6 BELBOURIE POLL Belbourie Poll was founded in 2005, Belbourie Polls are renowned for their heavy cutting medium wools with good nourishment. Lambing percentages are generally around 110% to 115%. Rams recently purchased from Bonavie Poll, Ngowee and a semen share from an East Mondulla Poll. Belbourie also have an on property auction in the first week of October and is also a member of the Marnoo Stud Merino s. Marnoo Inspection Day - 21 September on property. BEVERLEY NO. 2 Beverley No. 2 stud was formed in October 2014 with the purchase of 123 stud ewes from the No. 2 family at the One Oak dispersal sale, many of which were secured among the highest priced lots. Semen was purchased from One Oak No. 2 Sire Blue (sold for $26,000 at 2013 on property sale at One Oak) These rams to be offerred at Hamilton are therefor pure One Oak No. 2 blood. BLACKWOOD Blackwood Performance Corriedales EST 2006 Has continued with breeding objectives including: 1. Lambing percentage 2. Early Growth 3. Quality carcass including fat and muscle depth With this in mind we have selected sheep with traditional and measured classing techniques which Include bright well defined crimped wool, clean faces and structural soundness, with black feet. The 5 rams selected for Sheepvention 2017 are all Corriedale Performance Gold Rams {Top 10%DP$ index} well grown and suit today s markets, wool prices being high for mid micron wools and lamb prices continuing their solid run. Performance Corriedales will suit were wool and lamb markets are going, putting wool back into composite flocks or increasing lambing percentages in wool flocks. Sires of this year s rams include Blackwood 14/33 Very High Number of lambs weaned Sire Top 10% Sire}, Quamby Plains 13/393 High DP Index Sire 124 DP$ and Nayook South Ram 14/59 with thickness and growth. 7 BUNDALEER Bundaleer Merino Stud was first registered in Based on Pooginook bloodlines at first and now breeding from our own ewe base. Over the years selection and culling has led to reliable, true to type breeding, under paddock conditions. Bundaleer Merino Stud has always bred good framed sheep with soft, deeply crimped white wool with good cutting ability. Connewarran breeds rams to thrive in the difficult south-west Victorian conditions. With resistance to worms and fleece-rot, and high fertility, Connewarran Stud sheep compete commercially to profit under paddock conditions. They are large-framed, easy-care sheep with long-stapled, deepcrimping, bright, white wools of excellent processing quality. Eyemuscle is scanned for early growth lamb carcasses. The deep bodied ewes make excellent first cross mothers. Stud ewes average 18.3 micron with low S.D. and C.V. and excellent staple strength. Stud sheep are shorn twice yearly, flock sheep every 8 months, to harvest extra staple production. Connewarran Stud was founded with 25 Bindawarra ewes in There is a program of AI and ET inseminating up to 450 ewes annually using our leading sires. Doing ability and productive soft-handling wools are hallmarks of Connewarran sheep, as seen from wether and sire evaluation trials. EILAN DONAN Location: Elphinstone Cental Victoria. 700 millimeter rainfall, soils granitic. Owners: The MacRae family Sheep flock commenced 1882 by Alexander MacRae Stud established in 1923 on Boonoke blood, registered in Merryville introduced 1960 More recently top Nerstane and One Oak sires introduced. Until 2015 the stud supplied sires to the Eilan Donan commercial flock of 3000 ewes as well as commercial clients. The sheep are well known for their volume balance and outlook. The fine wools are pearly white, soft, long and well marked. The clip sits at around 18.5 micron and yields in the mid seventies, adult ewes cut 6 plus kilograms. 8 FOREST SPRINGS Forest Springs Poll Merinos, was founded in 2009 and registered in An extensive A.I. program has since been undertaken to further improve our genetic base. using An emphasis is placed on early maturing, highly fertile, sheep focusing on staple length, deeply crimped and heavy cutting white wool. Our long term goals are to produce the most profitable, reliable and easy care sheep of sound structure and excellent wools and a high meat yield. This year we will be having our second on property sale on Friday October 1.30, offering 50 rams, both autumn and spring drop, with current wool tests, carcase measurements and OJD vaccinated. Phone Mobile brucedean@bigpond.com GLANNA The Glanna Merino Stud was registered in 1984 following official inspection of Glanna Ewes. The Glanna flock was founded in 1934 by the late Jack Rayner with Mudgee fine wool ewes and rams of Dalkeith blood. From 1943 to 1984 rams of Bocoble blood were used along with a small number of Merryville rams. Since 1984 thirteen Merryville Stud Rams have been added to the stud including the record priced Merryville ram at the 1989 Goulbum Ram Sale for $34,000 and a Superfine Merryville ram bought for $20,000 at the 2000 Mudgee Ram Show and Sale. Gulgong is in the north western portion of the Central Tablelands in a 26 Summer Orientated Rainfall area Glanna now has 750 stud ewes mated in 2016 (Horned) and almost all have been naturally mated in single sire mobs. The Glanna Poll Stud was Registered in 1989 with a combination of Kurretta Poll Stud ewes from Mudgee and a few Glanna Polled ewes. Since then four Merryville Poll Stud Rams have been introduced and 3 Quamby Park Poll Stud Rams. The Poll Stud now comprises of 270 Poll Stud Ewes. In 2014 Willandra Desmond was introduced to our Polls via AI with sons used as lambs in The results have been tremendous and this coming season there will be a large number of Glanna 2nd generation progeny available for sale. Ron Rayner (02) Jeff Rayner (02) GLENPAEN The Glenpaen Merino/Poll Merino Stud commenced an extensive AI program in 1989, using some of the best genetics available and then registered with the purchase of Snowy Plain ewes and rams. Since then we have introduced Roseville Park genetics with the purchase of rams and also using semen from some of their top sires. Montrose Hill was introduced into the stud in 2000 by purchasing their top sires. Semen purchases were introduced into the breeding regimen, from Woodyarrup in 2003 and Wallaloo Park in This is to pay more emphasis on breeding a bigger plainer bodied Merino with good 6

