2 Public Instrument 15 of 2011 Published in Gazette No of 2nd August 2011 LAND ACQUISITION (XYLOTYMBOU-ORMIDHIA ROAD) NOTICE 2011 The Administrator, exercising powers under sections 2 and 3 of the Land Acquisition Ordinance(a), makes the following notice: Citation and commencement 1. This notification may be cited as the Land Acquisition (Xylotymbou-Ormidhia Road) Notice 2011 and comes into force on 8 August Declaration of undertaking of public utility 2. The Administrator declares that the upgrading of the Xylotymbou-Ormidhia road is an undertaking of public utility for the purpose of section 2 of the Land Acquisition Ordinance. Authorisation 3. The Administrator authorises the carrying out of the undertaking referred to in article 2 on any land in the Dhekelia Sovereign Base Area needed for such undertaking under the provisions of the Land Acquisition Ordinance. 3 Public Instrument 16 of 2011 Published in Gazette No of 2nd August 2011 GAME AND WILD BIRDS (HUNTING) REGULATIONS 2011 The Chief Officer makes the following Regulations in exercise of the power under section 17 of the Game and Wild Birds Ordinance 2008(a). Citation, commencement and expiry 1. (1) This Order may be cited as the Game and Wild Birds (Hunting) Regulations (2) This Order comes into force on the day that it is published in the Gazette and expires on 1 March (3) The Summer-Autumn Game Season (11-12), the Autumn-Winter Game Season (11-12) and the Winter Game Season (11-12) are defined in the Game and Wild Birds (Game Seasons) Order Maximum number of certain species 2. The number of a species of game that may be hunted and possessed on any day on which hunting is permitted is unlimited except that the maximum number of the following species of game which on any 1 day may be hunted and possessed by 1 person is- (a) 2 hares (Lepus europaeus), (b) 5 chukars (Alectoris chukar), and (c) 1 francolin (Francolinus francolinus). Hours when hunting is prohibited 3. A person must not shoot, kill, capture or pursue game between sunset and sunrise. Hunting accompanied by dogs 4. (1) A person accompanied by a dog may only shoot, kill, capture or pursue game (a) on any Wednesday or Sunday between 30 October 2011 and 21 December 2011 (both dates included) and on 24 December 2011 (Saturday), 28 December 2011 (Wednesday) and 31 December 2011 (Saturday), or (b) in the Akrotiri Sovereign Base Area, on 21 August 2011 and on any day between 28 August 2011 and 16 October 2011 (both dates included). (2) Subject to subsection (1), a person hunting alone, must be accompanied by no more than 2 dogs, or, if hunting as part of a group of people, the group is accompanied by a number of dogs that is no greater than twice the number of people in the group. Permitted periods for hunting for certain species 5. A person must not shoot, kill, capture or pursue game at any time unless it is permitted by any one of the following paragraphs (a) during the Summer-Autumn Game Season (11-12), a person may hunt a species specified in the first column of Schedule 1 in the period specified in the corresponding row of the second column of that Schedule, (b) during the Autumn-Winter Game Season (11-12), a person may hunt a species specified in the first column of Schedule 2 in the period specified in the corresponding row of the second column of that Schedule, and (c) during the Winter Game Season (11-12), a person may hunt a species specified in the first column of Schedule 3 in the period specified in the corresponding row of the second column of that Schedule. 63

7 EXPLANATORY NOTE (This note is not part of the Regulations) 1. This explanatory note relates to the Game and Wild Birds (Hunting) Regulations It has been prepared by the Office of the Attorney General and Legal Adviser in order to assist the reader of the Regulations, and does not form part of the Regulations. 2. Regulation 3, which prohibits hunting between sunset and sunrise, applies to all species of game on any day. Regulation 4, concerning hunting accompanied by dogs, also applies to any species of game. There are restrictions concerning the days on which hunting with dogs is allowed at regulation 4(1). There are also restrictions (at regulation 4(2)) as to the number of dogs that may accompany a hunter or a group of hunters. 3. Regulation 5, together with the three Schedules, specify the permitted periods for hunting particular species of game within each of the three game seasons. The three game seasons are prescribed by the Game and Wild Birds (Game Seasons) Order The restrictions in these Regulations apply in addition to the restrictions imposed by the Game and Wild Birds Ordinance 2008 and any public instruments made under it. It would not be lawful to hunt a species of game, even during a permitted period, if the hunting contravenes a provision of the 2008 Ordinance or a relevant public instrument (for example, a provision relating to the method of killing, or to game reserves). 67
