TOWN OF COCHRANE BYLAW NO. 1/96 Being a bylaw of the Town of Cochrane in the Province of Alberta, Canada, to provide for the management and regulation of the Cochrane Cemetery. WHEREAS: AND WHEREAS: The Council of the Town of Cochrane wishes to regulate and control the operation of the Cochrane Cemetery; The Cemeteries Act, Revised Statutes of Alberta 1980, Chapter C-2, and amendments thereto, authorizes Council to regulate and control the operation of a cemetery; NOW THEREFORE: THE MUNICIPAL COUNCIL OF THE TOWN OF COCHRANE, IN THE PROVINCE OF ALBERTA, DULY ASSEMBLED, HEREBY ENACTS AS FOLLOWS: 1. INTRODUCTION 1.1 The Cemetery is owned by the Corporation of the Town of Cochrane. 1.2 The Cochrane Cemetery is an interdenominational cemetery. 1.3 The Cochrane Cemetery is a perpetual care cemetery located at SE 1/4 10-26-4, W5M. 2. OFFICE 2.1 The Cochrane Cemetery office is located at the Town of Cochrane Administration building, 220-2nd Street West, Cochrane, Alberta, at which all records relating to the operation of the cemetery shall be kept and to which all inquiries may be directed.

OFFICIALS 3.1 The Chief Administrative Officer/Director of Corporate Services for the Town of Cochrane shall be responsible for the enforcement of this bylaw as it relates to sales, certificates of ownership, arrangements for interments and all general relations with the public. 3.2 The Director of Operational Services shall be responsible for the enforcement of this bylaw as it relates to improvements, care and maintenance, operation and supervision of the cemetery, the lots therein and the conduct of interments. 4. PLANS 4.1 The Town shall keep available for public inspection during regular offices hours, a copy of the cemetery plan which shall show the area for burial purposes subdivided into Blocks, Plots and Grave Lots. The Grave Lots shall be not less than five feet in width and ten feet in length. The Blocks, Plots and Grave Lots shall be numbered in a manner so that each grave lot may be properly located and identified. 5. SALE OF LOTS 5.1 Council is hereby authorized to adopt by resolution the tariffs and charges to be made for the purchase of grave lot(s) and opening and closing of the grave lots in the Cochrane Cemetery, as deemed necessary from time to time. 5.2 The cost of a grave lot includes perpetual upkeep of the lot but does not include the placement, maintenance or removal of grave markers. 5.3 Lots in the cemetery shall be used only for the burial of human remains.

Bylaw No. 1/96 - Cemetery Bylaw Page 3 5.4 All lots shall be held and disposed of free from the provisions of the Land Titles Act. 5.5 A grave site may be pre-purchased however choice of location of a pre-purchased site will not be permitted. At the time a pre-purchased site is required for interment the next available site shall be utilized. Pre-purchase of lots includes lot and perpetual care but not opening and closing fees which may only be paid at the time of need. 5.6 The Town will provide to the purchaser a receipt which shall clearly state the name and address of the person to be interred, description of the type of site purchased and the total consideration paid. 5.7 Pre-purchased lots may be sold back to the Town of Cochrane only; at the original purchased amount. 5.8 The sale of grave lots and opening and closing fees shall be determined and amended from time to time by Cochrane Town Council. 6. INTERMENT AND DISINTERMENTS 6.1 All graves will be prepared on the basis of recognized health and engineering requirements and soil conditions, so as to ensure safety and the prevention of health hazards at all times. 6.2 All burials will involve the use of a casket and grave liner. 6.3 The grave lots will hold a maximum of two stacked caskets and grave liners or, in the case of cremation, a maximum of six urns containing ashes. 6.4 The Town does not assume responsibility for the preparation of a grave for a funeral unless at least 48 hours notice is given.

Bylaw No. 1/96 - Cemetery Bylaw Page 4 6.5 No interment or disinterment shall take place on a Sunday or Statutory Holiday, unless: (a) (b) burial is necessary to comply with Public Health Regulations governing communicable diseases, or other special circumstances which, in the opinion of the Town, warrants departure from this regulation. 6.6 Funerals shall be conducted at the cemetery between the hours of 8:30 a.m. and 4:30 p.m., unless permission has been obtained from the Town. 6.7 Funeral corteges shall follow the route indicated by the Town and the Town has the authority to restrict the number, and kind, of vehicles that may enter the cemetery, and the roadways that may be used. 6.8 No remains shall be disinterred from any grave without a written order from the owner of such grave and a permit for disinterment from the Director of Vital statistics. 7. CARE OF LOTS 7.1 The Town of Cochrane is responsible for the complete care and maintenance of the Cemetery and of all lots whether disposed of or not and individual planting or landscaping is expressly forbidden. 7.2 In the interest of overall appearance of the Cemetery, no person shall, without the permission of the Town of Cochrane: (a) (b) (c) cultivate, plant, seed, pick, remove, break or alter any trees, shrubs, flowers, plant or other objects; cut any sod, move or install corner posts or markers, or perform work of any kind. flowers will be permitted, and will be removed at the discretion of the Town.

Bylaw No. 1/96 - Cemetery Bylaw Page 5 7.3 The Town of Cochrane is not responsible for the loss or damage to any marker, flower holder or any portable object placed on any lot(s). 7.4 No lot shall be covered by a slab of cement or other similar materials. 7.5 No lot shall be surrounded by fencing of any kind. 7.6 The Town of Cochrane may accept unconditional donations only; which will be used for the purpose of cemetery operation. Funds will be placed in a special designated cemetery fund. 8. MEMORIAL MARKERS 8.1 All memorial markers shall be of first quality statutory bronze. The town may designate specification for acceptable markers. 8.2 Two markers are allowed per grave lot. 8.3 One marker per Cremain lot 8.4 The size of the marker shall be no larger than twenty-four inches by eighteen inches and not smaller than twenty-four inches by twelve inches. 8.5 All markers shall be mounted securely on a suitable concrete base at least six (6) inches thick showing a smooth surface two (2) inches wide around the bronze marker. 8.6 All markers must be placed flush with the surrounding grade. 8.7 Grave lots: Adult are 5' x 10', Cremain are 2' x 3'.

VISITATION 9.1 The public may visit the Cemetery at any time between 8:30 a.m. and sunset. 9.2 Children under the age of 12 years must be accompanied by an adult who shall be responsible for their good conduct and for seeing that they do not run over the graves and lots. 9.3 Cars and other vehicles shall be driven with care and shall be restricted to the driveways and the maximum speed limit of 15 miles per hour. 9.4 No dogs or other animals shall be allowed. 9.5 Any person who disturbs the quiet and good order of the Cemetery by noise or improper conduct, or who violates any provision of these regulations may be expelled from the Cemetery. 10. TARIFF OF RATES 10.1 The Town of Cochrane shall make available to the general public during normal office hours a tariff of rates for the following: (a) (b) (c) (d) Prices of grave lots which shall include the cost of perpetual care and administration fees. Charges for opening and closing a grave lot for casket. Charges for opening and closing a grave lot for urn. Reinterment and disinterment charges.