9 constitution conformation and conversion. With the purchase of our first poll stud sire, from Roseville Park in 2009 and also using semen from other leading studs, our aim is to breed a dual purpose poll merino. Our average micron is 18.5 and we anticipate with these rams and our top sires that we have bred, will maintain our micron without sacrificing our wool cut. We are breeding big plainer bodied merinos without losing wool cut and producing long stapled white woolled productive sheep, with low coarse fibre content. We are confident these sheep are safe to take south and heavy enough cutters to take north. GOLDALEA Goldalea is situated 34 km north east of Hamilton at the foot of the Grampian s. Goldalea was established in 2002 with the purchase of 100 poll merino ewes from Karmala stud and rams purchased from Streeton stud. In 2005 all of the Streeton studs ewes were purchased when Max Kent decided to retire. 100 ewes were added in 2007 from Dalrye at Wagga Wagga (Dalrye was part of the group that contributed to the centre plus nucleus). In 2009 Goldalea poll merino stud was registered with the purchase of 100 poll merino stud ewes and a large framed 17.5 mic sire from Ridgeway Advance SA. Current influences come from Ridgway Advance and Glenlea Park. Our aim is to breed a modern poll merino with free elite fibre on a wellmuscled frame that will not only survive in the western district but will thrive. Goldalea on property ram sale is on Monday the 10th October 2016, Enquiries: Russell Gordon Trevor Gordon GULLENDAH The Gullendah Dohne Stud is situated at Baldry in Central West NSW, with an annual rainfall Of 700mm. The stud was established in 2001 with a mix of South Africa and Foundation flock genetics. The Foundation flock is bred from our stud Merino ewes with dohne rams for four generations. They are more adapted to the higher rainfall areas and have excellent quality wool and also provides a completely different genetic base to every other Dohne Stud. Gullendah breeds rams that are large framed, well muscled with crimpy stylish white wools. Gullenduh sells 300 plus rams a year to 5 and are proven in all climatic conditions. 10 GUNALLO Gunallo Poll Merino and Merino Stud is situated 8kms south of the Mallee Highway between Murrayville, Vic and Pinnaroo, SA. Gunallo breeds uncomplicated sheep that are early maturing, fertile with long stapled, crimpy white wools on the large frame that our sheep are noted for. They also have strong constitutions and are working towards a mules free sheep. Extensive artificial inseminations and some embryo transfer have been instrumental in achieving these goals as well as advice from our stud class, Bill Walker. In 2016, Gunallo sold rams to a top price of $16,000 with rams going to WA, SA, Vic and NSW. It was good to see clients once again receiving god prices for their wether lambs, young ewes and old ewes at Off- Shears sales around the country. We are quite excited about this year s young rams which are showing plenty of potential with more rams having elite free growing wools on large frames. Sires used for this years rams includes first progeny of Gunallo 007 Bond, Ridgway 721, Gunallo 67 Sandilands, Leahcim 2918, Moorundie NE08, as well as Kamora Park 37, Gunallo 55 Lustre, Gunallo 008 Pride, Leahcim 2918, Gunallo 374, Lea 190, plus other leading sires. Gunallo will be displaying rams at Burra, Karoonda, Bendigo and Hamilton and selling at Hamilton, Adelaide, Classing Classic as well as the on-property sale on Thursday 31st August Current wool tests will be available on all rams to be offered as well as ASBV/s from Sheep Genetics. Peter and Sally1s son Jonno joined the team full time in Hannaton Merinos continues to evolve but we remain focussed on quality, with a balance between wool, meat production and fertility. The current breeding program combines performance measurement and performance in the paddock with a focus on commercial profitability. We are now using Sheep Genetics information to record and improve fleece weights, post weaning weights, eye muscle and fat depth, staple length and reproduction while maintaining micron. All rams are now offered with ASBV s and parentage from Pedigree Matchmaker. All Hannaton sires are 50k DNA tested to help improve our genetic selection. Based initially on large SA bloodlines, recent infusions from Wallaloo Park, Glenlea Park, Gunallo. Ridgeway, Forest Springs and Kamarooka Park have continued to maintain our adult sheep under 20 micron, cutting 7-8 kg. Our rams perform successfully throughout the Mallee, Western District, Central and Southern VIC, and Southern NSW and we will be offering rams at Bendigo, Hamilton, Benalla and Murray Bridge multi-vendor sales as well as on property private selections. At Hynam Poll Merinos, we aim to provide affordable quality and service. Kamarooka Park sold the highest price Victorian bred ram at the Australian Sheep & Wool Show and sale at Bendigo in July The ram KPP Midasgold 193 sold for $7,500 to Lachlan Merinos of Forbes NSW. White wool on plain bodies. KEDLESTON PARK Clip Average 20.5 micron, 8.5-9kgs. Kedleston Park stud was founded in 1996 by JD & RE Humbert with the purchase of Roseville Park ewes and a Tara Park ram, both of the Purple Mandala families. The stud was registered in In recent years Wallaroo Park and Charinga Merino stud genetics have been introduced using AI Embryo transfer programs using our top special stud ewes have been conducted over the last six years with outstanding results. Kedleston Park stud is breeding quick maturing sheep, growing pearly white soft deep crimping long stapled medium wool, on a big fertile frame with high mutton yield. Placings in the Sheepvention Pen of 5 March Shorn Rams are: Third place Second place Rams have been sold to most districts of Victoria and the Southern and Eastern Riverina districts of NSW and Wagin in WA. 9

