Mr. Cropper asked Mr. Ball if the information on the exhibit was accurate. Mr. Ball answered Yes, the number of tables are correct as we are not changing anything. Mr. Cropper asked if the hours of operation will be from 4:00 p.m. 0:00 p.m. on weekdays and from 2:00 p.m. 0:00 p.m. on weekends. Mr. Ball responded Yes. Mr. Cropper asked how many employees do they expect to have. Mr. and Mrs. Ball both answered between 0-2 employees. Mr. Cropper asked if it is true that since opening in 203, the Café Mirage has not had any violations. Mr. and Mrs. Ball answered Correct. There were no questions from the Board. Mrs. Christian stated that she has recently relocated here and will work at the sushi restaurant. Mr. Cropper asked Mr. Christian to tell the Board about the restaurant. Mr. Cropper asked Mr. Christian if it is true to say that the restaurant will be,000 square feet with over 70 seats. Mr. Christian responded Yes, that is correct. Mr. Cropper asked the applicants how many employees they will hire. Mr. Christian responded Between 0-5. Mrs. Christian added that We both will hire staff. Mr. Cropper asked the applicants about entertainment. Mr. Christian stated that they would like to have background music and TVs but no live entertainment. Mr. Cropper asked if it is correct that they do not request off sale privileges. Mr. Christian answered Yes, that is correct. Mr. Cropper asked the applicants how many hours they will be at the restaurant. Mrs. Christian answered that she will be there A lot, many hours. Mr. Christian responded About 40 hours a week. Mr. Cropper asked the applicants if they agree that the license is essential to the opening of the restaurant. Both applicants responded Yes.

MINUTES FOR NORI SUSHI BAR & GRILL Commissioner Cropper asked if they will have any games. Mr. Christian answered No. Commissioner Pusey asked where the location of the bar is at the restaurant. Mr. Christian answered that the bar is location in the front of the restaurant. Mr. Cropper stated that the existing bar is small and noted that Mr. Cook s report has a total of 2 seats at the bar. Mr. Coates stated that the Lease is in order. Commissioner Pusey asked the applicants about their experience serving alcohol. Mrs. Christian answered that she has worked in restaurants as a server and as a hostess. Mr. Christian answered that his father had owned a restaurant and that he has worked there since he was 6. Commissioner Pusey stated that monitoring alcoholic is a serious responsibility. Mrs. Christian responded that they take it seriously and both she and her husband will be TAM certified along with her son, who will be the manager and her daughter who works at Fagers Island. Continuing, Mrs. Christian stated that we will all be certified as the four of us are going this week. Commissioner Nichols stated that certification is a requirement of the License. Both Mr. and Mrs. Christian shook their heads and responded Yes, we understand. Mrs. Christian added that they want everyone to be TAM certified. Continuing, Mr. Cropper asked Mr. Johnson if he understands his responsibilities as the Resident Agent and if he accepts the responsibilities. Mr. Johnson responded Yes. Mr. Cropper added that Dr. Masone did not qualify as the Resident Agent. Mr. Cropper asked Mr. Berardinelli if it is correct to say that he will be the manager and he will be the one responsible for the hiring and firing or employees. Mr. Berardinelli answered Correct. Mr. Cropper asked Mr. Berardinelli the hours of operation and the number of employees. Mr. Berardinelli answered 7:00 a.m. to 0:00 p.m. and we anticipate about 5 employees. Mr. Cropper asked Mr. Berardinelli if they will be open year round. Mr. Berardinelli answered that they will be open all year long and staff will be adjusted accordingly. Mr. Cropper asked Mr. Berardinelli for a copy of the Site Plan. Mr. Berardinelli did not have a copy; however, Ms. Payne gave the Board a copy of the Site Plan. Mr. Cropper submitted (Applicant s Exhibit #), Site Plan, into evidence. Mr. Cropper asked Mr. Berardinelli if the exhibit was accurate. Mr. Berardinelli responded Correct. Mr. Cropper asked Mr. Berardinelli if it is correct to say that the exhibit depicts 70 seats. Mr. Berardinelli responded Correct. Continuing, Mr. Cropper asked Mr. Berardinelli if it is correct to say that they are not requesting

