1 AGENDA ITEM NO. 4.a REPORT TO MAYOR AND COUNCIL TO THE HONORABLE MAYOR AND COUNCIL: DATE: March 22, 2011 SUBJECT: ADOPTING RESOLUTION NO APPROVING PROJECT NO (BALDWIN DOG PARK); APPROPRIATING $124,000 TO THE PROJECT; AND APPROVING AN OFFLEASH INTERIM DOG PARK (WW & PARKLAND FUNDS) Report in Brief Council has directed staff to research an economical, interim off-leash dog area at Baldwin Park while the design and construction of a permanent facility is underway. A Measure WW application in the amount of $104,000 to East Bay Regional Parks District (EBRPD) is being submitted at the end of March for approval of the Baldwin Dog Park Project. In order to accelerate the schedule and minimize the time for an interim off-leash dog park constructed of tee-posts and green snow fence material, staff recommends starting design on the project and meeting with the interested residents and community groups immediately. Staff recommends that the City Council adopt Resolution No approving Project No (Baldwin Dog Park); appropriating $124,000 to the Project; and approve an off-leash interim dog park. Background On February 22, 2011, Council approved the Measure WW Funding Allocation Plan and directed staff to submit an application to EBRPD for $104,000 in Measure WW funding to construct a dog park at Baldwin Park at Location 1 (Attachment C). Council also directed staff to return with details for an off-leash area within a temporary fence, to determine if a solution was economically feasible until a permanent dog park area could be constructed. Discussion Staff recommends adopting Resolution No which approves Project No 2195 (Baldwin Dog Park) (Attachment A). This will accelerate the schedule by working with the interested groups, including the Baldwin Canine Contingent, Baldwin Park Neighborhood Partnership and St. Michaels Church, and developing a bid package during the same timeframe that EBRPD is processing the grant application. EBRPD has stated that their review should be complete by mid June, The contract between the City and EBRPD for the Measure WW grant funds is already in place, so any expenditure associated with design work performed prior to approval of the project application are eligible for

If the project application was not approved, then those expenditures would need to be absorbed by Engineering operations funds (General Fund). The project is anticipated to bid in June, with the award of a construction contract in late July. Construction is scheduled for August with the opening of the permanent dog park at Location #1 in September, Staff has researched fence alternatives and recommends a tee-post fence with green snow-fence (Attachment B), which is estimated to cost $800 in materials and approximately half a day to install by Parks staff. Other alternatives reviewed but not recommended included tee-posts with erosion control fabric (silt fence) estimated at $1300 in materials, and renting a six-foot high chain link fence which is estimated at $2000 for six months rental. Parks staff will maintain the grass inside of the temporary fence weekly, but will weed whack along the fencing every two weeks. This effort is expected to take an additional 4-8 hours of maintenance per month (two men for 1-2 hours every two weeks). The temporary fencing would be installed at Location #1 until construction is ready to commence in August. It would then be relocated to Location #2 in the back of the park. This area, which has previously experienced wet and soggy areas of turf, should be dry due to the time of year that construction will take place. The areas sanctioned for off-leash dog activity will open during normal park hours and will be subject to the rules allowed under Contra Costa County Code S (Attachment D). Fiscal Impact Staff is requesting appropriation of $104,000 of Measure WW funds and $20,000 in Parkland Funds from the Fund Balance to cover any indirect costs not eligible under Measure WW. Construction of the project is contingent upon approval of the project application for Measure WW grant funds and will not take place unless this application is approved. The design process will begin ahead of the application approval. The contract between the City and EBRPD for the Measure WW grant funds is already in place, so any expenditures associated with design work (estimated at $20,000 for design and staff costs) performed prior to approval of the project application is eligible for reimbursement by EBRPD. If the project application is not approved, then these expenditures will need to be absorbed by Engineering operations funds (General Fund). Public Contact Posting of the Council agenda

During the construction period the off-leash interim dog area will be moved to Location #2. The areas sanctioned for interim off-leash activity will be allowed during normal park hours and will continue until the Permanent Dog Park is constructed. 8 Attachment 4 Baldwin Park Rules for Off-Leash Dog Area 1. Hours for off-leash dog area: dawn to dusk. 2. Off-leash area limited to temporary fenced enclosure. 3. All dogs must be on leash when entering and exiting the off-leash area. All other areas of the park require dogs on leash. 4. All dogs must wear tags showing current licenses. 5. Dogs must be supervised by their owner(s)/handler(s) at all times. 6. All persons using the off-leash area must carry a leash. 7. All dogs must be under the effective control of their owner(s)/handler(s) at all times. Owner(s)/Handler(s) who cannot effectively control their dog will be required to leash dog and/or remove dog from park premises. 8. All dog feces must be removed immediately and placed in provided trash receptacles. 9. Dogs must not be allowed to dig holes and damage the grass. 10. Use of the off-leash dog area is recommended for dogs six months or older. 11. Dogs in heat are not allowed in the off-leash dog area. 12. Abandonment of dogs is against the law. 13.
