THE CORPORATION OF THE CITY OF BRAMPTON BY-LAW Number 235-76 TO REGULATE the keeping of animals and birds; and TO RESTRICT the number of animals and birds that may be kept; and TO PROHIBIT the keeping of certain animals and birds. WHEREAS the Municipal Act R.S.O., 1970, Chapter 284, authorizes the passing of by-laws by Councils of local municipalities for regulating the keeping of animals and birds and for restricting the number of animals and birds that may be kept and for prohibiting the keeping of animals and birds; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF BRAMPTON ENACTS AS FOLLOWS:- 1. That no person shall within the City of Brampton, in the area set out in Schedule "A" attached hereto, keep any domestic fowl, cattle, goats, sheep, swine, mink, foxes, poisonous reptiles, cats other than those of the felis domestica species, except dogs (By-law 87-74). 2. No more than two rabbits may be kept on the premises of each dwelling unit within the City of Brampton, in the area set out in Schedule "A" attached hereto. (a) For the purposes of this By-law "dwelling unit" means one or more rooms connected together as a separate unit and constituting an independent housekeeping unit for residential occupancy by humans and the lands, owned or used in conjunction therewith.

No more than two (2), in total, of pigeons or poultry may be kept on the premises of each dwelling unit as defined in Paragraph 2 (a) above i'n the area set out in Schedule "A" attached hereto, and any pigeons or poultry shall be kept in a building in compliance with the following conditions:- (a) a pigeon loft or poultry coup shall be located not less than twenty-five (25) feet from any adjacent dwelling, stores, shop or apartment building, and at a distance of not less than five (5) feet from boundary or adjoining lands. (b) a pigeon loft or poultry coup shall be constructed so as to prevent the escape of the pigeons or poultry. (c) a pigeon loft or poultry coup shall be located and constructed in conformity with all relevant by-laws in force in the City of Brampton. (d) no pigeons or poultry shall be permitted to or allowed to escape from the building except in accordance with Section 4 (b). (e) All waste material shall be disposed of in a proper manner and no refuse or waste material shall be burned. 4. Notwithstanding the provisions of this by-law any person who is a registered member in good standing of a recognized club affiliated with a Provincial or Federal Association as per Column 1 of Schedule "B" may keep any number of the birds or animals designated in Column 2 of Schedule lib" for the club of which he is a member provided that such birds or animals are kept in accordance with the following provisions:-

,~ Page 3 (a) (b) Section 3 of this by-law the pigeons may be given liberty for not more than four (4) hours per day, and that the pigeons at all other times be confined to the pigeon 10ft; and provided that each club listed in Schedule lib" files with the City Clerk prior to March 31st of each year, the name and address of the President or Secretary of the club. (5) Notwithstanding any of the provisions of this by-law, any person who is a member of the Ontario Veterinary Association may in the City of Brampton, in the area set out in Schedule "A" attached hereto, keep premises for the boarding of animals or birds provided all buildings are constructed and operated in accordance with the relevant by-laws of the City and specifically the zoning and Building by-laws. (6) The Canine Control Wardens may seize and impound with the Ontario Humane Society, or any other pound or appropriate place, any animal running at large which appears to be sick or in distress. (7) The owner of any animal or bird so impounded may redeem the same upon payment of the applicable poundage fees. All animals or birds impounded shall be kept in accordance with the applicable statute. (8) If any animal or bird which has been impounded is not redeemed by the owner within the time period required by statute the Ontario Humane,0 Society, or any other authorized person, may sell the animals or birds to any other person at the same or at a greater price... (9) The Ontario Humane Society, or any other authorized person, may maintain or dispose of any animals or birds not redeemed or sold in accordance with the relevant provisions of the Revised Statutes of

The provisions of this By-law shall not apply to prevent the keeping of any animals or birds by Educational Institutions within any school building nor to prevent the keeping of animals or birds by the City Parks and Recreation Department within the- limits of Chinguacousy Park. (11) 0 Any person convicted of a breach of any of the provisions of this By-law shall forfeit and pay a penalty (not exceeding) (exclusive of costs) the sum of Three Hundred Dollars ($300.00) for each offence. Hendy Subject BY-LAW NUMBER 235-76 - A by-law to regulate the keeping of animals and birds, etc., Our File No. 37 Further to our conversation of Friday's date, this is to advise you that a recent review of the above noted by-law brought to my attention the fact that paragraph 1 of the by-law would appear to be improperly worded and it would seem that at the time the by-law was prepared, certain words were accidentally omitted from paragraph 1. I believe the paragraph should read as follows: "That no person shall within the City of Brampton, in the area set out in Schedule "A" attached hereto, keep any domestic fowl, cattle, goats, sheep, swine, mink, foxes, poisonous reptiles, cats other than those of the felis domestica species, or any other animals, except dogs (By-law 87-74) except in accordance with the provisions of this By-law." I also note in the last line of paragraph 3, sub-paragraph (a) the word "or" is used and it would appear the correct word should have been "of".