12 KERRILYN Kerrilyn is still breeding large frame fertile sheep with as much quality wool as possible. This is backed up by many successes by Kerrilyn blood sheep at sheep shows, fleece shows and wether trials. Kerrilyn Poll was registered in 2011 with the same aims as our merino stud. KEVLYN The Kevlyn Merino Stud celebrated 30 years as a registered stud in Our aims have always been to produce productive superfine sheep. Origans were of saxon types,in the early years but have been based on Merryville types for the last 20 years. The Rokeby Merino Stud has had a significant influence on the sheep with rams being purchased up to $ and several rams purchased for $5,000 or more. Recent purchases have included a share in 2010 of Alfoxton Diplomat.($46.000) and Alfoxton and 2015 saw us introduce through Al Terrick West sire 220. This sire is big and long, weight on full feed of 130 kg and still testing 16.5 micron. He will be the foundation sire of a poll stud. Enquires are welcome anytime Contact Kevin Lynne KOOLE VALE Koole Vale was founded in Since 1999 Glendonald has been introduced through the purchase of rams, ewes and semen. An annual AI program is conducted using top sires from Glendonald. In 2002 a Poll stud was formed using Koole Vale and Glendonald genetics. A ram from Weealla and semen from Nyowee has been added to the Poll stud. The aim is to produce large framed merinos carrying Fine-Medium/ Medium wool that is long stapled, soft handling, well nourished and white. Fleece rot and body strike resistance is of great importance. Our rams are sold into high and lower rainfall areas across Victoria. In 2001 the stud started showing at the Australian Sheep and Wool show in Bendigo. While showing is enjoyable, it is also used for promotion, learning, comparing and gauging improvement. At Hamilton Sheepvention Koole Vale has won Grand Champion Ram in 2005 and Ewe in Champion Medium Ram, Ewe and Strong ram in At the 2013 Ovens Valley wether trial Koole Vale wethers were placed in 2nd place, from 26 teams. They cut 8.71kg of 19.3micron valued at an average of $

13 KURRA-WIRRA Kurra-Wirra Merinos aims at the highly profitable dual-purpose nature of the modern merino and is a fully ASBV performance recorded stud on MerinoSelect. With a base of 2000 stud ewes, we annually implement intensive AI and ET programs. Clients adult ewes regularly cut an average of Kgs of quality wool at micron. Rams and semen is sold Australia wide. Situated in Central NSW (with 24 inch annual rainfall), commercial clients sheep consistently top sheep sales and secure top accolades at shows and ewe competitions. In 2015, two Langdene clients in NSW won flock competitions. Whilst in 2016, Wattle Grove Partnership, Dunedoo, won the Tablelands Ewe Competition for the fifth consecutive year. 14 MELROSE JB & JB Russell, 112 Russells Road, Nurrabiel (tel) Melrose stud was registered in 1934 when fine wool ewes were selected from the Melrose flock, which commenced in 1880 with Tasmanian fine wool sheep. Initially rams were purchased from Valleyfield and Winton. In 1975 Merryville rams were introduced, since then only fine wool blood genetics have been used. The Poll flock was founded in 1995 with Kooringa Poll ewes. Melrose sheep are bred to be large framed, genetically stable fine wool sheep, cutting the maximum amount of long stapled, stylish 18 micron wool. At Melrose we are striving to increase cut, maintain micron, improve body weight, fertility and survivai as well as continuing to improve the style and type of wool we grow. To do this we record the performance of many traits on all stud ewes and rams. Melrose utilise Merinoselect, ASBV s and Indexing to help us reach our goals. They have used semen from other studs for AI programs only when they have found top quality sires with the attributes they are requiring for their long term planning for the Merrignee sheep. Charlie & Jono s focus for Merrignee is to offer rams to clients that have reliability and consistency for very good wool that does not blow out in its micron over the long lifetime of the ewes, that will handle all weather patterns. Merrignee wool is well nourished, stylish with defined crimp that also has elasticity and strength, suitable for both the Italian trade and the best top makers world wide. Charlie & Jono have a strict adherence to correct conformation with good constitution, including a good spring of rib on a large frame sheep that will hold onto their good wool characteristics. Merrignee sheep are expected to produce lambs each year and cut 5-6kgs of quality fleece, that does not attract flystrike and therefore saves on management for the whole of the ewes life, be it 7 or more years. 12

At the 2017 Sydney Royal Easter Show Merryville was awarded The Sir Walter Merriman Trophy (Most Successful Superfine and Fine Wool Merino Exhibitor), the Sir Frederick McMaster Trophy (Most Successful March Shorn Merino Exhibitor) and the Most Successful March Shorn Poll Merino Exhibitor. Merryville won the Objective Measurement class for Ram 6 tooth and over with a Poll ram who cut 15.8kg wool, had a micron of 18.1 and a fleece value of $277. This ram was the highest scoring Merino in the OM classes. Merryville also took out the Grand Champion Superfine Wool Ram, Grand Champion Fine Wool Ram, Grand Champion fine Wool Ewe and Grand Champion Fine/Medium Wool Poll Ram. Merryville was also proud to win The Stonehaven Cup for the 27th time (Best Exhibit of five March Shorn Sheep). Merryville rams are available throughout the year at all major multi-vendor sales as well as at the stud s on-property ram sale on Friday 8 September Flock rams are also available from mid September each year. 16 MOORUNDIE POLL Moorundie Poll Merino stud has its foundations going back to Geoff and Bernadette operate the stud from Keith in the South East of South Australia. Moorundie sheep are highly sought after by commercial and ram breeding flocks. We sell rams and semen to all mainland states, and all five year old ewes are sold to studs. At Moorundie we believe in breeding for client profit and predictability of progeny. We concentrate on high fleece weight, fertility, early growth rates and white wool, able to handle rainfall. NAREEB NAREEB POLL The Nareeb Nareeb Poll Merino stud was registered No.705 in Recently the stud has grown substantially when in Fernleigh special stud ewes were purchased. Also the entire Barton Poll stud from Tasmania with around 700 stud ewes. Last year we sold close to a hundred poll rams and this year should have about 200 rams for sale. We breed for a balance of early maturity, doing ability, high fertility and heavy fleece weights. Our stud ewes average over 7kg per head of around micron wool. Our Pink family average around 21 micron and are bred very much to the Fernleigh type. Lambing percentages are regularly in excess of 100%. The Poll rams are similar to the horn rams, big framed easy care wool produces on an uncomplicated large frame. 14

17 ONE OAK POLL One Oak Poll was established 51 years ago in The property is located 45kms North of Jerilderie and is predominately Riverina plains and Boree country. 500 acres of cereal crops. are also grown annually. The Stud was founded on One Oak ewes and a Stud Park North Sire. Genetics were originally bought in from Bundamar, Merriville, Collinsville, Pooginook, Glenroy and Morundie Park. One Oak Poll sire Columbus had an impact on the Stud in late 1980 s. Since 1990 One Oak No.2 sire, B32(Merriville Ringmaster), has had an influence. This sires great grandsons won Grand Champion Poll Ram at Dubbo, and also at Sydney Royal. In 1996 semen from Collinsville 540 was used with success. His progeny, Mr Ed, won Grand Champion Poll Ram and Reserve Grand champion Ram Dubbo. These genetics injected more size, staple length and style, with correct structure. In , seven Wilimenup sires were used, including Sir Winston, creating a significant influence on the Stud. In 2010, Collinsville Majestic was used in an embryo transfer program to top One Oak/No2 ewes, which have then been used with success at One Oak Poll. Quality medium wool, size and fleece weight were a focus during the 1980 s, with a direction towards more nourished, stylish wool in the 1990 s. Since 2000, stabilizing breeding of a productive dual purpose Poll Merino with quality medium wool has been the focus. The five-year average micron of One Oak Poll is 20. The best of One Oak, One Oak No.2 ewes have been used in our stud through E.T and A.I. programs, over the past four years. Many of the Studs current progeny are by rams, descended from these joinings. ORRIE COWIE Mr T.A. Murdoch started the Orrie Cowie flock in 1937 with mated Kalabity ewes, selecting animals with open faces, sound backs and nourished, heavy cutting fleeces. Average ewe fleece weights increased from 4.3kg to 5.7kg and yields increased to 60% as dust penetration decreased. His son, Mr Vic Murdoch continued selecting breeding stock with large frames and superior wool quality and cut. He added a draft of mated Brewarrina ewes (low micron, Peppin blood) to the flock. Adult ewe wool cuts increased to 6.8kg and today cutting 9kg of stylish white, soft-jandling fleece of 21µm measuring 130mm in a very good year. The Merino stud was registered in 1965 and the Poll Merino stud registered in In 1999 Vic s son-in-law and daughter, Dennis and Heather Dalla purchased the Orrie Cowie Merino stud and a third of the Poll Merino Stud. They continue to select Australia s best breeding stock, knowing the value of the Orrie cowie elite wool qualities in reducing dust penetration, fleece rot and the incidence of flystrike. 15

The Pendarra stud is producing soft handling wool with a well defined crimp of pure white and nourished fine wool on a large frame sheep producing heavy wool cuts. Not only does Pendarra pay great attention to wool quality and quantity we also place a great emphasis on maintaining a large frame for the carcass value making it a dual purpose sheep. Pendarra blood sheep have proven themselves to perform very well in different areas and conditions. Clients have reported increased lambing percentages, wool cut, frame, staple strength and evenness of staple length and micron. In recent years Pendarra has introduced Poll Merino genetics. 19 RIDGWAY Ric, Gail, Matthew and Rachel Ridgway produce poll merinos with all the attributes of the genuine dual purpose product sought after by the progressive merino breeder. The Ridgway flock is assessed both subjectively and objectively, with the use of Australian Sheep Breeding Values in the Merino Select program over the last six years. Recent management advances include the use of DNA testing, electronic tags and the Pedigree Matchmaker system, which combined, have increased both production and pedigree accuracies. Ridgway continues its long-term selection for free growing, white and sharp crimping wools with an extra emphasis on nourishment and staple length combined with fibre density. All sheep are shorn twice a year at intervals of between 5-7 months depending on seasonal conditions, with the aim of cutting between 60 and 70 millimetres at each shearing, which is in line with increasing market preference. Other benefits of twice-a-year shearing include faster growth and maturity of young stock, ease of lambing, particularly in maiden ewes and the removal of the necessity to crutch. Details: Ric & Gail , Matt or u ROSEVILLE PARK Roseville Park Merino stud was founded in 1938 and is located at Dubbo in the Central west of NSW. The average rainfall is 650mm and is evenly distributed throughout the year meaning that because of regular summer rainfall events with high humidity the wool has become highly fleece rot and flystrike resistant. The sheep are run on predominantly native pastures on granite soil types. The stud s ewe breeding flock consists of 3,200 breeding ewes which this year tested 18.0 micron and had an average fleece weight of 8.86Kg. The Merino Stud has become one of Australia s most influential stud s influencing over 200 Merino studs and selling rams to over 650 commercial flocks in all environments and conditions. Roseville Park is also one of only a few stud s that is benchmarked to and leading the industry in every possible way through Central Test Sire Evaluation, Information Nucleus Flocks, Merinoselect, wether trials, fleece shows, flock ewe competitions, and the show and sale ring. Last year saw some outstanding results for the stud including a top price of $26,000 and selling 207 rams at auction to average $2995. 