Downs Bird Breeders Assoc Inc Page 3 AUCTION CONDITIONS 1. The Auction will be conducted in accordance with the Auctioneers & Agents Act. 2. Commission is to be paid to the Club at the rate of 10% up to a maximum of $50 per lot. 3. An administration fee of $5 will apply to each lot which is 'passed in', and also to each lot withdrawn from the Auction. 4. Lots presented for Auction will be accepted or rejected at the discretion of the Auction stewards. Hybrids or birds not independent of their parents will NOT be accepted. 5. Lots can be presented from 7.00 AM and MUST be in the Auction area prior to 8.15 AM. Lots presented after this time may be accepted at the discretion of the Auction stewards. 6. Lots must be presented in the display cage provided by the Club. Each cage/lot is to be presented inclusive of birds, applicable Club label attached, seed in container and with water container empty. 7. Vendors of lots which include native birds must present their Licence, for sighting, to the Auction stewards. i. The vendor must also provide a Movement Authority, duly completed, to transfer birds to Downs Bird Breeders Assoc. Inc. Centenary Heights High School Assembly Hall, Cnr South and Ramsay Streets, Toowoomba Qld. 4350. ii. The Club will supply a Movement Authority to transfer birds from the Auction venue to their destination, the cost of which will be borne by the purchaser. iii. Only birds listed on the Exempt, Controlled and Commercial Animals - Birds listings of the Nature Conservation and Other Legislation Amendment Regulation 2003 (Schedule 9) will be accepted. 8. Vendors of lots which include exotic birds must i. Supply on a DBBA Inc. approved form, information which allows lots containing exotic species to be traced back to the vendor of the lot. ii. Agree to allow DBBA Inc. to pass information provided by them in relation to lots containing exotic species to the purchaser of such lots if so requested. iii. No exotic bird species determined by the federal Department of Environment and Water as Class 1 shall be accepted for sale. Page 4 9. All care will be taken, however, the Club does not accept any responsibility in any matter relating to loss or injury of any bird. Birds remain the liability of the vendor until the fall of hammer, upon which the purchaser assumes responsibility. 10. The Club does not accept any responsibility for the condition, description or otherwise of any bird sold, and all birds are presented at the purchasers risk. 11. Passed In lots can be further negotiated throughout the day with the Club's appointed negotiator. Any sales are subject to the 'Auction Conditions' applying. Private sales are not allowed at the venue. 12. The Auction Coordinator will be the sole arbiter in any matter of dispute arising from the Auction events. 13. Only Auction Stewards are permitted to move or handle lots in the auction area. 14. Lots can be paid for and removed from the venue from 12.00 PM. Lots will passed over only on the presentation to the stewards of the appropriate receipt and Movement Authority. 15. Payment for lots purchased will be in cash. (Except sales exceeding $500 which may be paid by cheque providing satisfactory identification is produced to the cashier). 16. Purchasers of lots will be charged a "cleaning fee" of $2.50 per lot. Auction display cages always remain the property of DBBA Inc. Display cages will NOT be allowed to be removed from the Auction venue at any time. 17. Settlement for lots sold will not be available to vendors until purchasers have paid for those lots. 18. Approval to conduct this Auction has been granted by the Queensland Parks and Wildlife Service under the following conditions: i. the Auctioneer must be a licensed Fauna Dealer, ii. the Auction venue must be a registered premises, iii. suppliers of native birds must be licensed Fauna Dealers keeping birds in accordance with their Conditions of Licence, iv. native birds for sale, (other than those listed as exempt in Schedule 9, Exempt Animals - Birds), must be moved to the Auction venue under Movement Authority, v. and native birds, (other than those listed as exempt in Schedule 9, Exempt Animals - Birds) must be moved to their destination under Movement Authority.

Downs Bird Breeders Assoc Inc Page 5 Page 6 During the Auction, the auctioneer will be using different coloured cards to show the requirements needed to purchase the individual lots. They are as follows : Green Licence Exempt, no licence is required to purchase these birds and no restrictions on transactions. Yellow Controlled Birds, if you are not licensed you must not complete more than 10 transactions per year, these are indicated by (M#) in the catalogue. Pink Commercial Birds, you must be a current licence holder to purchase these birds, these are indicated by (M#) in the catalogue. Each year the Club has an unacceptable quantity of display cages NOT returned. The cost of replacements is becoming too large for the Club to continue to support. As a result, club boxes will NOT be allowed to leave the hall. (The Club is requesting buyers to bring their own carry boxes) to take their purchases home. Alternatively, inexpensive carry boxes will be available for purchase at the Auction venue. Transfer of birds into carry boxes, must be carried out by using the transfer tents provided.
