RESOLUTION LIVINGSTON COUNTY NO: DATE: REOLUTION AUTHORIZING THE PURCHSE OF A CLEAN AGENT FIRE EXTINGUISHING SYSTEM FOR THE 911 CENTRAL RADIO ROOM AND THE SHERIFF DEPARTMENT S COMPUTER ROOM AND BUDGET AMENDMENT - Building Services / General Government Committee the Building Services Department has recognized a need for adequate fire suppression in the 911 center radio room and in the Sheriff Department s computer room; and Building Services is recommending that a clean agent fire extinguishing system be installed in both locations; and Building Services has utilized the purchasing policy and has had three separate vendors bid on the projects. Building Services is recommending that Gallagher Fire Equipment Company be awarded the bid at a cost of $17,185; and Building Services will be paying for the projects using line 631-269- 819.000 and will reimbursed by 911 in the amount of $9,807 through line 636-346-977.000, and by the I.T. Department in the amount of $7,378 through line 636-258-747.000; and the proposed budget amendment ensures compliance with the Uniform Budgeting and Accounting Act, as amended; and a budget amendment to the Building Services Department fiscal-year 2008 budget in an amount not to exceed $17,185 for the above purchase. THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners hereby authorizes a purchase order for the installation of a clean agent fire extinguishing system at the 911 center radio room and the Sheriff Department s computer room installed by Gallagher Fire Equipment Company at a cost not to exceed $17,185.

RESOLUTION LIVINGSTON COUNTY NO: DATE: ----------------------------------------------------------------------------------------------------- RESOLUTION TO CREATE A POLICY PROHIBITING THE ADOPTION OR PLACEMENT OF PIT BULL TERRIERS, AMERICAN PIT BULL TERRIERS, AMERICAN STAFFORSHIRE TERRIERS, AMERICAN BULLDOGS, MIXES, OR ANY KNOWN AGGRESSIVE ANIMALS - ANIMAL CONTROL DEPARTMENT / GENERAL GOVERNMENT COMMITTEE the Animal Control Department has established a need to implement a policy to ensure the health and safety of its citizens; and the term Pit Bull refers to the Pit Bull Terrier, American Pit Bull Terrier, American Staffordshire Terrier, American bulldog and mixes and will be referred to as Bully breeds ; and the term aggression refers to observed or historical behavior that makes an animal a danger to the health and safety of people or other animal; and the bully breeds have been known to cause harm, create destruction and in some cases have caused death; and the prevalence of breeding for negative purposes of bully breeds has led to strong concerns about aggression against people and animals; and no bully breed or known aggressive animal will be made available for adoption or placement from Livingston County Animal Control; and any stray bully breed or aggressive animal that is brought to the animal shelter as a stray will be held for the State mandated holding period; and the State mandated holding period is four days with no collar, license, MDA tattoo or other evidence of ownership; or seven days with evidence of ownership; and after the State mandated holding period the animal will be humanely euthanized; and

any bully breed or aggressive animal that is claimed by its owner will be returned after fees are collected and the maximum charges allowed will be submitted to the Livingston County Prosecutors office for prosecution; and the Livingston County Animal Control staff has sole discretionary authority to deem an animal to be aggressive or to be a bully breed. THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners hereby approve the following policy changes effective immediately; No Pit Bull Terrier, American Pit Bull Terrier, American Staffordshire terrier, American Bulldog, mixes (AKA Bully breeds) or any aggressive animal will be adopted or placed from Livingston County Animal Control Stray Bully breeds and aggressive animals will be held for the State mandated holding period (pending owner claim). If not claimed the animal will be humanely euthanized Owners may claim their animal, pay fees and face prosecution the Livingston County Animal Control staff has sole discretionary authority to deem an animal to be aggressive or to be a bully breed BE IT FURTHER RESOLVED that the Livingston County Clerk forward a copy of this resolution to Governor Granholm, State Senator Garcia, State Representative Hune (47 th District) and State Representative Ward (66 th District) asking them to consider strengthening the existing laws pertaining to aggressive dogs and the punishment. # # #

RESOLUTION LIVINGSTON COUNTY NO: DATE: RESOLUTION AUTHORIZING THE PURCHASE OF ANIMAL CONTROL SOFTWARE FROM RESCUE CONNECTION SOFTWARE OF INCLINE VILLAGE, NEVADA AND BUDGET AMENDMENT Information Technology / Animal Control Department / General Government Committee the Animal Control Department is hereby requesting authorization to purchase software, AC+ 7.0 from Rescue Connection of Incline Village, Nevada, to facilitate daily operations of the department; and the department has very few of their daily tasks computerized and is in need of an application to streamline the operations of their office; and several software packages were investigated and AC+ 7.0 was the only one that met their needs; and the AC+ 7.0 software will be purchased at a one-time cost of $15,000, $2,500 in additional funds are needed for the first year s training and hourly support fees; and this Resolution has been recommended for approval by the Technology Committee; and the proposed budget amendment ensures compliance with the Uniform Budgeting and Accounting Act, as amended; and there was only $12,000 budgeted within the 2008 Animal Control and IT budget; and the Animal Control Director has identified the a source of funds for the $5,500 difference within another line item within her budget; and a budget amendment within the IT budget in an amount not to exceed $5,500 is necessary to cover the cost to purchase this application. THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners hereby approves the purchase of AC+ 7.0 Software from Rescue Connection of Incline Village, Nevada at a cost of $15,000, additional training and support services at $2,500 for a total cost not to exceed $17,500.

BE IT FURTHER RESOLVED that the competitive bid process per the purchasing policy be waived. BE IT FURTHER RESOLVED that the Livingston County Board of Commissioners hereby approve and adopt the Information Technology Department Fiscal-Year 2008 amended budget as follows: Fund 2008 Amended Budget Proposed Budget Amendment Proposed 2008 Amended Budget 636 $3,481,646 $5,500 $3,487,146 The budgetary worksheets showing the line-item changes for the proposed 2008 budget amendment will be attached as part of the resolution BE IT FURTHER RESOLVED that the Chairman of the Board of Commissioners be authorized to sign any necessary documents pertaining to this matter upon review of civil counsel. # # # MOVED: SECONDED: CARRIED:
