INTRODUCTION OF LATE ITEMS: Mayor Westbroek informed Council that correspondence from the Vancouver Island Health Authority would be addressed prior to Council considering third reading of Town of Qualicum Beach Taxation Exemption Bylaw No , MINUTES: Mayor Westbroek asked if there were any errors or omissions to the Minutes of the Special Meeting of July 25, Hearing none, Mayor Westbroek then stated that the Minutes of the Special Meeting held July 25, 2005 be adopted as printed and circulated. DELEGATIONS: 1. Faye Smith, Qualicum Beach Streamkeepers Ms. Smith gave an overhead projector presentation covering some of the highlights of the organization s work over the past ten years. Ms. Smith noted that the first major project was the Beach Creek Culvert Project for the enhancement of coho and cut throat trout, and that the most recent project is working on the Qualicum Beach Memorial Golf Course project. Ms. Smith expressed her appreciation to the Town for all of the assistance provided to the Qualicum Beach Streamkeepers. 2. Els King, 1975 Widgeon Road Ms. King addressed Council regarding the off-leash trails and its use by both joggers and off-leash dogs. Ms. King noted that there were limited areas where an owner could let their dog off-leash and was not in favour of changing the existing trail to accommodate joggers. 3. Lance Nater, 996 Royal Dornoch Mr. Nater addressed Council regarding the off-leash dog trails noting that common sense and courtesy should prevail and that the trails could be used by anyone wishing to use them. 4. Domena Desling, 564 Berwick Road Ms. Desling, dog trainer, addressed Council regarding the off-leash trails within the Community Park. Ms. Desling suggested that the status quo be maintained; however, additional signage should be installed.

2 Page 2 5. Cathy Carter, 81 Magnolia Drive, Parksville Ms. Carter also addressed Council regarding the off-leash trails within the Community Park. Ms. Carter queried the number of individuals who were in favour of retaining the off-leash trail versus the one complaint received. Ms. Carter also noted that, through an ad-hoc petition, in five and one half hours, eighty-five signatures were obtained to retain the off-leash trails and sixty-two of those signatures were in favour of joggers using on-leash trails only. CORRESPONDENCE: 1. Correspondence Log Council received the correspondence log dated August 8, Mayor Westbroek enquired what proactive steps were being taken in relation to the use of scooters within the municipality. Staff replied that the matter is under review between staff and the RCMP. 2. C.A. Design Council received correspondence from C.A. Design which included a report from Graham Kerr, ISA Certified Arborist, in relation to the possible protection of some trees on Blocks 16, 21 & 24, Memorial Avenue, during a proposed development. Paul Butler, Director of Planning, noted that the report stated that only a few trees at the south end of the property could be saved; however, he would be meeting with the Town s aborist to determine if additional trees could be saved. 3. Ministry of Public Safety & Solicitor General Council received an application to the Ministry of Public Safety & Solicitor General by the owners of the Courtyard Café for a change to their liquor licence. MOVED Councillor Avis, SECONDED Councillor Wilson that Council, after considering the following: potential for noise if the application is approved; impact on the community if the application is approved; whether the amendment may result in the establishment being operated in a manner that is contrary to its primary purpose; and the applicant being located in the downtown core and not adjacent to any residential area has no objection to the Courtyard Café receiving an amendment to their liquor licence to allow for an endorsement to allow for patron non-participation entertainment subject to the entertainment not exceeding 11:00 p.m. 4. The Right Honourable and The Lord Mayor Alderman Michael Savory Council received correspondence from the Mayor of the City of London, England, expressing his appreciation for the letter of condolence recently sent by the Town of Qualicum Beach in relation to the recent terrorist attack on the City of London. COMMITTEE & LIAISON REPORTS: 1. Chief Administrative Officer s Report Council received the CAO report within the agenda package as follows: Public Works the Beach Creek pond enhancement and fish passage project has been completed. Works were done in cooperation with the BC Salmon Foundation, Streamkeepers, the Qualicum Beach Memorial Golf Club Society and the Town

3 Page 3 the pavement overlay program for 2005 is now complete as well as the pavement markings and crack sealing minor storm improvements were done at Eaglecrest Drive and Mallard Place several drainage ditches were cleaned throughout the Town a new 2 water service was installed for the new development at Beach Road and Second Avenue West monitoring of the disinfection program as required by the Vancouver Island Health Authority is ongoing by the water crew repairs were conducted to two leaking residential services Parks trails are being barkmulched and maintenance work is being done Hoylake Road trail from Garrett Road to Canyon Crescent is nearing completion an irrigation system has been installed in the park located on Miraloma Drive in Chartwell preparation is underway for the installation of a storm line to the lower ball field flower beds are being tended to throughout Town including the various subdivisions Building Report iron gates have been installed on the washrooms located at the beach the exterior of the airport is being painted Administrative Activities boundary extension process is continuing for Oceancrest and neighbouring property 2. Financial Administrator s Report John Marsh, Financial Administrator, reported on the summarized 2005 Financial Plan dated August 3, 2005 and included within the agenda package. 3. General Government Mayor Westbroek reported on the following: the District of Lantzville s new OCP bylaw amendments regarding the Pheasant Glen Golf Course requested that staff address dust on applicable roads within the municipality 2005 is the 100 th Anniversary of UBCM 4. Community Development, Transportation & Library Councillor Avis reported on the following: undergrounding of utilities should be addressed at the intersection of Highway 19A and Laburnum Road the owners of the Eaglecrest Golf Club will be cleaning up the ditch on Eaglecrest Drive requested an update on a proposed four way stop at Chartwell Boulevard and Sunrise Drive, with staff noting that they were awaiting responses from other agencies Festival of Music beginning in September recent Grand Prix d Art development of the old Lodges of Eaglecrest property is proposed for November 5. Protective Services & Bylaw Enforcement Councillor Kruyt gave a fire department report for the month of July and expressed concern over the unsightliness of the burned

4 Page 4 buildings on Memorial Avenue, requesting that immediate steps be taken to have the property cleaned up. 6. Planning & Utilities Councillor Tanner reported on the following: due to the dry weather, appropriate signage should be place in the Town s parks and trails building permit report for the month of July the future of Garrett Road becoming a cul-de-sac 7. Parks & Recreation Councillor Wilson reported on the following: the minutes of the July 20, 2005 Recreation and Parks Commission with an emphasis on the use of the trail system within the Community Park 8. Motions Forward MOVED Councillor Avis, SECONDED Councillor Wilson that Council authorize the release of the following motions from the June 13, 2005 In-Camera minutes and that they be brought forward: that Council not accept the offer to purchase Lot 25, 260 Harlech Road in the amount of $145,000. that Ms. Hewer be informed that Council do not wish to sell Lot 25, Plan 37035, DL 52 & 53, Harlech Road, at this time for the price of One Hundred Fifty Thousand Dollars ($150,000). that Mr. Kosick be informed that the current Council has no intention of selling Lot 25, Plan 37035, DL 52 & 53, Land District 35, Harlech Road, within the Seawynd subdivision. NEW BUSINESS: 1. Development Permit Application MOVED Councillor Tanner, SECONDED Councillor Wilson that staff be directed to issue a development permit for 3021 Island Highway West, as presented. BYLAWS: 1. Bylaw No MOVED Councillor Avis, SECONDED Councillor Kruyt that Town of Qualicum Beach Taxation Exemption Bylaw No , 2005 be given third reading. MOVED Councillor Tanner, SECONDED Councillor Kruyt that consideration of a request by the Vancouver Island Health Authority for taxation exemption for their property at 777 Jones Street be deferred until a staff report is received. 2.
