1 LLS/ CITY OF BEVERLY HILLS COMMUNITY SERVICES DEPARTMENT MEMORANDUM TO: Recreation and Parks Commission FROM: Nancy Hunt-Coffey, Assistant Director of Community Services DATE: December 14, 2015 SUBJECT: Operational Plan for the Dog Park INTRODUCTION The Recreation and Parks Commission (RPC) is asked to make fal recommendations on aspects of the operational plan for the dog park. These recommendations brought to the City Council at an upcomg meetg for direction. be BACKGROUND The followg section is tended to memorialize all of the decisions and direction that have been received so far. Recommendations are not requested from the Commission on these items. Operations Based on the recommendations of the RPC, the City Council has given direction or feedback on the followg operational aspects of the dog park: --Hours of Operation: 8 am 8 pm everyday. --Allowable number of dogs (per person and total for the park): Each person can brg no more than three dogs to the park. There park. be a cap of 40 dogs for the entire dog --No breed restrictions: Particular breeds of dogs (e.g. pit bulls) shall not be restricted from the dog park. --Patron age limits: Children under 14 years of age must be supervised by an adult. be assigned to the park for all should be noted that staff is preparg a budget enhancement --For the first six months of operation, a park ranger hours of operation. It form for approximately $57,000 to cover the cost of the ranger. --Licensg: All dogs must have a current license, which ensures the dogs are spayed/neutered and have had a rabies vaccation.

Access to the park by these groups would be by permit. Details of permits are discussed below. --Park Rules The rules for the dog park are attached to this report. They are currently beg veiled by the City Attorney s Office for falization. The results of these tests DISCUSSION Permit Management As dicated above, City Council has expressed an terest durg the first 6 months of operation of the dog park. This which evaluation can be done. Toward the end of this period, staff havg a ranger present be a trial period durg return to the RPC and City Council with recommendations movg forward, cludg usage patterns and any adjustments needed to operations movg forward. Permits have been discussed to ensure that users meet the utilization and licensg requirements. There are a number of ways that have been discussed permit issue could be addressed. which the Use of a keycard system to control entry to the dog park has been discussed. The advantage of a keycard system is that it can control access at a fairly granular level. Access can be made live or withdrawn quickly. Time limits can be placed on keycards, so for example, access could be allowed only as long as the dog license is current and then denied until the updated license is presented. The drawback of a keycard system is that it can be expensive to purchase, estimated at $15,000 - $20,000, and there is the cost of ongog management of the system by issug keycards and keepg the data current. Capital Assets staff have dicated that a keycard system could be implemented at any time the cycle of the project, without a substantial variance cost. Because of the substantial cost to purchase a keycard system; because there is flexibility as to when could be stalled; and because there be a ranger assigned to the dog park for the first 6 months of operation, staff recommends that a relatively low tech solution be implemented to beg with. Keycards could then be considered and recommended, needed, toward the end of the trial period. it if Durg this trial period, staff recommends that a card system be used, similar to what is available at the library or at grocery stores. These solutions volve askg patrons to provide relevant registration formation (see below for more formation). The patron is then provided with a two part card. 3 of 6

4 One part is a standard credit card size and can be carried by the dog owner. The other part is tended to be placed on a keycha. This portion could either be carried by the dog owner, or it could be attached to the dog s collar. Staff is told that these cards are very durable. The cost for the card runs between $1-$2, clusive of shippg and design work. To verify their ability to use the dog park, patrons must submit documentation to prove that they fall to one of the approved utilization categories. Staff recommends that the followg documentation be required to obta a permit: Residents photo ID; current copy of gas or water bill with name that matches photo ID and Beverly Hills address on it. If their utilities are cluded their rent then a copy of their lease agreement. Must show proof that dog is currently licensed Los Angeles County. Guests of hotels photo ID; documentation from the hotel that shows name of guest (that matches photo ID) and term of stay; dog must be licensed home State/country OR provide proof of rabies and neuter/spay. Guests of residents photo ID; signed letter from resident that dicates term of stay and contact formation for resident; dog must be licensed home State/country OR provide proof of rabies and neuter/spay. Busess owner photo ID; current busess license. Must show proof that dog is currently licensed Los Angeles County. People who work BH photo ID; signed letter on letterhead from place of work, cludg contact formation OR paystub from with the last two months. Must show proof that dog is currently licensed Los Angeles County. Although it has been discussed havg outside organization(s) volved, it is recommended that City staff handle the permittg process, at least for the itial trial period. The ranger at the dog park could be equipped with a laptop and cards so that he/she could issue permits and cards (if recommended), should the dog owner meet all of the requirements at the moment. Staff is also workg on plans to issue permits, before the openg of the dog park to allow for a smooth distribution of permits, and also to allow dog owners to obta permits at one or mote of the Community Services public 4 of 6

5 desks. Staff is also determg the best manner of storg the permit data, cludg whether one of the existg City onle systems can be used to track this formation. The Recreation and Parks Commission is asked to consider and recommend delayg the implementation of keycards until the 6 month trial period has completed. The Commission is further asked to consider and recommend the use of barcoded cards for the first 6 months of operation. Feedback from the Commission is also welcome regardg the recommended verification methods for the different user groups. CCW/Dog cams There has been terest havg CCW cameras stalled at the dog park, both for playback security purposes, but also to provide a view to potential dog park patrons to see approximately how many dogs/people are the park. The City s IT Department has capital funds which can be used to stall CCTV cameras, and they were fairly highly recommended by the RPC, so staff recommends that they be placed the park. Staff has checked with the City Attorney s Office regardg any legal issues volved with providg public access to one of the CCTV cameras as a dog cam. The City Attorney s Office has dicated that someone gog to the park, which is a City-owned public facility (similar to any other City park or public street), does not have a reasonable expectation of privacy. This means that placg cameras at the dog park is permissible from a constitutional perspective. The next question that arises is whether the images from the cameras should be accessible to the public, as opposed to beg restricted to law enforcement. Typically, someone s likeness is gog to be published or used (such as a City publication, for example), you need their permission. This also applies to children, where parental consent is required. Sce obtag consent isn t realistic some dividuals may have privacy or security concerns about havg their images this circumstance, and available to the public on a City website, the City Attorney s Office has the followg recommendations: if 1. There should be signs posted statg that the dog park is beg filmed and the images are beg broadcast onto the City s website for public viewg, so the public can monitor whether the maximum number of dogs are, or are not, present. Ideally, you would post at least one sign where the public walkg to the area, separate areas, the sign(s), the City a location that is not beg filmed. As there are two it might be prudent to place a sign be each entry area. By placg have provided notice of the presence of the cameras, and someone who does not wish to be filmed can simply walk away and not use the dog park. 2. The City Afforney s Office also recommends that the cameras be placed close enough to the dog park so that someone can see how many people and dogs are 5 of 6

6 the park, but far enough away so that it be unlikely that someone s face would be recognizable. The Recreation and Parks Commission is asked to consider and recommend the provision of CCTV cameras for security purposes and also for a dog cam which would allow prospective patrons to see how many dogs/people are the park before gog to the park. Next Steps Staff asks the RPC to provide recommendations for the dog park the areas of permits, CCW and dog cam. Once these recommendations are received, and the additional formation from site testg has been reviewed, staff plans to return to the City Council at an upcomg meetg to ask that the Council falize the operational aspects of the park. 6 of 6