8 Public Instrument 17 of 2011 Published in Gazette No of 2nd August 2011 GAME AND WILD BIRDS (GENERAL GAME RESERVES) (AMENDMENT) ORDER 2011 The Chief Officer makes the following Order in exercise of the power under section 31(1) of the Game and Wild Birds Ordinance 2008(a) Citation and commencement 1. This Order may be cited as the Game and Wild Birds (General Game Reserves) (Amendment) Order 2011 and comes into force on the day on which it is published in the Gazette. Article 2 amended 2. In the Game and Wild Birds (General Game Reserves) Order 2009(b), article 2 is amended by revoking the definitions of the Akrotiri SBA map and the Dhekelia SBA map and respectively replacing them with the Akrotiri SBA map is the map labelled SBA/AOA/GGR/TGR/AKR(11), which is available for public inspection during normal working hours at the Area Office Akrotiri, and the Dhekelia SBA map is the map labelled SBA/AOD/GGR/TGR/DHK(11), which is available for public inspection during normal working hours at the Area Office Dhekelia.. 9 EXPLANATORY NOTE (This note is not part of the Order) 1. This explanatory note relates to the Game and Wild Birds (General Game Reserves) (Amendment) Order 2011 ( the Order ). It has been prepared by the Office of the Attorney General and Legal Adviser in order to assist the reader of the Order, and does not form part of the Order. 2. The Order amends the Game and Wild Birds (General Game Reserves) Order 2009 by indicating the Kouris temporary game reserve in light blue colour on a new version of the Akrotiri SBA map, and by decreasing the area of the Dhekelia general game reserve. The area of the Dhekelia general game reserve is coloured dark blue on the Dhekelia SBA map. The Dhekelia SBA map also shows the new Ayios Nikolaos temporary game reserve in light blue. 3. Both the Akrotiri SBA map and the Dhekelia SBA map are available for public inspection at the Akrotiri Area Office and the Dhekelia Area Office respectively, during normal working hours. The two maps show also the location of the temporary game reserve in the Areas as designated by the Game and Wild Birds (Temporary Game Reserves) Order Although this Order has no expiry date, it may be revoked by the Chief Officer at any time. 69
10 Public Instrument 18 of 2011 Published in Gazette No of 2nd August 2011 GAME AND WILD BIRDS (TEMPORARY GAME RESERVES) ORDER 2011 The Chief Officer makes the following Order in exercise of the power under section 32 of the Game and Wild Birds Ordinance 2008(a). Citation, commencement and expiry 1. (1) This Order may be cited as the Game and Wild Birds (Temporary Game Reserves) Order (2) This Order comes into force on the day that it is published in the Gazette and expires on 1 March Interpretation 2. In this Order the Akrotiri SBA map is the map labelled SBA/AOA/GGR/TGR/AKR(11), which is available for public inspection during normal working hours at the Area Office Akrotiri; and the Dhekelia SBA map is the map labelled SBA/AOD/GGR/TGR/DHK/(11), which is available for public inspection during normal working hours at the Area Office Dhekelia. Temporary game reserves 3. The following areas are designated as temporary game reserves for the periods specified (a) The area coloured light blue on the Akrotiri SBA map (the Kouris temporary game reserve ), for the period 22 August 2011 to 27 August 2011 (both dates included), (b) the area coloured red on the Akrotiri SBA map (the Kolossi temporary game reserve ), for the period 21 August 2011 to 3 January 2012 (both dates included), excluding any days in a close season, (c) the area coloured brown on the Akrotiri SBA map (the Southern Kouris temporary game reserve ), for the period 21 August 2011 to 29 October 2011 (both dates included), and (d) the areas coloured orange on the Akrotiri SBA map (the North-Western WSBA temporary game reserve ), for the following periods (i) 21 August 2011 to 29 October 2011 (both dates included), (ii) all Mondays, Tuesdays, Thursdays, Fridays and Saturdays, from 30 October 2011 to 21 December 2011, (iii) all days from 22 December 2011 to 3 January 2011, except 24 December 2011 (Saturday), 28 December 2011 (Wednesday) and 31 December 2011 (Saturday), and (iv) all Mondays, Tuesdays, Thursdays, Fridays and Saturdays, from 4 January 2012 to 19 February (e) the areas coloured green on the Dhekelia SBA map (the Dhekelia temporary game reserve ) for the period 22 August 2011 to 27 August 2011 (both dated included). 70
