PORTUGUESE WATER DOG CLUB OF AMERICA, INC. BREEDER REFERRAL PROGRAM & LITTER LISTING AGREEMENT 2018 Introduction Dedicated, responsible breeders of Portuguese Water Dogs ( PWD ) adhere to a set of principles designed to promote the welfare of the breed. The ultimate goal of responsible breeders is to preserve and improve the breed. The Portuguese Water Dog Club of America, Inc. ( PWDCA ) endorses the following guidelines for PWD breeders. Enrollment in this program is open to any PWDCA Voting Member ( Member ) in good standing. (Refer to the PWDCA Bylaws for a detailed explanation of Voting membership.) Enrollment requires Member sign this Breeder Referral Program (BRP) Agreement ( Agreement ). Member will be listed on the PWDCA Website (www.pwdca.org) under the Breeder Referral Program. Members will be eligible to list their litters, as long as they meet the requirements of the Agreement. Breeder Referral Program Annual Listing Requirements Member agrees to abide by and adhere to the PWDCA Code of Ethics (http://www.pwdca.org/assets/docs/club_documents/pwdca_code_of_ethics.pdf) Member must fill out an application and submit electronically to the BRP Coordinator. The application will become part of this Agreement. List of all litters owned or co-owned within the preceding calendar year. List of all dogs owned and co-owned along with reproductive status. All owned and co-owned dogs and litters must be listed in the Health & Litter Log (HLL). Regardless of reproduction status, the PWDCA strongly recommends that all dogs owned and co-owned have annual eye exams by a Board Certified Ophthalmologist up to 120 months. Member agrees to breed only owned/co-owned dogs following the PWDCA guidelines, who are age two years and older and the breeding meets certain health requirements prior to breeding. This includes the Member offering services of their Stud (owned or co-owned). Orthopedic Foundation for Animals (OFA) Hip Evaluation (normal) o Both Sire and Dam GM-1 Storage Disease (Gangliosidosis) o One Parent testing normal (non-carrier) or DNA parentage clear program Current ECR (CAER) Eye (normal) or CERF Normal up to 120 months o Both Sire and Dam Progressive Retinal Atrophy (prcd-pra) o Both Sire and Dam tested or DNA parentage clear program. One parent must test normal (non-carrier) Juvenile Dilated Cardiomyopathy (JDCM) o One Parent testing normal (non-carrier) or DNA parentage clear program Page 1 of 6 Pages

** Beginning in 2018 Early Onset Progressive Retinal Atrophy (EOPRA) o One Parent testing normal (non-carrier) All breedings on or after March 1 st, 2018 will require one parent testing normal prior to breeding. Test is currently available through Optigen. Member is expected to provide a truthful representation of the health of all their dogs and must advise potential owners of any known health problems that either Sire or Dam has or has produced. Member must provide owners, prior to transfer or sale, copies of all health certifications on the Sire and Dam. Member must ensure that puppies are eligible for American Kennel Club (AKC) registration. AKC papers should be supplied to the new owner at the time of transfer or provide a written bill of sale following the AKC requirements under Chapter 4, Section 5, as may be amended from time to time. https://images.akc.org/pdf/rulebooks/rregs4.pdf In the event a purchaser must give up their dog and it comes into the PWDCA Rescue and Relocation program the Member will claim the dog. If the Member is unable or unwilling to claim the dog, the Member will pay in accordance with the current fee schedules as outlined in the Policy & Procedure Manual. All litters bred or co-bred by Member must be recorded in the Health & Litter Log within six (6) months from the date of birth. Stud dog owners will make best efforts to have litters produced by their male included in the Health & Litter Log. Member will maintain a record of all their breeding-related activities in accordance with AKC s recordkeeping requirements, including any necessary DNA requirements under AKC s current policy. Member shall encourage each of their puppy buyers to apply for associate membership in the PWDCA inasmuch as the club, its members, and its publication(s) are a valuable source of information for PWD owners. The PWDCA strongly recommends all puppies be eye examined by a Board Certified Ophthalmologist. The American Kennel Club (AKC) made a formal recommendation to microchip all dogs and puppies. Best practices would include an eye examination and microchipping puppies prior to placement. Member Sales & Advertising Advertising, written or oral, shall be factual and not misleading and