HOLD HARMLESS Marilyn Hubley/Sally Kirkby (SHARP) (and/or affiliated entities, and/or agents) shall not be liable to the Adopter on any theory of legal liability including but not limited to the sole or concurrent negligence of Marilyn Hubley/Sally Kirkby (SHARP) (and/or affiliated entities, and/or agents), for any injury, death or damage directly or indirectly caused by the Dog. The Adopter does hereby release Marilyn Hubley/Sally Kirkby (SHARP) (and/or affiliated entities, and/or agents) from any and all liability, claims, suits, obligations, demands, or causes of action, known or unknown, foreseen or unforeseen, arising out of or relating in any way to the Dog or Marilyn Hubley/Sally Kirkby (SHARP) s release of the Dog to adopter. It is the expressed intention of the Adopter and Marilyn Hubley/Sally Kirkby (SHARP) that the release provided for in this paragraph is designed and intended to protect Marilyn Hubley/Sally Kirkby (SHARP) (and/or affiliated entities, and/or agents) from any personal injury claims by the Adopter or others and from the consequences of any harm, attack, behaviour, or other action by the Dog, and from the consequences of any act or omission or negligence on the part of Marilyn Hubley/Sally Kirkby (SHARP) (and/or affiliated entities, and/or agents) in obtaining custody of the Dog, in providing care for the Dog, in training or not training the Dog, or in failing to provide timely or adequate warning to any person concerning the Dog. INDEMNIFICATION The Adopter expressly agrees to defend, pay, indemnify and hold Marilyn Hubley/Sally Kirkby (SHARP) (and/or affiliated entities, and/or agents) from all suits, actions, losses, damages, claims, or liability of any character, type or description, including without limiting the generality of the foregoing, all claims for damages, expenses of litigation, court costs, and attorney's fees for any harm, injuries, damages, or death to any person, or damages, injury or harm to any property, received or sustained by any person or persons or property, arising out of or occasioned, directly or indirectly, by the Dog. It is the expressed intention of the Adopter and Marilyn Hubley/Sally Kirkby (SHARP) that the indemnity provided for in this paragraph is designed and intended to protect Marilyn Hubley/Sally Kirkby (SHARP) (and/or affiliated entities, and/or agents) from the consequences of any harm, injuries, damages, attack, behaviour or other action by the Dog, and from the consequences of any act or omission or negligence on the part of Marilyn Hubley/Sally Kirkby (SHARP) or the Adopter in obtaining custody of the Dog, in providing care for the Dog, in training or not training the Dog, or in failing to provide timely or adequate warning to any person concerning the Dog. NO WARRANTIES OR REPRESENTATIONS The Adopter understands that Marilyn Hubley/Sally Kirkby (SHARP) and affiliates make no warranties (express or implied) or representations as to the health, fitness, demeanor, behaviour, Page 3 of 10
temperament, or well-being of the Dog. The Adopter accepts the Dog "as is". Because of this, the Adopter understands that Marilyn Hubley/Sally Kirkby (SHARP) (and/or affiliated entities, and/or agents) accept no responsibility if the Dog is injured, ill, or dies after being released to adopter or if the Dog should bite, scratch, injure, harm, or cause the death of any person or animal, or directly or indirectly cause any damage to any property after being released into adopter's custody. The Adopter agrees that no promise or inducement has been offered or made to the Adopter except as expressly set forth in this agreement and this agreement is executed by the Adopter without reliance upon any statement or representation by Marilyn Hubley/Sally Kirkby (SHARP) (or any affiliated entities, and/or agents). This agreement represents the entire agreement between the Adopter and Marilyn Hubley/Sally Kirkby (SHARP). IMPORTANT INFORMATION PERTAINING TO CATS/SMALL ANIMALS Due to the high prey drive of the breed and huge risks associated with owning a cat/small animal and a husky; the adopter understands that it has been made very clear the risks associated with owning a dog of this breed and a cat and/or other small animal. The adopter agrees to accept any and all liability should injury of death of any cat/small animal occur. The adopter agrees to release Marilyn Hubley/Sally Kirkby (SHARP) and/or affiliates from any claim for damages, vet bills, loss or death. As such; the above 3 clauses are in full effect pertaining to cats/small Page 4 of 10
animals. Under no circumstances shall Marilyn Hubley/Sally Kirkby (SHARP) and/or affiliates be held accountable for the actions of the adopted dog. At the time of adoption, the adopter also agrees to the following clauses pertaining to the care of said dog: 1. If this dog is not already spayed/neutered upon adoption, the adopter must have such completed after 1 month (30 days) and before 3 months (90 days) of adoption on dogs over 1 year of age and under 7 years of age. Female dogs shall be spayed 2 months after the conclusion of a heat cycle, regardless of adoption timing. Under no circumstance shall an adopted rescue dog be bred. Dogs shall not be spayed/neutered under one year of age; but shall also not be bred. Dogs over the age of 7 years of age shall not be spayed/neutered unless deemed necessary by a veterinarian; and shall not be bred under any circumstances. Puppies (under 1 year of age) shall be spayed/neutered between the ages of 1 and 2 years of age. FAILURE TO COMPLY WILL RESULT IN OWNERSHIP FORFEIT BACK TO MARILYN HUBLEY/SALLY KIRKBY (SHARP) or previous owner WITHOUT REFUND. A $250 rebate cheque will be provided to adopters after proof of spay/neuter in dogs up to 7 years of age is presented to Marilyn Hubley/Sally Kirkby (SHARP). Adopters may use a vet of their choice. High volume clinics are strongly not recommended for rescue dogs. Proof of spay/neuter must be provided within 48 hours after surgery and can be in the Page 5 of 10
form of an invoice or a certificate from the surgical vet. If the dog is deemed unfit for surgery for ANY reason by a veterinarian, an extension/exemption will be granted provided a written and signed note by the veterinarian is provided. Health of the dog first! 2. Any changes to contact information, change of address, change of veterinarian information, etc. shall be reported either to Marilyn Hubley/Sally Kirkby (SHARP) or the previous owner of the dog within 1 week (7 days) of the changes being made. Updates shall be provided to either Marilyn Hubley/Sally Kirkby (SHARP) or the previous owner after 2 weeks and a minimum of every 3 months (4 times per year). Pictures are very much appreciated with the updates. 3. Do not remove or loosen the collar or ID tag the dog came with for at least 1 month. It may seem too tight, but until the dog is adjusted, they are a flight risk and can slip the collar if it is any looser than it is. This is for their safety. Failure to have identification tags on the dog at all times may result in loss of ownership. Leave a leash on the dog at all times, even inside the house, for a minimum of 1 month from adoption. This dog is microchipped, and is to be co-registered (emergency contact) to SHARP for the life of the dog. Change of address details will be kept up to date and updated in a timely manner after moving, along with notifying SHARP as per Clause 2 above. Page 6 of 10
4. Follow-up home visits may be conducted throughout the life of the dog. If the evaluator feels the care is not adequate, the dog may be seized and returned to the previous owner pending remedy of the issue, or indefinitely; at the discretion of the previous owner, the evaluator, or Marilyn Hubley/Sally Kirkby (SHARP). No refund shall be issued. Signatures: 5. The Skipper Clause: If the dog is at large TWO or MORE times, a home visit will be conducted. If deemed necessary by the evaluator, the dog shall be returned to the previous owner or to Marilyn Hubley/Sally Kirkby (SHARP) until such time as adequate confinement is installed; or indefinitely at the discretion of Marilyn Hubley/Sally Kirkby (SHARP), the previous owner, affiliates, and the evaluator. No refund shall be issued. Electric fence is not adequate confinement. If this dog is to be tethered, whether from day one or by rescue request, the use of a buckle collar is prohibited. The dog shall be tethered on a properly fitted, tight, buckle-less collar to minimize escape risk. Choke chains, prong collars and harnesses are not to be used for tether purposes at any time. Signatures: 6. The Bandit Clause: This dog shall NOT be allowed off leash, at any time, unless in a very securely fenced area and wearing full identification tags. Electric fence is not considered to be a securely fenced area. Noncompliance will result in immediate ownership loss and blacklisted for adoption. No refund shall be issued. Signatures: Page 7 of 10
7. If for any reason this dog needs to be re-homed, at any time, the dog shall be returned to the previous owner or Marilyn Hubley/Sally Kirkby (SHARP). Under no circumstances shall this dog be placed in a pound, shelter, humane society, other rescue group, etc; or destroyed. No refund shall be issued. 8. Unless an emergency, Marilyn Hubley/Sally Kirkby (SHARP) shall be contacted for advice prior to allowing your veterinarian to provide health/diet advice to your dog. This includes vaccinations, timing of spay/neuter, raw vs. kibble debate, etc. This is to protect dogs from being over-vaccinated which can result in damaging reactions and not all vets understand the needs and diet requirements of Northern Breeds.
