CONDITIONS OF SALE Except where otherwise stated by the Auctioneers at the time of sale, these conditions shall be binding on both vendors and purchasers of all classes of stock at this sale. Such person shall have power to order the return to vendor of any animals which he finds do not comply with the warranty and he may order the payment of costs and expenses by the third party and/or compensation or, if time allows on the day of sale, resale by auction of the entire lot with all faults described. All animals must pass through the sale ring and be offered by public auction. Private sales will not be permitted. Every vendor MUST ensure their sheep are penned in the correct pens BEFORE they are sold. The number of sheep in each lot shall be counted once leaving the pen to the ring and confirmed returning back from ring. IMPORTANT The time mentioned for making claims for breach of warranty must be strictly adhered to and no claim will be admitted if made out of time. The onus of providing that the claim is made within the proper time shall be on the person making it. EWES AND THEAVES ALL EWES AND THEAVES sold in this fair shall (unless otherwise stated at the time of sale) be warranted by the vendor to be right and straight. The term right and straight means that Ewes and Theaves are CORRECT IN THEIR TEATS AND UDDERS and CORRECT IN THE MOUTH. Ages will be referred by the age in years or shears etc. Vendors offering ewes of varying ages in one lot MUST disclose the number of ewes in each age group Claims of breach of warranty of the above having been provided, the purchaser shall have the option of leaving such animal(s), otherwise the vendor shall pay compensation as defined in the LAA conditions of sale. LAMBS *Unless otherwise stated it will be assumed that ALL WHETHER LAMBS ARE PROPERLY CASTRATED *Any complaint as to whether lambs have been misrepresented as ewe lambs must be made by the time stated above. Claims for breach of warranty under the above having been proved, the vendor shall pay to the purchaser compensation at the rate of 33% of the purchase price. E.I.D Sellers and Buyers must give particular note to the new LAA conditions of sale regarding liability as shown in the sales office. PAYMENT: All stock must be paid for on the day of sale. Terms are strictly CASH or CARD unless credit references have been cleared with the

Auctioneers prior to the day of sale for payment by cheque. A handling fee of 2.5% will be charged on credit cards and business debit cards. Cheques will be accepted from regular customers known to the auctioneers. The following Mortality Warranty will apply only where the Buyer makes payment of the additional mortality warranty premium at the time of purchase. 1 Mortality Warranty Subject to the conditions set out below the Society agrees to repay the hammer price of any animal sold at it s auctions which dies within seven days of the date of the fall of the hammer as a direct result of a condition which existed at the time of the fall of the hammer ( the mortality warranty ). The Society will not make any payment over and above the hammer price nor reimburse any consequential losses or incidental expenses incurred. 2 Conditions The conditions which must be satisfied before payment by the Society pursuant to the Mortality Warranty set out in sub condition 1 above are as follows:- 2.1 The Buyer must notify the Society in writing of the death of an animal which may give rise to a claim pursuant to the Mortality Warranty ( a Claim Notice ) so that such Claim Notice is received in the office of the Society within 24 hours of such death and then at the Buyer's own cost produce a certificate from a qualified veterinary surgeon:- A) confirming the cause of death, and B) confirming the veterinary surgeon s opinion that such cause existed at the time of the fall of the hammer, and C) confirming whether, in the veterinary surgeon's opinion, there is anything which might give rise to the belief that at the time of the sale the vendor of such animal knew or ought to have known of, or had good reason to suspect the existence of the condition which caused the death, or of any symptoms connected with such condition. Such certificate to be produced to the Society within 48 hours of death. 2.2 If the Society so wishes, it may at its own cost obtain a certificate from the veterinary surgeon of its own choice within three days of notification of death by a Buyer. 2.3 The Buyer shall not dispose of any animal in respect of which they intend to claim pursuant to the Mortality Warranty until three days have expired since the Buyer has give a Claim Notice and give the opportunity for the Society or its nominated veterinary surgeon to inspect such animal as soon as it wishes during that time. 2.4 No payment will be made pursuant to the Morality Warranty where the Society s veterinary surgeon certifies that the Buyer or the employees agents subcontractors or independent contractors engaged by the Buyer or their agents have caused or contributed to the death of the animal by the Buyer s own actions or omissions or those of the Buyer s employees agents subcontractors or independent contractors and the certificate of such veterinary surgeon shall be final and binding upon the Buyer and the Society. 3 Vendor s Responsibility If in the opinion of the veterinary surgeon whose opinion shall be binding on the vendor the vendor of any stock the subject of a claim pursuant to the Mortality Warranty knew, ought to have known, or had good reason to suspect the existence of the condition which caused such death at the time of sale then the Society will not pay the vendor for such stock or if payment has already been made to the vendor shall repay the hammer price of such stock to the Society within three days of demand. 4. General 4.1 All the times set out in Clause 2 above shall be of the essence. 4.2 Breach of any of the provisions of Clause 2 above by the Buyer will result in the Mortality Warranty being invalidated and no payment will then be made pursuant to it by the Society
