The adopter releases Atlanta Boxer Rescue, Inc. ( ABR ), from any and all liabilities, claims, costs, fees and obligations associated with the dog including without limitation any illness or other condition of the dog, and any damage, accident, or injury hereafter caused by said dog. The adopter agrees that ABR will not in any way be held responsible for the conduct of this dog after its adoption. The adopter understands that some or all of the information provided on the Adoption Agreement regarding said dog may have been received by ABR from a third party. The adopter understands that ABR does not make any representation or warranty regarding the dog or the accuracy of any such information. In addition, if the dog was found wandering or lost, the adopter acknowledges that ABR has no knowledge of the prior owner of the dog and that ABR has made every effort to locate the owner. If, at any time, the adopter desires to relinquish custody, or ABR demands its release for failure to comply with this Adoption Agreement, the adopter agrees to return said dog to ABR, making no charges of any nature for licensing, care, food or other services or items provided by the adopter. The adopter agrees to pay any reasonable attorney fees and court expenses if ABR must bring legal action against the adopter to enforce this Adoption Agreement. The adopter understands that any sum of money they have given to ABR is to be used for work in caring for this and other animals, and is not refundable except as provided in the Terms of Adoption. TERMS OF ADOPTION Return: If the dog is returned to ABR within TWO WEEKS of the above date, ABR will attempt to find another dog that better suits the family, but there will be no refund of the adoption fee or any other monies paid. A credit for a different dog will expire at SIX MONTHS past the date of adoption of the first dog. Prior to taking an adopted dog back into the rescue, the adopter should have attempted formal training with a professional trainer. After TWO WEEKS, no exchange will be made. It is the sole obligation and responsibility of the adopter to return the dog to the ABR representative of our choosing and to no other individual or rescue. If, at ANY TIME during the dog s life, the adopter is unable to keep the dog for any reason, adopter agrees to contact ABR and deliver the dog back to ABR (and not to any other person or entity) with the understanding that there will be no refund of any monies. If your adoption was based on special circumstances i.e, adopting a bonded pair of dogs, both dogs must be returned to ABR all verbal and written stipulations/agreement apply to this contract. Upon return of the dog, proof of updated vaccines and monthly heartworm medication must be provided. If the dog is returned to ABR and not current on vaccinations, ABR reserves the right to collect the fees associated with getting the dog current on vetting (rabies, distemper, current heartworm test). Heartworm Testing and Preventative: All ABR dogs are heartworm tested at intake and treated if found to be positive. The currently available heartworm tests detect the presence of an adult female heartworm. There is a possibility that a dog may have immature heartworms that are not detected on the tests. ABR makes no warranty against the presence of immature heartworms, larvae or microfilaria that were not detected at time of ABR testing, therefore it is important for dogs to stay on a heartworm prevention that continues to kill immature worms. Adopted dog must have a documented heartworm test at adopter s personal vet, and a 12 month supply of heartworm preventative must be purchased to go with the negative test within 10 days of adoption. Adopter must purchase heartworm preventative from a licensed veterinarian who can extend the manufacturer s warranty on dispensed heartworm preventative. An ABR representative will follow up to make sure ensure this is completed at the two week mark. after the 10 day period. HEARTWORM NEGATIVE DOGS: If adopted dog previously labeled as heartworm negative shows a positive result on a heartworm test within ten days of adoption, ABR will cover the expense of heartworm treatment according to its established treatment plan with an ABR approved veterinarian. Adopter will be responsible for any expenses beyond the approved treatment medications, which are limited to diroban, immiticide, doxycycline, gabapentin and/or prednisone. Adopter will assume all responsibility for following the established recovery protocol and for any subsequent problems caused by noncompliance by the adopter or the dog. After 10 days from the adoption date, ABR assumes no liability or responsibilty for any subsequent illness, treatment or medication surrounding heartworm status. HEARTWORM POSITIVE DOGS: If adopted dog has been treated for heartworms by ABR, the adopter is responsible for obtaining a new heartworm test six months after treatment. If dog continues to be found positive after six months and adopter can provide receipts showing purchase of heartworm preventative from an established local veterinary practice, Treatment will be redone