20 STUD PARK SOUTH Stud Park South Merino and Poll Merino Stud was established in Ewes and rams purchased from the dispersal of the Millear family s Buttabone Stud Park at Warren in NSW, provide the cornerstone of the Stud today. Whilst Stud Park South may be a relatively new stud, the Peppin genetics it carries are part of Merino folklore dating back to Thomas Millear and Albert Austin s joint purchase of the Wanganella Stud from the Peppin Brothers in Pat and Sarah Millear are proud to continue the family s long tradition of breeding big framed, heavy cutting merino sheep. Recently genetics from Wallaloo Park, Langdene and Coddington Poll have been added. These rams have all contributed significantly in shaping the type of sheep we are breeding today. The poll stud was founded on Poll Boonoke blood in the early 1950 s. In 1980 the horn stud was dispersed with the best ewes taken into the poll stud. We believe we are the oldest poll stud active in Victoria. Two rams were purchased from Moorundie Park in South Australia during the early 1980s. These rams bred very well adding great size and bulk to our sheep. In 1989 we purchased a fine wool ram at the Roseville Park Poll Stud dispersal and a second poll ram 3 years later. This ram was bred in the horn special stud at Roseville Park but was polled and he has proved to be an outstanding success at Terrick West. In recent years some semen from Wallaloo Park has been added with great effect. As most of our clients join some of their ewes to border leisters and other terminal sires it is important to produce large framed sheep with a plain body and a bulky deep crimped wool testing micron. These sheep are very fertile. With the concentration on soft handling deep crimped wools with high comfort factors the micron of our sheep continues to fall with most young sires now in the 17 to 19 micron range and exceeding 100kg by the time they cut their 2 teeth. The long term flock micron has been falling while wool cuts and body weights have increased at the same time. The past 3 years has seen the flock average 19 microns with grown sheep wool cut average over 8kgs. Over the last few years Terrick West has had considerable show and sale success with both stud and specially selected rams have been sold all over Australia. This shows that there is strong demand for the type of sheep we are breeding. Several Terrick West clients have achieved excellent prices for wether lambs over the hooks and high prices for surplus ewes. 18

Toland blood sheep are leading performers in wether trials and in the national Central Test Sire Evaluation Scheme. We have been benchmarking our flock with Sheep Genetics for the last 13 years. 52 TERMS AND CONDITIONS FOR THE SALE OF STUD STOCK BY AUCTION CHAPTER ONE - PRELIMINARY 1. (a) A vendor is bound by these terms and conditions by offering livestock for sale by auction. (b) (c) An agent (which includes an auctioneer) is bound by these terms and conditions by conducting an auction sale. A buyer is bound by these terms and conditions by bidding at auction. 2. (a) In these terms the expression auctioneer, agent, buyer and vendor respectively includes the servants, contractors, agents of each of them. The auctioneer, agent, buyer and vendor shall be wholly responsible for the acts and omissions of their respective servants, contractors and agents. The term auctioneer includes, so far as the law and context permits, the vendor s agent. (b) When used in these terms the expressions companion animals means all animals originating from the same property on a particular day. Where lots are split and sent to multiple establishments, then all of these animals shall be regarded as companions. 3. The following applies in interpreting these terms and conditions: (a) (b) The following words have the following meanings: Fees means all levies, charges, fees, costs and other expenses incurred or relating to these terms and conditions and the sale and purchase of livestock including, without limitation, transaction levies, yard and weigh dues, cartage, advertising and rebates, and whether paid for, or incurred, by the agent; Livestock means animals auctioned pursuant to these terms and conditions; and Price means the amount at which the lot has been sold to the buyer referred to in clause 7 of these terms and conditions (i) plus any Fees and other expenses incurred in relation to the purchase of livestock that are payable by the buyer; and (ii) plus any GST added in accordance with clause 12. These terms and conditions are subject to legislation or regulation in the State in which the auction is conducted and in the event of any conflict then the legislation or regulation will prevail. The provisions of these terms and conditions are in addition to, and do not derogate from, the duties and rights of vendors, agents and buyers set out in legislation and regulation in the State in which the auction is conducted. CHAPTER TWO - STANDARD TERMS OF SALE 4. Subject to any reserve price, and to the right, prior to the fall of the hammer, of the vendor to withdraw any lot without declaring the reserve, the highest bidder shall be the buyer. 5. The auctioneer has the right to bid on behalf of the vendor provided that right is notified prior to the commencement of the sale and is subject to State law. 6. A bid cannot be made or accepted after the fall of the hammer unless, in accordance with clause 8, the auctioneer decides to put the lot up again. 7. The last price called by the auctioneer at the fall of the hammer shall be the amount at which the lot has been sold. 8. In the event of a disputed bid, the auctioneer is the sole arbitrator of the successful bidder or the auctioneer may decide to put the lot up again. The auctioneer s decision is final. 9. The auctioneer may refuse to accept any bid which, in the auctioneer s opinion, is not in the best interest of the vendor and need not give reasons for doing so. 10. A bidder shall be deemed to be a principal unless, prior to bidding, the bidder has given to the auctioneer a copy of written authority to bid for or on behalf of another person. 50

53 11. The successful bidder at a livestock auction sale must give to the auctioneer at the fall of the hammer: (a) the purchaser s name; or (b) the bid card number which identifies the purchaser; or (c) the name of the person on whose behalf the successful bid was made; and (d) the Property Identification Code (known as the PIC ) of destination. 12. The auction shall be conducted on the basis that the bid price shall be exclusive of Goods and Services Tax (GST). GST shall be added after the fall of the hammer for those sales subject to GST. 13. As soon as practicable after the fall of the hammer, the buyer shall if requested by the agent, sign the agreement for sale. 14. If a buyer does not comply with any of these terms and conditions, which includes the requirements of State law, any livestock knocked down to that buyer may be re-sold by public auction or private contract in whatever lots and manner the auctioneer decides. The re-sale may be with or without notice and shall be at the buyer s risk. The buyer is responsible for all loss and expense arising out of a re-sale and is not entitled to any resulting profit. 