3 STYD Policies: By submitting this form you indicate your agreement with all the items listed hereof. Name: Words you and your refers to the Owner/Pet Parent. Conversely, We and our refers to STYD. Owner/Pet Parent and STYD may collectively be referred to as the parties, and singularly as a party. Emergency Contacts (other than Pet Parent): Name: Phone: Emergency Medical Care: If, in our judgement, your dog requires immediate medical care and we are unable to reach you, we will take your dog to a veterinarian or animal hospital. You understand that dogs may become seriously injured or gravely ill and may require IMMEDIATE medical care, your dog may need to be transported to and treated by a local Anacortes veterinarian. Every effort will be made by Smarter than your Dog STYD! staff member to contact an owner if your dog requires immediate care. If they are unable to reach an owner, this will serve to give Fidalgo Animal Medical Center or local veterinarian the authorization to provide care for your dog. You hereby authorize a staff person of STYD to transport your dog in the event of an urgent medical emergency. You agree to be solely responsible for the payment of all medical bills for your dog and you release STYD, it s Owners, Manager, Agents, and Employees of and from any and all responsibility for, or claims damages, debts, arising out of or related to such medical care, including, but not limited to, transportation to/from the veterinary clinic and choice of veterinary and animal hospital. Pick up of your dog: STYD will release your dog to the following person(s): You may verbally (by telephone) or in writing (facsimile or otherwise)request that STYD release your dog to someone other than the person listed above, and you release STYD of and from any and all responsibility for releasing your dog to any person STYD reasonably believes to be authorized by yourself. 3

4 STYD reserves the right to immediately change your dog s type of boarding/daycare if we believe it is necessary to protect the health and well-being of your dog, other dogs, or our staff. All dogs must be healthy, and current on all vaccinations. You will be required to bring a copy, fax or records from your veterinarian before you start daycare or board with us to ensure your dog s safety as well as that of our existing STYD dogs.you authorize STYD to obtain medical and vaccination records for your dog from the veterinarian listed above and you hereby authorize your veterinarian to provide these records to STYD. If your dog is exhibiting any symptoms that may suggest illness such as sneezing, coughing, wheezing, runny eyes or nose, vomiting, lethargy, or diarrhea, please do not bring your dog to daycare or boarding. Unspayed females in heat are not accepted. If your dog comes into heat while boarding you will be charged an extra $25 per day. Dogs with flea or tick problems will be bathed at the owner s expense. Drop off and pickup times are strictly enforced. Drop off and pickup times for boarding are from 7:30 am to 9:30 am and 4:00 pm to 6:00 pm, Monday through Friday. Monday through Friday, drop off or pick up your dog in Ollie Bay unit #101 in the 9119 building (Daycare). Arrangements must be made prior to drop off and pickup for Saturday and Sunday boarding dogs. Drop off and pickup for Saturday and Sunday boarding dogs are from the hours of 7:30 am to 9:30 am and 2:00 pm to 3:00 pm. Saturday and Sunday drop off and pick up dogs must enter/exit in Ella Bay and SPAW unit #102 in the 9121 building.saturday and Sunday dogs being picked up or dropped off outside these times will be charged the daycare fee from the hours of 9:30 am to 2:00 pm and the boarding fee after the hours of 3:00 pm. All charges must be paid in full upon pick up of your dog. Staff is unavailable for drop off and pick up outside these designated hours. National Holidays are recognized and will be charged an additional $15.00 for boarding. The following are nationally recognized holidays: New Years Day, Martin Luther King Day, Presidents Day, Memorial Day, Fourth of July, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, Christmas Day. Additional fees are applied due to staff salary increase of time and a half. Cancellation Policy: 24 hour notice to cancel is required for all boarding reservations. 4