by Paces Ferry Veterinary Clinic at no charge to the adopter. Adopter will be responsible for any expenses beyond the approved treatment medications, which are limited to diroban, immiticide, doxycycline and/or prednisone. Adopter will assume all responsibility for following the established recovery protocol and for any subsequent problems caused by noncompliance by the adopter or the dog. If no heartworm medication is purchased within 10 days of adoption, ABR assumes no liabilty or responsibility for any subsequent illness, treatment or medication surrounding heartworm status. ABR will not be responsible for any medical concerns once a dog is adopted from our rescue. Transfer of Ownership: The dog may not be transferred to any other person for any reason without ABR s written consent. If the undersigned adopter is forced to relinquish custody of the dog at anytime for any reason, said dog will be relinquished only to ABR. In addition to its other rights and remedies, ABR shall be entitled to collect from adopter a $200 fee if adopter breaches this Adoption Agreement by transferring ownership of the dog in violation of this section. In the event of the death of the adopter, ABR must be notified of the legal guardian of the dog. ABR may revoke the adoption and reclaim the dog if the guardian does not demonstrate to ABR that the guardian meets all requirements for adoption and ownership, including without limitation a home visit by ABR. Reimbursement: There will be no refund or reimbursement for any expenses incurred by the adopter for the above-designated dog for any reason, even if returned to ABR. Acclimation to New Home: ABR has reviewed the Bringing Home Your Rescue with you and recommends a two week decompression period with your new pet. This is a crucial time for him/her to bond with your family and get to know one another. Please try and avoid new house guests (2 and 4 legged) and outings in the first two weeks. As a foster dog, your pet was not introduced to dog parks or doggy day care as it is a liability to the rescue and it is NOT recommended until your new family member has fully settled in and you can read your dogs body language to tell if it is uncomfortable in these situations. Health Program: The following health programs and actions at a minimum must be provided and maintained by the adopter: Maintain a safe and caring environment free from physical or emotional abuse and/or neglect. ABR does not condone the use of pinch, prong or shock collars. If an electric fence is used, it must be installed by a licensed professional who will educate on how to properly use. The dog will be cared for humanely, including a high-quality brand food (not a grocery store brand), shelter, water and veterinary care and will be properly licensed in accordance with the laws in the jurisdiction in which the dog resides with the adopter. Updated boosters (for young dogs) or yearly vaccinations or Titers (tests of antibody levels in the blood to determine how much immunity the dog carries against a specific disease), as recommended by your veterinarian.
Monthly heartworm preventative and annual heartworm test Flea and tick control Provide veterinary care if the pet is sick or injured. The dog is to be an inside companion and be exercised in a fenced area or on a leash and is NOT to be free to roam, nor will the dog be physically restrained to any inanimate object (trees, cable run, etc.) Keep an ID tag on collar (ON DOG) at all times Proper care when traveling out of town Clean and comfortable living areas indoors Clean water at all times available to the dog Food: minimum twice a day for adults, three times a day for puppies Maintain an active microchip and keep contact information updated LOSS: If the dog is lost or stolen, the adopter will notify ABR immediately. By maintaining the microchip tag on the animal, which is a requirement of this agreement, ABR may be notified that the dog has been found and will assist in returning the dog to the adopter, therefore it is imperative that updated contact info be provided to ABR. It is also a requirement of this agreement that ABR be kept as a second contact through the microchip company. Adopter agrees to comply with all state and local laws and ordinances relating to the keeping of said dog, including licensing and leash laws. The Adoption Application you completed online, over the phone, fax or submitted in person is part of this Adoption Agreement. If any of the information on that form is found out to be submitted falsely, ABR has the right to reclaim said animal immediately at no expense to ABR. Adopter is to reimburse ABR for all expenses, costs and fees.
Reservation of Rights: ABR reserves the right to enforce this agreement in order to protect the welfare of the dog. It is understood that ABR may examine and may make inquiry about said dog at any time. If the terms and conditions of this Agreement are not upheld, ABR reserves the right to terminate this Agreement and to reclaim the dog. This shall include but is not limited to: Being left in an unsanitary or unsafe environment; mental or physical cruelty; leaving the dog in a car during warm weather; tying up outside while gone; riding in the back of a pickup truck without being secured with the proper tie and harness; failure to provide proper nutrition, housing, training and/or veterinary treatment. Adopter gives permission for agents of ABR to visit the premises where said dog is kept and to remove said dog from the premises if it is deemed that said dog is not receiving proper care, or if there has been a violation of this Adoption Agreement. Such entry shall not constitute trespass upon the premises occupied or, theft of property or any other unlawful conduct by ABR. PAYMENT: Adoption fees are to be paid by cash or via an electronic funds transfer system such as Paypal. If an electronic funds transfer system is used, a fee may be assessed. Additional comments: I hereby acknowledge that I have read and understand this Adoption Agreement and agree to abide by all of the rules and regulations set forth within this document.
