3 Related Text Page(s) Document: NARRATIVE/REMARKS Author: HAWKINS, MIKE S Subject: HAWKINS NARRATIVE Related date/time: Oct (Sat.) 2134 ON AT 2000 HOURS, I WAS DISPATCHED AS A COVER CAR TO THE PARKING LOT AND COMMON AREAS OF THE AURORA MEADOWS APARTMENTS AT 1090 N CIMMARON CIRCLE REFERENCE TWO GRAY AND WHITE PIT BULLS RUNNING AT LARGE. TWO REPORTING PARTIES HAD CALLED IN SAYING THAT A WOMAN WAS ATTACKED AND WAS ON THE GROUND AND THAT THE DOGS WERE CHASING AFTER PEOPLE. I RESPONDED ROUTINE AND ACTIVATED MY BODY WORN CAMERA ENROUTE TO THIS CALL FOR SERVICE. UPON ARRIVAL SEVERAL CITIZENS STANDING ON THEIR BALCONIES YELLED AND POINTED THE ANIMALS OUT TO ME. I REMAINED IN MY CAR AND OBSERVED THAT THESE DOGS APPEARED TO ME TO BE PIT BULL TERRIERS / STAFFORDSHIRE TERRIERS, A RESTRICTED BREED DOG IN THE CITY OF AURORA. THE DOGS RAN UP TO MY CAR AND JUMPED ONTO IT A COUPLE OF TIMES BARKING AT ME. IN MY 23 YEARS OF POLICE EXPERIENCE I HAD NEVER SEEN DOGS DO THIS. I WAS AWARE THAT THIS BREED OF DOG IS SOMETIMES BRED FOR FIGHTING AND THAT THIS BREED OF DOG IS FAVORED IN GANG SUB-CULTURE FOR THEIR EXCESSIVE BITE STRENGTH/POUNDS PER SQUARE INCH. I AIRED THIS INFORMATION AND REMAINED IN MY CAR. I DID RETRIEVE MY ISSUED SHOTGUN FROM THE LOCKED RACK AND LOADED IT AT THIS TIME AS THE DOG'S BEHAVIORS CONCERNED ME AND I HAD INFORMATION THAT THEY HAD ATTACKED A WOMAN. AT THIS POINT OFFICERS COE AND BEBEE ARRIVED NEXT TO MY CAR IN THEIRS. THEY ELECTED TO EXIT THEIR CAR. I NOTED A YOUNG WOMAN WALKING BY IN PROXIMITY TO THE DOGS, I BECAME WORRIED FOR THE SAFETY OF THIS WOMAN AND MY OFFICERS. I MOVED MY CAR AWAY FROM THE DOGS VICINITY. I EXITED MY CAR AND WAS MET BY THE LARGER OF THE TWO DOGS. IT WAS BARKING AND GROWLING AT ME, IT APPEARED STRONG AND WELL MUSCLED, IT'S HEAD WAS DOWN AND ITS EARS WERE PINNED. IT WAS LESS THAN 10 FEET AWAY FROM ME. BASED UPON POLICE IN-SERVICE TRAINING I'VE ATTENDED WITHIN THE LAST 5 YEARS I RECOGNIZED THIS BEHAVIOR AS A DOG THAT WAS ABOUT TO ATTACK ME. I WAS FRIGHTENED - I WAS AFRAID THAT THIS DOG COULD DO SERIOUS BODILY INJURY TO ME. I CAME UP ON TARGET CHECKED MY BACKGROUND AND SHOT THIS DOG ONE TIME WITH THE SHOTGUN CENTER MASS, IT RAN YELPING. IT IS MY CONSIDERED OPINION THAT THIS ACT WAS NECESSARY TO DEFEND MYSELF. I DO NOT BELIEVE A TASER, PEPPER SPRAY OR LESS LETHAL SHOTGUN WOULD HAVE BEEN EFFECTIVE. CITIZENS DIRECTED US TO DUE SOUTH OF THIS INCIDENT, BETWEEN APARTMENT BUILDINGS WHERE WE CONTACTED PARTICIA BUSTER (4.8.68) N CIMMARRON CIRCLE #308. SHE WAS SITTING ON THE GROUND WITH HER DACHSHUND. SHE APPEARED VISIBLY FRIGHTENED AND UPSET. I NOTED BLOOD SMEARS ON HER ARMS. SHE DECLINED PARAMEDIC SERVICES. SHE STATED SHE WAS WALKING HER DOG ON A LEASH WHEN ACCOSTED BY THESE DOGS. SHE PICKED UP HER DOG WHO WAS FRIGHTENED AND HAD SCRATCHED HER FOREARMS. For: Printed On: Oct (Thu.) Page 3 of 12
4 OFFICERS LOCATED THE WOUNDED DOG ON THE BACK STEPS OF AN ADAJCENT APARTMENT BUILDING WHERE IT WAS PLACED IN A NOOSE AND THEN PLACED IN AN ANIMAL WARDEN VEHICLE FOR TRANSPORT TO ALAMEDA EAST VETERINARY CLINIC. THE OTHER SMALLER DOG WAS NOT LOCATED AT THE TIME OF THIS REPORT. THE DOG'S OWNER DID ARRIVE ON SCENE AND A SUMMONS WAS ISSUED BY OFFICER WARNER. On , at approximately 2012hrs, I, Officer Warner, responded to 1090 Cimarron Cir, in the City of Aurora, Arapahoe County, State of Colorado, for two aggressive dog. I arrived and assisted in getting the dog contained. I observed the dog bleeding. As I caught the dog with a catch pole, the dog became more aggressive and started to bite at the pole and was growling. Animal Control arrived and I had them transport the dog to Alameda East for treatment. I was flagged down by Franciso Rodriquez DOB , who stated his daughter, later identified as Valeria Flores-Rios DOB , was missing her two dogs. I spoke to Valeria who stated her two dogs, "Luna" Am. Bulldog F/S blue and white and "Angelo" Am. Bulldog M/N blue and white, were missing from her house. Valeria stated her gate was open at her house and she suspects one of her neighbors let her dogs out but was not sure. Valeria stated the dogs are mom and son. Valeria stated when the dogs are together they act aggressive. For: Printed On: Oct (Thu.) Page 5 of 12
