MIKE BOYD, Having been first duly sworn by the Court, testified as follows: MR. LEONARD: May I proceed? You may. DIRECT EXAMINATION QUESTIONS BY MR. LEONARD: Q. Mr. Boyd, please introduce yourself to the Court. A. My name is Mike Boyd. I'm the owner of Boyd, Smith & Associates. I'm a polygraph examiner. Q. What is your educational background? A. I have an Associates of Arts in Law Enforcement in from San Jacinto Junior College and a Bachelor of Science in Law and Citizen in from the University of Houston, Clear Lake City. Q. Tell the Court a little bit about your professional experience? A. I've been a polygraph examiner since. years all in Houston. I've attended numerous seminars, continuing education and what not. I have certified workshops for sex offenders according to our guidelines set down by the state. Q. Have you ever testified as a witness before?

And can you identify him here in court today? It's the gentleman in the orange jump suit just to my left. MR. LEONARD: Judge, may the record reflect that the witness has identified the defendant? Yes. The record will show that. Q. (By Mr. Leonard) When was the last time you met him for an examination? A. I administered an examination on Mr. Combest on November th of. Q. And just in general, what were some of the things discussed during that examination? A. I ran what's known as a full sexual history examination according to the probation department. Along with that test, administered to cover -- go back prior to this probation beginning and going back to make sure that he did not have any other undisclosed minor child victims. Q. After that examination or on the day of that examination, when was the next time you heard from the

I received a call -- I answered a call that afternoon approximately -- I administered the test that morning. And I received a call from Mr. Combest asking -- he requested my address, which at that point I gave it to him. Q. And you recognize that it to be him on the other line on the other end of the phone? Q. And what did you tell him in response to him requesting your address? A. I told him I just -- because I could not disclose anything concerning any polygraph examination that they have over the phone, I gave him my address at that point. Q. Okay. And did you receive any communication from Mr. Combest? A. Yes, sir, I did. Q. And when did you receive this ? A. The next day. Well, when I came in my office -- the next day it was in my . Q. And that would be November th of?

I had a copy of his conditions, yes, sir. Q. And were you aware that one of the conditions of probation was that he was not supposed to use the computer? A. That's correct. Q. Okay. And at that time he told you that he was going to you, did you warn him or tell him
