The ONLY exception to this is if the Breeder is unable to offer the Buyer a dog in the size, class and gender the Buyer wants within one (1) year s date of the receipt of the deposit. The Buyer will not lose his/her deposit if the Buyer changes his/her timetable on the time best to purchase the dog as long as the Breeder is notified of the change in plans at least two (2) weeks before the dog is ready to go to its home. There will be a $200 assessment for holding the dog if a dog has been selected for the Buyer and the Buyer does not give the Breeder a two (2) week notice of the Buyer s intent of not taking the dog. All checks are to be made out to GoldenQuest The Buyer is expected to pick up their dog within 7 days of the date of deposit. Starting on day 8, a daily boarding fee will be charged. If the dog is less than 8 weeks when the deposit is received, the boarding fees will start when the dog is 9 weeks old. The daily boarding fee is $30/day. If prior to the placement of the dog, the Breeder thinks placement with the Buyer is not in the best interest of the dog/buyer (i.e. falsification of application, inability to care for dog), the Breeder may return the deposit in full and void the contract. CONDITIONS OF SALE The Buyer has THREE business days from the time of receipt of dog to have dog examined by a veterinarian. Any request to return the dog to the Breeder for a full refund must be made within this time period and may only be requested should the dog be found to have a health issue of such serious nature that the quality of life of the dog will be shortened or seriously altered. Buyer guarantees that at the time of delivery, the dog was checked by a licensed veterinarian and is in good health. Should dog be found to be in poor health of a serious nature that is diagnosed as permanently life altering by a veterinarian, Breeder will provide Buyer with a replacement dog from another litter, or a full refund of the purchase price of dog only after dog is returned to Breeder at Buyer's expense. Shipping & veterinarian expenses and associated costs will not be refunded. This warranty will be terminated immediately if dog is not examined by a veterinarian within 3 business days. Minor health ailments including, but not limited to, fleas, parasites, or stress induced diarrhea (frequently caused by the dog's transition from the Breeder s home), an umbilical hernia or an imperfect bite are not reason for dog to be returned to Breeder.
The owner agrees to follow the breeders preventative worming program. Preventative meds will be sent home with the puppy to help prevent stress diarrhea, an ailment common to 90% of puppies. If the preventative program isn t followed the health warrantee is void. Proof of examination and diagnosis must be provided to Breeder and Breeder s veterinarian, should Buyer wish to request returning dog for a refund. We do strive to produce a certain look but we do not guarantee size, color, or appearance. A warranty against all serious life altering genetic disease is provided for two years after date of birth. The disease needs to be known to occur from genetic factors only and not have environmental causes or influences, as the Breeder has no control over other factors. Should a (only) genetic disease be discovered during this time that will greatly shorten the life of, or greatly alter the quality of life of dog, Breeder will reimburse Buyer the veterinary costs up to the purchase price of the dog minus a $250 alter fee and any rebates, if dog is kept by Buyer, OR provide a replacement dog to Buyer from a similar litter type/price from first litter with availability. If a replacement dog is offered the Buyer will pay a $250 alter fee. This genetic disease warrantee can be extended if the Buyer puts his/her dog on NuVet and/or Life s Abundance daily starting from the day the dog goes home and the product is ordered from the Breeder s website. One year, from the date of purchase, will be added to the health guarantee for each of the products added to the dog s daily diet. Two independent veterinary examinations and reviews must be provided to Breeder documenting the genetic health issue. Reimbursement of veterinary fees is provided to Buyer once copies of the medical reports are received by Breeder. Veterinary reports must state the treatments provided, and itemize fees for the treatments. A warranty for hip dysplasia is provided for two years after the date of birth. This warranty will be terminated should dog be allowed to become overweight by 20% or more or developing joints be overstressed at any point during the warranty period. Veterinary medical records will be required showing the weight of dog and veterinarian s assessment of the weight. This warranty covers dogs found to be symptomatic with pain and found to have moderate or severe hip dysplasia within its first two years. Buyer must provide Breeder with proof in the form of documentation from PennHIP or OFA and a veterinary note stating the symptoms the dog presents. The Breeder reserves the right to confirm the results before a replacement or refund is provided. Should a veterinarian determine that an injury may have occurred that caused or contributed to the issue, no reimbursement or replacement will be provided. If the dog is lost/found the Breeder has the authority to take the dog into her possession. The Breeder will attempt to notify the Buyer of the dog s rescue.
