Iowa Code Care of Animals in Commercial Facilities Iowa Code of Law Chapter 162 entitled Care of Animals in Commercial Establishments defines who must be licensed or registered with the Iowa Department of Agriculture & Land Stewardship. Definitions! Permits: Commercial breeder, dealer, or public auction that is USDA Animal Care licensed! Registrations: Pound, animal shelter, and research facility! Licenses: Boarding kennel, dealer (st), commercial kennel, pet shop, commercial breeder (st), & public auction (st)

Animal Welfare License vs. Permit According to Iowa Code, Chapter 162.2 Commercial breeder means a person, engaged in the business of breeding dogs or cats, who sells, exchanges, or leases dogs or cats in return for consideration, or who offers to do so, whether or not the animals are raised, trained, groomed, or boarded by the person. Permittee means a commercial breeder, dealer, or public auction to whom a permit is issued by the department as a federal licensee pursuant to section 162.2A. " a USDA, AC licensed facility may chose to dual-license with IDALS rather than just obtain a permit. An IDALS inspector would do an annual inspection in addition to the USDA, AC inspector.

Summary of USDA Permitted Facilities

Iowa Administrative Code of Rules! Iowa Department of Agriculture & Land Stewardship (IDALS) licensed facilities must comply with Iowa Administrative Code of Rules Chapter 21-67 Animal Care.! IDALS licensed facilities are inspected by IDALS Animal Welfare/Livestock Inspectors. Annual unannounced inspections

Commercial Establishments Monitoring Permittees According to Iowa Code, Chapter 162, IDALS may enter onto the business premises of a permittee s commercial establishment, the department must have reasonable cause to suspect that the permittee is not providing for the standard of care required for permittees under section 162.10A. Complaints

Animal Industry Bureau Website! Animal Welfare Complaint Form This form can be completed and sent to our office for complaints on IDALS or USDA licensed facilities! The complainant must provide the complainant s name and address and telephone number.

Complaints! IDALS may enter and inspect any registrant or state licensee business premises! IDALS may enter a permitted business premises to monitor providing of standard of animal care " Must have reasonable cause to suspect and must be supported by: Oral or written complaint Report filed by USDA

IDALS and USDA AC! IDALS may monitor all Iowa authorized facilities, including USDA AC licensed facilities! If lacking standard of care IDALS may cooperate with USDA AC to investigate! Investigation completed! Reports of findings IDALS and USDA AC