15. The buyer of livestock must pay the agent the full amount of the purchase price in immediate funds on receipt of a tax invoice. Payment is required prior to delivery unless some other time for payment is specified in a written agreement between the buyer and the auctioneer that was made before the fall of the hammer. If, before delivery, payment has not been made then clauses 20 to 23 apply. 16. No person may bid unless, prior to the commencement of the sale, that person has made arrangements satisfactory to the auctioneer for payment for livestock purchased. If bids in breach of this condition are inadvertently accepted, delivery shall not be given until the purchase money is paid and any law, rule or practice to the contrary is accordingly negatived as far as possible. 17. (a) Cattle sold on a liveweight basis that are weighed pre-sale are at the risk and expense of the buyer upon the fall of the hammer. (b) Cattle sold on a liveweight basis that are weighed post-sale are at the risk and expense of the buyer immediately after weighing. (c) All livestock other than cattle sold on a liveweight basis are at the risk and expense of the buyer upon the fall of the hammer. 18. (a) Subject to this clause the sale is complete on the fall of the hammer. (b) (c) (d) (e) The time for rejection is the time commencing at the fall of the hammer and ending at the first of: (i) delivery is taken by a representative of the buyer; (ii) departure of the animal from the purchaser s delivery pen; or (iii) one hour after the last animal is: a. in the case of pre-sale weighing, sold; or b. in the case of post-sale weighing, weighed. During the time for rejection the buyer may reject any animal which is lame, blind or diseased where that condition existed prior to the fall of the hammer but could not be reasonably observed when the animal was in the selling pen. If the purchaser rejects an animal during the time for rejection then the sale of that animal is cancelled and the animal is returned to the vendor or sold on such terms as any buyer and the agent may agree, after the agent has disclosed the reason for rejection to that buyer. This sub-clause applies only to cattle which are sold in Queensland at auction for slaughter. The agent has responsibility for the prevention of loss or escape (but not death, sickness or injury) of those cattle from the time of the fall of the hammer, through delivery to and from the scales, to the buyer s delivery pen and on to the buyer s nominated transport. This responsibility ends at the earlier of those cattle boarding the buyer s nominated transport or sunset on the day after the sale. This sub-clause does not apply if the agent makes an announcement to that effect prior to sale. 51

54 19. (a) Subject to the right of rejection in Clause 18, all conditions and warranties expressed or implied by law are hereby excluded from the sale to the extent that the law allows. All lots are open for inspection prior to the commencement of the sale and are sold with all faults, if any. No compensation shall be given for any faults, imperfections, errors of description, number in or of any lots sold or otherwise. (b) (c) (d) (e) (f) Any claim or objection arising out of an error or misdescription in the provision of relevant information in terms of legislation or regulation concerning the National Livestock Identification Scheme (NLIS) must be made by 5:00pm on the seventh day after the fall of the hammer. No objection, requisition or claim against the vendor or agent in respect of such error or misdescription can be made after that time. Any statements made by the vendor or the auctioneer whether in writing or orally to the effect that any female has been pregnancy tested or scanned positive shall mean and require only that a certificate in writing shall be supplied to the buyer signed by a qualified veterinary surgeon or certified scanner certifying that the said female has been tested or scanned on the date specified in the certificate and that in the opinion of the surgeon or scanner was pregnant on that date. For slaughter cattle, the agent undertakes to make every reasonable effort to ensure that any NLIS cattle device number is transferred from the saleyard PIC to the purchaser s PIC on the NLIS database no later than midnight on the day of the sale. For other slaughter livestock the agent undertakes to make every reasonable effort to ensure that the NLIS information is transferred from the saleyard PIC to the purchaser s PIC on the NLIS database no later than midnight on the day of the sale. Where livestock have a food safety or market eligibility status derived from the National Vendor Declaration (NVD) and/or the NLIS/ERP database, the agent will inform the buyers by presale catalogue and/or announce the status prior to the offering of those lots. 20. If delivery is made to, or possession obtained by, the buyer or its representative before full payment of the Price, then until full payment is received, the buyer: (a) does not acquire title to the livestock; (b) holds the livestock as bailee only for the vendor; (c) must act in a fiduciary capacity in its relationship with the vendor; (d) must store the stock separately or so that they are readily distinguishable from other livestock owned by the buyer; (e) is responsible for the safety and well being of the livestock; (f) may make a bona fide sale for market value of any or all of the livestock. As between the buyer and the subsequent buyer, the sale shall be made by the buyer in its own name and not as agent for the vendor, however as between the vendor and buyer, the sale shall be made as bailee and agent for the vendor; and (g) must keep and account for the proceeds of any subsequent sale separately from its other money and hold those proceeds, together with the benefits of any rights against subsequent buyers, on trust for the vendor. 21. In addition to clause 20, if payment is not made according to clause 15, but delivery has been made to, or possession obtained by, the buyer or its representative: (a) The vendor or its agent may repossess and resell the livestock and enter property owned or occupied by the buyer or its representative if necessary to do so; and (b) Interest may be charged at the rate usually charged by the agent for overdue accounts on any amounts which remain owing at any time. 22. The buyer may not make any claim against the vendor for actions by the vendor or its agent under clauses 20 or 21 and indemnifies the vendor and its agent against any loss, damage, costs, expenses, penalties, fines or claims suffered by the vendor, the agent or any person or entity arising from the vendor exercising its rights under clauses 20 or Clause 23 applies whenever the agent pays the vendor before being paid by the buyer, which the agent is not bound to do. The agent is then the del credere agent of the vendor at law. 52

