Letter from the President, Hope everyone is doing well and getting ready for summer. The pools are open and looking good. Please help us keep them that way by doing your part and following the rules. I am using my space in the newsletter this month to ask that you participate in the vote on the proposed Amendment 6.1.1 to the Declaration of Covenants. I will not go into which way I believe you should vote; only that owner participation is important. The board had been asked by a larger number of members/owners to do something about the number of rentals in the community. We have 78 known rentals at this time. But, we believe there are several more, and that we are looking into. The primary concern and purpose of this amendment to our leasing restrictions is to deter investors from coming here and buying up homes for the purpose of renting them. It is not to create a hardship for current and future owners who may need to rent their homes due to job changes, military deployment, health issues, etc. In consultation with the community s attorneys (more than one), we explored several options: 1) preapproval requirements, 2)percent caps on number of rentals and 3) other ideas that other communities have tried. It was the attorneys recommendation to require an owner occupancy time requirement. In their opinions, this holds up in court stronger than the other explored options. This item was discussed at multiple board meetings before the amendment was written by one attorney and reviewed by the second. We have great attorneys and a good contract so the cost was controlled (for those concerned). The Declaration of Covenants requires a written consent to amend. So, to save on postage and so that it would be a member driven action, it was added to the Annual Membership Meeting agenda and mailing. As the request to amend was member driven, the board wanted the membership to decide if the proposal was to die at the annual meeting or was to be adjourned for 90 days (similar to a proxy-voted item). It was adjourned for final count within 90 days. Final Count will be don on July 14th at a Special Meeting (see below). Just because I have heard concern about how the secretary case the proxy votes she had representation for, I had management review the proxies in comparison to submitted written consent for the amendment. Of the 31 proxies given to the secretary for any vote that went to the floor, 26 signed in favor of the amendment, 3 did not turn in a consent form and 2 voted against. Please read the following letter. When you receive it in the mail, PLEASE participate by at least providing a proxy for quorum to have the meeting. There will be nothing to vote on as this meeting is just to finalize the signed consent count. If you have already submitted your written consent form, you do not need to resubmit. If you have not submitted it (for or against), please do so. Thank you, Peter Sacco, President Springs of Suntree Board of Directors Dear Member/Homeowner, (IMPORTANT) Re: Amendment 6.1.1 Leasing Prohibition & Restrictions A written consent form was sent to all registered owners/members of the Springs of Suntree POA outlining an amendment to the Declaration of Covenants Amendment 6.1.1 Leasing Prohibition and Restrictions as part of the Annual Membership Meeting packet and agenda. At the Annual Meeting on April 17th, the count in favor of the amendment stood at 149 and the count against was 26. However, a majority of 50%+1 is required to amend the Declaration of Covenants (313 in favor). A
motion was made and passed by members present and by proxy to adjourn/suspend the count for 90 days to allow for more membership participation. If you already have submitted your consent form (either for or against), this letter should be accompanied only by the proxy to hold a Special Membership meeting on July 14 th which requires 10% participation by proxy or person. If you are unable to come to the Special Membership meeting on July 14 th at 7, please turn in your proxy allowing the meeting to take place. This meeting is specifically to count the written consent vote for or against. The amendment as presented cannot be changed. It will either need to pass or die on July 14 th 2017. If you are one of the members who did not submit your written consent for or against the proposed amendment, this packet also should contain a new copy of the exact same amendment sent out with the 2017 Annual Membership Meeting. Please complete this form and turn it into the onsite office or mail to the onsite address at Springs of Suntree POA, 8300 Holiday Springs Rd, Melbourne, FL 32940. If you are unable to attend the Special Membership Meeting on July 14 th at 7 at the community center hall please submit your signed proxy to allow the members to have the Special meeting. A proxy has to be another member (owner) within the Association or the Secretary Director. There are no other items open for discussion and the proxy is only for a quorum allowing the meeting to be held. Should this Amendment fail to gain enough votes in favor, it will be closed with no further consideration as written. Residents