11 (f) the area coloured light blue on the Dhekelia SBA map (the Ayios Nikolaos temporary game reserve ) for the following periods: (i) 22 August 2011 to 27 August 2011 (both dates included), (ii) 30 September 2011 to 16 October 2011 (both dates included), (iii) all Mondays, Tuesdays, Thursdays, Fridays and Saturdays, from 30 October 2011 to 21 December 2011, and (iv) all days from 22 December 2011 to 3 January 2011 (both dates included), except 24 December 2011 (Saturday), 28 December 2011 (Wednesday) and 31 December 2011 (Saturday). 12 EXPLANATORY NOTE (This note is not part of the Order) 1. This explanatory note relates to the Game and Wild Birds (Temporary Game Reserves) Order 2011 ( the Order ). It has been prepared by the Office of the Attorney General and Legal Adviser in order to assist the reader of the Order, and does not form part of the Order. 2. The Order designates areas or clusters of areas as temporary game reserves under section 32 of the Game and Wild Birds Ordinance 2008 in the Western Sovereign Base Area and in the Eastern Sovereign Base Area. The map showing the location of the temporary game reserves in the WSBA is available for public inspection in the Akrotiri Area Office during normal working hours. That map also shows the location of the general game reserves in the Western Sovereign Base Area, as designated by the Game and Wild Birds (General Game Reserves) Order The map showing the location of the temporary game reserves in the ESBA is available for public inspection at the Area Office Dhekelia. That map also shows the location of the general game reserve in the ESBA. 3. Since the last game season, the southernmost tip of the general game reserve in the Ayios Nikolaos region of the ESBA has become a separate temporary game reserve. 72

(1) This Order may be cited as the Game and Wild Birds (Game Seasons) Order (2) This Order comes into force on the day that it is published in the Gazette and expires on 1 March Game seasons 2. Each of the following periods (both dates included) is prescribed as a game season (a) 21 August 2011 to 16 October 2011, (the Summer-Autumn Game Season (11-12) ), (b) 30 October 2011 to 3 January 2012, (the Autumn-Winter Game Season (11-12) ) and (c) 4 January 2012 to 29 February 2012 (the Winter Game Season (11-12) ). 14 Public Instrument 20 of 2011 Published in Gazette No of 2nd August 2011 GAME AND WILD BIRDS (POSSESSION OF KILLED GAME DURING A CLOSE SEASON) ORDER 2011 The Chief Officer makes the following Order in exercise of the power under section 30(2) of the Game and Wild Birds Ordinance 2008(a). Citation, commencement and expiry 1. (1) This Order may be cited as the Game and Wild Birds (Possession of Killed Game During a Close Season) Order (2) This Order comes into force on the day that it is published in the Gazette and expires on 16 March Possession of killed game during a close season 2. (1) Subject to paragraph (2), a person who possesses killed game during any of the following periods (both dates included), does not commit an offence under section 30 of the Game and Wild Birds Ordinance 2008 (a) 17 October 2011 to 29 October 2011, (b) 1 March 2012 to 15 March (2) Paragraph (1) applies only in respect of a species of game that may lawfully be killed during a game season that precedes the period referred to in paragraph (1) in which the person possesses the killed game. 15 EXPLANATORY NOTE (This note is not part of the Order) 1. This explanatory note relates to the Game and Wild Birds (Possession of Killed Game During a Close Season) Order It has been prepared by the Office of the Attorney General and Legal Adviser in order to assist the reader of the Order, and does not form part of the Order. 2. Section 30 of the Game and Wild Birds Ordinance 2008 makes it an offence to possess any game in the close season, including in the period immediately following a game season. The effect of this Order is that, for up to 15 days in any close season immediately following a game season, a person may possess killed game without committing an offence under section 30 (providing that the game is of a species that can be lawfully killed in that game season). 75
