1 ORDINANCE NO. XXXX An Ordinance of the Westwego Council Amending Chapter 4 Animals and Fowl Subchapter B. Household Pets Part ii. Dogs WHEREAS, the City of Westwego has interest in the health safety and welfare of its citizens and; WHEREAS, there is a duty of an owner and keeper of a dog to be responsible for the care, and risk of injury to others; BE IT ORDAINED, by the mayor and council of the City of Westwego, Louisiana, that the Code of Ordinances of the City of Westwego, Louisiana, is hereby amended to read as follows: Chapter 4 ANIMALS AND FOWL SUBCHAPTER B. HOUSEHOLD PETS PART II. DOGS Sec. 4: Registration and licensing of dogs required. It shall be the duty of the owner or keeper of a dog to register same with the Jefferson Animal Shelter Department by the purchase of a license tag which shall be numbered and shall indicate the current calendar year. State law reference Authority of municipalities to regulate the keeping of dogs, R.S. 3:2731. Sec. 4: Confinement of dogs required. It shall be the duty of the owner or keeper of a dog to have such dog confined within his or her yard or enclosure, or secured by a chain therein, or if said dog is allowed outside of said enclosure, it shall be under leash and shall be accompanied by his owner or keeper. Sec. 4: Definition of owner or keeper. Any person who shall harbor or permit any dog upon or about his or her premises shall be deemed the owner or keeper of such dog. Sec. 4: Release of confined animals prohibited. It shall be unlawful for any person to release or entice any dog secured by the owner or keeper within his or her yard, or by a chain, outside of the premises of such keeper or owner. Sec. 4: Keeping of dogs at large restricted. It shall be unlawful for the owner or keeper of any dog to allow such dog to be at large in any tenement building or yard thereof. Sec. 4: Owner or keeper of dogs causing injury to others. If anyone shall be injured in his or her person or apparel by a dog in the streets, parks or other public places of the City of Westwego, the owner or keeper of such dog shall be guilty of a violation of this part. Sec. 4: Excessive number prohibited. It shall be unlawful for any person to keep or harbor more than three dogs that are four months of age or older on any premises. Only one litter of offspring may be kept on the premises until the age of four months. Exceptions are veterinary clinics or hospitals, licensed kennels, pet shops and shelters. Sec. 4: Unlawful keeping of pit bulls. (a) Prohibited. It shall be unlawful for any person to have, own, possess, keep, exercise control over, maintain, harbor, transport, or sell within the city any pit bull. Westwego, Code of Ordinances Page 1

2 (b) Definitions. (1) "Immediate family" for purposes of this chapter, includes the owner's spouse, child, parent or sibling. (2) "Handler" for purposes of this chapter, means an individual with a disability who is utilizing a service dog, as that term is defined in this chapter, to do work or perform tasks directly related to the individual's disability. If over the age of 18, the handler must also be the owner of the service dog. If under the age of 18, the handler's legal guardian must be the owner of the service dog. (3) "Muzzle" for purposes of this chapter, shall mean a restraining device made of metal, plastic, leather, cloth or a combination of these materials that, when fitted and fastened over a snout/mouth/head, prevents the dog from biting but allows room for the dog to breath and pant. The muzzle must be made in a manner that will not cause injury to the dog or interfere with its vision or respiration, but must prevent it from biting any person or animal. (4) "Pit bull" for purposes of this chapter, is defined as any dog that is an American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, or any dog displaying the majority of physical traits or genetic markers of any one or more of the above breeds, or any dog exhibiting those distinguishing characteristics which substantially conform to the standards established by the American Kennel Club or United Kennel Club for any of the above breeds. (5) "Secure temporary enclosure" for purposes of this chapter, is a secure enclosure used for purposes of transporting a pit bull and which includes a top and bottom permanently attached to the sides except for a "door" for removal of the pit bull. Such enclosure must be of such material and secured with a keyed or combination lock so that the pit bull cannot exit the enclosure on its own. (6) "Secure pen or enclosure" for the purposes of this chapter, shall mean a six-sided structure designed to prevent entry of a child or escape of a pit bull. Such pen or structure must have minimum dimensions of five-feet by ten-feet per animal housed within and must have secure chain-link sides, a secured top and a secure bottom. The enclosure must provide protection from the elements for the dog. All structures erected to house a pit bull must comply