2 Introduction This policy on dogs is prepared in accordance with the Dog Control Act 1996 (the Act). Council is required to have a Dog Control Policy. In adopting a policy, Council must have regard to: (a) (b) (c) (d) The need to minimise danger, distress and nuisance to the community generally; The need to avoid the inherent danger in allowing dogs to have unimpeded access to public places that are frequented by children, whether or not the children are accompanied by adults; The importance of enabling, to the extent that is practicable, the public (including families) to use streets and public amenities without fear of attack or intimidation by dogs; and The exercise and recreational needs of dogs and their owners. Council recognises that that the majority of dog owners are responsible and that most interaction between dogs and the public is positive. It is also recognised that dogs can play a positive role in society and provide enjoyment and health benefits for individuals and families. This Policy seeks to achieve a balance between the control of dogs and recognition of the community benefits of responsible dog ownership. Our Objective Council s objective is to encourage responsible dog ownership that allows owners to enjoy their dogs without infringing on the enjoyment and safety of others. Good dog owners should: (a) (b) (c) (d) (e) (f) (g) Register their dogs and make sure they wear a current registration tag; Keep their dogs under control; Provide their dogs with care and attention; Provide their dogs with proper and sufficient food, water, shelter, and exercise; Not let their dogs be a nuisance to others; Make sure their dogs do not injure, endanger, intimidate or distress any person or other animal or damage property; Comply with the Act, any regulations and the Dog Control Bylaw. Our Policy 1. Access to Public Places This Policy identifies public places in Marlborough where dogs are prohibited or must be controlled on a leash. It also identifies areas where dogs are free to be exercised at large. The Bylaws will provide for such areas. Criteria for determining levels of access for dogs to public places. Access should be restricted where: Access could be less restricted where: There is intense public use Another predominant use exists Significant wildlife or habitats exist There is significant risk to other users The area is not used extensively by other users It is of significant size There are sufficient sight lines The area is well-bounded from adjacent areas Page 2
3 1.1 Dog Prohibited Areas Dogs are prohibited from Dog Prohibited Areas at all times. Dog Prohibited Areas are: Those areas identified as the Dog Prohibited Areas in the attached Schedule and as confirmed in the Bylaw. Note paragraph 1.4 regarding land administered by the Department of Conservation. Where a children s playground is established in a public place after this policy and the bylaw is promulgated, dogs will be prohibited within 3 metres of the playground notwithstanding that the place may be designated a Dog on-leash Area or a Dog Exercise. 1.2 Dog Exercise Areas Dogs are permitted on or off-leash in Dog Exercise Areas. Owners must keep their dogs under control at all times and must carry a leash with them. All dog faeces must be removed immediately by the owner of the dog. Owners must have a practical means of removing their dog's faeces. Dog Exercise Areas are: Those areas identified as Dog Exercise Areas in the attached Schedule and as confirmed in the Bylaw. 1.3 Dog On-Leash Areas Dogs are permitted in Dog On-Leash Areas but must be controlled on a leash. All dog faeces must be removed immediately by the owner of the dog. Owners must have a practical means of removing their dog's faeces. Dog On-leash Areas are: Those areas identified as Dog On-leash Areas in the attached Schedule and as confirmed in the Bylaw; and With the exception of Dog Prohibited Areas and Dog Exercise Areas, dogs are permitted in all public places provided the dog is on a leash. Note: nothing in this Policy permits dogs to enter public places which are under the control of another organisation without authorisation from the relevant organisation (for example areas under the control of the Department of Conservation). 1.4 Controlled or open dog areas under Conservation Act 1987 and national parks under National Parks Act 1980 No controlled or open dog areas, on lands administered by the Department of Conservation, have been declared under Part 5C of the Conservation Act There is a small portion of Nelson Lakes National Park in Marlborough District, where dogs are prohibited. Queen Charlotte Track-Anakiwa to Davies Bay (Umungata) Permit Dogs must be on a leash at all times. 