If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification [A11 j (4)] 2 To disqualify her from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club [A11 j (5)] 3 To disqualify her from acting as an Officer or serving on the committee of any canine society [A11 j (6)] 4 To disqualify her from taking part in the management of any event licensed by the Kennel Club. The Committee noted that Mrs Gobin did not respond to the referral under Rule A12 and therefore no mitigation or contrition has been expressed. The Committee noted that a five year disqualification from owning/keeping dogs was imposed by the Magistrates Court. Mrs Gobin was an experienced breeder and it is apparent from this conviction that there was a blatant disregard for the welfare of the whelping bitch which is entirely unacceptable. At its meeting on 24 September 2015, the Kennel Club Disciplinary Sub-Committee considered the convictions of Mr T McGougan of Andover, from the East Dorset Magistrates Court for offences contrary to the Consumer Protection from Unfair Trading Regulations The Committee imposed the following penalties: 1 To disqualify him from exhibiting at, taking part in, attending and/or having any connection with any event licensed by the Kennel Club. If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification [A11 j (4)] 2 To disqualify him from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club [A11 j (5)] 3 To disqualify him from acting as an Officer or serving on the committee of any canine society [A11 j (6)] 4 To disqualify him from taking part in the management of any event licensed by the Kennel Club. [A11 j (9)] The above listed disqualifications are to be for six years (6) years from 24 September The Committee noted that Mr McGougan did not respond to the referral under Rule A12 and therefore no mitigation or contrition has been expressed. The Committee considered that for a breeder to deliberately mislead and not provide vital information to a purchaser of a Kennel Club registered dog about the health and known condition affecting a puppy is a serious matter. It undermines the confidence and trust which a puppy buyer is entitled to have when buying a Kennel Club registered dog. At its meeting on 24 September 2015, the Kennel Club Disciplinary Sub-Committee considered the conviction of Mrs S Pope of Wistanswick, from the Shropshire Magistrates Court for offences contrary to the Animal Welfare Act The Committee imposed the following penalties: 1 To disqualify her from exhibiting at, taking part in, attending and/or having any connection with any event licensed by the Kennel Club. If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification for a period of twelve months from 24 September 2015 [A11 j (4)] 2 To disqualify her from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club for a period of twelve months from 24 September 2015 [A11 j (5)] 3 To disqualify her from acting as an Officer or serving on the committee of any canine society for a period of fifteen (15) years from 24 September 2015 [A11 j (6)] 4 To disqualify her from taking part in the management of any event licensed by the Kennel Club for a period of fifteen (15) years from 24 September 2015 [A11 j (7)] 5 To disqualify her from judging at any event licensed by the Kennel Club for a period of fifteen (15) years from 24 September 2015 [A11 j (8)] The Committee, following the imposition of these penalties, would draw the attention of the Respondent to the effect of Rule A11 sub-section n. The Committee noted that the Magistrates Court had imposed a disqualification order for life upon Mrs Pope from keeping horses. The mitigation in terms of personal circumstances, the character references and the significant contribution made by Mrs Pope to the breed over many years was taken into account. There was no suggestion that the dogs in her care were or are at risk in terms of welfare. The conviction arose from horses not being properly inspected and cared for. Good animal husbandry is a paramount concern for anyone involved at any level in the care and keeping of animal(s). The conviction cannot therefore go unremarked and without reaction and penalty. A11 DISCIPLINARY CASES At its meeting on 30 July 2015, the Kennel Club Disciplinary Sub-Committee considered a complaint brought by the Kennel Club under Kennel Club Rule A11 a (1) (b) against Mr T Sainsbury; namely that he behaved discreditably and prejudicially to the interests of the canine world, in that he subjected Mr W Goodwin to threatening, intimidating approaches and verbal abuse on 8 March 2015 at Crufts The complaint was upheld and the Committee imposed the following penalties: KC FILE FOR DECEMBER

The Committee considered the accumulation of all the witness evidence, the demeanour of the parties when giving evidence and the submissions from all parties. On the basis of a combination of all this, the Committee has formed what it considers is a common sense conclusion as to what, on the balance of probabilities, occurred. The Committee is satisfied that a confrontational situation developed and escalated between Mr Goodwin and Mr Sainsbury, and in which Mrs S Garside involved herself. It is clear that the catalyst for the situation was a posting on Facebook the previous evening by Mr Sainsbury about Mr Goodwin s judging at the Bulldog Club (Incorporated) Championship Show the day before. Mr Sainsbury has apologised for the offending post and acknowledged and recognised that this was inappropriate and resulted in the deep hurt and offence caused. The Committee is satisfied that the confrontation between Mr Goodwin and Mr Sainsbury was not one sided, but that Mr Sainsbury did remonstrate and make extremely threatening and confrontational approaches and was verbally abusive during the situation