with all zoning and building ordinances and regulations of the city and shall be kept in a clean and sanitary condition. The gate of the pen or enclosure shall be secured with a keyed or combination lock. (7) "DNA testing" DNA (Deoxyribonucleic Acid) is the genetic blueprint that contain most of the genetic instructions for every canine's body make up (height, weight, size etc.). DNA testing means a genetic analysis to identify key single-nucleotide polymorphisms marker locations (genetic markers) that may detect the breed, type and variety of a dog and may show the ancestral breed composition of a particular dog. (8) "DNA test evidence" an owner may, at the owner's expense, submit a DNA sample of a dog to a veterinarian or other professional to test for the genetic history of a dog. Such test should look for the genetic markers for the following breeds: American Pit Bull Terrier, American Staffordshire Terrier, and Staffordshire Bull Terrier. In order to be considered a pit bull the DNA testing must demonstrate a genetic blueprint of excess of 50 percent of pit bull. The DNA test results shall constitute evidence which the court may consider in establishing that a dog is other than a breed banned by this section. DNA testing results shall override any subjective evidence including observational findings to the contrary. If an owner indicates to a judge that a DNA test will be performed, the court may issue appropriate orders as to the release of the dog with any additional conditions that the court believes will minimize any danger to the community during the pendency of the testing and obtaining the results. 3 (c) Exceptions. The prohibition in subsection (a) shall not apply in the following enumerated circumstances. Failure by the owner to comply and remain in compliance with all of the terms of any applicable exception may subject the pit bull to immediate impoundment and disposition. (1) The owner of a pit bull who has applied for and received a pit bull license and who maintains the pit bull at all times in compliance with the pit bull license requirements of subsection (d) of this section and all other applicable requirements of this chapter, may keep a pit bull within the city. (2) Code enforcement may temporarily transport and harbor any pit bull for purposes of enforcing the provisions of this chapter. (3) Any veterinarian while treating or grooming a pit bull, or holding such pit bull after treatment until claimed by the owner or released to a code enforcement officer. (4) A person may temporarily transport into and hold in the city a pit bull only for the purpose of showing such pit bull in a place of public exhibition, contest or show sponsored by a dog club association or similar organization. However, the sponsor of the exhibition, contest, or show must receive written permission from the city manager or designee, must obtain any other permits or licenses required by city ordinance, and must provide protective measures adequate to prevent pit bulls from escaping or injuring the public. The person who transports and holds a pit bull for showing shall, at all times when the pit bull is being transported within the city to and from the place of exhibition, contest, or show, keep the pit bull confined in a secure temporary enclosure locked with a keyed or combination lock and bearing a caution sign affixed in a conspicuous location warning people a pit bull is confined within. (5) The owner of a pit bull may temporarily transport the pit bull through the city. During such transport the owner may not stop within the city for any reason not reasonably related to and necessary for travel. During such travel, the owner shall keep the pit bull muzzled and either in a secure temporary enclosure or securely leashed with a leash no longer than four feet in length held by someone 21 years of age or older who is capable of effectively controlling the dog. Extension-style leashes may not be used. Leashes may not be attached to inanimate objects. (6) The owner/handler of a pit bull that is the handler's service animal who has applied for and received a pit bull license in accordance with subsection (d) of this section, and who maintains the pit bull at all times in compliance with the pit bull license requirements of subsection (d) of this section and all other applicable requirements of this chapter, may keep a pit bull that is a service animal within the city. If an animal care division or other authorized city law enforcement officer makes contact with an owner/handler of a pit bull not licensed pursuant to this section and the owner/handler asserts that his or her dog is a service animal, the owner/handler shall be informed of this section and instructed to obtain a pit bull license pursuant to subsection (d) below within 72 hours of the initial contact. Failure to obtain a pit bull license shall result in impoundment of the dog pursuant to subsection (e) of this section. (7) A non-resident owner/handler may temporarily transport into and hold in the city a pit bull that is the owner/handler's service animal for a period not exceeding two weeks. During such temporary transport or holding, the owner/handler shall keep the pit bull muzzled and securely leashed with a leash no longer than four feet in length held by the owner/handler who requires the use of the service animal. In the event the handler, because of a disability, is not able to use a muzzle or leash no longer than four feet in length, or in the event the use of a muzzle or a leash no longer than four feet in length would interfere with the service animal's safe, effective performance of work or tasks, the service animal must be otherwise under the handler's control. 