1 CHAPTER 4 - DOG CONTROL The Marlborough District Council hereby makes by resolution the following Chapter 4 of the Marlborough District Council Bylaw 2010 pursuant to the powers contained in Sections 145 and 146 of the Local Government Act 2002, Section 20 of the Dog Control Act 1996, and any other Act or authority in any way enabling the Council in that behalf. 401 Object of This Chapter of the Bylaw The object of this Chapter of the Bylaw is to provide for the care and control of dogs in the area administered by the Marlborough District Council. 402 Interpretation In this chapter of this Bylaw, unless specified or the context otherwise requires, the terms and definitions used have the same meaning as in the Dog Control Act 1996 and its amendments: Beach means the foreshore, and any adjacent area which can reasonably be considered part of the beach environment including areas of sand, pebbles, shingle, dunes or coastal vegetation. Control means that the dog is not causing a nuisance or danger and that the owner of the dog is able to obtain an immediate and desired response from the dog by use of a leash, voice commands, hand signals, whistles or other effective means. Disability Assist Dog has the same meaning as in section 2 of the Dog Control Act Dog Exercise Area means an area listed as a Dog Exercise Area in the Schedule to these Bylaws. Dog On-Leash Area means: an area listed as a Dog On-Leash Area in the Schedule to these Bylaws; and any public place administered by Council not listed as a Dog Prohibited Area or a Dog Exercise Area in the Schedule to these Bylaws. Dog Prohibited Area means an area listed as a Dog Prohibited Area in the Schedule to these Bylaws. On Leash means that the dog is kept under control by means of a leash, lead or chain which is secured or is held by a person so that the dog cannot break loose. Owner has the same meaning as in section 2 of the Dog Control Act Note: Owner is defined in the Dog Control Act as in relation to any dog, means every person who (c) owns the dogs; or Has the dog in his or her possession, whether the dog is at large or in confinement, otherwise than for a period not exceeding 72 hours for the purpose of preventing the dog causing injury, damage, distress, or for the sole purpose of restoring a lost dog to its owner; or The parent or guardian of a person under the age of 16 years who (i) Is the owner of the dog pursuant to paragraph or paragraph of this definition; and Page 1

2 Public Place has the same meaning as in section 2 of the Dog Control Act 1996 and, for the avoidance of doubt includes any Beach or Reserve. Working Dog means any working dog as defined in section 2 of the Dog Control Act Wearing or Display of Current Registration Tags The owner of a dog on land or premises other than land or premises of the owner, must ensure the dog is wearing a collar with a current registration tag attached No expired registration tag may be displayed or worn by a dog. 404 Dogs Fouling in Public Places Where any dog defecates in a public place or land or premises other than that occupied by the owner, the owner must remove the faeces immediately and dispose of them in an appropriate manner Every person who takes a dog into a public place must have a practical means of removing that dog s faeces while the dog is in that public place. 405 Bitches in Season and Diseased Dogs The owner of any bitch in season or dog infected with an infectious disease must not allow that dog on any public place or on any property other than that occupied by the owner, except: where the dog is taken to another property with the consent of the occupier; or where the dog is taken to a registered veterinary clinic for treatment; or provided that the dog is transported in a way that avoids as far as possible, contact with other dogs and the spread of disease Except during planned mating of a bitch in season, the owner of a bitch in season or dog with an infectious disease must ensure that the dog is confined in an appropriate enclosure or controlled to prevent contact with other dogs The owner of a bitch in season or dog with an infectious disease must ensure that the dog is adequately exercised while confined. 406 Limits on Number of Dogs No owner or occupier of any property may keep or allow to be kept on the property more than two dogs over the age of three months (whether or not the dogs are registered) for a period exceeding 14 days, unless: the occupier is the holder of a Multiple Dog Licence issued by Council; or (ii) Is a member of the parent or guardian s household living with and dependent on the parent or guardian; but does not include any person who has seized or taken custody of the dog under this Act or the Animal Welfare Act 1999 or the National Parks Act 1980 or the Conservation Act 1987 or any order made under this Act of the Animal Welfare Act Page 2

3 the property is situated within the Rural 1 or 2 Zone of the Marlborough Sounds Resource Management Plan and the dogs are kept solely or principally for herding stock and the number of dogs is reasonably necessary for that purpose; or (c) the property is situated within the Rural 3 or 4 Zone of the Wairau/Awatere Resource Management Plan and the dogs are kept solely or principally for herding stock and the number of dogs is reasonably necessary for that purpose An application for a Licence must: (c) Be in writing in and in general accordance with the form required by Council; and Include any additional information reasonably required by Council to process the application; and Include payment of the application fee, prescribed by Council from time to time, at the time of lodging the application An application for a Licence will be considered by the Council in its absolute discretion, taking into account: (c) (d) (e) (f) The location and size of the property on which dogs will be kept; Containment and housing of the dogs, and the distance of that housing from the property boundary and neighbouring houses; The method of removing and disposing of dog faeces, liquid waste and wash down water; The availability of adequate supervision and exercise for the dogs; Any previous history of non-compliance with the Dog Control Act 1996 and/or Bylaws; Any other factors considered relevant by the Council The Council may impose any reasonable conditions under a Licence that are consistent with the objects of the Dog Control Act 1996 or this Bylaw Unless otherwise stated in the Licence, the Licence Holder must comply with any conditions imposed by the Council within one month of the grant of the Licence Council may enter the property at any reasonable time to inspect the property when assessing an application for a Licence, for compliance with these Bylaws, the Licence and any conditions imposed under the Licence Failure to comply with the conditions of a Licence within the specified time will invalidate that Licence If Council determines that the keeping of the additional dog(s) is inconsistent with the provisions of the Dog Control Act 1996 or this Bylaw, Council may impose additional conditions under, or revoke, any Licence by giving one month s notice in writing to the Licence Holder On revocation of the Licence, the Licence Holder must, within 14 days of the date of Council s notice of revocation reduce the number of dogs kept on the property to the number specified by Council Nothing in bylaw 406 applies: To any premises used as a registered veterinary clinic; or To any premises used lawfully for the purpose of a commercial boarding kennel; or Page 3

