VENDORS & PURCHASERS ALIKE PLEASE NOTE: Rule 9 of the Auctioneers Conditions of Sale states in connection with private sales on the sale premises, either before a lot is offered for sale at auction or, if it fails to sell at auction, afterwards:- a. Either the vendor or the purchaser shall book the transaction with the Auctioneers and the purchase money shall be payable to the Auctioneers in full. b. The Auctioneers may charge the commission which would have been payable if the lot had been sold at auction for the price obtained on the private sale, and if they exercise that right the Auctioneers may deduct the commission from the purchase money before accounting to the vendor. If the vendor fails to comply with the above provisions the Auctioneers reserve the right to charge commission based on the price at which a lot was withdrawn from auction or any reserve price set. REGULATIONS & CONDITIONS OF SALE 1. The bidding to be regulated by the Auctioneers, if any dispute arises the lot in dispute may at the discretion of the Auctioneers be put up again and re-sold. No person shall retract the bidding. 2. All lots to be paid for at the close of sale and to be at the risk and expense of the purchaser from the moment that they are sold. 3. Immediately after the fall of the hammer the purchaser shall give his name and address and shall remove the stock immediately after the sale with all faults and errors of description, if any. 4. All statements given in the catalogue are made at the entire responsibility of the vendors. The Auctioneers take no responsibility for the correctness of any statements made in the catalogue or given verbally at the time of sale. The Auctioneers shall be under no liability either to the vendor or purchaser in any way whatsoever,and if any dispute or claim arises between the vendor andthe purchaser that cannot be amicably settled, the remedy if any, of the vendor shall be against the purchaser or vice versa. 5. The Auctioneers shall not be responsible for any accident or injury to stock through fire or any other cause whatsoever or for any damage done by animals prior to, during or after the sale. 6. Warranty as to Breeding Ewes a. All ewes are sold as right in udder and fit to breed, except where otherwise stated. b. The vendor shall correctly describe the teeth of each lot of ewes. c. Unless otherwise stated, all ewes are warranted not to be in lamb. 7. In any case where ewes fail to comply with the above warranty, notification must be made to Auctioneers in writing within three days of the sale, after which no complaints will be entertained. 8. All ram and ram lambs will be sold as warranted capable of getting stock. In case of incapacity of any ram or ram lamb the purchaser must notify the Auctioneers in writing within three months of the date of sale after which no complaint will be entertained. If it is established that any ram or ram lamb is incapable of getting stock and such incapacity is not due to injury suffered or illness contracted since the date of sale, then the purchaser may return it at his own expense to the vendor and the vendor shall refund the purchase price in full or make a replacement with a ram or ram lamb acceptable to the purchaser. In no case shall the vendor be liable for a sum exceeding the amount for which the ram or ram lamb was sold (and any expenses awarded under the following paragraph). In the case of any dispute between the vendor and the purchaser as regards the incapacity or otherwise of any ram or ram lambs, then the vendor and the purchaser shall mutually agree upon a veterinary surgeon, or if they cannot agree the Auctioneers shall appoint a veterinary surgeon, to examine the ram or ram lamb and to declare whether or not in his opinion the ram or ram lamb is capable to getting stock, and if found to be incapable then it shall be decided whether or not its capacity is due to injury suffered, or illness contracted since the date of the sale. The veterinary surgeons decision shall be accepted as final and binding on both parties and the party at fault shall pay the veterinary surgeons fees. 9. Any reserve price must be given to the Auctioneers in writing at least one hour before the commencement of the sale. 10. Commission Ewes will be sold in pounds and commission charged at 3.5% in the pound. All Rams and Ram Lambs will be sold in pounds and commission charged at 5%. Normal tolls will be charged in addition. 11. The Auction Bidding Agreement Act 1927 is incorporated, but in the case of any inconsistency the said Act and the aforegoing Regulations and Conditions of Sale shall apply. 12. Upon failure of compliance with any of these Regulations and Conditions by public or private sales and any deficiency that may arise on such re-sale together with any expenses and charges, shall be made good to the defaulter. Warranty as to Stock Rams 59.1 VENDORS WARRANTY: The vendor warrants that any ram sold as a stock ram for the amount in paragraph (j) of the Appendix or more is capable of and effective at natural service. This warranty is a 10 week warranty. 59.2 PURCHASERS RIGHTS: If the purchaser proves a breach of warranty then the purchaser may return the ram to the vendor who shall, at the purchasers option, either replace the ram with another ram of equal value which is capabale and effective at natural service, or refund the purchase price together with such other costs and charges as the purchaser may be entitles to under these Condiitons. Notice of a claim must be supported by a veterinary surgeons certificate confirming that: A) The ram s incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of sale; and B) The purchasers breeding stock are not responsible for the ram s incapacity or ineffectiveness.