1.5 Exceptions to 1.1 and 1.3 Dogs are permitted in Dog Prohibited Areas and are permitted off-leash in Dog On-Leash Areas in the following situations: (a) (b) (c) Where the owner has express written permission from the Council for the dog to be in a Dog Prohibited Area or to be off-leash in a Dog On-Leash Area; or Where the dog is a working dog as defined in the Act carrying out its duty; or Where the dog is confined completely within a cage or vehicle, provided that the dog is kept under control at all times. Note: This does not permit dogs to enter public places that are under the control of another organisation without authorisation from the relevant organisation (for example lands administered by the Department of Conservation). 1.6 Disability Assist Dogs Disability assist dogs have a special status in the Dog Control Act and are allowed in all public places even those declared to be prohibited under Council s bylaws. They are also permitted in premises registered under the Health Act 1956 such as restaurants. A disability assist dog is a dog certified by one of the following organisations as being a dog trained to assist (or as being a dog in training to assist) a person with a disability: (a) (b) (c) (d) (e) (f) (g) Hearing dogs for Deaf People New Zealand; Mobility Assistance Dogs Trust; New Zealand Epilepsy Assist Dogs Trust; Royal New Zealand Foundation of the Blind; Top Dog Companion Trust; Assistance Dogs New Zealand; and Perfect Partners Assistance Dogs Trust. 2. Menacing Dogs Council must classify dogs of the following breeds as menacing dogs: American Pit Bull Terrier Page 4
5 Brazilian Fila Dogo Argentino Japanese Tosa Perro de Presa Canario Council may classify any other individual dog as menacing if the dog poses a threat to any person, stock, poultry, domestic animal or protected wildlife because of the behaviour of that dog or because of any characteristics typically associated with the dog s breed or type. If a dog is classified as menacing, the owner of the dog must ensure the dog is muzzled when in public (except when confined completely in a vehicle or cage). The classification of a dog as menacing is in force throughout New Zealand. The classification is noted in the National Dog Database which is accessible to all territorial authorities with dog control responsibilities. The Act requires Council to state whether dogs classified as menacing are required to be neutered and, if so, whether the requirement applies to all such dogs. Council must also state whether dogs classified as menacing by another territorial authority and registered in Marlborough must be neutered. Council s policy is that all dogs classified as menacing will be required to be neutered. This applies to: dogs classified as menacing by Council; and dogs classified as menacing by any other local authority and registered with Council. Council will also require owners of menacing dogs to undertake dog owner and dog obedience education. 3. Dog Fees and Charges The Council may set dog control fees for the registration and control of dogs. Fees will be set and advertised annually before the beginning of each registration year. Categories for which fees will be charged Registration Impounding Working dogs First impounding Non-working dogs Subsequent impounding (category 1) Daily sustenance Non-working dogs (category 2) Dangerous dogs Late payment of registration Miscellaneous Multiple Dog Property Licence Destruction Replacement tags Working dogs are defined in the Dog Control Act. In brief, they include: (a) (b) (c) (d) (e) (f) Disability assist dogs; and Various dogs used by government agencies (such as Police, Prisons, and Customs) in the course of their duties; and Farm dogs (used solely or principally for the purposes of herding or driving stock); and Dogs used to destroy pests or pest agents under pest management strategies made under the Biosecurity Act 1993; and Guard dogs used by licensed property guards; and Dogs declared by Council to be a working dog. 6 Non-Working Dogs (category 1) are all non-working dogs that meet all of the criteria below: (a) (b) (c) (d) (e) (f) The dog has been implanted with a functioning microchip transponder of the prescribed type and in the prescribed location; and The dog has been neutered; and The dog has not been classified as dangerous or menacing; and The owner has not within the previous seven years been classified as probationary or been disqualified from owning a dog; and The owner of the dog has not within the previous seven