4 (c) (d) To any premises used for the purpose of impounding dogs under the Dog Control Act 1996; or To any premises where animals are kept under the care of the Society of Prevention of Cruelty to Animals. 407 Standards for Keeping Dogs Dog owners must ensure that their dog(s) is provided with: (c) (d) Clean and hygienic accommodation that provides shade, shelter, dry, adequate ventilation and draft-free conditions, such that the dog is kept an appropriate temperature; and Adequate food, water, care and attention; and Adequate exercise; and Appropriate veterinarian care Dog owners must ensure that dog accommodation is: located and designed to minimize nuisance and/or risk to humans and other animals; and at least two metres from a boundary fence If the Council has reasonable grounds to believe that a dog is being kept in contravention of Bylaw 407, the Council may, by written notice, require the owner to take such action as is necessary to ensure compliance within a specified timeframe. Should the owner not comply with that notice, the Council may issue infringement notices. 408 Dogs in or on Vehicles Any person who allows or leaves a dog in a public place inside or on a vehicle must take all reasonable steps to ensure that the dog: (c) is unable to escape that vehicle; does not present a risk or cause distress or nuisance to members of the public; and has adequate ventilation, water and shelter to ensure the dog is comfortable and is not at risk of overheating or dehydration When on a vehicle in a public place, dogs must be secured in a manner that prevents the dog from jumping or falling from that vehicle. 409 Neutering of Dogs Where any owner fails to keep his or her dog under control on repeated occasions, the Council may, by written notice, require the owner to cause that dog to be neutered. The owner must, within one month after receipt of the notice, produce to the Council a certificate issued by a veterinarian certifying: that the dog is or has been neutered; or that for reasons that are specified in the certificate, the dog will not be in a fit condition to be neutered before a date specified in the certificate. 5 409.2 If a certificate under clause is produced, the owner must within one month after the date specified in the certificate, produce a further certificate to the Council under clause. 410 Impounding of Dogs Where any dog is impounded for any reason under the Dog Control Act 1996 or this Bylaw the dog will not be released unless registered and all registration fees, pound fees and other associated costs have been paid, and any other provision required by the Dog Control Act 1996 and this Bylaw has been complied with. 411 Containment When a dog is on land occupied by its owner, the owner must ensure that the dog is physically restrained, or confined, or under direct control, so that it cannot freely leave the land. 412 Dogs in Public Places With the exception of Dog Prohibited Areas and Dog Exercise Areas, dogs are permitted in all public places provided the dog is on a leash No person shall allow a dog to be in a Dog Prohibited Area or shall allow a dog to be offleash in a Dog On-Leash Area unless: (c) the owner has express written permission from the Council for the dog to be in the Dog Prohibited Area or to be off-leash in the Dog On-Leash Area; the dog is a working dog carrying out its duty; or The dog is confined completely within a cage or vehicle, and provided that the dog is kept under control at all times Dogs are permitted off-leash in Dog Exercise Areas provided the dog is under control and the owner carries a leash with them For the avoidance of doubt nothing in this Bylaw permits dogs to enter public places which are under the control of another organisation without authorisation from the relevant organisation (for example areas under the control of the Department of Conservation) Where a children s playground is established in a public place after this bylaw is promulgated, dogs will be prohibited within 3 metres of the playground notwithstanding that the place may be designated a Dog on-leash Area or a Dog Exercise in the Schedule to this Bylaw A list and maps of Dog Prohibited Areas, Dog On-Leash Areas and Dog Exercise Areas are set out in the Schedule to this Bylaw. 413 Contravention of Bylaws Every person who fails to comply with this Bylaw may be liable to pay an infringement fee in accordance with the Schedule 1 of the Dog Control Act Any person who breaches this Bylaw commits an offence and is liable on summary conviction to a fine not exceeding $20,000. 6 SCHEDULE Dog Prohibited Areas Dog Prohibited Areas - Marlborough Description of Public Place All land administered by the Department of Conservation, including the foreshore (to Mean Low Water Springs) of any island administered by the Department of Conservation (unless the dog owner has a permit from the Department of Conservation or there is Department of Conservation signage that identifies where a dog may be taken without a permit). The area within three metres of any children s playground whether or not the balance of the area is designated as a Dog Exercise Area or a Dog On-Leash Area. All sports grounds (including bowling greens) and including the whole of the grounds, the playing fields and their immediate surrounds and their car parks. (Note: most current sports grounds are listed in the Schedule below. In some cases, dogs are allowed on parts of the grounds but only in the areas, for the purposes and under the conditions specified in relation to a particular sports ground.) All museums and halls including their grounds and car parks. All cemeteries including their car parks; and All war memorials including their grounds and car parks. Dog Prohibited Areas - Blenheim Athletic Park including the grounds that surround the enclosed oval) except that dogs are allowed on lead only on the unformed pathway on the northern boundary and solely to access the riverbank from Brewer and Stratford Streets. A direct route must be taken and the dog and owner cannot stop within the Park. A & P Park (the whole of the Park including the car park) except that dogs are allowed at: The annual A&P Show; Brewer Street, Blenheim Maxwell and Alabama Roads, Blenheim Any authorised dog obedience courses; The dog park area at the Farmers Market; and Any other activities as authorised in writing by Council. Central Business District of Blenheim being that area marked on Map 1 Churchward Park except that dogs are allowed on lead only on the formed pathway and solely to access the riverbank from Maxwell Road. 7 direct route must be taken and the dog and owner cannot stop within the Park. College Park Harling Park Japanese Garden Stephenson Street, Blenheim Howick Road, Blenheim (Note: dogs are allowed off lead in the balance of the Park) Horton Park Lansdowne Park Oliver Park Golf Course at Pollard Park Rewi Murray Polo Park except that dogs are allowed on lead only on the formed pathway on the eastern boundary and solely to access the Sutherland Stream walkway. A direct route must be taken and the dog and owner cannot stop within the Park. Seymour Square, Blenheim Sheps Park except that, once the grave on the land has been fenced off and Council has given notice that the fencing has been completed, the area of the Park that is not fenced off and leased for grazing stock will become a Dog Exercise Area. The balance of the Park (i.e. the fenced area leased for grazing stock) will remain a Dog Prohibited Area. Whitehead Park - Croquet and Bowls areas only Redwood and Stephenson Streets, Blenheim Lansdowne Street, Blenheim Weld, Cleghorn & Bythell Streets, Blenheim Parker Street, Blenheim Redwood Street, Blenheim Bounded by Seymour, Alfred, Henry and High Streets, Blenheim Severne Street, Blenheim Brooklyn Drive, Blenheim (Note: dogs are allowed off lead on the balance of the Park). Wither Hills Farm Park (including the Mountain Bike Tracks but does not include the Redwood Street carpark or the Sutherland Stream Reserve ) Taylor Pass Road, Rifle Range Place, Forest Park Drive, Solway Drive, Weld Street, Redwood Street, Fyffe Street, Dry Hills Lane, and Cob Cottage Road Dog Prohibited Areas - Picton, Waikawa and Koromiko Auckland Street Skate Park Bobs Bay Reserve except on the formed track Wairau & Auckland Streets, Picton Shelley Beach & Victoria Domain Loop Road, Picton (Note: dogs are allowed off leash on the formed track) Page 7

