1 THE CORPORATION OF THE TOWNSHIP OF GEORGIAN BAY BY-LAW NO Being a by-law to licence dogs and to prohibit the running of dogs at large and to cany out the operation of an animal shelter and pound. WHEREAS the Municipal Act^ S.O. 2001, as amended, authorizes the Council of a local municipality to pass by-laws prohibiting or regulating the keeping of animals or any class of animals within the municipality, prohibiting or regulating the running at large of dogs in the municipality and requiring the licensing of dogs; AND WHEREAS the Municipal Act, S.O. 2001, as amended, authorizes the Council of a local municipality to pass by-laws for the seizure, impounding and sale of impounded animals; AND WHEREAS the Municipal Act, S.O. 2001, as amended, authorizes the Council of a local municipality to pass by-laws regarding the muzzling and leashing of dogs; NOW THEREFORE the Council of the Corporation of the Township of Georgian Bay enacts as follows: 1. Short Title This By-law may be cited as the "dog control" by-law. 2. Interpretation For the purposes of this By-law, the following terms shall have the following corresponding meaning: 2.1 Animal Control Officer shall mean a person appointed as such by a by-law of the Township; 2.2 Capable Person shall mean a person of sufficient size and stature able to control and restrain a dog to such an extent that the physical well being of any person or animal is not threatened; 2.3 Control shall mean secured by a leash of not more than 1.5 metres in lengtb and under the supervision of a capable person; 2.4 Guide Dog shall mean a dog trained and used as a guide for a blind person or for the hearing impaired and shall include a service dog to aid a person due to medical condition; 2.5 Kennel shall mean: A premise where more than three (3) dogs are kept for the purpose of show, training or breeding; or A premise where more than three (3) dogs are kept and cared for on behalf of the owner of a dog. 2.6 Licence Inspector shall mean a person or persons appointed as a municipal law enforcement officer by the Township; 2.7 Muzzle shall mean a covering for the snout of a dog that when fastened over a dog's snout and mouth prevents the dog from biting; 2.8 Officer means a police officer, licence inspector, municipal law enforcement officer, animal control officer, poundkeeper or any other person appointed by by law to enforce the provisions of this By-law; 2.9 Owner of a dog includes a person who possesses or harbours a dog, and if the owner is a minor, the person responsible for the custody of the minor, and "owns" and "owned" have a corresponding meaning;
2 2.10 Police Work Dog shall mean a dog trained to aid law enforcement officers and used by such officers in the execution of their duties; 2.11 Pound shall mean such premises and facilities designated as a Township Animal Shelter and Pound; 2.12 Poundkeeper shall mean the person appointed as such by the Township; 2.13 Tag shall mean a tag issued by the Township indicating the year issued and tag number; 2.14 Township shall mean the Township of Georgian Bay or the land within the geographic limit of the Township of Georgian Bay as the context requires. 3. Singular and Plural Use In this By-law, unless the context otherwise requires words importing the singular shall include the plural and use of the masculine shall include the feminine, where applicable. 4. Licensing 4.1 Every owner of a dog shall licence the dog with the Township, except owners who have legally registered and licensed their dogs in another municipality, before the 28th day of February in each calendar year and pay the required fee as set out in Schedule "A" of this By-law. 4.2 Every owner of a dog, immediately after the dog comes into his possession or care, shall licence the dog with the Township. 4.3 In order to license a dog and obtain a tag, the owner of the dog must produce to the Township a certificate or letter signed by a practicing veterinarian indicating that the dog has been inoculated with a current and up-to-date rabies vaccine. 5. Guide Dogs or Police Work Dogs 5.1 Notwithstanding Section 4, the owner of a guide dog or a police work dog, is not required to licence the dog with the Township. 5.2 The Township may require the owner of a dog to establish to its satisfaction that the dog is a guide dog or a police work dog. 6. Tags & Replacement Tags 6.1 Every owner shall securely fix the tag issued by the Township to the dog for which it was issued. 6.2 Every owner shall ensure the tag remains securely fixed on the dog at all times. 6.3 No owner shall use a tag on a dog other than the dog for which the tag was issued. 6.4 A replacement tag may be obtained upon payment of the fees set out in Schedule "A" of this By-law, and upon the Township confirming a tag was previously issued for the current calendar year. ^ 7. Kennels 7.1 Every owner of a kennel shall obtain a licence from the Township, before the 28lh day of February in each calendar year and pay the required fee as set out in Schedule "A" of this By-law. 7.2 The issuing of a kennel licence is subject to zoning approval and compliance with the Ontario Building Code Act. 7.3 No person shall keep more than three (3) dogs over three (3) months of age at one location unless a kennel licence is obtained.