years been convicted of an offence under the Dog Control Act 1996, or under Part 1 or Part 2 of the Animal Welfare Act 1999 in respect of a dog or any offence against section 26ZZP of the Conservation Act 1987 or section 561 of the National Parks Act 1980; and The owner of the dog has not, within the previous three years, committed any infringement offence under the Dog Control Act 1996, or under Part 1 or Part 2 of the Animal Welfare Act 1999 in respect of a dog or any offence against section 26ZZP of the Conservation Act 1987 or section 561 of the National Parks Act Non-Working Dogs (category 2) are all non-working dogs that do not meet all of the criteria of a Category 1 dog. 4. Education Council recognises the importance of education to promote awareness: In owners, of their responsibilities as dog owners; and In the public, of safety around dogs. Council will: Provide education to primary and intermediate school children on dog control, animal welfare, bite prevention and hygiene; Offer bite prevention training to employees who enter properties on a regular basis; (This programme is charged on a cost recovery basis) Promote dog obedience and dog owner education courses; and Educate dog owners on the risk to stock from taenia ovis posed by dogs Information and education will be provided through brochures, websites, newspapers and school education programmes. 5. Classification of Owners and Disqualification 5.1 Probationary Classification Council can classify certain persons as a probationary owner. Classification may be considered for any person convicted of an offence under the Act (or other specified offences against the Animal Welfare Act 1999, the Conservation Act 1987 or the National Parks Act 1980) or any person who has received three or more infringement notices in a 24 month period. Council will consider: In all situations classifying such persons as probationary owners Probationary classification has the following effects: The owner is not allowed to own any dogs other than dogs that were owned at the date of the relevant offence or date of the third infringement offence; Page 6
7 The owner must dispose of any unregistered dogs; and Probation lasts for up to 24 months. 5.2 Disqualification Council must disqualify certain persons from being a dog owner, but not where Council considers disqualification is not warranted or where Council will instead classify the person as a Probationary Owner. The Council must disqualify any person convicted of an offence under the Act (or other specified offences against the Animal Welfare Act 1999, the Conservation Act 1987 or the National Parks Act 1980) or any person who has received three or more infringement notices in a 24 month period. Council will consider: In all situations disqualifying such persons. Disqualification has the following effects: The owner must dispose of all dogs they own; The owner cannot own any more dogs; and Disqualification lasts for up to five years. 5.3 Objection to decision A person can object to a decision to classify that person as a Probationary Owner or to disqualify that person as the case may be. A Sub-Committee of Council will hear and consider the objection. The owner will have the right to be heard by the Sub-Committee. In considering any objection, the Sub-Committee must have regard to: The circumstances and nature of the offence(s); The competency of the owner in terms of responsible dog ownership; Any steps taken by the owner to prevent further offences; The matters advanced in support of the objection; and Any other relevant matters. The Sub-Committee may decide to uphold or rescind the decision. 6. Infringements Dog Control Officers can issue infringement notices which impose an instant fine on the recipient. Infringement notices may only be issued for particular offences (listed in the Schedule to the Act). Fines range from $100 to $750. Council will: Use the infringement notice process for minor breaches; Consider prosecution for more serious breaches. 7. Bylaws Council must create bylaws to give effect to this Policy. Bylaws have already been enacted and it is intended that the current Bylaw will be amended to reflect this Policy. The Act lists the matters for which bylaws may be made. Council's Bylaw applies to all dog owners and will be enforced using the range of enforcement mechanisms available to Council such as Page 7
