W HEREAS it is deem ed expedient to pass a Bylaw in respect to the licensing, restraining, regulating and im pounding o f dogs on M uskoday First Nation; AND WHEREAS it is deemed necessary for the protection o f the public health, safety and w elfare to provide for the regulation of dangerous dogs; NOW THEREFORE THE COUNCIL OF THE M USKODAY FIRST NATION IN OPEN M EETING ASSEM BLED ENACTS AS FOLLOWS: Title: 1. This Bylaw m ay be called "The Dog Licensing and C ontrol Bylaw. Definitions 2. In this Bylaw, unless the context otherwise requires, the expression: (a) Council shall m ean the M uskoday First N ation Council. Dog shall m ean any dog, m ale or female, o f every breed or classification or m ixture o f breeds. Animal Control Officer shall m ean the employee hired by the Council, w hose duty it is to enforce this Bylaw. O w ner shall m ean and include any person owning, possessing, harboring or having custody or control of a dog, w ithin the lim its o f the M uskoday First N ation.

(e) A t Large or Fnnninp At T shall maon off the) isos beyond ih (f) boundaries o f the land occupied by the owner or beyond the boundaries o f any land where the dog m ay be w ith the perm ission of the owner or occupant o f such land and when not tied or secured to a leash or chain or other similiar restraining device, not exceeding tw o m eters (2 m) in length, the other end o f a leash or chain or other sim ilar restrianing device is held, secured or controlled by the owner or another person who is physically able to hold, secure or control the dog. Community m eans M uskoday Reserve. Licenses 3. (a) Every owner o f a dog w ithin the Community of Muskoday First N ation shall obtain a license for the said dog from the Animal Control Officer, w hich license shall not be tran sferab le to any other dog or any other owner. W hen applying for such license, the applicant shall provide the Animal Control O fficer w ith a description o f the dog, the nam e and address o f the owner o f the dog, and any other relevant inform ation w hich m ay be required by the Anim al Control Officer, and, the Anim al Control Officer is authorized to register dogs and record the registration o f such dogs, along w ith the name and address o f the owner, and to issue licenses in conform ity w ith this Bylaw. Yearly license fees shall be payable in advance and shall be: For each dog For each spayed /neutured dog $20.00/year $5.00/ycar A ll licenses issued under this Bylaw shall be the size which can be conveniently attached to a dog collar. A dog owned by Sightless persons and used as a guide dog, shall be registered and licensed as provided in this Bylaw, but without charge. (e) A dog shall be considered spayed7neutured when a document to that effect signed by V eterinary Surgeon is provided to the Animal C ontrol Officer.

4. (a) W hen issuing a license for a dog, the Anim al Control Officer shall supply the owner w ith a m etal license tag and a receipt o f payment o f the license, and the said owner shall attach the said m etal tag to the collar to be worn around the neck o f the said dog and take all necessary steps to assure that the said m etal tag shall rem ain attached to the said collar at all times and to have it replaced in case o f loss. Upon satisfactory proof that the license tag originally issued has b e at lost, the Animal Control Officer shall issue a replacem ent tag for a fee of $1.00. The failure o f any owner to have the m etal tag attached to the collar o f the said dog is an offence under this Bylaw and w ill be fined $5.00 each tim e a dog is caught w ithout a tag. The tag shall be valid from the 1st day o f A pril o f that year until the 31st day o f M arch o f the next year. (e) N o person other than the owner o f a dog licensed under this Bylaw shall remove its collar or tag. Running at Large 5. (a) N o dog shall be running at large in the Community. The owner o f a dog found running at large shall be deemed guilty o f an infraction o f this Bylaw. Every dog w ithin the Community shall be licensed under this Bylaw, and further, shall w ear a collar to w hich shall be attached the license tag. In default o f either provision, the dog may be seized and dealt w ith as hereinafter provided. Every owner o f a dog shall, on demand by the Animal Control Officer m ust show his license receipt or other evidence that a dog is licensed, and further, m ust show the m etal tag. (e) If a dog defecates on any public or private property, the owner of the dog shall remove the defecation immediately or be fined $5.00.

Seizure o f P o p s 6. (a) Except as otherwise provided in this Bylaw, any dog found running at large contrary to the provisions of this Bylaw m ay be taken by any person 18 years of age and older to the Dog Pound provided by the Community, or to the A nim al Control Officer. The Anim al Control Officer, or any other person authorized by Council, is hereby authorized to seize and capture dogs running at large, w hether or not such dog is wearing a collar w ith tag attached thereto and to im pound the said dog. Any person attem pting to rescue or who rescues a dog lawfully restrained by or in the custody o f an Animal Control Officer or any other person that is authorized by Council to restrain a dog shall be guilty o f an offence under this Bylaw. Dog Pound 7. A dog pound w ill be constructed in an area designated by the Council. Animal C ontrol Officer 8. (a) The Council shall hire a person to m aintain the dog pound and to apprehend dogs running at large and shall hold office at the pleasure o f the Council. A ll licensed dogs impounded in the Dog Pound shall be confined therein for a period o f seventy two hours from the tim e o f capture, excluding such days when the Dog Pound is not open to the public. D uring the 72 hours, the owner or keeper of a dog impounded shall have the right to repossess the dog upon payment to the Anim al Control Officer the appropriate pound fee as follows: - the sum o f ten dollars ($10.00) for each day or any fraction o f a day the dog shall rem ain in the Dog Pound to the m axim um o f three days (72 hours). - The owner shall be required to pay a ten dollar ($10.00) fee for the impounding o f the dog.