which developed between Mr Goodwin and himself. This conduct was entirely incompatible with the standards of behaviour expected at Kennel Club events, inappropriate and deeply disappointing. It is of further disappointment that there has been no effort to take responsibility for the part played in a deeply disturbing incident at Crufts. The Committee must therefore acknowledge the seriousness with which it has viewed this incident, which took place at the most prestigious and celebrated highlight in the dog showing calendar. The Kennel Club s position on social media conduct and interaction is clear. The Committee is not making an adjudication on the Facebook posting in this incident. Nevertheless, it is clear that the posting was the catalyst for the incident. As Mr Sainsbury acknowledged, but for the posting on Facebook, the incident would not have occurred. It therefore demonstrates the impact and consequences that can follow an ill-thought out keyboard attack on an individual. It is the Committee s view that, if it is shown that a social media posting were to cause such a situation in the future, that may result in serious penalties for the posting itself. Private opinion and comment, from disappointment in judging decisions and indeed in other contexts, should either be expressed in civil and measured language or perhaps not expressed in writing at all. At its meeting on 30 July 2015, the Kennel Club Disciplinary Sub-Committee considered a complaint brought by the Kennel Club under Kennel Club Rule A11 a (1) (b) against Mr W Goodwin: namely that he behaved discreditably and prejudicially to the interests of the canine world, in that he subjected Mr T Sainsbury and Mrs S Garside to threatening, intimidating approaches and verbal abuse on 8 March 2015 at Crufts The complaint was upheld and the Committee imposed the following penalties: 1 To warn him as to his future conduct. [A11 j (1)] 2 To censure him [A11 j (2)] 3 To fine him the sum of 1000 [A11 j (3)] 4 To disqualify him from exhibiting at, taking part in, attending and/or having any connection with any event licensed by the Kennel Club. If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification [A11 j (4)] 5 To disqualify him from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club [A11 j (5)] 6 To disqualify him from acting as an Officer or serving on the Committee of any canine society [A11 j (6)] 7 To disqualify him from taking part in the management of any event licensed by the Kennel Club. [A11 j (7)] 8 To disqualify him from judging at any event licensed by the Kennel Club [A11 j (8)] The above listed disqualifications are to be for 12 months from 30 July 2015, save that the disqualification from judging at any event licensed by the Kennel Club, the period of the disqualification is to be for 2 years. The Committee, following the imposition of these penalties, would draw the attention of the Respondent to the effect of Rule A11 sub-section n. On the basis of a combination of all this, the Committee has formed what it considers is a common sense conclusion as to what, on the balance of probabilities, occurred. On considering the evidence and hearing the parties, the Committee has not been able to and does not make any finding about the crate incident. The Committee is satisfied that Mrs Garside involved herself unnecessarily in the incident. It has been suggested that Mrs Garside had made efforts to defuse matters which eventually got quite out of hand. The Committee s view is that Mrs Garside did involve herself and became embroiled in the situation when she should have walked away and distanced herself. The incident at Crufts was highly unacceptable. Mrs Garside is a judge approved to award Kennel Club Challenge Certificates, and in the context of this incident did not behave in an appropriate manner and her involvement cannot go unremarked and without reaction and penalty. APPEALS TRIBUNAL 19 OCTOBER 2015 MR W GOODWIN - V - THE KENNEL The Appeals Tribunal met on 19 October to consider the appeal by Mr W Goodwin from the decision of the Disciplinary Sub-Committee dated 30 July These are prescribed legitimate grounds for appeal and the Appeal Tribunal s task was to consider the procedural concerns which were raised and also the level of the penalty imposed and whether this was disproportionate and/or had an excessive adverse effect on Mr Goodwin. It is understood that the incident at Crufts was very unfortunate and it must have caused considerable distress all round. Ground 1: Decision made in a procedurally unfair manner The Appeals Tribunal was not satisfied that the complaint that the procedure had been unfair was established. It was apparent to the Tribunal that the procedure had been flexible, that latitude had been given where appropriate and that there had been equal treatment for all parties Ground 2: Decision made with no reference to relevant factors Submissions were made that the decision of the Disciplinary Sub-Committee had not been made with reference to relevant factors, particularly in relation to the timing of complaints and statements received, and the weight attached to various statements. The Appeals Tribunal was not satisfied that this ground of appeal was established. Ground 3: Relevant New Evidence Further character references were presented to the Appeals Tribunal which goes to mitigation for Mr Goodwin. Background This was an appeal from the Disciplinary Sub- Committee decision of 30 July 2015 pursuant to Rule A11 in connection with an incident at Crufts The Disciplinary Sub-Committee found that Mr T Sainsbury had behaved discreditably and prejudicially to the interests of the canine world, in that he had subjected Mr W Goodwin to threatening, intimidating approaches and verbal abuse on 8 March 2015 at Crufts The papers