Rules and Regulations The goal of Aunt Lyn s is to provide a safe, fun and stimulating social and educational environment for your dog(s). To ensure the safety and health of persons and pets, we require compliance with the following Rules and Regulations, which are subject to change from time to time without notice. PARTICIPATION IN THE PROGRAM: Aunt Lyn s reserves the right to refuse service to any dog for any reason. AGE: All dogs must be three (3) months of age or older, and must be spayed or neutered if older than six (6) months. In special circumstances this requirement may be waived. Please call to discuss. DROP-OFF AND PICK-UP TIMES: drop-offs and pick-ups must be pre-arranged and approved via phone call, as pets may be out for a walk, a drive, in training, at play, etc. All dogs, but especially the pups, can get overly excited/distracted (barking, excitement peeing ) when one is being pick up/dropped off. So it is important that I get them, as well as your dog ready. THX Day Care Drop-off 7:00am and 9:00am Pick up 4:00pm and can vary depending on your daycare day but no later than 7pm (Pick-ups after 7:00pm will incur the full overnight charge fee.) Vacation Drop-off - 7:00am and Noon Weekday Pick up 7:00 am and 7 pm must be scheduled Weekend Pick up Prior to Noon VACCINATIONS: All dogs must have up-to-date vaccinations. Owners must provide written proof that their dogs have received DHPP (Distemper, Hepatitis, Para-influenza, and Parvovirus) within the last year and the Kennel Cough (Bordetella) vaccine within the past six (6) months. Rabies must also be current as required by local law. HEALTH: All dogs must be in good health. Owners will verify that their dogs are in good health and have not been ill with a communicable condition in the last thirty (30) days. On admission, all dogs must be free from any conditions, which could potentially jeopardize other persons or pets. All dogs will require a veterinarian certification of health to be admitted or readmitted after any illness. FLEAS AND TICKS: All dogs will be free from any conditions, which could potentially jeopardize other persons, pets, or property. Dogs found to have fleas or ticks will be treated. Owner will be charged for the cost of the treatment in accordance with the then current Fee Schedule, as well as any additional charges required to treat other animals or property that have been infested as a result of Owner s dog s condition. BEHAVIOR: All dogs must be non-aggressive, not object or food possessive towards humans and other dogs. Owners hereby certify that their dogs have not harmed or shown any aggressive or threatening behavior towards any person or other dogs. Please remember that your pet will be spending time with other persons and pets and that their safety and health is our main concern. What To Bring Required Items: The following items are required at the time you drop-off your dog. Visit our website for frequently Asked Q n A Food (only if staying for meals) Dog s may experience stomach upset if their diets are changed. Therefore, we require that you bring an adequate supply of your dog s usual food at drop-off. Food should be either in a container, bag, or properly portioned in individual zip-lock bags, all individually labeled with your dog s name. Medication - Please clearly label medications and include written instructions with your dog s name, type of medication, dosage and schedule. Please alert Aunt Lyn s in advance if you know your dog will require medication. When multiple medications are to be administered, please combine daily doses with the dog s food in individual clearly marked and labeled zip lock bags. Aunt Lyn s reserves the right to refuse a dog for services if your dog is taking medication for a communicable illness. Daycare Dogs Only below Collars Two collars are required; one for play and one for walking. If you do not have these collars, Aunt Lyn s will supply them for a fee (refer to Fee Schedule). For Play Quick Release Collars - This helps ensure a safe environment. For Walking In addition to the Quick Release collar, one of the following is required: Martingale Collar (preferred for small dogs), Pinch collar (preferred for medium/large dogs) This collars are used for walking purposes. They stop pulling and help teach good walking habits without causing stress to the pets neck or trachea. These collars encourage pets to correct themselves, and they have built in safety stops to prevent choking. An alternative to Martingale and Pinch collars is a Halti Collar. The Halti, while not preferred, would be acceptable. Under no circumstances will we use or accept Choke collars. Dogs can choke and excessive use can cause tracheal damage. Standard Leash (e.g., non extension or overly long) this helps ensure a safe environment. If you do not have a standard leash, Aunt Lyn s will supply one for a fee (refer to Fee Schedule). Nice To Haves for Overnight: You are not required to bring the following items from home, but they may help your dog(s) adjust more quickly and make their new surroundings feel more like home : Favorite Blanket and/or one (1) Favorite Toys Other Tips and Information: While owners may want to stay and watch the dogs play, it is a distraction to the dogs and disrupts the training schedule and any bad behavior/possessiveness they exhibit with you will be displayed while you are around. We therefore, respectfully request that you leave soon after dropping off your dog. All items brought from home should be clearly labeled with your dog s name.

