CITY COUNCIL JUNE 10, 2015 7:00 PM Meeting was called to order by Emily Chatterton at 7:00 pm. Present: Council: Bryce Wood, Emily Chatterton, And Joyce Bayles Also present: Damon Yardley (did not sign in), John Packer, Barbara Packer, Ammon Sharp, Stella Sharp, Molly Nelson, Hudson Nelson, Chevy Nelson, Natalie Wood, Darek Kimball. Emily Chatterton welcomed everyone to this meeting and excused Mayor Todd Hawkes. Damon Yardley thanked the City for helping with his eagle project. The Council thanked him also for all the hard work and stated that it was a great project and is being used a lot. The minutes of regular city council meeting held on May 13, 2015 were read. Joyce Bayles made the motion to accept the minutes as written. Bryce Wood seconded. Unanimous. The May bills were reviewed. Bryce Wood made the motion to pay the bills. Joyce Bayles seconded. Unanimous. Business License Kathryn Eavenson Potato Bug Photography: canceled because she had to work and will try next month. Hudson Nelson Eagle Scout Project: Stated that he wanted to make a welcome sign that would be on the North end of Franklin. Kelly Spackman has given permission to put it on his parking lot property. The sign will be eight feet tall, four feet wide, and seven feet long. It will be pressure treated wood with metal lettering. He will probably have it done the middle of August. It will say Welcome to Franklin, est. 1860. Emily Chatterton stated that the city would donate $50 towards his project. Ammon Sharp & Diana Bacon - Problem with Dogs Junk cars Weeds: Corey & Brooke Richards have some complaints with the cars on Ammon Sharp property but are not here tonight to talk about it. There have been a lot of complaints with loose dogs chasing people. Diana Bacon has around six dogs and Ammon Sharp has four. Both places the dogs are not licensed or do not have kennel licenses. Jeremy Kimpton asked the council what they want him to do. More than two dogs need a kennel license. See attached Ordinance 4-1A-3- Kennel License, 4-1A-2- License Required, 4- Page 1 of 6

1A-4-Running at large or Committing Nuisance, 4-1A-8-Dogs showing rabies symptoms or biting any person, 4-1A-9-Vicious animals. Dave Priestley is our Pound master/dog Catcher but has a full time job and is not able to get here all the time. The city workers can pick them up if they see them wandering around town or are called about a dog. Emily Chatterton stated that she would like a letter to be written to them first and make sure they are notified. Bryce Wood asked what percentage of dogs get picked up. Jeremy Kimpton stated very few, 1 out of 10 maybe. Bryce Wood asked what the dog catcher makes. Jeremy Kimpton stated that he gets the thirty five dollars which is the fee of the impoundment. Joyce Bayles stated that the city should hire another dog catcher if he cannot do the job. Bryce Wood asked what happens when someone is bit. Jeremy Kimpton stated that s a good question. We don t require paper work to see if the dog has been vaccinated for rabies. Joyce Bayles asked if someone gets bit and they report it does the sheriff take care of that or are we suppose to. Jeremy Kimpton stated that s what we need to decide. Bryce Wood stated that we need a letter to remind everyone to register your pets and give those seven days after they receive the letter or we are going to crack down. If we give everyone fair warning then we are not targeting anyone citizen. Joyce Bayles stated that we need a dog catcher to inforce it. Bryce Wood asked if there is a contract deal. Jeremy Kimpton stated that they are appointed. The mayor should make a recommendation and the council approves him. I don t know if they need to be in city limits. Or could that be something we contract with Preston, if they would come down. I don t know. Emily Chatterton asked how many calls does the city get a month on dogs. Page 2 of 6

Jeremy Kimpton stated maybe two or three in a month. Some months are more than others some months none. Emily Chatterton stated to get a blanket letter and then we need to start enforcing it. Also put in the letter that if anyone is interested in being a dog catcher to contact the city. Joyce Bayles stated that we have got to be able to enforce it. Bryce Wood stated that we need to send the letter and then we need to be aggressive so people know we are going to inforce it. Emily Chatterton asked about the junk cars. Jeremy Kimpton stated that this is Corey & Brooke Richards issues and they aren t here. Jeremy stated that he thought that Ammon Sharp might know what s up. Jeremy stated that he was asked to put that on the agenda. Ammon Sharp stated that there is a certain amount of vehicles that you can have on your property. It s like two vehicles and if you have more it s considered junk vehicles. I understand why the Richards would complain but one of my cars is unusable, the second one has a flat tire and my bronco I don t use it very often because I don t have heat in it but it can be started and moved. The only one I can t start and move is my mustang. The county ordinance says that if it s three or more vehicles then they need to be behind a fence but that would pertain to a salvage yard. Jeremy Kimpton stated that the city ordinance states: See attached Ordinance Junked or Abandoned Vehicles 4-3-3 Prohibition & Exceptions; Temporary Special Permit, 4-3-4 Penalties, Civil, Remedies, & Attorney fees. Ammon Sharp stated that they are off the sidewalk and I keep the weeds cut down around them. Stella Sharp stated that you need to be very careful. If you drive around town you see very few places where you don t have four or five cars out there and so who s going to say that these four cars are not being used at certain times. Ammon Sharp stated that he understands that the truck is a junk vehicle because it looks like a piece of junk but it runs and it moves. It has a flat tire right now. Ammon stated that he keeps the weeds mowed down on the city property and his property as much as Page 3 of 6

