DOG PARK RELEASE, WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT I, hereby certify that I am over 18 years of age and of sound mind and memory at the time of executing this Agreement. WHEREAS, the City of Satellite Beach (hereinafter CITY ) has made available an off-leash dog park; and WHEREAS, by my executing the Agreement and agreeing to be bound by its terms, the CITY agrees to allow me access to the dog park to participate in off-leash activities with my dog(s). NOW THEREFORE, in consideration of being allowed to participate in such activities, I hereby agree as follows: 1. I am aware of and fully understand the inherent dangers involved in participating in off-leash activities at dog parks, including the risk of death, personal injury, and property damage to myself, my minor(s) and dog(s), and other persons and their dogs while participating in such activities. I further acknowledge that participants and other persons at the dog park are not covered under insurance of the City. I freely and voluntarily execute this Agreement with such knowledge, and assume full and sole responsibility for the risk of death, personal injury, and property loss connected in any way with my or my minor(s) presence or participation in any activities at the dog park. 2. I hereby release and forever discharge the CITY and its employees, agents, or independent contractors and their respective sureties, insures, successors, assigns, and legal representatives, from any liability, claim, cause of action, demand, or damages for the death, personal injury, or property loss of any kind to me, my minor(s), or my dog(s) as a result of my participation, or that of my minor(s) or dog(s), in dog park activities, whether such death, injury, or property loss is caused by the intentional or negligent act or omission by any employee, agent, or independent contractor of the CITY or any other person at the dog park. Furthermore, I agree to pay all attorney s fees and costs of the CITY, and any of its employees, agents, and independent contractors if I bring claim, action, or demand against the CITY or any of its employees, agents, and independent contractors for any reason for which this Agreement applies. 3. I agree to indemnify and hold the CITY and its employees, agents, and independent contractors and their respective sureties, insurers, successors, assigns, and legal representatives harmless from any liability, claim, cause of action, demand, or damages for the death, personal injury, or property loss of any kind to any person or property as a result of my participation, or that of my minor(s), or dog(s), in dog park activities, regardless of whether such death, injury, or property loss is caused by the intentional or negligent act or omission by me or my minor(s) or dog(s) while in the dog park. Furthermore, I agree to pay all attorneys fees and costs of any persons covered herein for any action arising under this paragraph, whether or not such action is well-founded. 4. By executing this Agreement, I hereby bind my heirs, executors, assigns, and all other legal representatives, as well as those of my minor(s). 5. I agree that this Agreement is intended to be interpreted as broadly and inclusively as permitted by the laws of the State of Florida. If any portion of this Agreement is found or declared to be invalid or unenforceable, such invalidity shall not affect the reminder of this Agreement, which shall remain in full force and effect. 6. I agree to abide by all rules and regulations that the CITY may impose regarding dog park use and operation. 7. By executing this Agreement, I certify that I have read and understand this Agreement, have been advised and had the opportunity to seek independent counsel of my choice, have freely and voluntarily executed this Agreement, and have received a copy of the dog park rules. I acknowledge that, but for the execution of the Agreement and agreeing to be bound by its terms, the CITY would not authorize me or my minor(s) to gain access to the dog park and participation in its activities. E. Lorraine Gott OFF-LEASH DOG PARK 750 Jamaica Blvd. Satellite Beach, Florida DOG PARK RULES Please observe the following rules to help make our dog park a safe and enjoyable place. Thank you. 1. All participants using the off-leash dog park are required to submit the proper registration forms and provide documentation of current vaccination records for all dogs prior to entry into the facility. 2. All dogs must display current license and vaccination tags. 3. Users of this facility do so at their own risk. Dog behavior can be unpredictable around other dogs & strangers. 4. Dog owners and handlers are strictly liable for any damage or injury caused by their dog(s). 5. Dog handlers must be 16 years of age or older. Children under 16 are not allowed in the park unless accompanied by an adult. 6. All dogs must remain leashed until they are within the designated, fenced area. There are people at the park who are not using the dog park, please be courteous. 7. Dogs must not be left unattended, & must be in view and under the voice command of their owner at all times. 8. ***Dog handlers are responsible for cleaning up after their dogs*** 9. Dogs in heat and puppies under four months of age are not permitted in the park. 10. Dogs that fight or exhibit aggressive behavior must be immediately removed from the park by their owner. Aggressive behavior will not be tolerated (Including humans!) 11. No more than three dogs per handler are allowed at one time. 12. No large dogs are permitted to enter the small dog area (25lbs or more). 