shall be in conformity with federal, state, and local consumer protection laws. PWDCA Litter Listing Guidelines Litters which are bred by the Member are eligible to be included in the PWDCA s Litter List of available puppies and dogs. Page 2 of 6 Pages

Co-bred litters are eligible to be listed as long as the co-owner is a PWDCA Member (Voting, Associate, Foreign, Junior or Honorary Member). All breeders of record must be in consent of the litter listing. Upon request, a written consent of the co-breeder(s) must be provided. Failure to provide consent will result in the removal of the litter listing. The listing will be under the BRP Member name only and they will be fully responsible for compliance under this Agreement. If a dog is co-owned by two or more persons who legally reside at the same address, who are current PWDCA Members in good standing and are in compliance with the BRP requirements, then each co-owner must sign this Agreement. The procedure for listing a litter or older dog parallels the PWDCA s current advertising guidelines outlined in The Courier and as outlined below: Litter Listing Requirements: Prior to breeding, all health clearances must be completed, current and entered into the Health & Litter Log for both Sire and Dam. Minimal health criteria: Orthopedic Foundation for Animals (OFA) evaluation for Sire and Dam receiving a passing score of Excellent, Good or Fair. Current (normal) OFA Eye Certification Registry (CAER) with passing rating for Sire and Dam (up to the age of 120 months) a) Litters that are produced from frozen semen. (a) If Sire is alive, the CAER must be current throughout the litter listing period except where the Sire is over 120 months of age or the CAER or a CERF (Canine Eye Registration Foundation) was current at such date. (b) If the Sire is deceased, the CAER or CERF exam status must have complied with the then current PWDCA health recommendations at the time of his death. Progressive Retinal Atrophy (prcd-pra) Both Sire and Dam are required to be tested with one parent testing normal (non-carrier). Laboratory Clear Certification or certification of DNA parentage analysis via the Canine Health Information Center (CHIC) DNA parentage clear program. GM-1 Storage Disease (Gangliosidosis) One parent, either Sire or Dam, testing normal (noncarrier). Laboratory Clear Certification or certification of DNA parentage analysis via the Canine Health Information Center (CHIC) DNA parentage clear program. Juvenile Dilated Cardiomyopathy (JDCM) One parent, either Sire or Dam, testing normal (noncarrier). Laboratory Clear Certification or certification of DNA parentage analysis via the Canine Health Information Center (CHIC) DNA parentage clear program. Unaltered Dogs: Name, date of birth, disclosure of health testing results and Sire / Dam names. Testing not completed can be listed as Not Tested. Altered Dogs: Name, date of birth, Sire / Dam names. No health testing is required. PWDCA Litter (and dog) Listing Procedures Member must complete the required PWDCA Litter Listing Form and submit it electronically to the Breeder Referral Coordinator on the PWDCA website. http://www.pwdca.org/breeder-referral-program Litters: Listing period may begin four (4) weeks before the expected whelp date and can continue up to 12 weeks after the whelping date. Adult Dogs: Listing period is 16 weeks. Upon written request, the Member may request a four (4) week extension. Written requests shall be sent to the Breeder Referral Program Coordinator. All health information is complete, current and can be validated in the Health & Litter Log. All litters must be listed in the HLL. Within six months from a litter s whelping date, the litter registration number, gender, coat type and coloration must be entered in the HLL database by the Member. Disciplinary Action Education and communication are the preferred methods of obtaining compliance to this Agreement; however, flagrant, serious and/or repeated disregard of this Agreement may result in formal charges brought before the PWDCA Board of Directors by any PWDCA members under the terms and conditions outlined in the Club s Bylaws. Contract violations, as well as slanderous or libelous allegations, arising between the Member and/or buyers or sellers shall be adjudicated in a court of law, and the PWDCA shall not be part of such court proceedings. However, if complaints made by the potential buyer, buyers or other members which indicate that the BRP Member is not in compliance with the PWDCA Code of Ethics (which encompasses fraud or fraudulent Page 4 of 6 Pages