have lost several pets and some neighborhood well-liked wild life characters recently due to speeding drivers. With the kids running all over the place we need to be more careful. Mate in June, but they stake out territory in May so be on the lookout for Gators, and Snakes. Water Moccasins (cotton mouths) have been sighted in the wooded and over growth water s edge areas. Keep your pets and kids away from the shore line unless you have looked first and are with them. GET YOUR COMMUNITY SERVICE COLLEGE SCHOLORSHIP HOURS HERE. Volunteering at the Springs of Suntree Community Center qualifies for volunteer hours towards many scholarship programs as community service. Check with your guidance counselor and then help out your community while helping out your future. Rosenberger Her very Special Cinnamon Apple Cake The Second Monday of the Month Potluck Luncheon or better known as OCHIO DE MAYO This month's luncheon is on May 8th at Noon. Bring a dish to share (something Mexican if possible but not limited to) and come enjoy the company as we hear some enjoyable music. Many thanks to Mr. Bice, our last month s guest, he certainly is involved with a worthwhile project - recording history one veteran at a time. 1 /34 C sugar divided 1 6oz. fat-free blocked Cream Cheese ½ C Butter (or Margarine) softened 1 Tsp. Vanilla extract 2 large eggs 1 ½ C all-purpose flour 1 ½ Tsp baking powder ¼ Tsp salt 2 Tsp ground cinnamon 3 C chopped peeled Rome apples (about 2 cups)* Cooking Spray *Can use 3-4 Granny Smiths Apples Farewell Gift from Hannelore Directions for mixing Cinnamon Apple Cake Preheat oven 350 degrees Beat 1 ½ C sugar, cream cheese, butter and vanilla at medium speed until well mixed. (About 4 min.) Add eggs one at a time, beating well after each addition; set aside. Lightly spoon flour into dry measuring cups; level with knife. Combine the flour, baking powder and salt. Add flour mixture to creamed mixture and beat at low speed until blended. Combine ¼ C sugar with cinnamon mixture and apples in a bowl; stir apple mixture into batter. Pour batter into an 8- inch spring form pan coated with cooking spray. (if using a 3X9X2 cake pan bake for 1 hour at 350 degrees) Bake for 1 hour and 15 minutes or until cake pulls away from side of pan. Cool cake completely on wire rack on a wire rack and cut using seriated knife. Yield 12 servings. Note: You can also use a 9 inch square cake pan; just reduce cook time by 5 minutes. Bunko will resume playing on the last Tuesday of each month at 7:00. IF you have an activity that you think other residents of the Springs of Suntree would enjoy let us know the community center has room for more. (Parent & Tot groups, craft or book clubs etc.) Every activity has to have a volunteer coordinator
WOW:-1 st Springs of Suntree The 1 st (hopefully Annual) SOS Community Artisan Fair held on April 29 th showed off some amazing SOS local artist. If you missed it, here are a few photos that do not do the work justice but should make you want to mark you calander next time. Hundred Acre Hollows, Inc. news The Gopher Tortoise Day activities were well received. About 50 people, mostly from the surrounding neighborhoods walked Hundred Acre Hollows on Sunday April 9 th. Special thanks to our junior Ranger tour guides! It was a beautiful day for checking out HAH. On April 10, Rachel King and Jonny Baker from FWC walked HAH and gave suggestions for restoring the land to better habitat for the wildlife. The biggest immediate problem is the invasive Cogon Grass which is spreading and needs to be eradicated as soon as possible. The herbicide is expensive and we need certified people to apply it. It has to be applied twice to be effective. That evening, Rachel gave a very interesting presentation at the Springs of Suntree clubhouse. She talked about the many other animals that the gopher tortoise burrows support. She said pets (dogs) cause the most harm to tortoises. Lt Dan, the wildlife hospital GT ambassador, is missing part of his right front leg due to a dog. An exciting possible use for Hundred Acre Hollows is for a practice area for K9 tracker units. We are in talks with several police departments around the county. The fact that the land is fenced is a big asset. There are many trees for the lost person or perpetrator to hide. If the police and their dogs regularly patrol the land, there won t be squatters or people doing things they shouldn t be doing in HAH. What is the difference between the police dogs and pet dogs? Training! The police dogs have a job to do and won t mess with the gopher tortoise burrows. The handlers will pick up any dog poop. So don t be alarmed if you see several police cars at the entrances to HAH. They will park there while training. This is indeed something that will benefit all citizens of Brevard County. Thank you to the approximately 40 households that have donated to Hundred Acre Hollows, Inc. from the surrounding neighborhoods. We ve received about $1,500 and have approximately $500 now after start-up expenses, which were mostly state and federal fees and insurance. Please donate if you haven t already.