6 Follow Up Report # 1 Valeria arrived at the location. I advised her of the incident about the dog being aggressive in the neighborhood. The second dog was not located and ran off. Due to the dogs being off leash and no restraint, the aggressive behavior of the dogs, no collars or tags on the dogs, I issued summons K (a) Running at large X2, 14-7(a) Keeping vicious, aggressive or dangerous animals X2, 14-11(a) Rabies Tag not attached X2, 14-41(a) License required x1, 14-41(d) License tag not attached X2. I was advised by Animal Control, per their records, the two dogs above have been a subject of a summons for being aggressive and running at large. Coe ) responded to 1090 N. Cimarron Cir, City of Aurora, County of Arapahoe, State of Colorado, on a report of a civil animal complaint, two loose pit bulls in the area. Upon arrival I met with Sgt. Mike Hawkins already on scene. He was still in his patrol vehicle at the north end of the apartment complex and the two loose pit bulls were running loose around his patrol vehicle. The two dogs were barking and jumping on vehicles in the parking lot. Sgt. Hawkins repositioned his vehicle and parked facing north bound. As he parked his vehicle one of the dogs jumped at his passenger side window. As Sgt. Hawkins exited his vehicle the other pit bull approached him on the driver' side of his vehicle. I saw that Sgt. Hawkins had deployed his shotgun as he exited the vehicle. The bit bull continued to approach Sgt. Hawkins and began to bark and snarl in an aggressive manner. I saw that the animal had fixed his gaze on Sgt. Hawkins and began to lower his body towards the ground. Based on my previous training and experience regarding handling aggressive animals I recognized the dogs behavior as pre attack indicators. The pit bull began to approach Sgt. Hawkins in the above described manner and Sgt. Hawkins fired one shot at the animal with his shotgun. The shot appeared to For: Printed On: Oct (Thu.) Page 7 of 12
8 Follow Up Report # 2 strike the animal low center mass causing it to temporarily fall to the ground. The animal immediately jumped back to its feet and then ran south bound, away from our location. I did not see where the other dog went but it also left the area. At this point we were flagged down by an uninvolved party that related they had contacted another female that had been attacked by the dog. This party showed us to the apartment complex common area and I observed a female party sitting on the ground holding her small dog. I contacted the female party, she identified herself as, Patricia Buster (DOB: ) I asked if she was injured and she stated that she did not think she was. I checked Buster and did not observe any injures. I asked her what happened and she related that she was walking her dog in the common area on the grass when two pit bulls came out of nowhere and attacked her dog. She related that she jumped on top of her dog to protect it from the attack. She related that she remained on top of her dog until bystanders came to assist her and chased the pit bulls away. At this point the police arrived. I asked Buster if the bit bulls bit her and she said she did not think so. I asked Buster if she would like medics to respond to check on her and she refused medical treatment. After taking her statement I walked with Buster back to her unit due to the fact that the two dogs were still loose at this time. Officers were in the area actively looking for the animals. After Buster was returned to her building I observed that the pit bull that had been shot was now behind me near the doorway of Busters building. When I saw that dog I observed that it was bleeding from wounds to its front area. When the dog saw me it walked away, south bound, around the corner of the building and out of sight. I followed the blood trail to the front of building 1091 and saw that the dog was standing on the south side of the building. Officers established a perimeter around the animal and Officer Chad Warner utilized a dog catcher pole to secure that dog.
