Raining Cats and Dogs Spring 2014 Raining Cats and Dogs is a public art benefit for the Windsor Education Foundation and Windsor Chamber of Commerce (WEF and WCC). As a community wide event we encourage participation by all businesses, organizations and individuals. Animal Selection Sponsors will choose their dog or cat form and the artist who will design it. A portfolio of four (4) animals is available from which sponsoring businesses, organizations and/or individuals may select. Once the portfolio of available artists is compiled, you will be able to select the artist for your dog based on their designs. Sponsorship Levels Advertise your business with the sponsorship of one of four fiberglass animal forms. Sponsors of the fiberglass animals are essential to making the event a success. Our goal is to have 40 cats and dogs featured throughout the town of Windsor! Sponsorship Benefits Sponsor selects artist from design portfolio Sponsor name on removable nameplate on fiberglass cat or dog Sponsor name on all print advertising and collateral material Sponsor name on the Raining Cats and Dogs section of the WEF and WCC web sites Quarter-page black-and-white ad in auction catalog Two tickets to the Sponsors Artist Selection Event The public will participate in a contest, visiting each sponsor/animal Filming of events aired on local public access Ownership/Proceeds The Windsor Education Foundation and Windsor Chamber of Commerce will retain ownership rights to the animals throughout the event. The cats and dogs will then be sold at auction. Proceeds from the auction and from the sale of all merchandise associated with the event will benefit the Windsor Education Foundation and Windsor Chamber of Commerce. Copyright and Usage Ownership of any copyright of use of any likeness of any animal will reside with the Windsor Education Foundation and Windsor Chamber of Commerce and/or the Raining Cats and Dogs Planning Committee (RCDPC). WEF, WCC and RCDPC will have the right to photograph, videotape and/or record the image of all cats and dogs during the production or during the Exhibit and Auction and to use any of those materials relating to
the cats and dogs for promotion, publicity, commercial, retail or other purposes deemed appropriate by WEF, WCC and/or the RCDPC. Such rights will continue after the transfer of ownership of the cats and dogs. Display The animals will be on public display during April and May at the sponsor s location or around town, or if the sponsor does not wish to have the animal displayed at its location, the animal will alternatively be displayed at a location mutually agreeable to sponsor, RCDPC, WEF and WCC. At the auction in May, the animals will be offered for sale to the public. that corporate branding or corporate logo may be permitted provided the sponsor purchases the animal for an additional fee equal to the sponsorship amount for the animal form selected, which amount will be due prior to the time the animal is delivered to the artist chosen by the sponsor. Sponsors must agree to display their animals at all events associated with the Raining Cats and Dogs public art project, including the Auction, even if they have purchased the animal as provided for herein and it has been removed from bidding. Sponsors will provide funds (tax-deductible to the extent provided by law) to the Windsor Education Foundation and Windsor Chamber of Commerce through the Raining Cats and Dogs project, by sponsoring an animal and/or purchasing an animal during the Gala Auction. Sponsorship Details and Agreement: Raining Cats and Dogs Purpose of this agreement: Sponsors will provide funds as a donation (tax-deductible to the extent provided by law) to the Windsor Education Foundation and Windsor Chamber of Commerce through the Raining Cats and Dogs project, by sponsoring an animal and/or purchasing an animal during the Gala Auction. Ownership: The Windsor Education Foundation and Windsor Chamber of Commerce will own the animals during the Raining Cats and Dogs Public Art Exhibit. Ownership of any copyright of use of any likeness of any animal will reside with the Windsor Education Foundation and Windsor Chamber of Commerce and/or the Raining Cats and Dogs Planning Committee (RCDPC). WEF and WCC and RCDPC will have the right to photograph, videotape and/or record the image of any animal during the production or during the Exhibit and Auction and to use any of those materials relating to the animals for promotion, publicity, commercial, retail or other purposes deemed appropriate by WEF, WCC and/or the RCDPC. Such rights will continue after the transfer of ownership of the animals. The artist who is hired as the creator of the design will share the copyright of the design with the sponsor and the project in perpetuity, however, the artist and the sponsor cannot use the image of the design for commercial purposes until the event has concluded, such right being reserved by Windsor Education Foundation and Windsor Chamber of Commerce during the project. Windsor Education Foundation and Windsor Chamber of Commerce and/or RCDPC shall have the right to reproduce and distribute the design or a derivative of the design for purposes of promoting the event by all means and media, including the right to use the design or design derivative on a variety of merchandise that may as yet be determined. No additional payment will be made to the sponsors or artists for these rights. Financial Consideration: The cost to sponsor one animal, depending on the form chosen, is $500 or $1,000 as set forth on the Sponsorship Commitment form. The sponsorship benefits are specified in the Sponsorship Opportunities page attached hereto. Painting of the Animals: Sponsors may select from designs submitted to and approved by the Artist Selection Committee, or sponsors may commission their own artist, who must submit designs for approval to the Artist Selection Committee. Designs must be appropriate for family viewing. Designs that include political, sexual, racial, religious and commercial messages are not acceptable. Blatant or direct advertising and use of corporate logos and branding in the animal design is prohibited with the exception that tasteful incorporation of corporate branding or corporate logo may be permitted provided the sponsor purchases the animal for an additional fee equal to the sponsorship amount for the animal form selected, which amount will be due prior to the time the animal is delivered to the artist chosen by the sponsor. In no event will designs that include content that may hurt, ridicule or persecute a third party or groups be allowed. Placement: The Raining Cats and Dogs Planning Committee will work with the sponsor to determine a suitable display location at the sponsor s business or at another mutually agreed upon location. Installation/Transportation: The Raining Cats and Dogs Planning Committee will assume responsibility for the transportation and installation of the animal to the initial display location. Liability, Care and Maintenance: RCDPC will assume responsibility for theft or damage to any animal. RCDPC will obtain liability insurance for the period of time covering the event. Cancellation: WEF, WCC and/or RCDPC reserves the right to cancel the exhibit in the unlikely event that there are insufficient sponsor funds such that the costs of the event will not be covered or so minimally covered as to negatively impact the purpose of the exhibit. In case of cancellation, all sponsor payments for the animals will be refunded. WEF, WCC and/or RCDPC will not be required to produce or deliver the animals and sponsors will not be entitled to any other compensation.
