1 166 DECREE of 15 April 2005 implementing certain provisions of Act No 114/1992 on conservation, as amended, in connection with the creation of the NATURA 2000 network Pursuant to Section 3(2), Section 5(7) and, by agreement with the Ministry of Agriculture, Section 5a(4) of Act No 114/1992 on conservation, as amended by Act No 218/2004 (hereinafter referred to as the Act ), the Ministry of the Environment lays down the following: Section 1 (with respect to Section 3(2) of the Act) A list of European habitat types 1) which occur on the territory of the Czech Republic, including priority habitats, is given in Annex No 1 to this Decree. Section 2 (with respect to Section 3(2) of the Act) A list of species 2) that are important from a European perspective and which occur on the territory of the Czech Republic, including species requiring special area protection, is given in Annex No 2 to this Decree. Section 3 (with respect to Section 5(7) of the Act) A list of forms, methods and means prohibited for the capture and killing of selected wild fauna from the group of invertebrates is given in Annex No 3 to this Decree. Section 4 (with respect to Section 5a(4) of the Act) A list of the species of birds in respect of the keeping, sale, transport for sale, keeping and breeding for sale, and offering for sale of which the provisions of Section 5a(1)(e) and (2) of the Act shall not apply is given in Annex No 4 to this Decree. Section 5 (with respect to Section 5a(4) of the Act) A list of species of birds in respect of the hunting of which, defined and implemented in accordance with separate legal regulations 3), the prohibition laid down in Section 5a(1)(a) and (e) of the Act shall not apply is given in Annex No 5 to this Decree. Section 6 Effect This Decree shall enter into effect on the date of promulgation hereof. Minister: Ambrozek m.p.

13 Annex No 3 to Decree No 166/2005 LIST OF THE FORMS, METHODS AND MEANS PROHIBITED FOR THE CAPTURE AND KILLING OF SELECTED WILD FAUNA FROM THE GROUP OF INVERTEBRATES (1) Forms and methods prohibited for the capture, taking, hunting and killing of species from Annexes 2b) and 2c) of this Decree from the group of invertebrates: a) nets and traps which are based on the principle of non-selective capture or which, under certain conditions, make non-selective captures, b) sources of artificial lighting, c) electrical or electronic devices capable of killing or stunning, d) poisons and bait containing poison or a deadening effect, e) gassing. (2) Vehicles prohibited for hunting are aircraft, motor vehicles or vessels, except in cases where a vessel has a floating speed of under 5 km per hour.