Waiver and Release This Waiver and Release is between (hereinafter referred to as Aunt Lyn s ) and the pet owner whose name appears below (hereinafter called Owner ). ASSUMPTION OF LIABILITY Aunt Lyn s, and all owners who trust us with the care of their dogs, rely on Owner s honesty and full disclosure of any and all past and current health, behavior, safety or other factors that may affect Owner s dog s eligibility for daycare or boarding. Failure to fully disclose any issue past, current, or future may spread disease and infestations or cause injury to dogs, employees and other persons and pets. Even if the information that Owner provided on the various forms submitted to Aunt Lyn s is complete and true to the best of Owner s knowledge, dogs often respond differently to new people, dogs, situations and environments. By signing this Waiver and Release, Owner assumes full responsibility for Owner s dog s behavior and assumes full responsibility to Aunt Lyn s and Aunt Lyn s employees, agents and other dog owners for all damages and injuries to property, dogs and persons caused by Owner s dog(s), even if there is alleged or actual negligence by Aunt Lyn s. INDEMNIFICATION OF AUNT LYN S Owner hereby agrees to indemnify, defend and hold Aunt Lyn s harmless from and against any and all claims, actions, causes of action, losses, damages, liabilities, costs, judgments, and attorney s fees to which Aunt Lyn s may become subject to, relating to or arising out of Owner s dog s presence at Aunt Lyn s or caused by Owner s dog(s). ASSUMPTION OF RISK As a dog owner, Owner understands and acknowledges that there is an inherent risk of accident or injury to Owner s dog(s), other dogs or persons as a result of and associated with group dog play. Owner understand that, even in the most controlled and well-supervised circumstance, there may be incidents and unpredictable behavior that could result in injury to Owner s dog(s). Owner s dog(s) might contract an infection or illness from close contact with another dog. After considering these factors, Owner has decided that the risk associated with placing Owner s dog(s) in a group setting with other dogs is outweighed by the benefits of socialization, exercise, and stimulation derived by Owners dog(s) through its participation. Therefore, Owner expressly and voluntarily assume all risk of injury suffered by Owner, Owner s employees, agents, third parties and Owner s dog(s) during a stay at Aunt Lyn s, regardless of whether the harm is suffered as a result of alleged or actual negligence on the part of Aunt Lyn s, another dog or third party. WAIVER AND RELEASE Owner hereby waives all claims and releases Aunt Lyn s, its employees, agents and other dog owners from all liability to Owner s person, Owner s dog(s), Owner s employees, agents, representatives, successors and assigns for all liability, claims, damages, or demands for personal injury, death, or property damage, known or unknown, past, present, and future, arising from or related to Aunt Lyn s dog care services provided whether the illness, injury, death, or property damage occurs on or off Aunt Lyn s premises. This release includes, without limitation, any personal injury, death, or property damage caused by the active or passive negligence of any of Aunt Lyn s and Owner bears sole responsibility for any loss. Owner acknowledges that Owner has carefully read the Aunt Lyn s Agreement, associated forms, including this Waiver and Release, understand its contents, and understands that this agreement includes an assumption of the risk of Aunt Lyn s negligence and liability. Owner acknowledges that Aunt Lyn s is materially relying on this waiver and is allowing Owner s dog(s) to engage in play with other dogs and, if boarding, to stay at Aunt Lyn s. THIS IS A SPECIFIC RELEASE GIVING UP ALL RIGHTS WITH RESPECT TO THE TRANSACTIONS OR OCCURRENCES THAT ARE BEING RELEASED UNDER THIS AGREEMENT. Signed Dated:, 200

Agreement Agreement This Agreement is between (hereinafter referred to as Aunt Lyn s ) and the pet owner whose name appears below (hereinafter called Owner ). Care: Aunt Lyn s will provide daycare and other services as requested by Owner for Owner s dog(s) Screening: In order to provide a healthy, safe and fun experience, Aunt Lyn s screens all Owners and Owners dog(s) before accepting a dog into daycare or boarding. By signing this Agreement and the other forms provided by Aunt Lyn s, Owner warrants that all information is true and correct and that there are no issues which, if made known to Aunt Lyn s, would cause Aunt Lyn s to exclude Owner s dog(s) from daycare or boarding. Aunt Lyn s reserves the right to refuse service to any dog for any reason. Dog s Health: To use the facilities Owner s dog(s) must be spayed or neutered if older than six (6) months of age, and must have