Warranties shall apply only to original Buyer. Transfer of dog ownership shall void all such provisions of this agreement. Buyer agrees to first contact Breeder should it ever become necessary to re-home dog. Breeder may assist in re-homing the dog. Buyer agrees to never relinquish the dog to an animal shelter, rescue organization or puppy mill. Under no circumstances shall the Breeder be liable to the Buyer or to any third party for any consequential incidental or special damages resulting from or in manner related to the dog. The Breeder must approve any re-home and be notified of the new owner s name, address, phone and email so that the Breeder can assist in recovery of the dog if the Breeder is notified of it being lost/found. Upon execution of this contract all veterinary care and its associated costs are the sole and exclusive responsibility of the Buyer. GoldenQuest is attempting to track the health of the dogs bred and the effectiveness of our program. We may send two (2) surveys the first year and once per year after. Buyer agrees to fill out these surveys. Buyer agrees to notify Breeder of changes in address, phone number or email address. This ensures that we have accurate data in the event we are contacted in regard to a lost/found dog and enables us to aid in the dog s return. MAINTENANCE Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to, inoculations and internal and external parasite treatments for fleas, tick & heartworms. Veterinary records must be provided to Breeder if requesting refund or replacement. Buyer also agrees to provide, at minimum, basic obedience training for dog. If any of the above preventative care has not been provided, health warranty will be void. We encourage you to go to AKC and get a K9 partner number so you can get titles on your dog. You can get Agility, Obedience, Rally or Coursing titles. If Breeder is provided with proof of titles (AKC and Non-AKC titles qualify), Breeder will rebate Buyer up to 0ne-hundred (100.00) dollars per title up to the full purchase price of the dog minus $500. Contact Breeder about qualifying titles and details prior to starting the titling process. TEMPERAMENT Our dogs have a reputation for having excellent temperaments. Because many factors, including training, can affect the dog s temperament, temperament cannot be guaranteed. Buyer understands that all dogs can exhibit certain undesirable behaviors (nipping, chewing, barking, marking, etc). Buyer is responsible for appropriate training of dog to correctly teach acceptable behaviors, and is responsible for proper socialization of dog. Should Buyer not be successful at training on their own, Buyer agrees to seek professional help from a certified trainer. Any time a dog is returned to
GoldenQuest for any reason, we assess the dog for behavior or other issues. If any issues are found they need to be remediated before the dog is placed in a new home. By returning the dog to GoldenQuest, the Buyer forever relinquishes to GoldenQuest all of its ownership interest in the dog, and GoldenQuest shall be deemd the legal owner of the dog with full rights and privileges to do as it pleases with the dog, including reselling it. GoldenQuest cannot be responsible for your dog s behavior but we strive to support owners in training their dogs. If bad behavior occurs, it is best to address it promptly. Buyer agrees to contact Breeder within one week of behavior occurring and every week thereafter until behavior is resolved. If extensive support is needed, our trainers can offer local or telephone support for a fee. Any time a dog is returned to GoldenQuest we assess the dog for behavior or other issues. If any issues are found they need to be remediated before the dog is placed. The charge for this will be $45/day. In addition, after remediation, the dog will be boarded/trained until an appropriate home is found and the dog can be placed. The charge for this will be at the rate of $45/day. In addition, if any medical issues, procedures necessary are we will attempt to remediate the issue and the medical fees will be calculated and charged. Remediation, training, boarding fees will not exceed the purchase price of the dog. There will be a $500 rehoming fee in addition to boarding and training the dog. Once the dog is placed GoldenQuest will subtract the rehoming, rebates, medical, boarding and training fees from the sale price. The former owner will be rebated the difference of the costs from the original payment. The owner agrees to these terms. In addition, the owner agrees to reveal any and all behavioral, medical and/or other problems he/she has had with the dog. The owner agrees to give copies of all documents of training and veterinary care while in his/her care including worming, flea treatment, heartworm and vaccination. The owner will provide contact information to the Breeder for veterinarian, trainer and any other relevant professional(s). The owner will provide permission for veterinarian, trainer and any other relevant professional(s) to speak with the Breeder regarding the dog. SPAY/NEUTER Breeder is selling this dog with a non-breeding contract. All dogs are sent home spayed/neutered unless circumstances prevent us. If the dog has not already been altered, the Buyer is required to have the dog spayed or neutered within the first 7 months of its birth date. Failure to do so or to provide documentation by the age of 7 months will void the health guarantee and the Buyer will be responsible for a $500 contract breach fee. There will be a $15,000 contract breach fee for every 6 months that the dog is not altered starting at the age of 9 months. All non-breeding breaches will be assessed a $2000 fee per incident.
Enforcements GoldenQuest has the right to bring suit for the violation of any provision of this contract. GoldenQuest has the right to recover all of its reasonable attorney s fees and costs associated with enforcing any provision of this agreement. The parties agree that all lawsuits regarding the terms or enforcement of this agreement shall be brought in Woodford County, Kentucky and that Kentucky law shall govern all disputes between the parties without regard to principles of choice of law. *-to be filled out by Buyer.
