(hereinafter called " the kennel" ) and the pet owner whose signature appears below (hereinafter called " owner." ) By signing this contract the owner is aware it is valid for this current stay and any future stays. 1. Owner agrees to pay the rate for pet care provided in effect on the date the pet is checked into the kennel. 2. Owner further agrees to pay all costs and charges for special services requested, and all veterinary costs for the pet during the period said pet is in care of the kennel. 3. Owner further agrees that the pet shall not leave the facility until all charges due are paid in full by the owner or proper payment arrangements are agreed upon by both parties. 4. By signing this Agreement and leaving pet with the kennel, Owner certifies to the accuracy of all information given about said pet. The kennel reserves the right to deny admittance to the Owner's pet for any reason at any time. 5. The kennel shall exercise reasonable care for the pet delivered by the Owner to the pet care provider. It is expressly agreed by Owner and the pet care provider that the kennel's liability shall in no event exceed the lesser of the current chattel value of a pet of the same species or the sum of $400 per animal admitted for boarding and shall not exceed $50 for any other services or form of care. While working and caring for live animals situations may occur that are out of the kennels control. IE: boarding while sick, becoming sick with a common canine cold/virus ( such as giardia, leptospirosis ), or infestation of fleas. The Owner further agrees to be solely responsible for any and all act or behavior of said pet such as: Eats sticks, rocks, grass, or a toy in which the said dog requires medical attention while it is the care of the pet care provider. Also to include payment of all costs for injury to staff or other animals or damage to facilities caused by the pet. Furthermore, the aforementioned costs shall be paid in full by Owner before the pet shall leave the facility. All dogs that are boarded trained, or otherwise handled or cared for by the kennel is done so, without liability on the part of the kennel, it's staff or any agent who represent the Kennel for loss or damage from disease, death, running away, theft, fire, injury to persons, other dogs, or property by said dog or cat, or other unavoidable causes, due diligence and care having been exercised. 6. Owner specifically represents that he or she is the sole owner of the pet, free and clear of all liens and encumbrances. 7. Owner specifically represents to the kennel that, to Owner's knowledge, the pet has not been exposed to any contagious disease within a thirty day period prior to check-in. During the period of this agreement, Owner also agrees to notify the kennel of any known exposure of pet to a communicable disease or injury and hold the pet out of attending the kennel until pet is

symptom free for a minimum 30 days or with written veterinary clearance. Owner further agrees to maintain currency of vaccinations as required by the kennel's policy, administered to their pet prior to their stay, and they are all current and will NOT be older than 365 days during their stay. All vaccination requirements are subject to change without notice by Top Notch Kennels, Inc.. The kennel further requires that the pet be free from all worms, ticks, fleas, lice, mites and lyme disease. If on examination the pet is found to be infected with any such condition, Owner agrees to pay for treatment of pet and any other pet infected by Owners pet. Any of the costs incurred in such a case are to be paid in full before Owner's pet shall leave the facility. Keep in mind the gestational period of most diseases is more than 14 days, with the possibility of the said dog may have come into TNK infected. TNK takes no fault and no monetary reimbursement will be given to dog owner. Keep in mind any NATURE related illness or situation is not in our control. 8. All charges incurred by Owner shall be payable upon pick-up of pet. The kennel shall have, and is here by granted, a lien on the pet for any and all unpaid charges resulting from services provided by the kennel. The Owner hereby agrees that in the event the charges are not paid when due in accordance with this contract, the kennel may exercise its lien rights upon 10 days written notice given by the kennel to Owner by certified mail to address shown on contract. The kennel may dispose of pet for any and all unpaid charges, at private or public sale, in the sole discretion of the kennel, and Owner specifically waives all statutory or legal right to the contrary. If such sale shall not secure a price adequate to pay such costs of pet care or other charges delinquent, plus cost of sale, then Owner shall be liable to the kennel for the difference. All monies realized by the kennel at such sale, over and above the charges due and costs of sale, shall be paid by to owner. 9. If pet becomes ill or injured, or if the state of the animal's health otherwise requires professional attention, the kennel, in its sole discretion, may engage the services of a veterinarian or administer medicine or give other requisite attention to the animal, and the expense thereof shall be paid by the Owner in full prior to the pet leaving the facility. 10. Top Notch Kennels will not be held responsible for toys, towels, bedding or other personal items left on the premises due to items being damaged, lost, stolen, soiled or otherwise destroyed. 11. The Agreement contains the entire agreement between the parties. All terms and conditions of this Agreement shall be binding on the heirs, administrators, personal representatives and assigns of the Owner and the kennel. 12. Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any party to this Agreement, shall be settled in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by an arbitrator may be entered in any court having jurisdiction thereof. The arbitrator shall, as part of the award, determine an award to the prevailing party of the costs of such arbitration and reasonable attorney's fees of the prevailing party. 13. Owner is to look over pet after completion of grooming service and sign exit evaluation. If owner does not sign pet out for any reason then payment of all services will act as written agreement that the pet displays 100% satisfaction of services. 14. Once pet leaves Top Notch Kennels property owner waives the rights to all claims of injuries, infections, or allergic reactions to any and all products used by Top Notch Kennels. In addition, TNK has no way of knowing that owner did not correct or enhance any part of the professional grooming services done by any and all agents of Top Notch Kennels, therefore, TNK is not responsible for any veterinary bills occurred if any medical conditions occur after grooming service. Or not responsible for a common canine illness. 