4 (d) License. The owner of a pit bull who has applied for and received a pit bull license within 60 days of the effective date of this section or the owner/handler of a pit bull that is a service animal who has applied for and received a pit bull license shall be allowed to keep such pit bull within the city. As a condition of issuance of a pit bull license, the owner shall at the time of application, comply with or otherwise provide sufficient evidence that the owner is in compliance with all of the following regulations: (1) The owner of the pit bull shall provide proof of a current rabies vaccination and shall pay an annual pit bull license fee to be set by city council. The annual pit bull license fee shall be waived for a pit bull that is a service animal. (2) The owner of the pit bull shall keep current the license for such pit bull through annual renewal. Such license is not transferable or renewable except by the holder of the license or by a member of the immediate family of such licensee. A pit bull license tag will be issued to the owner at the time of issuance of the license. Such license tag shall be attached to the pit bull by means of a collar or harness which must be worn by the animal at all times, clearly visible, and shall not be attached to any pit bull other than the pit bull for which the license was issued. (3) The owner must be at least 21 years of age. This regulation shall be waived for a pit bull that is a service animal when the handler is between at least 18 years of age, but under 21 years of age. (4) The owner shall present to the code enforcement officer or designee proof that the owner has homeowner's or renter's insurance with a minimum of $100, for liability coverage which will cover any damage or injury caused by a pit bull during the 12-month period covered by the pit bull. This regulation shall be waived for a pit bull that is a service animal. (5) The owner shall, at the owner's own expense, have the pit bull spayed or neutered and shall present to the city code enforcement officer or designee documentary proof from a licensed veterinarian that this sterilization has been performed. (6) The owner shall, at the owner's own expense, have a microchip containing an identification number implanted into the pit bull. The owner shall also, at the owner's expense, register the microchip number with a national data bank and provide proof of such registration to the animal care division. The city code enforcement officer or designee shall maintain a file containing the registration numbers and names of the pit bull and the names and addresses of the owners. The owner shall notify the city code enforcement officer or designee of any change of address. (7) Except as stated below and at all times when a pit bull is at the property of the owner, the owner shall keep the pit bull confined. When outdoors, all pit bulls shall be confined in a locked secure pen or enclosure or with its owner/handler or an adult at least 21 years of age in the rear yard with the dog, and the rear yard enclosed by a six foot fence of a chain link fencing material, no closer than five feet from the property line and no closer than twenty feet from any neighboring home. A warning sign shall be affixed to the gate of the structure notifying people a pit bull is contained within. This regulation related to the warning sign shall be waived for a pit bull that is a service animal. (8) No pit bull may be kept on a porch, patio or in any part of a house or structure that would allow the dog to exit such building on its own volition. This regulation shall be waived for a pit bull that is a service animal. Westwego, Code of Ordinances Page 4

