Please read it carefully. Article I. The following pages are a contract between the below named buyer(s) and breeder. Breeders agree to provide buyer with a full refund or replacement (if possible) within 96 hours of purchase if it is determined by a veterinarian that the cat/kitten was in poor health at the time of purchase. Breeders agree to provide a valid health certificate and current vaccine record for the cat/kitten listed above. Breeders agree to provide TICA and CFA litter registration slips upon proof of the kitten being altered. 2. Breeders will take back cat/kitten listed above for any reason or any age. 3. Breeder makes no guarantee as to the show quality of the cat/kitten listed above. Section 1.06 Initial if in agreement Guarantees by Buyer(s) 1. Buyer agrees to have cat/kitten examined by a licensed veterinarian within 96 hours of purchase and to advise breeders of the results of the exam. Cat/kitten should be isolated from any other animal in buyers home until said veterinary exam. Failure to do so may result in voiding heath guarantee. Buyer should be mindful that the stress of re-homing the cat/kitten may result in temporary signs of illness which may include sneezing, runny nose, watery eyes, diarrhea, and/or constipation. To help reduce signs of stress, buyer should feed cat/kitten identical food as have breeders. We ask that you take reasonable measures to reduce stress. Do this by slowly introducing cat/kitten to house and other members of the household, as well as limiting time cat/kitten may be with strangers, children, or other animals. 2. Buyer promises and warrants that this cat/kitten will be an INDOOR ONLY animal, not allowed outdoors except in a protected, enclosed area, a carrier or on a leash. 3. Buyer will not confine this cat/kitten to a cage for extended periods of time. I-2 P age
4. Buyer agrees that the cat/kitten will NEVER BE DECLAWED. 5. Buyer insures the cat/kitten will receive regular veterinary care including at least an annual exam, vaccination boosters, as well as any needed veterinary attention. If the buyer is unsure whether veterinary care is warranted, a vet will be contacted, the situation explained and the veterinarians advice acted on. 6. Cat/kitten will receive kind and frequent human attention. 7. Cat/kitten will be given proper diet and will have fresh water available at all times. 8. Cat/kitten will not be left unattended if buyer is away overnight, but will be attended by a pet sitter (or equivalent human) at least once a day or boarded at a reputable facility. 9. If at any time the cat/kitten is found to be ill, malnourished, abused, neglected, or unattended outdoors, buyer will surrender cat/kitten unconditionally to breeder(s) with no refund of purchase price. Failure to surrender cat/kitten in above circumstances will lead to breeder s starting legal action. 10. Under no circumstances will this cat/kitten ever be abandoned, sold, leased, given away to any pet shop, humane society, pound, shelter, research facility, or euthanized for behavioral problems. If for any reason buyer cannot keep cat/kitten, breeder will be notified immediately PRIOR to any disposition of said cat/kitten. Breeder(s) then have the option to take back cat/kitten and/or to help find another suitable home. Buyer will not be reimbursed for purchase price. 11. Kittens must be altered by the age of six months. Pedigree will be provided at time of purchase and litter registration slips will be marked not for breeding. THIS KITTEN MAY BE SHOWN IN THE PEDIGREED CAT ALTER CLASS IF THE BUYER WOULD LIKE TO AND THE BREEDER AGREES THE KITTEN IS SHOW QUALITY. REGISTRATIONS BEING PROVIDED WILL BE VERY SPECIFIC. 12. Buyer agrees to notify breeders of any change in address or phone numbers; of any health problems; loss or death of the cat/kitten. Section 1.07 Exclusions and Amendments to this contract 1. Failure to honor any part of this contract may result in legal action brought by breeders against buyer. All legal fees and court costs necessary to enforce this contract, including those incurred by the breeders, will be obligation of the buyer(s). Should any of this contract be found illegal or unenforceable in a court of law in the state of South Carolina, sale to be instituted in same, the remainder of this contract is to remain valid and enforceable. 2. Buyer agrees that the contract will be bound by the laws of South Carolina and that any dispute regarding this contract will be settled in a court of the state of Florida. I-3 P age
3. Deposit made upon execution of this contract is NON- REFUNDABLE except in the event that breeder cannot meet the guarantee at the time of adoption. In as much as the below signed buyer(s) have read and understood the terms and restrictions of the sale and understand that this contract is a legal and binding agreement, enforceable within the confines of the United States and the costs incurred in interstate litigation by the breeders are within the accepted responsibilities of the buyer(s), this contract is legal and effectual and enforceable document within and by all the boundaries of this United States and Canada. Breeder: Date: Breeder: Date: Buyer: Date: Buyer: Date: Section 1.08 Health Guarantee The health guarantee is in effect providing buyer abides by the following conditions: Has cat/kitten examined by a licensed veterinarian within 96 hours of purchase. Has isolated cat/kitten from other animals until examined by buyer s veterinarian. Buyer does not vaccinate for FIP, as said vaccine may potentiate FIP. Section 1.09 Breeders guarantee that The cat/kitten is in sound health and is free from infectious diseases, fungus, infections, and internal and external parasites The cat/kitten is free from FELV and FIV at the time of leaving the cattery. The cat/kitten has been vaccinated against upper respiratory diseases, feline distemper at least twice. I-4 P age
Buyer will be provided with a shot record and valid health certificate from a licensed veterinarian. If problems occur during the guarantee period of 96 hours: Medical problems detected at that time shall be brought IMMEDIATELY to the attention of the breeders. Unless the situation is an emergency, no major treatment such as anesthesia, surgery, or euthanasia may be undertaken without breeders consent. The breeder retains the right to a second opinion by the breeder s veterinarian, if located at a reasonable distance to buyer, or by veterinarian at other unrelated practice. After exercising these options, Breeders will authorize buyer to initiate treatment. Buyer agrees to provide a written report, signed by examining licensed veterinarian, which will be include diagnosis, test results, and furnish proof that the condition is a pre-existing one. This documentation will be reviewed by breeders veterinarian to determine medical accuracy. The portion of the bill incurred by the buyer for the DETECTION and TREATMENT of any such illness shall be paid by the breeders to the veterinarian, up to 75% of the price of the cat/kitten. Buyer shall not be reimbursed directly. The buyer may, at their option and within 5 (five) days of the veterinary diagnosis elect to either cancel their contract and be refunded full purchase price or to accept a replacement cat/kitten if and when one is available. The breeders may, at their option and within the same 5 (five) day period, elect to cancel this contract, reclaim the cat/kitten and refund full purchase price to the buyer. All costs of returning the cat/kitten to breeders will be responsibility of the buyer. Within five years of date of sale, if the cat/kitten should die from a problem which a licensed veterinarian can document as having been present prior to sale, the breeder will either replace the cat/kitten with a similar quality as soon as one becomes available or refund the purchase price of the kitten. In any of the above scenario, the total liability of the breeder shall in no case exceed the total purchase price of the cat/kitten. I-5 P age
