SCHEDULE 16 TO BY-LAW # RELATING TO KENNELS, PET BOARDING AND PET DAYCARE FACILITIES 1. In this Schedule: Animal means a dog, cat or any other pet that is generally understood to be domesticated and is typically kept indoors; Kennel means any premises or facility where more than three dogs are accommodated for the purposes of show, training or breeding; Pet Boarding and Daycare Facility means any premises or facility in which Animals owned by persons other than a Licensee are accommodated for any period of time for financial gains; Inspector shall include an Animal Control Officer for the purposes of this Schedule. 2. Prior to applying for a new Licence and at the discretion of the Licence Issuer for every Application for Licence renewal, the applicant shall submit to the City s Animal Services Section: A site plan of the facility; A brief description outlining the number and species of Animals that may be accommodated in the facility; and A brief description outlining how animal sickness, disease or injuries will be handled at the facility. 3. Every Application for a new Licence and at the discretion of the Licence Issuer every Application for a Licence renewal, shall be accompanied by: Where applicable, a copy of proof of ownership, a lease or written permission from the owner or property manager, of the property where the Kennel or Pet Boarding and Daycare Facility is to be located and operated; An original criminal reference check issued within the last 30 days for Sections 445.1, 446, 447 and 447.1 of the Criminal Code of Canada, RSC 1985, c. C-46, for the Applicant(s) or, where the Applicant is a corporation, for every person who will be in charge of the boarding facility during the term of the Licence; 1
Letter of approval from the Animal Services Section that the premises meets the City s requirements. 4. A separate Licence shall be obtained for each Kennel or Pet Boarding and Daycare Facility that is under the same ownership. 5. No Licence shall be required for: An animal shelter operated by or on behalf of the City; A recognized animal rescue organization or other organization approved by the City dedicated to protecting the rights of Animals; A publicly funded educational institute; An animal shelter operated by a branch or affiliate of the Ontario Society for the Prevention of Cruelty to Animals; A facility licensed under the Animals for Research Act, R.S.O. 1990, c. A. 22, as amended; or; An accredited veterinary hospital or clinic. 6. No Licence shall be required for a Kennel or Pet Boarding Facility located anywhere in the City where the number of Animals being accommodated, including the Owner s Animals, does not exceed the number permitted in a dwelling unit under the City s Animal Control By-law and Dog Licence By-law, as both may be amended from time to time. 7. No Licensee shall accommodate any animal prohibited by law. GENERAL 8. Every Licensee shall: Maintain and make readily available to personnel at all times, written Animal care procedures dealing with, amongst other matters, methods of handling animals, sickness, injury or death, and contact information for a licensed veterinarian; Ensure that all Animal waste materials are disposed of in a manner that will not create a public nuisance or health hazard; and 2
Ensure that the Kennel or Pet Boarding Facility is sanitary, well ventilated and free of offensive odours. CARE OF ANIMALS 9. Every Licensee shall: (g) Comply with the provisions of the Ontario Society for the Prevention of Cruelty to Animals Act R.S.O. 1990, c.o.36, as amended; Ensure that any Animal suffering from any disease, ailment or injury shall be given care and attention from a veterinarian forthwith and that the animal is kept in quarantine area until a veterinarian certifies that the animal is in good health; Ensure that each cat or dog coming into the facility is current in its vaccinations against rabies; Provide each species of Animal with adequate food and water specific to the animals needs; Provide adequate light specific for the need of each species of Animal; Provide all Animals with an opportunity for exercise; and Ensure that dogs housed in cages less than 2 metres x 1 metre in size are exercised at least twice a day. 10. Every Licensee shall ensure that every cage or other container used for the keeping or housing of any Animal: Is of adequate size to permit the Animal to stand normally to its full height; to extend its legs and body to their full natural extent; to turn around and to lie down in a fully extended position; Is equipped with receptacles for food and water, mounted or situated that they cannot be easily overturned or contaminated; Is in good working condition and is not dangerous to the Animal s health or well-being; Provides adequate enhancement to promote the expression of species appropriate behavioural and mental activities; and 3
Is maintained in a clean and sanitary condition at all times with all excrement, refuse and other objectionable material removed at least twice in every 24 hour period, including weekends and holidays. 11. No Licensee shall accommodate more than one Animal in a single enclosure without prior consent of the pet owner. FACILITY REQUIREMENTS 12. Every Licensee shall ensure that all of the following Kennel and Pet Boarding Facility standards are met: (g) (h) (i) (ii) The facility shall be situated at least 40 metres from any school, dwelling unit or other premises used for human habitation, other than the licensed premises; Walls shall be smooth, durable and impervious to facilitate cleaning; Roof coverings fastened to sheathing or directly to the roof joists shall be laid so as to prevent the entrance of rodents and vermin, and covered with suitable materials in order to eliminate leakage and exposure to adverse weather conditions; Ceilings and walls shall abut to prevent rodent infestation; Corners of ceilings, walls and partitions shall be caulked and painted to facilitate cleaning; Proper air circulation shall be maintained to prevent the spread of contaminants, viruses, bacteria and moulds; The temperature for an indoor facility shall be maintained at a minimum of 10 degrees celcius with a maximum of 27 degrees celcius; Enclose the yards and runways associated with the facility with a solidly constructed fence having a height of at least 1.3 metres so as to: obstruct fully, the visibility of the neighbouring properties from the animals as reasonably as possible given the grade of the property and the City s fencing restrictions; and prevent the animals from escaping from the premises. 13. Every Licensee shall ensure that all of the following additional Kennel and Pet Boarding Facility standards are met: 4
(g) Floors shall be of smooth concrete finish or like material and shall be adequately sloped to drains; Where floors are on a grade, suitable bedding shall be provided; Each dog run shall have a minimal floor area of 2 metres by 1 metre in size; Runs shall be maintained in a manner that will keep the dog securely enclosed; Run surfaces shall be kept safe and not slippery, and free from debris that could cause injury; Dogs placed in outdoor runs shall be monitored according to weather conditions; and All indoor and outdoor hard surface runs shall be disinfected after use by each dog. 14. Every Licensee shall ensure that any cage used to confine a cat has a solid floor. RECORDS 15. Every Licensee shall record: The names and addresses of the owners of all Animals accommodated at the Kennel or Pet Boarding Facility; Emergency contact number for the owners of the Animals; Emergency contact number for the veterinarians of the animals; The name, breed, description and health records stating any special medical needs of boarded Animals; and The dates of arrival and departure of all Animals 16. Every Licensee shall ensure the records are available for inspection by the Licence Issuer, or Inspector during business hours, and the records shall be retained for the period of 24 months following the end of the term of the Licence. 5
INSPECTIONS 17. Upon request, a Licensee shall provide an Inspector with medical reports for any Animal. 18. No Person shall withhold, destroy, conceal or refuse to furnish any information or thing required by an Inspector for purposes of an inspection. 19. No Person shall prevent, hinder or interfere or attempt to prevent, hinder or interfere with an inspection undertaken by an Inspector. 20. If grooming services are provided at a facility licensed under this Schedule, a Pet Grooming Facility Licence is not required but the Licensee must comply with the provisions of the Pet Grooming Facility Licence Schedule 19. 6
