1 United States Department of the Interior FISH AND WILDLIF SRVI 176 roghan Spur Road, Suite 200 harleston, South arolina April 17, 2012 Re: Marion ounty Industrial Park, Protected Species Assessment, Marion ounty, South arolina, FWS Log No A-0218 he U.S. Fish and Wildlife Service (Service) has reviewed your April 5, 2012, letter regarding the 351 acre property located near the intersection of U.S. Hwy. 501 and U.S. Hwy. 76, in Marion ounty, S. S&M, Inc., performed an assessment for protected species on the site and are requesting the Service's concurrence on your findings. S&M, Inc. provided a habitat description of the site and a survey for threatened and endangered species known to occur in Marion ounty. Upon completion of the survey you determined that no threatened or endangered species or suitable habitat that might be impacted by any future development is found on the site. he Service has compared your project location to our species and habitat databases and agrees that there are no recorded Federal trust resources in the area. While the Service is pleased to assist you on this project, it should be noted that a section 7 consultation pursuant to the ndangered Species Act of 1973 (SA), is only performed to review actions undertaken by Federal agencies. A Federal action may include funding or authorization of a project or through direct agency involvement such as a civil works project. It is then the responsibility of the Federal agency to determine impacts and seek concurrence from the Service pursuant to section 7. As your request does not constitute a Federal action, we cannot provide a concurrence pursuant to the SA. Further, if the Federal action agency concludes that the project will have no effect upon protected species no consultation is required.

(S&M) is pleased to submit this report detailing our Protected Species Assessment for the above-referenced site located in Marion ounty, South arolina. his work was performed in accordance with authorized S&M Proposal No , dated March 19, his report and the on-site pedestrian survey have been conducted to assess the potential for the presence of protected species at the subject site, to meet specific due diligence services necessary to satisfy portions of the South arolina Department of ommerce's (SDO) Site ertification Program. his assessment was conducted in conjunction with other due diligence services such as a wetland delineation. he subject property is comprised of approximately 3 51 acres, located north of the intersection of U.S. Highway 501 and U.S. Highway 76, in Marion ounty, South arolina. A Site Vicinity map is attached to this letter as Figure 1. he site is also identified on Figure 2, which includes a portion of the USGS 7.5-minute Mullins, S.. topographic quadrangle map, dated As part of the previous SDO Site ertification process in 2005, the U.S. Fish & Wildlife Service (USF&WS) concurred with our findings by the issuance of their letter (FWS Log No A-0059) dated November 1, In that letter, the USF&WS stated "that it is unlikely that any federally endangered or threatened species occur there."