5 Please cancellations at During daycare hours Monday through Friday you can speak to staff by calling (360) After daycare hours and on the weekend, you may speak to staff by calling (360) During Peak Season,72 hour notice to cancel boarding reservations is required, in addition 25% of the total estimated fee for that visit will be charged to your credit card. Reservations made for designated Peak Season dates require a valid credit card on file at the time the reservation is made. For all other reservations a valid credit card must be on file at the time of drop off for all boarding residents. Peak Season Includes: Wednesday to Wednesday for Memorial Day weekend, June 15th through Labor Day weekend, Wednesday to Wednesday Thanksgiving week, December 15th to January 3rd. 72 hour cancellation notice applies to these dates. At the time the reservation is made, an estimated 50% deposit for that stay will be collected. All deposits will be refunded for cancellations prior to 72 hours of the scheduled arrival boarding date. If you cancel your reservation in the 72 hour window, you will only receive 25% of the total estimated bill for that stay. Abandoned Pets: Pet Parent understands and agrees that if his or her pet is not picked up within seven (7) calendar days after the scheduled pick up date, the pet shall be deemed to be abandoned and additional boarding charges shall apply, and in such event, STYD shall gain legal custody and ownership of the pet and retain the right to keep the pet, or place the pet in a shelter or with animal control, or place the pet in a new home with a new owner, with no recourse by Pet Parent against STYD or any STYD Party. PET PARENT FULLY UNDERSTANDS AND AGREES THAT IF PET PARENT ABANDONS HIS OR HER PET AT THE COMPANY FACILITY, PET PARENT MAY BE UNABLE TO RETRIEVE POSSESSION OF HIS OR HER PET AND WILL HAVE NO RECOURSE AGAINST ANY COMPANY PARTY. Pet parents are welcome to bring their own bedding and toys if desired, however we cannot guarantee that they will be returned in the same condition. All items in open boarding are at risk of being damaged by other dogs. For the safety and comfort of all of our guests, we are unable to accommodate visitors during boarding. We are happy to send updates for pet parents wanting to check in with their dogs. Payment is due upon pick up of your dog. Unless you 5

6 indicate otherwise, your credit card on file will be charged for our fees. STYD reserves the right, without notice, to adjust its fees for services. You release, indemnify, and agree to hold STYD harmless from any and all manner of damages, claims, loss, liabilities, costs or expenses, causes of actions or suits, whatsoever in law or equity, (including without limitation, attorney s fees and related costs) arising out of or related to the services provided by STYD, except which may arise from the sole gross negligence or intentional and willful misconduct of STYD, including, without limitation, (i) any inaccuracy in any statement made by yourself or information provided by you to STYD, (ii) your dog, including but not limited to destruction of property, dog bites, injury, and transmission of disease, and (iii) any action by yours which is in breach of the terms and conditions of this agreement. Any controversy and claim arising out of or relating to this contract, or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any party to this contract, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgement upon the award rendered by an arbitrator may be entered in any Court having jurisdiction thereof. The arbitrator shall, as part of his award, determine an award to the prevailing party of the costs of such arbitration and reasonable attorney s fee of the prevailing party. This agreement covers the current relationship between STYD and yourself. Each time you bring your dog to STYD Daycare, Boarding and Grooming, you affirm the terms of this Agreement, and the truthfulness and accuracy of all statements you make in this Agreement. I hereby assign and grant permission and consent STYD the right and permission to use and publish any photograph(s), film(s), video tape(s), electronic representation(s) and or sound recording(s) taken of my pet without limitation at the discretion of STYD and specifically waive any right to compensation I may have for any of the foregoing. I hereby authorize the reproduction, copyright, broadcast, electronic storage and/or distribution of said photograph(s), film(s), video tape(s), electronic representation(s) and or sound recording(s) taken of my pet without limitation at the discretion of STYD and I specifically waive any right to compensation I may have for any of the foregoing. I agree to be added to STYD mailing list both US Postal and electronic. A separate contract must be signed for grooming, bathing and walk-in services. 6

7 Force Majeure: Neither Owner(s) nor STYD shall be responsible for failure or delay in performing duties under this Agreement if such failure or delay is due to earthquakes, volcanic eruption, tornadoes, thunderstorms, fire, floods, drought, riot, war or other acts of nature.
