Incident No: Title: NARRATIVE Report Type: I Date Entered: 4/18/2018 On Sunday April the 15th, 2018 Humane Society of Louisiana Executive Director Jeff Dorson made contact with Washington Parish Sheriff s Office Criminal Investigations Division Detective Demmie Rice; in reference to receiving complaints on several dogs being neglected and left in an over grown lot near Piggott s Crossing Road in Washington Parish. On Monday April the 16th, 2018 at approximately 06:30 hours Det. Rice located the described area; finding 11 dogs severely malnourished. The 11 dogs were found in heavily over grown grass and areas infested with insects. The 11 dogs of various sizes and breeds all show obvious signs of being neglected. Det. Rice observed that of the 11 dogs, 8 had ribs and backbones showing and skin clinging, the 3 other dogs pups appearing to be 4 months old also had some showing of ribs. Det. Rice observed that the dogs 8 were on heavy chains with the 3 pups in a make shift cage/kennel built around a tree. The 8 dogs and 3 pups either had no water or larva infested water or rusty dirty water. Shelters for the dogs, 2 had a dog house, 1 had a broken pet taxi and remaining had barrels. Det. Rice found the all but 1 shelter was adequate for shade, however inadequate for prevention of cold and rain, however broken pet taxi was badly in need of repair. Det. Rice after leaving the location met with Humane Society member (within Washington Parish and was able to obtained food for the dogs for 2 days. Due to Det. Rice not having her debit card on her at the time, asked the Humane Society member if they could donate some food for the dog. The Humane Society member spoke with a co-worker who was a former employee of Pet's Mart for 20 years, who advised to feed the dogs high protein puppy food. The Humane Society member then purchased 2 cases of puppy food and small bag of dry puppy food totalling $ Det. Rice then returned to the location. Upon feeding the dogs, dogs were biting at the cans of dog food before Det. Rice could empty them out in pans found in the area. The dogs appeared to inhale the food as if taking breaths of air. The pans that Det. Rice found appeared to not have been use in days, having dry dirt/dust on it. Det. Rice checked with neighboring residents to find out that the owners of the dogs Jesse James Hodges had not been seen there in days. Also advising that his wife Shelly Hodges, worked at Tractor Supply. On Tuesday April the 17th 2018 again went to check on the dogs on Piggott s Crossing; Dogs were in the same condition as Det. Rice had left them. Det. Rice again fed the dogs with the remaining dog food and found no signs that the owner or anyone else had been there to check on the dogs and to see to their needs. On Wednesday April the 18th, 2018 at approximately 07:45 hours, Det. Rice arrived at the Piggott s Crossing location, finding the dogs still had not been tended to. As Det. Rice was walking up to her unit a van drove up behind Det. Rice s unit. The van was driven by a white male later identified as Jesse James Hodges, was accompanied by Hodges was his wife Shelly Hodges, whom Det. Rice recognized from working at Tractor Supply and already being familiar with Shelly Hodges. Det. Rice advised Hodges that she had received complaint that the dogs on his property were being neglected and was there to investigate the complaint. Hodges immediately stated that he took

5 Page 5 care of his dogs everyday and why was Det. Rice there. Det. Rice then advised Hodges that she had received the complaint was had been checking on the dogs for several days. Advising Hodges of the neglect she had found. Hodges became irate and aggressive towards Det. Rice stating you re not taking my dogs. Det. This caused Det. Rice to advise Hodges and his wife Shelly to step back and stand by their vehicle. Hodges ignored Det. Rice request. Det. Rice then ordered Hodges and his wife Shelly to step back and stay by their vehicle. Det. Rice then requested assistance from W. P. S. O. Patrol. Upon the arrival of Sgt. David Cupp and Det. Kody Glenn Hodges seemed to calm down. Having prior knowledge of Jesse James Hodges had a warrant for his arrest, Det. Rice advised Hodges that he was being placed under arrest for the Warrant and 11 counts of Cruelty to an Animal. While Sgt. Cupp was placing Hodges in handcuffs and patting him down for weapons, Det. Rice advised Hodges of his Rights as per Miranda, of which he gave verbal acknowledgment he understood. Hodges stated he might have missed a day but he had been feeding and watering his dogs every day. Hodges also advised that none of his dogs had been vaccinated for rabies, stating the vet told him his dogs had to be a year old Definitions; cruelty to animals The following words, phrases, and terms as used in R.S. 14:102.1 through R.S. 14:102.4 shall be defined and construed as follows: (1) "Cruel" means every act or failure to act whereby unjustifiable physical pain or suffering is caused or permitted. (2) "Abandons" means to completely forsake and desert an animal previously under the custody or possession of a person without making reasonable arrangements for its proper care, sustenance, and shelter. (3) "Proper food" means providing each animal with daily food of sufficient quality and quantity to prevent unnecessary or unjustifiable suffering by the animal. (4) "Proper water" means providing each animal with daily water of sufficient quality and quantity to prevent unnecessary or unjustifiable suffering by the animal. (5) "Proper shelter" means providing each animal with adequate shelter from the elements as required to prevent unnecessary or unjustifiable suffering by the animal. (6) "Proper veterinary care" means providing each animal with veterinary care sufficient to prevent unnecessary or unjustifiable physical pain or suffering by the animal Cruelty to animals; simple and aggravated A.(1) Any person who intentionally or with criminal negligence commits any of the following shall be guilty of simple cruelty to animals: (a) Overdrives, overloads, drives when overloaded, or overworks a living animal. (b) Torments, cruelly beats, or unjustifiably injures any living animal, whether belonging to himself or another. (c) Having charge, custody, or possession of any animal, either as owner or otherwise, unjustifiably fails to provide it with proper food, proper drink, proper shelter, or proper veterinary care.

6 Page 6 (d) Abandons any animal. A person shall not be considered to have abandoned an animal if he delivers to an animal control center an animal which he found running at large. (e) Impounds or confines or causes to be impounded or confined in a pound or other place, a living animal and fails to supply it during such confinement with proper food, proper drink, and proper shelter. (f) Carries, or causes to be carried, a living animal in or upon a vehicle or otherwise, in a cruel or inhumane manner. (g) Unjustifiably administers any poisonous or noxious drug or substance to any domestic animal or unjustifiably exposes any such drug or substance, with intent that the same shall be taken or swallowed by any domestic animal. (h) Injures any animal belonging to another person. (i) Mistreats any living animal by any act or omission whereby unnecessary or unjustifiable physical pain, suffering or death is caused to or permitted upon the animal. (j) Causes or procures to be done by any person any act enumerated in this Subsection. (2)(a) Whoever commits the crime of simple cruelty to animals shall be fined not more than one thousand dollars, or imprisoned for not more than six months, or both. (b) Whoever commits a second or subsequent offense of simple cruelty to animals shall be fined not less than five thousand dollars nor more than twenty-five thousand dollars or imprisoned, with or without hard labor, for not less than one year nor more than ten years, or both. In addition, the court shall issue an order prohibiting the defendant from owning or keeping animals for a period of time deemed appropriate by the court. (c) In addition to any other penalty imposed, a person who commits the crime of cruelty to animals shall be ordered to perform five eight-hour days
