without reference to any delivery or acceptance of the Lot or Lots, other than the first delivery by the fall of the hammer, or to resell any Lot or Lots bought by such Purchaser, either by Public or Private Sale, and the full amount of the purchase money at the present sale, or the deficiency (if any) arising from the second sale together with all interest thereon at the rate of, 15% per annum, costs, charges and expenses shall be made good by the defaulter and be recoverable as and for liquidated damages. 11.Accidents Neither Vendor nor Auctioneer will be responsible for any damage to life or limb or property, prior to or during the progress of the sale, or any time during the removal of lots. Cars are parked entirely at Owners risk. AUCTION RULES 1. No responsibility as to reserve prices can be accepted unless the same are communicated in writing to the Auctioneers at least a quarter-of-an-hour before the Auction. The Auctioneers will not hold themselves responsible for any Reserve Prices given verbally. Vendors must arrange to be present when their stock is being offered, as if a vendor has failed to place a reserve on any lot, and is not present at the time when it is offered, the lot in question will be sold without Reserve. 2. Should any bird for any reason not be sold by auction but is sold subsequently by private treaty as the result of its exposure for sale at the auction and in any case if it is sold before it leaves the yard the Vendor shall be liable to pay the commission in full on the agreed purchase price and in such case where the Vendor refuses to disclose the purchase price, at the reserve price or the price at which the bird was withdrawn from the auction, whichever shall be higher. 3. In the event of any claim being made by a Purchaser the Vendor shall under no circumstances be liable for consequential loss whether or not the bird the subject matter of the claim be sold with a guarantee of capability to get stock 4. In no case shall the vendor be liable for any claim exceeding the amount for which the bird was sold at this sale. 5. Poultry may be penned from 10am on the day of the sale. 6. All Poultry must be cleared from the sale building within one hour of the sale of the final lot. The Auctioneers reserve the right to resell/remove any lots which are still within the sale building after this time. 7. All Poultry to be sold in pounds ( s) and the bidding to be Per lot or cage. The Purchaser to take all birds in the lot.

7 8. BUYERS NUMBERS will be used potential buyers must obtain a Buyers Number from the sale office (in exchange for their Name, Address and Telephone Number) prior to the commencement of the sale. Two forms of formal identification will be required. 9. No lot will be delivered to any Purchaser without presentation of a Buyers Pass, and no lot may be removed from the cages without supervision by the Auctioneers Porters. 10. Any stock showing signs of excessive stress, ill health or injury may be removed from the sale at the Organisers discretion and no refund of Entry Fee will be made. 11. All lots to be sold in the order catalogued. Any lot which fails to reach its reserve price (if any) will be passed and no refund of Entry Fee will be made. 12. The Vendor of each lot is solely responsible for the correctness of information supplied regarding his entries. Purchasers are deemed to have satisfied themselves, by inspection, prior to sale, as to the physical quality, condition and description of each lot and every lot is sold with all faults and imperfections as seen. All lots are sold without warranty. 13. Any change to the lot as described on the Entry Form may only be made at the discretion of the Sales Organiser, and a notice of any change must be clearly displayed on the cage or pen by the Vendor once permission from the Auctioneers has been obtained. 14. Neither the Sale Organiser, nor the Auctioneers will be responsible for any accident or injury to persons or property through fire or any other cause whatsoever nor any damage by stock prior to, during or after the sale. All lots are the Vendors responsibility before the fall of the hammer and the Purchasers thereafter. 15. All lots are accepted for sale on the terms that the Vendor warrants his or her right to sell same and undertakes to indemnify the Sale Organisers/Auctioneers against any claims to which they may be exposed by reason of any defect in the Vendors title. 16. 28 ACTION PLAN FOR POULTRY SALES AT SEDGEMOOR AUCTION CENTRE To be implemented in the event of suspicion of notifiable disease: 1. Pig shed to be sealed and all doors closed to prevent entry of people or poultry. 2. Announcement of occurrence to be made on sale microphone in pig shed. Announcement of occurrence to be made on the market tannoy. 3. Local authority inspector to be notified. 4. Local veterinary inspector to be notified or if LVI (vet) not available, SVS to be telephoned on and duty VO notified. 5. Vendors and public to be removed from building. Names and addresses to be taken. Footwear to be cleansed and disinfected. Hands to be washed. 6. Protect your birds from the risk of Avian Influenza (Bird Flu) poster to be distributed.
