2 Part 2: Design of monitoring plan Pesticide Residue Control Plan for the year 2012 is laid down in Commission Regulation No 915/2010, concerning the coordinated multiannual community control program of the Union for 2011, 2012 and 2013 to ensure compliance with maximum residue levels and to assess the consumer exposure to pesticide residues in and on food of plant and animal origin. Estonian national monitoring program contains a minimum number of samples to be taken and analyzed according to Commission Regulation No 915/2010 and it also includes risk based sampling plan provided by Agricultural Board (AB) and Veterinary and Food Board (VFB). In the year 2012 the VFB sampling plan contains the commodities laid down in the Regulation 915/2010 and vegetable based baby food samples (see Table 2. The national sampling plan for year 2012). Sampling is part of the routine surveillance activity. Inspectors of the VFB county centers carry out sampling for residues of foodstuffs in the context of food control activity according to the provisions of the law and by the monitoring plan and guide prepared by VFB central office. Samples are taken using the sampling method outlined in Commission Directive 2002/63/EC for the official control of pesticide residues. Samples (according to VFB plan) are planned to be taken from storage (S), retail (R), processing/production (P) level. Where possible the samples are taken randomly at storage level. The number of samples to be taken from domestic or imported foodstuff is depending on the availability of the foodstuffs on the market. While a relatively high percentage of fruits origin from Third countries (TC), it is not possible to predict the actual numbers of domestic or European Union (EU) or TC samples of certain foodstuffs. In 2012 there is an opportunity to analyze many samples of commodities which are originated from TC (e.g. table grapes, orange juice and bananas). But some of the commodities are suitable to take samples from domestic production (e.g. wheat, chicken eggs, cauliflower) and from EU production (e.g. peppers, olive oil, chicken eggs, broccoli). The number of organic products to be analyzed is depending from the actual market situation and from the crops harvested by farmers. Sampling plan of surveillance of use of plant protection products will be drawn up by AB at primary production (PP) level. AB s sampling plan is based on evaluated risks and results of previous year s sampling, attached in annual control plan. Crops cultivated each year and Estonians eating habits are also included. Sampling for residues of use of plant protection products of plant origin foodstuff is carried out by inspectors of AB county centers. Samples are taken using the sampling method outlined in Commission Directive 2002/63/EC for the official control of pesticide residues. The analytical results of surveillance of use of plant protection products will be included in the pesticide monitoring program at the end of the year The exact numbers of samples per commodity are not yet finite and will be corrected after finishing this years sampling and analyzing the results and risks. 4 Part 3: Analytical Methods and Quality Assurance Two laboratories analyze the samples: Health Board Tartu laboratory in Tartu (HB) and Agricultural Research Centre Laboratory for Residues and Contaminants in Saku (ARC). The laboratories are accredited by the Estonian Accreditation Centre (EAK) for all analytical methods used for official control of pesticide residues in food. All certificates of the accreditation can be found on the website of the EAK ( The EC guidelines SANCO/2007/3131 Method Validation and Quality Control procedures for Pesticide Residues have been implemented as far as practicable. The ARC laboratory uses multi-residue method for pesticide residue analysis in food of plant origin and a single residue method for determination of dithiocarbamates from food of plant origin; glyphosate, chlormequat and mepiquat residues in cereals. The list of residues which the laboratory analyzes is given in Table 3. The HB Tartu laboratory uses multi-residue method for pesticide residues analysis in food of plant and animal origin and in baby food. A single residue method is used for determination of dithiocarbamates in food. The list of residues which the laboratory analyzes is given in Table 4. During each year both laboratories plan to add analytes to their multi-residue methods and therefore the lists which are given in tables 3 and 4 are not complete for the year Unfortunay in many cases the residue definitions can not be achieved by laboratories because some metabolites are unstable and are difficult to detect and therefore difficult to add to the multi-residue methods. In case of exceeding the MRL (as defined in the Regulation (EC) No 396/2005) enforcement actions will be taken. Competent authority VFB gives a precept (injunction) according to national Food Act and Regulation No 178/2002 and prohibits the handling or delivery to the final consumer of this particular unsafe food. The product will be withdrawn from the market, it is organized by that food business operator (for example food processor, wholesaler, importer) who s product was analyzed and the result was non-complaint. Whenever possible follow-up samples from the same food business operator s food are taken next year. When a result is numerically close to MRL or is numerically exceeding the MRL or is actually exceeding the MRL then a risk assessment is conducted and when appropriate a RASFF notification is issued. EFSA acute chronic model and Guidance Document on Notification criteria for pesticide residue findings to the Rapid Alert System for Food and Feed (RASFF) is used for the risk assessment. 17
