3. Amount due: $000.00 (tness2@capellauniversity.edu for paypal) a. Payments/deposits are ALWAYS nonrefundable. Should breeder not be able to provide described puppy a replacement puppy may be chosen from that litter or from the Dam s subsequent litter. 4. A deposit in the amount of $300.00 is required to hold the puppy of your choice until it is ready to either be picked up or shipped via the airline. You may send your deposit by United States Postal Money Order or Cashiers Check. If you prefer online or credit card payments, POP Money or Paypal are acceptable, with buyer responsible for fees. Cash Deposits must be made in person. 5. Personal Checks are not accepted for payment** 6. Deposits for puppies are accepted in the order that they are received. You will be notified of the order of your pick, when your deposit is received. 7. **All puppies must be paid for in full by the time they are to leave** 8. It is mutually agreed upon by both parties that the puppy will be held by the Breeder until at least 8-9 weeks of age, regardless if being picked up or being shipped by an airline. 9. This deposit signifies full intent on the behalf of the purchaser to follow through with the purchase transaction of the puppy, as stated in this agreement. If a deposit is taken for a male and all pups are female, your deposit will be applied to a subsequent litter. 10. Breeder will maintain contact with the buyer until date of pick up. If seller is unable to reach buyer at date of pick up, after 5 days the puppy will be resold and deposit forfeited. 11. Shipping is not included in the purchase price. Shipping fee is additional and must be paid PRIOR to puppy leaving. This price will include airline shipping crate, required airline health certificate, and the cost of the airline ticket. The puppy shall have Kaiser in the beginning of her registered name.
14. The Breeder guarantees this puppy/dog to be of sound health and temperament at the time of this sale. a. A health record of all shots and worming s will be provided by the Breeder. b. To qualify for this health guarantee buyer must take the puppy to their veterinarian within 72hrs of purchase for a general health check (exceptions will be made if purchased on a holiday or weekend when the vet s office is closed. Please see the date below this paragraph for when you must have the puppy seen by. A receipt from the veterinarian with a date MUST be given if a claim is to be made to the breeder. There are no exceptions to this rule. Puppy must be seen by for warranty to be effective. (Only exception, if picked up on holiday or weekend when vet is closed. If you are picking up puppy on a weekday the 72hr notice is in order) 15. The Buyer agrees to provide a life-long commitment, comfortable indoor environment, prompt medical attention, proper grooming and responsible care. a. This includes keeping this puppy/dog parasite free and up to date with inoculations, proper nutrition, which consists of a good quality professional feed given at regular intervals, and fresh water available at all times. b. Breeder asks that you have your puppy/dogs vaccines/flea prevention/heart guard up to date at all times as well as on a proper deworming schedule. c. Breeder asks that you DO NOT take your new puppy to public places such as dog parks, pet stores, or wherever strange dogs/puppies frequent until at LEAST 6mo of age or the age that puppy has had all of its shots/final booster. d. The Buyer promises to provide a safe environment for the dog, and never allow the dog to roam freely without proper fencing or supervision. e. The Breeder strongly recommends that the puppy/dog be micro chipped or tattooed in order to facilitate his return if lost or stolen. f. Any evidence of neglect, abuse or negligence will void this contract. The full ownership of the puppy/dog will immediately revert to the Breeder with the reasonable costs of transport due from the Buyer to the Breeder. g. If at any time the buyer is unable to care for or keep the puppy/dog they shall return it to the breeder. At no time will RDF pay for the return of a puppy. 16. When asked for current pictures (twice a year) must be provided with in 48hrs or a reasonable time frame mutually agreed upon in case of vacations. a. This may be done by tagging on Facebook or via email. b. By neglecting to send updates Breeder will assume that the puppy/dog from RDF has been sold, traded, given away, hurt, thrown outside in a kennel/shed/chained, deceased etc.breeder will then be forced to act as if the dog is being neglected and reinforce our contract through the legal system. 17. The Breeder guarantees this puppy until 2 years of age against fatal and life altering genetic diseases, including crippling hip/elbow dysplasia, genetic heart defects. a. Buyer MUST contact Breeder (within 72 hours of becoming aware of the genetic defect) in the event of any crippling genetic defect Buyer must provide a written statement from a licensed veterinarian AND must get a second opinion with Breeder s Veterinarian of choice, at the cost of the BUYER. b. Should the puppy need to be euthanized due to the genetic defects within the first two years of life, Breeder will provide a puppy from a future litter. c. Buyer agrees puppy should NOT be taken on long walks/jogs or endure any strenuous activities until they are between the ages of 1.5-2yrs old. This guarantee does NOT cover any injuries due to this or your puppy falling, slipping on ice, other animals playing too rough etc. d. Also not covered is if you decide to feed your puppy/dog food that is above the recommended protein level (25%), or give them any supplements that is NOT made for them especially calcium causing them any problems. e. If the puppy should die of any genetic problems a necropsy is required from a state certified lab and sent to my vet to confirm for a replacement puppy, at Buyer s expense. 18. Buyer is also aware that whoever signs this contract is the one given sole possession of said puppy/dog. In the event that there is a divorce, break up, move etc. puppy/bitch is to remain with the party that has SIGNED the contract below. If you cannot keep puppy/bitch then it is to be returned to Breeder unless otherwise agreed upon with Breeder with written permission. 19. All puppies sold solely under this contract ARE REQUIRED to provide proof of spay/neuter between 12-24 months of age. They are at no time to be used for breeding purposes. Registration papers will NOT be provided until proof of spay/neuter has been provided (Vet bill). 20. This sales contract and health guarantee has been read and understood by both parties (Breeder/ Buyer) whom sign below. In the event that Buyer should breech or attempt to falsify claims against this contract there will be a $1000.00 fee assessed to them as well as any other fees associated with each point in this contract, depending on what was breeched. Should there be an actual event were this contract should go to court buyer agrees to pay and/or reimburse ANY and ALL expenses to include but not limited to filing fees, attorney fees, missed wages and traveling fees for KGD/Tara Ness. Kaiser Great Danes prefers to settle outside of court in a civil manner, however all cases to go to court will be settled within the BREEDERS state of Wisconsin and county of Winnebago.
I fully understand and agree to the terms on this sale agreement (this being the 5 th and final page) and health guarantee and fully agree to all the above terms by signing this contract.