current Distemper, Parvo, Rabies, and Bordatella vaccinations (bordatella vaccinations are required every six (6) months). If requested to do so, Owner will provide Aunt Lyn s with copies of health and vaccination certificates verifying compliance with these requirements. Aunt Lyn s reserves the right to limit or deny usage if Owner does not provide required verification, and in such event Owner is not entitled to any refund or credit. Owner acknowledges that Owner s dog(s) will be free from any conditions, which could potentially jeopardize other persons, pets, or property. If Owner s dog(s) is found to have fleas or ticks, Aunt Lyn s will treat the condition and charge the Owner a fee in accordance with the then current Fee Schedule. Owner will also be responsible to pay any costs associated with treating other animals or property that have been infested as a result of Owner s dog s condition. Prior to drop-off, Owner will advise Aunt Lyn s of any medications that must be administered to Owner s dog(s). At Owner s request, one type of medication will be administered to Owner s dog(s) usually at no charge to Owner. Medicine must be in the original container. For administration of injections or multiple medications, Owner will be charged a fee in accordance with the then current Fee Schedule. Owner also acknowledges the risk that Owner s dog(s) may be injured or develop a cough, runny nose, sneezing, canine influenza, parasites o stomach virus amongst other ailments that may occur as a result of playing and interacting in a cage-less environment and/or exposure to other animals and persons at Aunt Lyn s. Owner hereby waives and releases Aunt Lyn s, its employees, agents, and other dog owners from any and all claims, damages, liabilities, law suits, or losses of any nature that arise or occur as a result of the aforementioned or any other ailments. Owner s Responsibilities: Owner agrees to abide by all of the Aunt Lyn s Rules & Regulations, as may be changed from time to time by Aunt Lyn s, as well as the abiding by the obligations and requirements as specified in the various forms provided by Aunt Lyn and signed by Owner. Payment for Services: Owner agrees to pay for all Aunt Lyn s services by cash, or check prior to or at drop off. Aunt Lyn s may change fees at any time by posting notice in Aunt Lyn s facility and/or on the website. In addition to any other remedies available under applicable law, returned checks will be subject to a Thirty Five Dollar ($35.00) administrative fee plus any fees charged by Aunt Lyn s bank. Photos and Publicity: Owner s dog(s) may be videotaped, photographed and recorded while they are attending Aunt Lyn s. Aunt Lyn s shall be the sole owner of all copyrights and all proceeds of tapings, photography, and recordings with the rights, throughout the world and reserves all rights to reproduce, display, distribute and use an unlimited number of times in perpetuity, license to others in any manner. Owner s dog(s) may be used in any and all media and in the promotion, advertising, sale and publicizing, and exploitation of Aunt Lyn s at no cost to Aunt Lyn s. Miscellaneous Provisions: This Agreement along with various other forms signed by Owner: (a) represents and incorporates our entire understanding and may be amended only by a signed written instrument; (b) will be binding upon and will inure to the benefit of the successors, executors, administrators, heirs, representatives and assigns of the parties; and (c) is governed by New Jersey law. Waiver of a breach of this Agreement will not operate or be construed as a waiver of any subsequent breach of the same or any other provision. If any portion of this

Agreement is determined to be invalid or unenforceable, the remainder will be enforceable to the maximum extent possible. If any legal, equitable or other action, claim, or proceeding of any kind or nature (including appeals, enforcement of judgments and collection) is brought to enforce or interpret any provision of this Agreement, then the prevailing party will be entitled to its attorneys' fees and costs, in addition to any other relief to which it may be entitled. Remedies and Agreement to Arbitrate: In no event will Owner s remedies and Aunt Lyn s liability for any damages under this Agreement exceed the amount of fees paid by Owner to Aunt Lyn s. Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any party to this Agreement, will be settled in accordance with the rules of the American Arbitration Association, and the judgment upon the reward rendered by an arbitrator may be entered in the Superior Court of New Jersey in and for Bergen County. The arbitrator may, as part of his or her judgment, allocate costs or award to the prevailing party of the costs of such arbitration and reasonable attorney s fees of the prevailing party.
