1 CITY OF ENCINITAS CITY COUNCIL AGENDA REPORT Meeting Date: January 23, 2013 TO: VIA: FROM: SUBJECT: City Council Gus Vina, City Manager Tim Nash, Director of Finance Lisa Rudloff, Director Parks and Recreation Michael Stauffer, Senior Analyst Award of Multi-Year Contract to County of San Diego for Animal Control Services. BACKGROUND: The County of San Diego Department of Animal Services provides animal-related law enforcement, sheltering, medical and pet adoption services for the unincorporated areas of the County, and for the cities of Carlsbad, Del Mar, Encinitas, San Diego, Santee, and Solana Beach. Other Cities, such as Oceanside and Escondido that do not contract with the County either maintain their own shelter and enforcement agencies or contract with a local humane society for services. The County Department of Animal Services helps protect animals from abuse and neglect, the public from dangerous animals, and save the lives of thousands of lost and abandoned pets each year. They operate three County animal shelters that provide safe, temporary housing and care for stray and owner-relinquished animals, and adoption opportunities for friendly and healthy or treatable orphaned pets. They promote safe and healthy communities for people and animals through their law enforcement and public education activities, and they also developed plans to help protect animals and assist their owners if and when they are threatened by disasters. The City of Encinitas has contracted with the County of San Diego for animal control related services since incorporation. August 20, 2008 City Council awarded a five year agreement with the County of San Diego for animal control services that will expire on June 30, ANALYSIS: Section (e) of the California Health & Safety Code (Attachment A) mandates that each city, county or governing body provide for the maintenance of an animal pound system, a rabies control program and enforcement of the applicable provisions of the Health & Safety Code. 2 Animal Services the issuing authority to enforce all applicable laws, rules and regulations related to the possession of animals in the City. By contracting with the County for these services, the City fulfills its obligations under the State mandate. In the past, the City has received some reimbursement from the State, on an annual basis, for this unfunded mandate. The proposed five-year contract will take effect July 1, 2013 and terminate on June 30, 2018 unless terminated sooner as provided by the contract. The agreement may be extended beyond June 30, 2018 for additional five-year terms with written consent of the parties. Services include shelter management, field services, dog licensing, rabies clinics, veterinary medical services and the spay/neuter program. Animal Services has requested that contract cities secure approval of the new Contract by February 2013, at which time all contracts will be presented to the County Board of Supervisors for final approval. FISCAL AND STAFF IMPACTS: The County of San Diego Department of Animal Services shall provide animal control services to the City of Encinitas as specified in Section 3 and 5 of the contract (Attachment C). FY Estimated Budget General Fund animal control contract gross costs $410,452 Revenue from collected fees (102,900) Net Budget Impact $307,552 The FY Financial Plan regarding the award of this contract is described below: The gross cost of providing animal control services to the City of Encinitas for FY is estimated to be $410,452. The County shall collect license and other fees, as specified under the Contract. The revenue amount to be collected within the City of Encinitas for FY is estimated to be $102,900. After deducting estimated revenues from the gross cost, the City of Encinitas shall pay the County the net amount of $307,552 for FY , which includes the amount of $4,000 to finance the spay/neuter program as provided for in Sections 6 and 8 of the contract. The net amount $307,552 is included in the FY proposed operating budget.
