Ordini/ Gli ordini, anche se assunti tramite agenti e rappresentanti, s intendono sempre salvo approvazione della casa e non possono essere revocati da parte del committente. a conferma d ordine inviata dall azienda è definitiva ed impegnativa per il cliente che non può in nessun caso annullare l ordine Consegna e Spedizione/ I termini di consegna scritti nella conferma d ordine sono indicativi e mai impegnativi. a merce viaggia sempre a rischio e pericolo del committente anche se viaggia in porto franco Pagamenti/ I pagamenti devono essere fatti presso la sede dell azienda alle condizioni stabilite. Nel caso di ritardo nei pagamenti il compratore dovrà corrispondere gli interessi convenzionali nella misura di (otto) punti oltre all Euribor a 3 mesi Reclami/ Prima di accettare la merce dal vettore il cliente deve controllare scrupolosamente la merce ed annotare eventuali perdite o danni sul D.D.T. Se ci sono perdite o danni il cliente deve informare immediatamente il vettore. Se il danno è nascosto o non rilevabile finché la merce non è sballata, il cliente deve indicare sul D.D.T. la dicitura con riserva di controllo del materiale o simili. I reclami nei confronti dell azienda verranno presi in considerazione solo se formulati per iscritto ed inviati a mezzo lettera raccomandata entro (otto) giorni dal ricevimento della merce. I reclami non hanno effetto sulle scadenze di pagamento Resi di Merce/ Qualsiasi reso potrà essere accettato solo se preventivamente autorizzato per iscritto dall azienda e comunque dovrà essere accompagnato da regolare D.D.T. indicante gli estremi del documento di acquisto Controversie/ In caso di controversie viene riconosciuta l esclusiva competenza del Foro della Venditrice Riserva di proprietà/ a merce consegnata rimane di proprietà dell azienda fino a totale pagamento della fornitura General Information 1) Finishes a) The finishes are those of the sample book. For special finishes please ask availability and surcharge to the factory b) Slight colour differences of the element that make up the product are always possible; furthermore in case of products purchased at different times, changes in colour and/or shade are likely. These differences shall not give rise to claims and/or returns of goods c) Due to technical reasons is not possible to guarantee the perfect correspondence of the finishes reproduced in this brochure 2) Models, specifications and dimensions a) The factory reserves the right to change its models as deemed necessary to cancel some products without prior notice b) The specifications and dimensions indicated in the catalogue and/or in the price-list are approximate and not binding 3) Upholtery with materials supplied by the customer a) unit consumptions of fabric refer to upholstery of at least pieces. Sales CONditions The acceptance of the following conditions by the buyer occurs at the same time as the beginning of the performance of the contract. The contract is understood to be drawn and signed at the factory head office. The order confirmation sent by the factory to the Buyer is final and binding for the Buyer who can not cancel the order under any circumstances Delivery and Shipping/ The delivery terms indicated in the order confirmation / Proforma Invoice are approximate and never binding. Goods travels at buyer s risk even if shipped free of charge. If Buyer cannot collect the goods when they are ready, the factory reserves the right to place them in a special warehouse, debiting to the Buyer handling and warehousing costs and fares Payment/ Payments shall always be made to the factory head office as provided in the agreed payment terms. In case of delay in payment the Buyer shall be charged with conventional interests on a basis of (eight) points over the quarterly Euribor rate Claims/ Before accepting goods from the forwarding agent the Buyer shall carefully inspect them and specify any loss or damage on the delivery note. Should the damage not be visible before unpacking, the Buyer shall write on the delivery note under reserve of inspection of the goods or similar. Claims have to be forwarded to the factory within (eight) days from the receipt of the goods by registered letter showing delivery details. Should no claims be forwarded during this period the goods shall be considered accepted. Claims shall not give cause to change in payment terms. Returns/ Returned goods shall be accepted only if previously authorised by the factory in write and shall travel with regular delivery note stating the data of purchasing document Controversies/ In case of controversies, the Court of the Seller shall be the only one having jurisdiction Ownership/ Consigned goods shall be owned by the factory until full payment 1