5 (e) (f) (9) At all times when a pit bull is away from the property of the owner, the owner shall keep the pit bull muzzled and either in a secure temporary enclosure or securely leashed with a leash no longer than four feet in length held by someone 21 years of age or older who is capable of effectively controlling the dog. Extension-style leashes may not be used. Leashes may not be attached to inanimate objects. In the event the handler, because of a disability, is not able to use leash no longer than four feet in length, or in the event the use of a muzzle or a leash no longer than four feet in length would interfere with the service animal's safe, effective performance of work or tasks, the service animal must be otherwise under the handler's control at all times when away from the property of the owner/handler in a manner relayed to the city manager or designee at the time of licensing. This regulation and the means for controlling the pit bull may be modified and portions may be waived for service animals by the City Council determined on a case-by-case basis. (10) The owner shall not sell or otherwise transfer the pit bull to any person residing within the city except a member of the owner's immediate family who will then become the owner and will be subject to all of the provisions of this section. (11) The owner shall immediately notify code enforcement and the Jefferson Parish Animal Shelter Department in the event that the pit bull is loose, stolen, at-large, unconfined, has mauled, bitten, attacked, threatened, or in any way menaced another animal or human, or has died. (12) The owner shall have posted at the front door entrance to the owner's property where the pit bull is kept a conspicuous and clearly legible pit bull warning sign. This regulation shall be waived for a pit bull that is a service animal. (13) Failure to comply with any of these conditions shall result in a revocation of the license, impoundment and disposition pursuant to subsection (e) of this section. Impoundment. Code enforcement is authorized to immediately impound any pit bull found within the city limits which does not fall within the exceptions listed in subsection (c) or (d), subject to a hearing pursuant to summons before the Magistrate for the Westwego City Court. If the dog is found to be an unlicensed pit bull it shall be destroyed unless the owner produces evidence deemed sufficient by the court that the pit bull is to be permanently taken out of the city. Sufficient evidence must include, but is not limited to, a notarized agreement from the person taking custody of the animal containing an address and date of transfer. Additionally, the owner must consent to an in-home inspection by the code enforcement within 30 days of release for the purpose of verifying the dog's removal from the city. Prior to release, the owner must pay the cost of impoundment and microchip the dog pursuant to the subsections of this section. If the dog is found not to be a pit bull or if the dog is found to be a service animal, the dog shall be released to the owner. It shall be the burden of the owner or keeper to submit DNA testing evidence to sustain a finding that the dog is not a pit bull. Notwithstanding a finding that the dog is not a pit bull or a finding that the dog is a service animal, a dog may be impounded and the owner/handler may be held responsible for violations of this section or any other applicable state or local law. Penalty. (1) Any person found guilty of violating this section with a licensed pit bull, upon conviction, could be subject to the penalty provisions of the City Code. (2) Any person found guilty of violating this section with an unlicensed pit bull shall, upon conviction, be subject to the payment of a fine of not less than $ In addition to the fines stated in this subsection, a person convicted under this section may be subject to not more than six months in jail and may be imposed in addition to the court-ordered destruction provided herein. 6 Sec. 4: Muzzling and restraining of potentially dangerous animals. (a) Definition. A "potentially dangerous animal" means any dog or other animal: (1) Which, according to the records of the parish animal shelter or other appropriate law enforcement authority: a. Has without provocation inflicted severe injury on a human being on public or private property; or b. Has killed a domestic animal without provocation while off the owner's property; or c. Has previously been found to be a "dangerous animal," the owner having received notice of such, and the animal again bites, attacks or endangers the safety of human beings or domestic animals; or (2) Which is owned or harbored primarily or in part for the purpose of dog fighting or any dog trained for dog fighting; or (3) Which would otherwise be deemed dangerous, but upon review of the facts is declared and designated a vicious animal, after a hearing in accordance with the rules and regulations of the Parish of Jefferson. (b) It shall be unlawful for any owner to allow a potentially dangerous animal to be outside of the dwelling of the owner or outside of its kennel unless it is securely muzzled and restrained with a chain having a tensile strength of three hundred (300) pounds and not exceeding three (3) feet in length. (c) The potentially dangerous animal shall be under the direct control, supervision and physical restraint of the owner or other responsible person whenever it is outside of the dwelling of the owner or outside of its kennel. (d) The required muzzle