13. No smoking, food or alcohol is allowed within the park. 14. Fill in any holes your dog may dig or make appropriate repairs to disturbed areas. ***Scoop the Poop: ALWAYS cleanup after your dog right away! It s easy to forget and all eyes will be on you. This is one of the most important things owners can do to insure the ongoing success of the Dog Park. If dog waste is left on the ground, it will cling to the wheels of the Public Works equipment and be carried to other recreational fields used by children (an unacceptable situation). Pet waste also contaminates the ground water, especially during rainy times of the year, which runs into and pollutes the Indian River Lagoon. REMEMBER: IF IT EXITS YOUR DOG S BOOTY, IT S YOUR DUTY! *** Individuals failing to comply with posted park rules and regulations are subject to temporary or permanent loss of park privileges. Park Hours: 7:30am to 7:30pm daily (closed M-F 11am-4pm for required maintenance operations). Revised 10/13/17 PETIQUETTE AND PRECAUTIONS What is important to know before I bring my dog? Canine Behavior/Communication Don t overreact to normal behavior. Being overprotective makes your dog nervous and aggressive. If you ve never been to a dog park, familiarize yourself with canine play before visiting the park. There are dogs that like a rough and tumble style with lots of growling, grabbing, wrestling and tackling. Some dogs are daintier with bowing and chasing but not much physical contact. Some dogs like to herd other dogs and may bark and nip at others. Understand canine communication. Dogs that enjoy rough and tumble play may growl and snap as part of that play. Dogs may also snap to set their limits with other dogs, to let the other dog know they are being too rough or pushy. Dogs have various ways by which they communicate their dominance to other dogs. This may include a stiff-legged posture with the head held up and back; raising the hackles on the back; raising the tail; or laying the head across another dog s shoulders or back. Be sensitive to the other dogs with whom your dog is playing. Watch your dog carefully and be prepared to intervene if the interaction seems to be going down the wrong road. If your dog seems to be pestering or annoying another dog, divert his/her attention immediately. This means you A first time dog-park visit can be stressful for canines and humans, consider visiting the park at non-peak times. (Peak times are usually Monday through Friday from late afternoon until dark and on weekends & holidays) should move to another part of the park or leave. Don t be discouraged if your dog doesn t jump right in and begin playing. It may take a couple of tries, or even a few weeks of visits, before your dog comes out of his/her shell. Be patient & understanding, please. If your dog becomes fearful or anxious, don t force him/her to stay. Prevent Problems Be Alert The best way to avoid a fight is not to allow it to happen in the first place. Know your dog; monitor situations carefully and be prepared to intervene before naughty behavior escalates into a full-fledged fight. Do not bring dogs with aggressive tendencies to the park. You are risking harm and creating a potential liability for yourself. If a dog fight occurs, owners are responsible for breaking it up. Both owners must get control of their dogs at once. If one owner gets control of his or her dog but the other owner does not; it creates a very dangerous situation for the first dog owner. The safest way to break up a fight is to pull the dogs apart from behind. Grab the tail or the hind legs. Do not grab the collar or put your hands near the dogs head. Both owners should grab their dogs and pull them away from each other at the same time. Each dog should then be leashed and removed from the park.. Both owners must get control of their dogs at once. If one owner gets control of his or her dog but the other owner does not; it creates a very dangerous situation for the first dog and owner. Other owners should get hold of their own dogs, and divert their attentions elsewhere. The sight of a fight breaking out sometimes incites other dogs to get involved. Children in the Dog Park The dog park is NOT a petting zoo. The dog park is a place for people to enjoy their dogs Most dogs are curious and friendly; not all dogs are child friendly. Dogs may feel threatened if a child runs toward them, yells or grabs at them.. Babies & toddlers are not permitted in the dog park. If you choose to bring a child over the age of 5 to the dog park, you must supervise your child. Keep children under control & close by, you are responsible for your child s safety. Dogs often run fast and play vigorously and they may inadvertently knock down and hurt a child. If you choose to bring your child to the dog park, please make sure your child follows these rules: Does not wave arms wildly, run, scream, chase or tease the dogs. Does not pet any dog without asking permission from the owner first. Teach your children how to react in an emergency situation: Do not run! Hide face with arms and stand still like a tree or lie down like a log with arms and legs tucked into the body. Wait until an adult arrives to help or the dog leaves. Your main responsibility is to monitor your dog(s) and to be prepared to intervene if there is any sign of trouble. Before bringing children to the park, consider whether you can effectively supervise both the dog and the children at the same time. Consider taking your children down to the Liam J. Perk playground on the east side of the park, but keep your dogs out of the playground.
