His biographical information is set out below, and his resume is attached. Gary Goforth, P.E., Ph.D. Dr. Gary Goforth has more than 35 years of experience in water resources engineering, encompassing strategic planning, design, permitting, construction, operation and program management. For the last 30 years, his focus has been on large-scale environmental restoration programs in the Kissimmee-Okeechobee-Everglades ecosystem. He was the Chief Consulting Engineer during the design, construction and operation of the $700 million Everglades Construction Project, containing over 41,000 acres of constructed wetlands. He is experienced in public education, water quality treatment design and evaluation, engineering design and peer review, systems ecology, statistical hydrology, hydrologic modeling, hydrodynamic modeling, water quality modeling, environmental permit acquisition and administration, hydrologic and water quality performance analyses.

For the last 19 years, his focus has been on large-scale environmental restoration programs in the Kissimmee-Okeechobee-Everglades ecosystem. He was the Chief Consulting Engineer during the design, construction and operation of the $700 million Everglades Construction Project, containing over 41,000 acres of constructed wetlands. He is experienced in water quality treatment design and evaluation, engineering design and peer review, systems ecology, statistical hydrology, hydrologic and hydrodynamic modeling, environmental permit acquisition and administration, and public education. PROFESSIONAL EXPERIENCE Present ly President and Principal Engineer, Gary Goforth, Inc. 1/97-12/2004 CHIEF CONSULTING ENGINEER, South Florida Water Management District (SFWMD). Responsible for strategic planning, design review, development of operational plans, and program management of Everglades restoration projects. Provided factual and expert witness testimony in State and Federal courts. 4/94-12/96 DIRECTOR, Everglades Program Management Division, Ecosystem Restoration Department, SFWMD. Developed and implemented a management system for over 50 projects comprising the Everglades Program, estimated value of approximately $800 million. Responsible for state and federal coordination of Everglades Program implementation, including acquisition and administration of environmental permits. 12/88-4/94 DIRECTOR, Project Management Division, Construction Management Department, South Florida Water Management District. Responsible for coordinating the planning, engineering design, permitting and construction of capital facilities. 8/86-12/88 SR. WATER RESOURCES ENGINEER, Resource Operations Dept., South Florida Water Management District. Developed a functional prototype of a decision support system to aid in the operation of the agency's 250 major water control facilities. 12/83-7/86 RESEARCH ENGINEER, Dept. of Environmental Engineering Sciences, University of Florida. Evaluated the technical feasibility of using a large-scale centrifuge to investigate the movement of hazardous waste through soil. Appointment included January

17 TOWN OF SEWALL S POINT PAMELA MAC KIE WALKER Town Manager TO: FROM: Town of Sewall s Point Commission Pamela Mac Kie Walker, Town Manager SUBJECT: Agenda Item 3 Town Clerk Salary Town Commission Meeting, April 18, 2017 Background: Salary increases for Town employees require extensive justification and are subject to extreme scrutiny. Town Commissioners and management are appropriately reluctant to support increases without a compelling case that the expenditure is in the Town s best interest. Before making a recommendation for a salary increase, staff has reviewed the job descriptions, salaries and benefits of 20 municipal clerk positions selected due to their proximity or population to Sewall s Point, i.e., they are either located within 50 miles of Sewall s Point or have a population within ten percent of Sewall s Point s. (Full copies of 137 pages of documents are available on request.) First, the summary also shows that the average salary for municipal clerks in the communities listed is $78,000. Among the municipalities with which Sewall s Point competes for employees, the average Clerk salary is $83,000. Previous Sewall s Point Town Clerks have been paid 55,000 and $70,000. The current Clerk s salary of $53,045 is more than 30% under current averages. Some have questioned whether a town as small as Sewall s Point requires the services of a qualified municipal clerk. With the extensive reporting and compliance requirements for even a small municipality, the answer can only be yes. Despite the position s title, there is little in the job description that is clerical; rather, compliance with public records and retention laws alone justifies a professional position from a liability avoidance perspective. But to ensure maximum benefit for dollars expended, the Sewall s Point Town Clerk performs significant additional duties, including human resources, payroll, accounting, purchasing and others. A memo from the current Town Clerk is attached, providing insight into her unique diversity of education and experience which qualify her for the variety of responsibilities required of the position. Recommendation: As with any position, there is a market rate of compensation commensurate with the position of Municipal Clerk. In order to recruit and/or retain a qualified Clerk, the salary for the position must be adjusted to compete in that market. Staff respectfully recommends that the rate of compensation for this position be increased to $63,045, with a budget amendment reflecting the transfer to be processed at the next regular meeting of the Town Commission.