previously before the Disciplinary Sub- Committee were presented to the Appeals Tribunal, together with Mr Sainsbury s appeal against the penalty imposed. Decision The Appeals Tribunal did not consider the penalty was disproportionate. The penalty reflected the role played by Mr Sainsbury in this very unfortunate incident and the Tribunal therefore endorsed the decision made by the Disciplinary Sub-Committee. SHOW REGULATION CHANGES The following amendments to the Show F Regulations have been approved by the Kennel Club General Committee and are effective from 01 January (Deletions struck through. Amendments in bold) KC FILE FOR DECEMBER The decision of the Appeals Tribunal is set out below. Background This appeal arose from the Disciplinary Sub- Committee decision of 30 July 2015 pursuant to Rule A11 in connection with an incident at Crufts The Disciplinary Sub-Committee found that Mr W Goodwin had behaved discreditably and prejudicially to the interests of the canine world, in that he had subjected Mr T Sainsbury and Mrs S Garside to threatening, intimidating approaches and verbal abuse on 8 March 2015 at Crufts The papers previously before the Disciplinary Sub-Committee were presented to the Appeals Tribunal, together with the Notice of Appeal from Mr Goodwin and the Response on behalf of the Kennel Club. Mr Goodwin attended the appeal hearing with Counsel, Ms Camilla Whitehouse and Mr Dominic Lewis attended on behalf of the Kennel Club. The Appeals Tribunal considered the Notice of Appeal and the Response and appreciated the attendance and the clarification given by the legal representatives at the hearing. Appeal Grounds and Decision Mr Goodwin appealed on four grounds: 1. the decision was made in a procedurally unfair manner; 2. the decision was made without reference to relevant factors; 3. relevant new evidence; 4. the penalty imposed was disproportionate. The further statements produced provided support for existing issues which had been raised at the disciplinary hearing and the Tribunal did not consider that there was anything new that would significantly have affected the decisions already reached or necessitated a review or rehearing of such decisions. The Appeals Tribunal was not satisfied that this ground of appeal was established. Ground 4: The penalty was disproportionate The Appeals Tribunal did not accept that the penalty imposed, a fine plus a suspension for a limited period, was disproportionate. The penalty reflected the respective role and degree of involvement by Mr Goodwin in the incident. However, the Tribunal accepted that Mr Goodwin s inability to attend events was having an excessive adverse impact and causing substantial difficulty and therefore for that mitigating reason alone the Tribunal was prepared to commute the period for the disqualification on attending licensed events to six months from 30 July Further details on the decision are available to read upon request to the Kennel Club Secretary. APPEALS TRIBUNAL 19 OCTOBER 2015 MR T SAINSBURY V- THE KENNEL The Appeals Tribunal met on 19 October 2015 to consider the appeal by Mr T Sainsbury from the decision of the Disciplinary Sub-Committee dated 30 July The decision of the Appeals Tribunal is set out below. Definitions of Classes Annex A to the F Regulations (F(A)) In estimating the number of awards won, all wins up to and including the seventh day before the date of closing of postal entries shall be counted when entering for any class. Regulation F(1)9.i. In estimating the number of awards won, all wins up to and including the seventh day before the date of closing of postal entries shall be counted when entering for any class. Entry for Exhibition Regulation F(1)9.b. Entries for a Show must close at the time indicated in the schedule and at the latest on the fourteenth seventh day before the show opens. Veterinary Support Regulation F.12 The Secretary of a licensed show is required to arrange veterinary support compatible with the arrangements for the show and the anticipated entry. At shows at which a veterinary surgeon is present, they must be on site when the show opens for the duration of each day s judging. At shows where there are less than 200 classes scheduled, veterinary support can be on call rather than present at the show venue. F(1)13.a. a. Show Societies are to arrange veterinary support in accordance with Regulation F11 F12. Judging Contracts F(1)22.e. When requested to do so, judges must submit a completed breed health monitoring report form and a copy of their critique to the Kennel Club within 21 days of the close of the show.

A person must have: Previously awarded CCs to at least three breeds within the relevant Group (i.e. the same group as the host Group), or previously awarded CCs to at least two breeds within the relevant Group and one CC in another Group, or been previously approved by the Kennel Club to Judge a Group at Championship Show level. The following lists include those judges who meet the above minimum entrance criteria and have received a Breed Credit Certificate. Whilst there are some additional judges who may have attended a Judges Development Programme Seminar, been assessed and achieved a Breed Credit, they do not yet meet the above minimum entrance criteria and have therefore not been included on the lists. When these people reach the minimum entrance criteria, their names will be added to the lists. It should be noted that the following judges are, by virtue of their Breed Credit, exempt from Kennel Club Regulation F(1)b.(1) (b) which require judges to be included on a Breed Council/Club B Judges list or above in order to judge more that three breed classes (5 classes for Stud Book Band E breeds) for the breed in question. This applies to Open Shows and to breeds without CCs at a Championship Show.