3 7.4 Every person who owns or operates a kenne! shall comply with the following requirements: A kennel shall be in a separate building and shall not be attached to a building which is or may be used for human habitation; A kennel shall be maintained in such a manner as to be free from damage. ^ 7.5 Every person who owns or operates a kennel shall ensure the kennel facility has: A floor of concrete or other impermeable material; A drain opening constructed as a plumbing fixture; Electric lighting; Windows that may be opened for proper ventilation; A heating system sufficient to adequately heat the building; Hot and cold running water; and A food preparation area. 7.6 Where dogs are permitted to use an outside area, there shall be constructed around such area a fence having a height of at least five feet (5'); the wall of an adjacent building may be included as part of the fenced-in area. The fenced-in area shall not be required where the outside area is more than two hundred feet (200') from the property lines. 7.7 Every person who owns or operates a kennel shall; Display the licence in a conspicuous place on the premises for which the licence is obtained; Maintain the kennel in a sanitary, well ventilated clean condition, and free from offensive odours; Clean the floor area daily, or more frequently if required; Keep the dogs in a sanitary, well bedded, well ventilated, naturaliy lighted, clean quarters at an appropriate temperature; Adequately feed and give water to the dogs periodically each day and keep them in a clean, healthy condition free from vermin and disease. 8. Inspections An officer or any other person authorized by the Township, may inspect any premise where dogs are kept, pursuant to this By-law. 9. Number of Dogs 9.1 No person shall keep or permit to be kept at any one time on any one property no more than three (3) dogs, excluding dogs three (3) months of age or less. ^ 9.2 Notwithstanding Section 9.1 in the communities of Port Severn as defined in Schedule "B" of this By-law, Honey Harbour as defined in Schedule "C" of this By-law and MacTier as defined in Schedule "D" of this By-law, no person shall keep or permit to be kept at any one time on any one property no more than two (2) dogs. 9.3 Section 9.1 does not apply to the owner of a licensed kennel, the owner of an animal hospital operated by a veterinary surgeon, the owner of a pet store or the Poundkeeper. 10. Running at Large 10.1 Every owner of a dog shall ensure that his dog does not run at large within the Township.
4 10.2 For the purpose of this By-law, a dog shall be deemed to be running at large when found in any place other than the premises of the owner of the dog and not under the control of a capable person but shall not include a dog being used for hunting in the bush An officer may destroy any dog running at large if it; represents a threat to the safety of any person or animal; or w is severely injured. 11. Leashing of Dogs 1 i.l Every owner of a dog shall keep the dog leashed and under the control of a capable person when the dog is on land in the municipality other than that of the owner, unless prior consent is given by the person owning the land on which the dog is found After a dog has bitten a person or a domestic animal, an officer may issue a muzzle order as set out in Schedule "E" of this By-law to the owner. The owner shall ensure that the dog is muzzled at all times when out of the owner's residence The owner of any dog required to be muzzled or leashed may request a hearing before a committee appointed by Council who may exempt the owner from the muzzling or leashing requirement or both. 12. Poop and Scoop 12.1 Every owner of a dog shall immediately remove excrement left by the dog anywhere in the Township Section 12.1 does not apply to the premises of the owner of the dog, but does not relieve the owner of the dog from his responsibility under the Township's property standards by-law. 13. Keeping of Dogs No person shall keep, or permit to be kept, any dog in a building, structure, pen or run unless it is at least two (2) metres (six (6) feet) from the boundary of the property upon which it is located. 14. Noise and Nuisance No person shall allow a dog to persistently bark, howl, whine or otherwise become a nuisance. 