Mr. Berardinelli quickly responded No Sir, no games. Mr. Cropper asked about the menu. Mr. Berardinelli answered that they will serve traditional breakfast items, lunch and dinner with pizza and side plate items along with salads. Mr. Cropper asked if the name will be Squarz Pizza 2 and Mr. Berardinelli responded that it is possible that it will be another name adding that they will know within the next week. Mr. Cropper stated that for this proceeding the name will be Squarz Pizza 2 and if the name changes to Toast Café he will immediately inform the Board. Mr. Cropper asked if the sole investor was Dr. Masone. Mr. Johnson responded Correct. Commissioner Cropper asked if they are requesting carry out. Mr. Cropper responded No, no carry out. Mr. Coates stated that the Lease is in order. Commissioner Pusey asked Mr. Berardinelli about his experience. Mr. Berardinelli responded that he was the General Manager of the ABC store in Delaware and is experienced in checking IDs. Commissioner Pusey asked if he had ever had a violation. Mr. Berardinelli answered No. Mr. Cropper asked Mr. Johnson about his Touch of Italy experience. Mr. Johnson stated that he has worked in restaurants most of his life as a server and bartender but not as a manager. Commissioner Pusey stated that as the Resident Agent, Mr. Johnson, will be the one brought before the Board should a violation occur. Mr. Johnson responded Yes, I understand as I am a retired police officer. Mr. Cascino stated that he will be the manager and hold 9% interest. Continuing, Mr. Cascino stated that he has been a resident of Worcester County all his life and has worked in several local restaurants including the Blacksmith, located in Berlin, as the most recent place of employment. Mr. Cascino has been TAM certified for the last 0 years and has never had a violation. Mr. Cropper asked both applicants if they had ever held a License and both answered No. Mr. Cropper asked the applicants about the hours of operation. Mr. Cascino stated that they will be open on a seasonal basis from Easter through Thanksgiving from :00 a.m. midnight, seven days a week. Mr. Cropper submitted (Applicant s Exhibit #), Menu, into evidence. Mr. Cropper asked the applicants to tell the Board about the exhibit. Mr. Cascino stated that the menu was an old menu but they do not anticipate any changes. Mr. Cropper submitted (Applicant s Exhibit #2), Site Plan, into evidence. Referring to the exhibit, Mr. Cropper asked the applicants if it is correct to say that they have 26 seats inside and 2 seats at the bar. Mr. Cascino responded Yes, that is correct. Continuing, Mr. Cascino stated that the premises is an L shape Plan with the left hand side for outside seating. Mr. Cropper asked how the area will be

Mr. Cascino responded that it is fenced in and has signage with two means to access the area; one is the entrance and the other is the Handicap ramp. Mr. Cropper asked if patrons will be monitored. Mr. Cascino responded that staff will monitor and no one will enter the area or leave the area with alcoholic beverages. Mr. Cook gave his phone to the Board to review the photos of the subject property. The Board noted that the ownership percentages on the application were different on the application. Mr. Cropper apologized to the Board and revised the application to reflect the correct percentages of ownership. The Board accepted the revised application. Mr. Cropper asked that a copy of the Resolution be sent to him. Mrs. Payne stated that she will forward a copy to his attention. Mr. Coates stated that Mr. and Mrs. Sebastian will need to file separate tax returns. Mr. Cropper concurred. Commissioner Cropper asked why Mrs. Sebastain, who owns interest in the corporation, is not here. Mr. Cropper answered that Mrs. Sebastian is an investor and that the applicants in attendance hold the responsibility of the License as they are the applicants and Mrs. Sebastian is just an investor. Mr. Coates added That is correct. Commissioner Pusey thanked Mr. Cook for the photos on his phone and stated that they were very helpful. Commissioner Pusey asked what was the distance from the flower garden to the street. Mrs. Henry projected an aerial view of the premises. Commissioner Nichols referred to the map and noted that the distance, as calculated by Mrs. Henry, was 0 feet from the flower garden to Philadelphia Avenue. Mr. Coates asked if the premises is the same as previously licensed. Mr. Cropper responded Yes. Mrs. Henry showed the Board a front view of the premises on the map which depicted the elevation of the front deck of the premises.