possible. There is an area of his yard that he can t do because grass is about five feet tall and there are weeds mixed in with it. Ammon stated that he wants his house kept neat with the exception of the last two weeks because his lawn mower has quit and he is trying to get that fixed. Whatever weeds they are complaining about I don t know because he keep the weeds against his fence mowed and the grass mowed in his dog run and behind his house. Emily Chatterton stated that everyone needs to help the city look nice. We all should have pride in our city, ourselves and our property. Ammon Sharp stated that I m trying to get that area taken care of but I m still fighting junk that Mark Perry left there. I have to mow around it and I ve been burning as much as possible. I don t just want to have a bon fire. When it s gone I can control that area of my yard more. There are piles of gravel and rocks everywhere in my yard. Most of the junk is branches from trees and I think people see the pile and throw more branches on it. I am making efforts to control it. It s not that I m not doing anything or am just lazy. Emily Chatterton stated that she suggest that you should keep the weeds down because it helps with keeping the flies and mosquitos down. Anything you can do to be the kind of neighbor you would want them to be is helpful. If everyone could do that it would cause a lot less arguing. Ammon Sharp stated that I m trying to keep the weeds taken care of. I m not calling the police on anyone despite the fact that they are being called on me for stupid reasons. I m trying to get my yard in line but its taking a little while because I m cleaning up after someone else. It s not a house that I built on a pristine property. I m trying to take care of it the best I can. Emily Chatterton stated that as long as you re trying and continue your efforts in cleaning up his property. Ammon Sharp stated that his bronco isn t registered because he doesn t use it that often. Emily Chatterton asked how the ordinance states it. Bryce Woods stated the ordinance. Jeremy Kimpton stated that the ordinance gives people a chance to come in and get an application asking to receive a temporary special permit if they are working on a car or something like that. Emily Chatterton stated that we have spent enough time on this so if there isn t anything else let s move on. Stella Sharp stated that she had some concerns. We have a real problem in Franklin, a lot just around this block. There are a lot of motor bikes and they are constant and go very fast. They go through the park and over in the church parking lot and whip around through the cars and around the swings. They are constantly endangering little kids and people that are out there. There used to be signs out there but they aren t there anymore. There used to be a fence around the park that cured that quite a bit. Jeremy Kimpton stated that he has talked to one of the kids about this the other day. Are you still seeing it? Stella Sharp stated that last night there was. They were mutual age kids. Ammon Sharp stated that they rip through the corner that he live on and don t stop. Stella Sharp stated that she has even called the police in Preston when she see it happening and they say they will send someone up and they never do come. Emily Chatterton asked if we have any more of the signs. Jeremy Kimpton stated that we talked about it in staff meeting two or three months ago and stated that the city needs to get more signs up around the park. Stella Sharp stated that you should put it in your city newsletter that it is against the law. If they are going to be riding they need to be safe and not go over the speed limit and use a helmet. Joyce Bayles stated that if they are too young we can t say to just be safe. If they are too young they shouldn t be riding them. Emily Chatterton stated that s true. Ammon Sharp stated that another problem we have is the basketball court in the church parking lot. It s not a problem except if he has to listen to them playing music and playing basketball at three o clock in the morning. I m not saying that they are juvenile delinquents or Page 5 of 6

anything but maybe if we could put a sign up or something on the standard over there that after eleven p.m. show some respect. Jeremy Kimpton stated that he needs to call him and he will come over and talk to them. Ammon Sharp stated that he has gone over and asked them to leave but I don t have any authority. Emily Chatterton stated to maybe put it in the newsletter to inform the parents of the noise ordinance and remind their kids. Emily Chatterton then closed the meeting.