BURCH, TOWN CLERK TOWN CLERK SALARY My purpose in writing this memo is to share with you information about my skills and experience, as well as to provide further information about the responsibilities of the Town Clerk in Sewall s Point. My knowledge and experience in local government is broad and varied, having served in local government for twenty-three years. Working in various roles and municipalities through the years, I have gained experience not only as a municipal clerk, but with utilities, city management, finance and payroll. I have a Master s degree in Organizational Leadership, a Bachelors degree in Organization Management with dual minors in Organization Behavior and Human Resources, and an Associate of Applied Science degree in Business. I am a Certified Municipal Clerk and currently working towards my Master Municipal Clerk certification. This wide variety of knowledge and experience is especially critical in Sewall s Point, where the position of Town Clerk encompasses so many roles: Human Resources: I am responsible for all HR functions, such as making sure all new hire, termination and resignation paperwork, disclosures and compensation settlements are properly processed. I manage the enrollment of all employees and dependents in all insurances offered by the Town, including health, dental, vision, life, disability and statutory police life insurance. I am also responsible for the employees pension which includes proper enrollment, loan disbursement and repayment, and remittance of the monthly contributions, including employees voluntary payroll deductions for 457 plans and additional insurances purchased. I am responsible for certain risk management duties, as well, including the workers compensation annual audit and liability insurance filings. Elections: I am the Qualifying Officer for town elections pursuant to F.S (7)(c), in addition to serving as the liaison for the Town to the Supervisor of Elections for Martin County. My duties as the filing officer include the responsibility of determining whether a candidate is qualified, ensuring that the qualifying papers have been properly filed and properly verified (by oath or affirmation) pursuant to F.S (1)(a). Public Records: I am responsible for compliance with the law relating to public records requests, which is a complicated system of rules that have serious consequences for failure to comply. Finance: I oversee certain accounts payable and accounts receivable functions, including approval for payment of bills, approval of the bi-weekly check run, and verification of all bank deposits. I review all credit card payments processed through the CLOVER and online building permitting systems. I assist the outside consultant with the annual audit and monitor assigned budget line items. I am responsible for compliance with the Truth-In-Millage filings for the annual budget adoption process. Records Management: As the official keeper of records for the Town, I have the tremendous responsibility and legal liability associated with enormous accountability requirements of a local government to maintain records in accordance with the rules promulgated by the State of Florida Division of Library and Information Services. I also record and publish all commission meeting minutes, ordinances and resolutions, retain custody of the official seal, and manage contracts and bids where required by purchasing rules and regulations. I enjoy working for the Town of Sewall s Point and feel that I am a valued member of the staff, but the reality is that I am commuting 100 miles a day, and I am not being paid commensurate with my peers in salary and/or benefits in other cities within a 50 miles radius. As highly respected professionals in your fields of expertise, you understand that there is a rate of compensation related to your occupation and levels of experience. I am seeking that same level of compensation within my field of expertise. In closing, I hope that this explanation of my responsibilities, along with the attached chart providing information about municipal clerk compensation and responsibilities, will assist you in making the decision in the best interest of the Town of Sewall s Point about the appropriate level of compensation for the Town Clerk position.

21 On June 3, 2016, Captec submitted a grant application to the South Florida Water Management District for a portion of the Marguerita/Mandalay project, requesting $70,000 as a match towards a $145,000 portion of the project for exfiltration in the existing road right of way. The Town was awarded a portion of our request in the amount of $31,639. The Town has received the grant agreement, which requires construction of the exfiltration pipe within one year, at a cost to the Town of $49,571, as shown below:

22 On May 20, 2016, Captec submitted a grant application to the South Florida Water Management District for a portion of the Marguerita/Mandalay project, requesting $250,000 as a match towards a $500,000 portion of the project for exfiltration pipes in the basin. The Town was awarded a portion of our request in the amount of $100,000. The Town has received the grant agreement, which requires construction of the project within one year, at a cost to the Town of $100,000. The components of the project funded by this grant is shown in the illustration below: The Town Commission has previously directed staff to seek to delay execution of the grant agreements pending a determination regarding the success of the Special Appropriation Request of HB 2553 in the amount of $892,500 (50% of the total cost of $1,785,000) for a stormwater treatment system. The appropriation request is in the Senate budget with a placeholder of $100,000.

23 There also is a possibility that the project will receive $700,000 in Local Mitigation Strategy grant funds for a flood protection portion of the project, which will require a match from the Town of $175,000. The remaining portion of the project unfunded would then be approximately $430,000, as shown in the chart below: Recommendation: Staff recommends that the Town Commission accept the grant funds and move forward with the funded portion of the project while continuing to pursue the potential grants and appropriations for the balance of the project.

24 TOWN OF SEWALL S POINT PAMELA MAC KIE WALKER Town Manager TO: FROM: Town of Sewall s Point Commission Pamela Mac Kie Walker, Town Manager SUBJECT: Agenda Item 5 Septic-to-Sewer: County Offer of Master Plan and Appropriations Update Town Commission Workshop, April 18, 2017 Background: The purpose of this item is to update the Commission and the residents on activities related to this issue since the last Commission meeting and to seek direction on next steps. At our March 29, 2017 meeting we learned that our appropriation requests had not been included in the proposed House budget, but that there was a possibility that they could be added to the Senate budget via a conference by Representative Harrell and Senator Negron. Mayor Campo, working with the Town s grant consultant, Amy Adams, requested that all three appropriation requests be added to the Senate Budget proposal. Mayor Campo discussed the issue with Senator Negron, who agreed to have two amendments filed for our appropriation requests. The Town received notification yesterday of two budget amendments filed for our requests, as follows: : $100,000 for Septic-to-sewer conversion, and : $100,000 for the Mandalay and Margarita flooding issue. On April 3, 2017, Mayor Campo met with Martin County Commission Chairman Doug Smith regarding the Town s investigation of the viability and benefit of septic conversion to sewer, updating Chairman Smith about the Town s appropriation requests and education efforts to date. Mayor Campo indicated to Chairman Smith that Sewall s Point residents want a master plan with the design, logistics and costs to the town and to each property owner. Noting his appreciation for the Town s significant efforts, Chairman Smith offered to write and pay for a master plan for the Town, estimating its cost at $200,000 - $300,000 and requiring 6 months to develop. Chairman Smith advised that the issue would be presented to the County Commission to approve putting an agreement together for the County to create a master plan for sewer that would not mandate the Town convert to sewer. Recommendation: If the Commission is committed to Septic Conversion, efforts including professional lobbyists should be considered to increase the possibility of legislative appropriations. Staff further recommends that the Commission formally request that the County produce the Sewer Master Plan without cost or requirement for mandatory assessment to the Town.
