Requirements for keeping hens and coops. A maximum of 6 domestic hens shall be kept on a property that is zoned and occupied for a single family residential use only. The keeping of roosters and the slaughter of any chicken is prohibited. Hens shall be inside an enclosed approved chicken coop with adjacent covered outside fence area. The outside area shall be no larger 32 square feet in area. The enclosure and adjacent occupied fence area shall be set back Thirty 30 feet from any adjacent residential structure and not less than a twenty feet property line. All enclosures shall be constructed and maintained in a manner to be free of rodent infestation. A building permit is required for all chicken coops. The permit fee is S25 Electrical services must be inspected by the Winnebago County Building Dept. No extension cords allowed. Hens shall be kept in the enclosure and let out only with supervision in a fenced yard. All areas where hens are kept shall be maintained neat and clean and free of undue accumulation of waste such as to cause odors detectable on adjacent property. YILLAGE OF ROSCOE ORDINANCE NO.2014-46 @copy AI{ ORDINANCE APPROVING A TEXT AMENDMENT TO THE VILLAGE'S ZONING REGULATIONS CONCERNING THE PERMITTED KEEPING OF CHICKENS WITHIN RESIDENTIAL ZONING DISTRICTS. WHEREAS, the Village of Roscoe wishes to amend Section $90.01 and 90.10 (B) and create a new Section $150.24 of the Village of Roscoe Code of Ordinances to regulate the raising of Urban Chickens within residential zoned areas ofthe Village; and WHEREAS, there has been significant public input presented to the Zoning Board of Appeals and Village Zoning Commi$ee that there is a substantial community benefit from permifting residents to keep a limited number of chickens (6 hens) for personal use in residential areas of the Village; and WHEREAS, pursuant to notice, the Zoning Board of Appeals held a public hearing on September 17, 2014, and received input and testimony from the public conceming such amendments to the Village Code; and WHEREAS, the Village of Roscoe is authorized and empowered by statute to adopt and enforce the provisions of this ordinance; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF ROSCOE, ILLINOIS, AS FOLLOWS; Section l. The foregoing recitals are incorporated herein as findings of the Village of Roscoe Board of Trustees. Section 2. That the Section $150.24 [NEW] (or such other nep section that shall be created for the functional organization and codification ofthe Village Code) Urban Chickens ofthe Code of Ordinances of the Village is hereby qealed, to reflect as follows: " $1s0.24 URBAN CHTCKENS. A. The maximum number of domestic hens permitted to be kept on a property zoned and occupied for a single family residential use shall be limited to 6 hens. B. The keeping of roosters and the slaughter of any chicken is prohibited. C. Hens shall be housed in an enclosed chicken coop approved by the Zoning Department or within an adjacent covered outside fenced in area. The outside area shall be no larger 32 square feet. D. All chicken coops shall be approved through the Village's design review process.

E. Hens shall be kept in the enclosure and let out only with supervision in a fenced yard. F. The enclosure and adjacent occupied fence area shall be set back thirty (30) feet from any adjacent residential structure and not less than a twenty (20) feet from the property line. G. All enclosures shall be constructed and maintained in a manner to be free of rodent infestation. H. A Coop Permit issued by the Village of Roscoe shall be required prior to the installation of any chicken coops. Anyone desiring a permit for a coop shall pay a $25 fee to the Village. I. All electical services must be inspected and approved by the Winnebago County Building Dept. Extension cords may not be used to provide power to chicken coops' J. All areas where hens are kept shall be maintained neat and clean and free of undue accumulation of waste such as to cause odors detectable on adjacent ProPerty. K. Owner shall not allow chickens to produce noise loud enough to disturb the peace of neighbors. L. Owner shall allow inspections from the Village of Roscoe Code Enforcement and Zoning Department Section 3. That the Section $90.10 created,to rcad as follows: " (E) of the Code of Ordinances of the Village is hereby "(E) The maximum number of hens permitted on a residentially zoned parcel shall be six (6)." Section 4. That the Section $90.01 ofthe Code of Ordinances ofthe Village is hereby amended, to reflect as follows: " SDEFINITIONS. FARM ANIMAI. Includes horses, ponies, mules, bison, cattle, goats, sheep, swine, potbelly pigs or any other hoofed animals and fowl rooster, for no matter what purpose such animal is kept. [NEW] IIENS. Female egg laying chicken. INEWI CEICKEN COOP, An approved coop for egg laying chickens." Section 4. Any portion of any other ordinance in conflict with this ordinance is hereby expressly repealed to the extent ofthe conflict.

Section 5. All other portions of the Code of Ordinances of the Village of Roscoe shall remain in full force and effect. Section 6. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