15. Impoundment 15.1 An officer may seize and impound a dog running at large. w 15.2 An officer may destroy a dog in a humane manner where required for reasons of safety to people or animals, or where the dog is injured and should be destroyed without delay for humanitarian reasons, and no damages or compensation whatsoever shall be recovered by the owner of the dog or any other person on account thereof An officer may seize and impound dogs kept in a kennel where it is found the kennel is not operating in accordance with the requirements of this By-law, and the kennel licence shall be revoked hi the event that a dog is not destroyed, the Animal Control Officer or the Poundkeeper shall restore possession of a dog to the owner when: the owner attends at the pound and claims possession of the dog within ten (10) days, excluding the day on which the dog was impounded, statutory holidays and Sundays; and
5 The owner pays the required fee as set out in Schedule "A" of this By-law The owner has or obtains a valid current dog licence Where a dog is impounded, and whether or not the dog is claimed from the pound or not, the owner of the dog shall be liable for the pound and maintenance fees set out in Schedule "A" of this By-law, plus the costs of any damages, fines, expenses, veterinary care, vaccination or immunization, and shall pay all fees on demand by the Township Wliere possession of a dog is not restored to the owner of a dog within the ten (10) day period referred to in Section 15.4, the Animal Control Officer or the Poundkeeper may sell the dog for such price as he deems reasonable Where the owner of a dog does not claim the dog within the ten (10) day period referred to in Section 15.4, and the dog has not been sold, the Animal Control Officer or the Poundkeeper may destroy the dog in a humane manner, or otherwise dispose of the dog as he sees fit, other than for experimental purposes, and no damages or compensation whatsoever shall be recovered by the owner of the dog or any other person on account thereof Any dog impounded and not wearing a tag for the current year, may at the discretion of the Animal Control Officer or Poundkeeper be given an inoculation to provide temporary immunization against distemper or any other contagious or infectious disease Any dog running at large may be seized by any person, who shall deliver the dog as soon as practicable to the Animal Control Officer or the Poundkeeper. 16. Sevcrabilitv If a court of competent jurisdiction declares any section of part of this By-law invalid, it is the intention of Council that the remainder of the By-law shall continue in force. 17. Enforcement and Penalty 17.1 The enforcement of this By-law shall be conducted by an officer or other persons appointed by the Township No person shall hinder or obstruct an officer in the enforcement of this By-law Any person who is alleged to have contravened any section of this By-law shall identify themselves to the officer upon request, failure to do so shall be deemed to have hindered or obstructed the officer in the execution of Ins duties Every person who contravenes any of the provisions of this By-law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act, R.S.O. 1990, as amended. 18. Animal Control Officer have read this notice and agree to the following methods of restraining my dog. Owner's signature METHOD OF RESTRAINING DOG a) While the dog is on the property of the owner or harbourer as described above, the owner shall be responsible for restraining the dog by keeping it inside a building or house or in an enclosed pen of sufficient dimension and strength to be humane and to prevent a dog from coming into contact with persons other than the owner of the dog or any other domestic animal, or within a securely fenced yard where the fence is a minimum height of 1.83 metres. The enclosed pen or the fenced yard shall be equipped with a locking device and self-latching device. Such self-latching device to be designed in such a manner that the pen or gate cannot be opened from the outside by a small child. The owner is responsible for ensuring that the dog is prevented from escaping and running at large. b) While the dog is off the property of the owner, as described above, the owner shall ensure that: 1) It is securely on a collar-type leash with a maximum length of one {1) metre and of sufficient strength to restrain the dog and keep it from chasing a person or domestic animal. 2) A muzzle is fastened humanely over the mouth of a dog of adequate strength and design and suitable to the breed of the dog that fits over the mouth of a dog and cannot be removed by the dog, to prevent a dog from biting or attacking a person or domestic animal.