55 23.2. The vendor hereby gives notice to the buyer of the assignments referred to in clause When this clause applies, in addition to any rights of the agent that arise by operation of the law, the parties agree that, subject to clause 23.6 the agent is subrogated to all rights of the vendor under these terms and conditions against the buyer Title to the livestock does not pass to the agent or a nominee of the agent unless the agent, by written notice to the vendor, notifies the vendor that it is to be transferred to the agent or a nominee of the agent The vendor acknowledges that the agent may take enforcement, repossession or other action to recover any livestock for which the buyer has not paid in full, or the Price of such livestock, owing by the buyer under these terms and conditions: (a) when this clause does not apply, as agent of the vendor (including by reselling the livestock); and (b) when this clause applies, on the agent s own behalf exercising the rights of the vendor by subrogation or assignment under these terms and conditions (whether in the vendor s name or not) and, where title to the livestock has not passed to the agent, by selling the livestock as agent of the vendor without the agent having to account to the vendor for the proceeds of sale The agent may at any time, assign, transfer, securitise or otherwise dispose of all or any of its rights under these terms and conditions and any debts created pursuant to it (including, without limitation, the rights assigned to it under clause 23.3) The vendor hereby irrevocably appoints the agent as the vendor s attorney to: (a) do at any time and in any manner as the agent thinks fit all acts necessary or desirable to perfect or improve the rights and interests afforded, or intended to be afforded, to the agent under these terms and conditions; and (b) appoint one or more sub-attorneys to do anything that the agent may do as the vendor s attorney These terms and conditions do not render the agent liable to the buyer as vendor nor entitle the buyer to set off against the agent any right the buyer may have against the vendor or otherwise The buyer acknowledges that the provisions of this clause 23 are intended solely for the benefit of the agent (and its assigns) and the vendor. The liabilities and obligations of the buyer will not be in any way affected: (a) by this clause 23, other than as it expressly provides; or (b) by the failure of the agent or the vendor or either of them to comply with the terms of this clause The buyer must pay all amounts payable to the vendor or the agent under these terms and conditions without any deduction, withholding, set off or counterclaim whatsoever, whether the benefit of a deduction, withholding, set off or counterclaim is alleged to exist in favour of the buyer as against the vendor or the agent in any capacity whatsoever or any other person including any assignor of the vendor s or the buyer s interests under these terms and conditions. 24. (a) The agent agrees that he is liable to pay to the vendor the Price, less such commission as is agreed between the vendor and the agent, and in the absence of any agreement such amount as is reasonable, and less the Fees that are payable by the vendor that were incurred by the agent on behalf of the vendor in relation to the sale of the livestock. (b) (c) In the event that the buyer pays the Price or part of it direct to the vendor then the agent has no liability to the vendor for the amount of such payment. Further, if the agent pays the vendor any amount which the buyer also pays direct to the vendor in respect of the same livestock, then the vendor must repay the agent that amount and the agent may debit that amount to an account held in the name of the vendor by the agent. Regardless of whether or not a sale has occurred the agent may, but is not under obligation so to do, instead of deducting payments owed to it by the vendor, debit the amount of the commission and fees to an account held in the name of the vendor by the agent. 53

56 25. (a) The auctioneer has been retained by the vendor as auctioneer for the purpose of selling the livestock comprised in the lots. The terms of engagement between the auctioneer and the vendor do not extend to the provision of advice by the auctioneer to the vendor in relation to the safety or otherwise of the sale ring, the saleyards and the surrounding environments. (b) The vendor, the agent and the buyer agree to comply with their several duties under the Australian Animal Welfare Standards and Guidelines for the Land Transport of Livestock and further to consign, manage, receive, transport and handle livestock in accordance with any other or additional requirements of animal welfare legislation specific to the jurisdiction in which livestock are consigned, managed, received, transported and handled in the course of the auction process. CHAPTER THREE VENDOR WARRANTY FOR CORRECT PRESENTATION AND DECLARATION 26. This chapter applies only in the case of livestock and their companion animals sold at auction for slaughter when the buyer is the slaughterer and the livestock are transported direct from the sale yard to the meatworks at which they are slaughtered. This chapter does not apply if the buyer is a trader who subsequently resells the livestock to a slaughterer. A slaughterer is any person who pays the AMPC Processor levy. 27. The warranty of a vendor is that livestock and their companion animals offered for sale at auction: (a) pass DAFF and other regulatory authority requirements and inspections at the time of slaughter; (DAFF refers to the Federal Government Department of Agriculture, Fisheries and Forestry) (b) (c) (d) (e) are of merchantable quality; carry an NLIS device in accordance with State law; in the case where a representation has been made in the pre-sale catalogue that the livestock have particular characteristics or are fit for a particular purpose or market, and such representations are based on information in the NVD, the livestock will have those characteristics or will be fit for the particular purpose or market; and all information in any NVD provided by the vendor is true, complete and correct in all material respects. 