No unlicensed dog w hich is impounded shall be released to its owner or keeper or to any other person until the appropriate pound fee is paid, and a license has been purchased for it, if the dog is to remain in the Community. Whenever any dog w ithout a license or collar is impounded, the dog shall be deemed to be a stray and confined for a period o f 24 hours from the tim e o f capture. U pon the expiration o f such tim e, the said dog shall be destroyed or so ld. (e) Prior to a dog being destroyed or sold, the owner may redeem the such dog by making payment o f all license fee s, pound fees and tag fees. (f) The owner of any dog impounded shall pay the Animal Control Officer in advance o f release o f the said dog, the sum o f ten dollars ($10.00) for the first impounding o f such dog in a 12 month period; foe sum o f tw enty dollars ( $20.00) for the second im pounding o f the same dog within a 12 m onth period; the sum o f thirty dollars ($30.00) for foe third and all subsequent im poundings o f foe same dog in a 12 m onth period; phis the sum of $10.00 per day or part thereof for each day that such dog shall have remained in the Pound. (g) All impounded dogs w hich are not claimed or redeemed by their owners w ithin the time limits im posed by this section may be sold by the Animal Control Officer or other persons so authorized by Council, to any person paying for such dog, the pound fees and other fees or penalties owing to the M uskoday F irst N ation. (h) It shall be a condition o f sale that before foe Purchaser can have possession o f a dog, the dog m ust be properly licensed pursuant to this Bylaw if the dog is to remain in foe community. (i) Any dog that has been impounded and has not been redeemed by any person or owner under foe provisions o f this Bylaw w ithin foe tim e lim its im posed by this section, may be destroyed or otherwise disposed of by the Animal Control Officer. (j) The Animal Control Officer shall keep a record o f all dogs im pounded and foe manner in which they are disposed of, and shall make a report to foe Council on or before foe 15 th day each m onth o f all fees paid and monies collected in respect to the preceeding calendar month; and, all fees collected shall be turned over to foe Council w ith foe report.

10. D angerous (fogs Subject to Section 81 of the Indian A ct, and any regulations set by Council, providing that, when, upon complaint that a dog has bitten or attempted to bite a person, it appears to Council having cognizance o f the com plaint, that the dog is dangerous, the Council m ay m ake an Order directing that the dog be kept by the owners or keeper under proper control or destroyed: and, that a person failing to comply w ith the Order shall be liable to a fine not exceeding $25.00 for every day during which the failure continues; and providing that when a dog is ordered to be destroyed, the Council may, by the sam e O rder, direct any person to destroy the dog. 11. Dog Breeding A person m ust make application to the A nim al Control Officer for Dog Breeding on reserve, and ensure that the kennels are secure and safe so that there is no chance o f any dogs causing injury to any other person. The owner o f any dog that has had a litter o f pups w ill be given a period of six weeks to license or sell the said litter. Failure to comply, w ill result in the impoundment o f the said litter and w ill be subject to provisions o f this bylaw. 12. Rabies (a) The Animal Control Officer or any other person authorized by Council m ay request anyone who owns, possesses or harbours a dog, to provide a Cerificate issued by a qualified Veterinarian to the effect that the dog has been innoculated against rabies and such Certificate shall be produced forthwith in the event that a Certificate is in existence, or alternately, if a Certificate is not in existence, then the onus shall be an the person to produce a Certificate for the said dog w ithin one business day of the request In the event that where a request has been m ade and a Certificate to the effect that the dog has been innoculated against Rabies is not produced for w hatever reason, the dog shall be im pounded and dealt w ith as an impounded (fog in accordance with this Bylaw.

13. Oeneral (a) N o unauthorized person shall remove from a dog - a collar or license tag. N o person shall own, possess or harbour any dog w hich chases a moiorvehicle or any other vehicle, or is at large in the Community and who also at large creates a disturbance to the annoyance or discomfort o f other persons or w hich causes injury to any person. Every female dog in heat shall be confined to their yard or kennel. N o one shall abandon a dog w ithin the lim its o f the Community. 14. Penalty (a) Any person who commits a breach o f any o f the provisions o f this Bylaw shall be guilty o f an offense and shall be liable and fined a fee o f $50.00 exclusive of costs. 15. Exceptions This Bylaw shall not apply to dogs transported through the Com m unity expressly for the purpose o f participating in any D og Event sanctioned by Council.

Introduced and read a 1st time, this 8th day o f November, 1996. Read a 2nd tim e, this 6th day o f December, 1996. Read a 3rd time, this 12th day o f May, 1997. Read a 4th tim e, this 21 st day o f May, 1997. This Bylaw shall come into force and take effect on the date of final reading thereof.