8 infringement notices and prosecutions open to Council. Specific enforcement mechanisms are also provided for in the Bylaw. Council has identified the following issues for which Bylaws will be created. Dogs are required to wear current registration tags Dog owners are required to dispose of dog faeces deposited in public places Bitches in season and diseased dogs must be contained and are prohibited from public places Dog owners keeping more than two dogs require a licence in most circumstances Dog owners must meet minimum standards for keeping and caring for dogs Dogs in or on vehicles must be adequately restrained and cared for Council may require neutering of dogs not kept under control on multiple occasions Impounded dogs will not be released until the dog is registered and all fees and costs paid Dogs must be sufficiently contained within its owner's property Dog owners must comply with the restrictions on dog access in public places A person who breaches the Bylaw may be liable to pay an infringement fee or may be liable on summary conviction to a fine not exceeding $20,000. 9 SCHEDULE Dog Prohibited Areas Dog Prohibited Areas - Marlborough Description of Public Place All land administered by the Department of Conservation, including the foreshore (to Mean Low Water Springs) of any island administered by the Department of Conservation (unless the dog owner has a permit from the Department of Conservation or there is Department of Conservation signage that identifies where a dog may be taken without a permit). The area within three metres of any children s playground whether or not the balance of the area is designated as a Dog Exercise Area or a Dog On-Leash Area. All sports grounds (including bowling greens) and including the whole of the grounds, the playing fields and their immediate surrounds and their car parks. (Note: most current sports grounds are listed in the Schedule below. In some cases, dogs are allowed on parts of the grounds but only in the areas, for the purposes and under the conditions specified in relation to a particular sports ground.) All museums and halls including their grounds and car parks. All cemeteries including their car parks; and All war memorials including their grounds and car parks. Dog Prohibited Areas - Blenheim Athletic Park including the grounds that surround the enclosed oval) except that dogs are allowed on lead only on the unformed pathway on the northern boundary and solely to access the riverbank from Brewer and Stratford Streets. A direct route must be taken and the dog and owner cannot stop within the Park. A & P Park (the whole of the Park including the car park) except that dogs are allowed at: The annual A&P Show; Brewer Street, Blenheim Maxwell and Alabama Roads, Blenheim Any authorised dog obedience courses; The dog park area at the Farmers Market; and Any other activities as authorised in writing by Council. Central Business District of Blenheim being that area marked on Map 1 Churchward Park except that dogs are allowed on lead only on the formed pathway and solely Taylor Pass Road, Blenheim Page 9
10 to access the riverbank from Maxwell Road. A direct route must be taken and the dog and owner cannot stop within the Park. College Park Harling Park Japanese Garden Stephenson Street, Blenheim Howick Road, Blenheim (Note: dogs are allowed off lead in the balance of the Park) Horton Park Lansdowne Park Oliver Park Golf Course at Pollard Park Rewi Murray Polo Park except that dogs are allowed on lead only on the formed pathway on the eastern boundary and solely to access the Sutherland Stream walkway. A direct route must be taken and the dog and owner cannot stop within the Park. Seymour Square, Blenheim Sheps Park except that, once the grave on the land has been fenced off and Council has given notice that the fencing has been completed, the area of the Park that is not fenced off and leased for grazing stock will become a Dog Exercise Area. The balance of the Park (i.e. the fenced area leased for grazing stock) will remain a Dog Prohibited Area. Whitehead Park Croquet and Bowls areas only Redwood and Stephenson Streets, Blenheim Lansdowne Street, Blenheim Weld, Cleghorn & Bythell Streets, Blenheim Parker Street, Blenheim Redwood Street, Blenheim Bounded by Seymour, Alfred, Henry and High Streets, Blenheim Severne Street, Blenheim Brooklyn Drive, Blenheim (Note: dogs are allowed off lead on the balance of the Park). Wither Hills Farm Park (including the Mountain Bike Tracks but does not include the Redwood Street carpark or the Sutherland Stream Reserve ) Taylor Pass Road, Rifle Range Place, Forest Park Drive, Solway Drive, Weld Street, Redwood Street, Fyffe Street, Dry Hills Lane, and Cob Cottage Road Dog Prohibited Areas - Picton, Waikawa and Koromiko Auckland Street Skate Park Wairau & Auckland Streets, Picton Page 10