shall be made in a manner that will not cause injury to the dog or interfere with its vision or respiration but shall prevent it from biting any person or animal. (e) Nothing in this section shall be construed to relieve pet owners of their duties imposed by other sections of the Westwego Code of Ordinances. Sec. 4: Dogs running at large prohibited; leash requirements; Jefferson Parish Animal Shelter Department authorized to impound dogs running at large. (a) No dog shall be permitted to run or be upon any street, alleyway, highway, common or public square, unless held under leash and accompanied by its owner or keeper. (b) Whoever shall keep a dog or shall permit the same to run at large, unleashed and unaccompanied by its owner or keeper, in the streets, parks or other public places of the City of Westwego, shall be subject to the penalty imposed by section of this Code and it shall be the duty of the Code Enforcement Officer and the Jefferson Parish Animal Shelter Department, or its agents, to seize and impound any such dog, wherever found. Sec. 4: Jefferson Parish Animal Shelter Department directed to prepare and make available license tags; tag fees; registration of dogs by department. (a) The Jefferson Parish Animal Shelter Department is directed to cause to be made, prior to January 1st of each year, license tags made of aluminum, brass or other suitable material, numbered, bearing the calendar year, which license tags shall be distributed and placed for sale, commencing January 1st of each year, and Jefferson Parish Animal Shelter Department shall have the right to designate some suitable agents to handle the sale of such license tags in the City of Westwego, Louisiana. 7 (b) The Jefferson Parish Animal Shelter Department shall furnish such tags to all persons applying for same, at the rate determine by the Department, said tag to be available for use only for the year in which issued, and to be attached to the collar of the dog registered, as hereinafter set forth. Before said tag is delivered to the owner or keeper of any dog, it shall be the duty of the Jefferson Parish Animal Shelter Department through its proper official, to record in a book, kept for that purpose, the name and address of the person who owns or has charge of the dog to which the said tag is to be attached, a brief description of said dog and the registered number assigned to same. Sec. 4: Certificate of inoculation required before issuance of license; inoculation at time of license issuance; certificate fee. The Jefferson Parish Animal Shelter Department shall, before said license is issued, require the owner or keeper to present a certificate of inoculation of the dog with an approved and recognized antirabies vaccine, administered by a licensed veterinarian, or any other person designated by the health officer of the Parish of Jefferson. The date of administration of vaccine shall be within the same calendar year as that within which the license is issued, and wherever a dog has not been inoculated before the issuance of said license the said health unit, if the owner so desires, shall cause said dog to be inoculated with an approved and recognized anti-rabies serum which shall render said dog immune from rabies for a period of one year, such inoculation to be effected by a licensed veterinarian, or any other person designated by the Jefferson Parish Animal Shelter Department, or through his agent and shall issue to each owner a certificate of such inoculation at a charge as designated by the department. Sec. 4: Counterfeiting of license tags prohibited. Any person who counterfeits or imitates the license tag, or any person who shall put on a dog any such counterfeit or imitation tag, or who shall use a license tag on a dog for which it was not issued, shall be subject to the penalties provided for in this code. Sec. 4: Removal of license tag by person other than owner prohibited. Any person who shall maliciously or wantonly remove or cause to be removed, directly or indirectly, any such tag from the dog of another person shall be subject to the penalties provided for in this code. Sec. 4: Impoundment of dogs found at large; redemption requirements; redemption fees. Any dog found on the streets, roads, highways or in parks or other public places, within the corporate limits of the City of Westwego at any time without a leash and unaccompanied by its owner or keeper, shall be seized and impounded by the Code Enforcement Officer or Jefferson Parish Animal Shelter Department or its agents. If the owner of said dog does not possess a certificate of inoculation for the current year, said dog before being released to its owner shall be inoculated with an anti-rabies serum, as above set forth. If such dog shall bear a license for the current year, then such owner shall pay the sum designated by the Parish for the release of said dog. If such dog shall not bear a license then the owner before release of such dog, shall pay to the