28. In the event of a breach by the vendor of the vendor s warranty and provided such breach is notified by the buyer to the agent by 5:00pm on the 7 th day after the fall of the hammer then the buyer is not liable to pay the portion of the Price of such of the vendor s livestock to which the breach applies. 29. However if the breach by the vendor is such that the livestock are not rejected outright but are instead downgraded then the buyer will pay the value of the livestock at their next highest and best use. 30. In the case of a breach by the vendor of the vendor s warranty then the vendor will also be liable to the buyer for any further losses which the buyer might establish but the buyer will take all reasonable steps in co-operation with the agent and vendor to mitigate both the effect of the breach and the amount of any loss. 31. Where a sentinel animal of a lot tests positive for chemical residue, or foreign material contamination and provided such test is certified and notified as required by these vendor warranty terms, then: (a) the buyer will be entitled to delay payment for the price of all livestock in that lot only; or (b) the vendor has the option, at the vendor s cost, of collecting the companion animals, if allowed by law; or of having the livestock slaughtered in which event the risk of further condemnations will be that of the vendor. Where product integrity is potentially jeopardised, the Processor has the right to refuse slaughter and send the livestock back to the consigning property at the vendor s cost. 32. The auctioneer is liable to the buyer in respect of any breach of the vendor s warranty arising out of: (a) any error, by the auctioneer, of transcription of information from the NVD completed by the vendor to the pre-sale catalogue or the buyers post-sale summary; 54

57 (b) (c) any failure by the auctioneer to notify the buyer, prior to bidding, of any breach by the vendor of the warranty of the vendor if the buyer establishes that the agent knew of such breach prior to the sale; and any failure by the auctioneer to announce prior to bidding, or disclose in the pre-sale catalogue, that the vendor has failed to provide a NVD that is complete in all material aspects. CHAPTER FOUR - OWNERS RISK FOR CONDITION OF CATTLE 33. This chapter applies only in the case of cattle and their companion animals sold at auction for slaughter when the buyer is the slaughterer and the cattle are transported direct from the sale yard to the meatworks at which they are slaughtered. This chapter does not apply if the buyer is a trader who subsequently resells cattle to a slaughterer. A slaughterer is any person who pays the AMPC Processor levy. 34. Owners risk reflects the producer s responsibility to provide slaughter cattle for sale that are fit for human consumption. Cattle are fit for human consumption if they are not condemned as unfit by DAFF. Owners risk applies if the condemnation is due to a condition in the animal which the buyer establishes, by the DAFF certificate, existed prior to the fall of the hammer. 35. A buyer with the benefit of owners risk protection is not liable to pay the Price of that animal to the vendor. The buyer remains nevertheless liable for all costs incurred after the fall of the hammer in transport, slaughter, testing and disposal of the animal. 36. Owners risk protection is available to the buyer of cattle to which this chapter applies if all of the following are satisfied: (a) a certificate is issued by DAFF which states the relevant NLIS RFID tag number and PIC, the date of the certificate, the reason for condemnation and that the reason for condemnation existed prior to the fall of the hammer; (b) (c) the certificate is received by the selling agent either in its original form or by fax by 5:00pm on the 7 th day after the fall of the hammer; and if the condemnation is due to chemical residue the certificate follows testing in a DAFF approved laboratory which establishes maximum residue limits in excess of the Australian limit. 37. Owners risk does not apply, and the buyer must pay for the cattle, if the reason for condemnation is any of the following: (a) bruising, (b) fever, (c) partial condemnation, or (d) emaciation. CHAPTER FIVE - NOTICES REQUIRED BY STATE LEGISLATION NSW Legislation Property, Stock and Business Agents Act 2002 Warnings Penalties for collusive practices. It is an offence against the Property, Stock and Business Agents Act 2002 for a person to do any of the following as a result of a collusive practice, or to induce or attempt to induce another person by a collusive practice to do any of the following: (i) to abstain from bidding; or (ii) to bid to a limited extent only; or (iii) to do any other act that might prevent free and open competition. Severe penalties may be imposed on persons convicted of collusive practices. The auctioneer has the right to make one bid on behalf of the vendor if the auctioneer clearly and precisely announces that fact prior to the sale. Tasmanian Legislation An auctioneer conducting a public auction must not appear to acknowledge the making of a bid if no bid was made. A person must not participate in collusive practices by way of making or receiving an unlawful promise to abstain from bidding, not to bid except to a limited extent or do any other thing which may prevent free and open competition. 55

58 Western Australian Legislation Auction Sales Act 1973 s31 NOTICE. It is an offence to: (i) (ii) (iii) (iv) (v) induce or attempt to induce another person to abstain from bidding by means of a promise, expressed or implied, that the other person will have the right to elect to take over as buyer or to toss or draw lots to establish who is to become the owner; abstain or agree to abstain from bidding as a result of such a promise; knowingly enter or permit or cause to be entered in the auctioneer s record any name other than that of the actual successful bidder; enter in the auctioneer s record the name of the buyer other than that of the actual successful bidder; or in the case of successful bidder supply wrong information as to the name of the buyer to the auctioneer or to any person, firm or corporation on whose behalf the sale is conducted. The vendor, or any person on behalf of the vendor, or the auctioneer have the right to make no more than three bids.