8 Collins Memorial Reserve and Koromiko Forest Reserve (includes the rest area and the forest reserve along Freeths Road) Endeavour Park Essons Valley Reservoir excluding the formed tracks State Highway 1, Koromiko Waikawa Road, Picton Garden Terrace, Picton (Note: dogs are permitted off leash on the formed tracks) Nelson Square Picton Foreshore area including the carpark and the beach adjacent to the Foreshore except that dogs can be walked on leash only on the paved pathway along the waterfront and solely to access the ferry terminal and the water taxi jetties. A direct route must be taken and the dog and owner cannot stop within the Foreshore. Queen Charlotte Drive Lookout Shelley Beach Reserve the area south of the Queen Charlotte Yacht Club including the grassed picnic area and the adjacent beach only Wairau Road, Picton London Quay, Picton Queen Charlotte Drive, Picton Access from Picton Marina entrance, Waikawa Road, Picton (Note: dogs are allowed off leash in the Reserve north of the Queen Charlotte Yacht Club including on the adjacent beach. Note: dogs are allowed on leash on the road leading to the Bobs Bay Reserve Track) Victoria Domain except the formed walking tracks Surrey, Sussex & Leicester Streets, Waikawa Road, Shelley Beach & Picton Marina, Picton (Note: dogs are permitted off leash on the formed walking tracks except the tracks designated for mountain biking-(dogs are prohibited on the designated mountain biking tracks)) Waikawa Foreshore Reserve the grassed area, the playground and the adjacent beach only Waikawa Bay, Picton (Note: dogs are permitted on-leash in the balance of the reserve to access jetties) Waitohi Domain Dublin Street, Picton Dog Prohibited Areas - Marlborough Sounds and Havelock Barnicoat Trail Canvastown Hall Grounds Queen Charlotte Drive, Havelock State Highway 6, Canvastown Page 8

Until this time, the whole of Sheps Park will be a Dog Prohibited Area.