15. If owner does not leave hand written instructions per the groom and is unsatisfied, TNK will not reimburse or give credit. This is the sole responsibility of the owner to disclose exact instructions that they may have per the breed cut, or just likes or dislikes. Owner does need to inform us at time of pick up if there happens to be a critique, but understand if the critique was not verbalized or written down it still is the responsibility of the dog owner. Our groomer is accredited and professional, however, there are subjective choices. Also, if owner wants dog to be kept long and the groomer is finding the dog fully matted please assume she had to trim shorter to get out the mats. The mats are not the fault of TNK, but is a responsibility of the owner to maintain in between grooms. Groom prices can change without notice. 16. Owners whose boarding dogs are scheduled to be groomed on their departure day will be notified via phone call when their dog is ready to be picked up. Your dog may not be ready for pick-up prior to this phone call. 17. If you are monthly daycare client there is no charge for group playtime, all other exercise options charges still apply. 18. Special food items need to be either pre-bagged (such as chicken chunks added to your pups meal or shredded cheese)

or tell us the exact number of chunks. If you pre-bag your pups special treats by the number of dogs x days x number of feedings your pup will be getting exactly what you are expecting. If the item is shredded cheese we will now need a measuring amount. Feel free to place spoon in bag so we have the right amount. If it is sliced cheese then please assume we will fold in quarters. 4 x reason for the cheese x days given. If your pup needs a food item for a pill please give us specific instructions on how to be successful at administering the medication or vitamin. 19. If your dog is a fast eater please supply a slow feeding bowl. This is the only time a personal bowl is allowed. Please label with your pets name. Bloat: when the dog eats fast and stomach begins to twist, causing the dog to have severe stomach ache, vomiting, drooling, Requires immediate emergency attention: Most cases need surgery to correct the stomach. Deep chested dogs are very susceptible to this. Preventative surgery does exist call your local vet for information. TNK is not responsible for a dog eating too quickly/fast. Even with knowledge and protective measures in place, TNK is not responsible for any emergency veterinary care needed. 20. TNK reserves the right to move your dog to a different accommodation for any and all reasons to maintain safety of all staff and guests. If TNK requires your pet to move accommodations TNK will always upgrade your pet's move (ie your pet will not be moved to a smaller accommodation but will be moved to equal or larger size) BEHAVIOR QUESTIONS: 1. Pet owner is to call the vet and set up appointment, payment arrangements, and consent for medical treatment. TNK is not responsible for any decisions the emergency contact has made or any medical payments. If no emergency contact is listed pet owner will need to set up appointment, payment arrangements, and consent for medical treatment directly with the vet. TNK will only take "pet" to local vet in Oswego or the surrounding area IF WE HAVE STAFF AVAILABLE AT THE TIME. If no emergency person is available and the owners are unreachable a TNK staff will automatically be assigned, WHEN AVVAILABLE, to your pet and will act on behalf of yourself, with the understanding that the owner takes all responsibility for any decisions or payments that are deemed necessary for the health of the dog. There will also be an automatic flat fee of $25 going to a TNK staff.** VACCINATIONS: I hereby acknowledge my pet has all the required and recommended vaccinations. I understand that these are to minimize the severity of any illness, infection, or disease and not to be used as a guarantee of my pet being around multiple dogs, and the NATURE of the property. I also acknowledge that I choose to board my dog here knowing that the risk is higher for NATURE born situations then at another pet hotel. I acknowledge that fleas and tics, among other nature pests could be all over ( even in my back ground, neighboring yards ETC) And some have a life cycle longer than my pets stay. It is possible that my pet could have been infected with any disease, or unknown health situation WITHOUT my knowledge. Drank infected water at hime, chewed a toy or foreign object at home, or when infected with fleas that had not hatched at home. I acknowledge that TNK does as much as they can to control the NATURE of their property and I will not hold them responsible for any NATURE based problem with my pets stay. I am aware that TNK will do a flea check within the first 2 hours of my pet's stay. If the pet is deemed to have flea dirt, or fleas in any cycle of the gestation TNK will take precautions to treat my pet at my expense. I am also aware if my dog infects another dog I am to pay for their treatment as well. TNK will not turn my dog away as this is just the NATURE of having a pet. TNK has the responsibility to minimize continued damages. TNK may move pet for their own safety and to mitigate damage. HSH prices will apply to move. Per HSH contract* Owner will receive an e-mail notice. I understand that if my dog destroys or damages TNK property, I will be notified, and pay "ACTUAL REPLACEMENT" cost. CANINE INFLUENZA NOTICE: Owner understands that the flu virus is going around Illinois and while TNK is doing everything possible to minimize the situation, a dog may still come in asymptomatic (displays no symptoms but is contagious). TNK cannot control where dogs go and what they may previously have picked up before arriving on the premises. Therefore, owners must exercise their own judgment when choosing to board their pet and TNK is not responsible for any pet who may get the flu. TNK is strongly recommending the canine influenza vaccination which may or may not decrease the spread around the country. I have accurately disclosed all past and current injuries or professional diagnoses that may effect the quality and care of my pet during his/her stay @ TNK SWEATERS/CLOTHING: TNK does not accept any sweaters/coats that pull over. If the owner insists one be left on, TNK is not responsible for any injury/accident that may occur as a result. TNK's preference is that a velcro coat/sweater be left so that it may be taken on and off as safely as possible.