advertising) or this Agreement, the BRP Administrator will bring these complaints to the PWDCA Board of Directors. The complaints will be reviewed by the PWDCA Board of Directors in Executive Session. Disciplinary action will follow as listed below. HLL Listing Failure Discipline Members of the BRP program who do not adhere to providing health documentation and updating the HLL on a timely basis will be removed from the BRP program until such time the HLL is current. Examples (but not limited to): a. Litter not listed in the HLL within six months from whelping date. b. Sire / Dam are health tested prior to breeding, as per the BRP Agreement, but the HLL database has not been updated. The BRP Coordinator, once made aware, will send an email notification to the Member(s). The Member has 30 days to update the HLL. It will be the responsibility of the Member(s) to notify the BRP Coordinator once completed. If a Member exceeds the 30 day period, the Member will need to reapply to the BRP Program. Contact the BRP Coordinator to reapply. An important reminder: Health Testing results that are obtained via the OFA database (open registry) are not acceptable to meet the BRP requirements. Health test results/numbers and dates of testing must be added into the HLL by the Member(s). All health documents also must be uploaded into the HLL directly by the Member(s) and ensure that documents are received by the HLL administrator. Breeding Violation Discipline The Member may participate in breedings that do not comply with the BRP Agreement as outlined here within. In order to avoid disciplinary action, the Member must make notification to the Breeder Referral Program Coordinator. Notification must be made no later than six weeks post-breeding. The Member will voluntarily remove themselves from the Breeder Referral Program and Litter Listing for three months. Procedure: Notification made to BRP Coordinator by email. If litter is non-compliant, the Sire / Dam AKC names and registration numbers along with the AKC litter number is required if a litter was bred outside of the of the BRP minimum requirements. Self-removal period will be three (3) months. Member may request to be reinstated to the BRP after the self-removal period. Notification must be made by email to the BRP Coordinator. BRP Coordinator will keep notification records of self-removal confidential (within the committee / PWDCA Board of Directors). Disciplinary action will be taken if a Member is found to produce a litter(s) that does not meet the BRP Agreement requirements and no self-removal notification, with litter information, was made. If Member is not in compliance with the breeding terms of this Agreement, upon written notification to Member by the PWDCA Board or its designee(s), Member will be suspended from the Breeders Referral Program and Litter Listing for a period of: a) First Offense: Six (6) months following date of suspension. b) Second Offense: Twelve (12) months following date of suspension. c) Three or more offenses: Review will be conducted by the PWDCA Board. At the discretion of the PWDCA Board, the Member may be subject to suspension from the BRP program and Litter Listing (including co-owned litters) and/ or be removed as a PWDCA Member in good standing. The suspended Member will be listed in the PWDCA Board Meeting minutes. No litter listing can be transferred by the Member during the suspension. Note: If suspended Member is listed as a co-breeder, all related listings will be suspended. No listing will be changed to a non-suspended Member s name without documentation that the suspended Member s name has been removed from AKC individual dog and litter registrations. Suspended Members may reapply to the BRP following the suspension period. Applications of Member that have had three or more suspensions from the BRP will require PWDCA Board approval. The BRP Coordinator will forward the application to the PWDCA Board. Venue Any and all matters in dispute between the parties to this Agreement, whether arising from or relating to the Agreement itself, or arising from the alleged extra-contractual acts prior to, during or subsequent to the Agreement shall be governed by and enforced in accordance with the laws of Wisconsin, regardless of the legal theory upon which such matter is asserted. Civil actions will be brought forward in the Courts of Wood County, Wisconsin. I have agreed to submit this application by electronic means. This Agreement is signed voluntarily and does not constitute the PWDCA s endorsement of a breeder. Any infraction as outlined above, or under the Club s and/or AKC s Bylaws, shall result in an immediate suspension of participation in this program until such time that Member is reinstated.
