THE CORPORATION OF THE TOWN OF WHITCHURCH-STOUFFVILLE BY-LAW NUMBER 71-76 A By-law for licencing and requlrlng the registration of dogs and for the control of dogs within the Municipality of the Town of Whitchurch-Stouffville. WHEREAS The Corporation of the Town of Whitchurch-Stouffville has pursuant to The Municipal Act, Section 354 1), and Part 1 of The Dog Tax and Live Stock and Poultry Protection Act, authority to enact this By-law: NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF WHITCHURCH-STOUFFVILLE ENACTS AS FOLLOWS: 1. In this by-law, rl I a) b) c) d) "Dog" means a male or female dog, over the age of 12 weeks; "Owner" of a dog includes a person who possesses or harbours a dog and "owns" and "owned" have a corresponding meaning; "Pure-bred" means, i) registered or eligible for registration in the register of The Canadian Kennel Club, Incorporated, or ii) of a class designated as pure-bred in the regulations made pursuant to The Dog Tax and Live Stock Protection Act. "Animal Control Officer" includes the person or Association who has entered into a contract with The Corporation of the Town of Whitchurch-Stouffville to control dogs and to maintain a dog pound and any servants or agents of such person. 2. Subject to Section 7 hereof every owner of a dog shall, on or before the 15th day of February in each year, or upon 1, becoming the owner of a dog after the 15th day of February, in any year, register such dog with The Corporation of the Town of Whitchurch-Stouffville and procure a licence and dog tag for each dog owned by him.
- 2-3 _ Upon application for a licence the owner shall produce a '"' certificate signed by a practising veterinarian that the dog has been inoculated with an anti-rabies vaccine within a period of twenty-four months of the date of application for the licence. 4. a) Every dog tag shall bear the serial number and the year in which it was issued and a record shall be j' I ;-, kept by the Town of Whitchurch-Stouffville showing the name and address of the owner and the serial number of the tag. b) The owner shall keep the dog tag securely fixed on. " \{,,x I\. 5. 6. the dog for which it was issued at all times and shall not use said tag in respect to any other dog. The fee charged for the replacement of lost dog tags shall be 25 cents. Every licence issued pursuant to this by-law shall expire on the 31st day of December of the year in respect of which it was issued and the licence fee to be paid to The Corporation of the Town of Whitchurch-Stouffville at the ; -1 f\' time of the issuing of the licence shall be as follows for each dog: for a male dog, if only one is kept $ 3.00 for each additional male dog $ 6.00 for a female dog, if only one is kept $ 5.00 for each additional female dog Where a certificate in writing by a Veterinary $10.00 Surgeon or a receipt from a previous year is produced indicating that a female dog has been spayed, such female dog shall be taxed at the same rate as a male dog. 7. The owner of a kennel of dogs that are pure-bred shall pay.r an annual tax of twenty-five dollars $25.00) upon the kennel to The Corporation of The Town of Whitchurch Stouffville and such owner is not liable to pay any licence fee imposed pursuant to Section 6 hereof. /t. 8. i) No owner of a dog shall allow the dog to run at large within the limits of The Municipality of the Town of
- 3 - Whitchurch-Stouffville;. t, I 9. 10. ii) For purposes of this section a dog shall be deemed to be running at large when found on a highway or other public place and not under the control of any person. iii) No owner of a dog shall allow the dogto howl or bark excessively or otherwise become a nuisance. Every person who contravenes sections 1 to 8 of this by-law is guilty of an offence and is liable upon Summary Conviction to a fine not exceeding $50.00, exclusive of costs and every such fine is recoverable under The Summary Convictions Act. a) Subject to sub-paragraph iv) of paragraph e) of this clause, a peace officer or animal control officer may: i) seize and impound any dog found running at large; and ii) restore possession of the dog to the owner thereof where the owner claims possession of the dog within five days exclusive of statutory holidays and Sundays) after the date of seizure.. b) The owner shall pay to the Municipality a pound fee of five dollars $5.00) for a dog seized and impounded plus a maintenance sum of two dollars $2.00) for each day subsequent to the day of seizure that the dog remains impounded. 'U t c) Any female dog found to be running at large in heat may be held at the pound until no longer in heat, but in any case no longer than 21 days. d) Where a dog is impounded, the owner, if known, and whether the dog is claimed from the pound or not, shall be liable for the pound and maintenance fees prescribed and shall pay all fees on demand. e) i) No dog shall be returned to the owner unless it has been licensed in accordance with the provisions of this by-law and any owner of a dog without a licence or a dog tag and any purchaser of a dog without a licence or a dog tag shall obtain a licence and a dog tag for the current year before delivery is made.
- 4 - e) ii) Where, at the end of the said five days, It possession of the dog has not been restored to the owner under sub-paragraph a) of this clause, the dog may be sold for such price as the control officer deems reasonable. iii) Where the owner of a dog has not claimed the dog within five days after its seizure under subparagraph a) of this clause and the dog has not been sold, such dog may be destroyed in a humane manner or otherwise disposed of and no damages y or compensations shall be recovered on account of its disposition. iv) Where a dog seized as provided under this by-law is injured or should be destroyed without delay for humane reasons, or for the safety of persons or animals, the dog may be destroyed in a humane manner as soon as it is deemed expedient after seizure, without permitting the owner or any person to reclaim the dog or without offering it for sale and no damages or compensation shall be recovered on account of its disposal. 11. Any summons issued pursuant to The Summary Convictions Act i f /1- /' for the contravention of any provision of this by-law may be endorsed with a notice that the person to whom the Summons is directed may payout of court a penalty of $10.00 and ln such case the summons shall provide for a plea of guilty as provided in The Summary Convictions Act. 12. This by-law shall come into full force and effect on the final passing thereof with the following exception: i) Clause 3 shall not come into full force and effect until January 1st, 1973. 13. By-law Number 71-19 is hereby repealed. 14. In the event of conflict between the provisions of this by-law and any other by-law presently in force in the area J f f.'