Jefferson Parish Animal Shelter Department or its agent the sum as determined by the department which will cover the cost of inoculation before release, as well as the cost of the license tag for the current year. In addition to the charges to be paid to the Jefferson Parish Animal Shelter Department for the release of any impounded dog, any owner who has permitted his unlicensed dog to roam at large in the streets, road or highways or in the parks or other places of the city, without leash and unaccompanied by the owner or keeper, shall be guilty of a violation of this part and shall be subject to a penalty, as set forth in this code. Sec. 4: Escape of dogs captured running at large; refusal of owner to deliver said dogs. Should any dog be captured while at large by the Code Enforcement Officer or Jefferson Parish Animal Shelter Department or its agents and shall escape from said agents by entering premises of the owner or keeper, and such owner or keeper refuses to deliver such dog to such agent, such owner or keeper shall be subject to the penalties provided for in this code. 8 Sec. 4: Redemption of dogs, time limitations. Any person claiming a dog seized under the provisions of this part and providing ownership thereof shall be entitled to possession of such dog upon payment of the amounts stipulated to be paid in accordance with the amounts as provide by the Parish of Jefferson, however, that such claim shall be made before the expiration of five (5) days. Sec. 4: Destruction of impounded dogs held over five days. Any dog not redeemed within five (5) days after being taken shall be destroyed or otherwise disposed of by the Jefferson Parish Animal Shelter Department. Sec. 4: Destruction of vicious dogs by Animal Shelter Department; other persons prohibited from destroying dogs. The Jefferson Parish Animal Shelter Department or its agents shall destroy any vicious dog found in violation of this part, which cannot be safely taken up or impounded, but it shall be unlawful for any other person to kill any dog by shooting or poisoning at any other place than the dog pound, except in a case of an emergency. Sec. 4: Impoundment of dogs that have bitten someone or are suspected of having rabies; destruction of dogs showing signs of rabies. It shall be the duty of the Code Enforcement Officer and Jefferson Parish Animal Shelter Department or its agents to impound or cause to be impounded any dog or other animal that has bitten a human being within the corporate limits of the City of Westwego, or which has been bitten by any animal having rabies or any infection associated therewith, for a period of at least ten (10) days for observation, and if such animal so impounded shows indication of rabies, it shall be the duty of the Jefferson Parish Animal Shelter Department to destroy such animal. Sec. 4: Jefferson Parish Animal Shelter Department directed to maintain animal pound, registration records. The Jefferson Parish Animal Shelter Department or its agents shall maintain a proper shelter and pound for all animals seized by it, shall keep proper books in which shall be registered all dogs brought to its pound, by whom brought, and the time of their being released or destroyed, and the amount of fees paid, which books shall be open at all times for public inspection. Sec. 4:128. Enforcement agents authorized to patrol for stray, homeless dogs. The Jefferson Parish Animal Shelter Department or its agents shall have power to patrol the streets, roads and highways of the City of Westwego with proper and suitable dog wagons, to employ proper agents, and shall have the power to perform all such acts that may be necessary to efficiently catch and impound all stray, homeless or vicious dogs which may be found in the streets, parks or public places of the City of Westwego. Sec. 4: Interference with agents in performance of duty prohibited. Any person or persons who shall hinder or molest, or interfere with Code Enforcement any officer or agent of the Jefferson Parish Animal Shelter Department in the performance of any duty provided for by this part shall be deemed guilty of and shall be subject to the penalties provided for in this Code. Secs. 4:130 4: Reserved. Sec. 4: Transporting requirements for kennels and guard dog services. No small animal shall be transported by a commercial kennel or guard dog service, whether by private or public means unless individually housed in a container designed for that purpose, including provisions for adequate ventilation and food and water. The container must open at one end, have a solid top and bottom and a minimum of fifteen (15) percent of the total accumulated side and end area shall incorporate an open grill for air circulation. Open space shall be maintained around the outside of each animal's container to ensure adequate ventilation. Westwego, Code of Ordinances Page 8

9 Sec. 4: Notice required for premises protected by K-9 or attack trained dogs in the city. (a) Any person, firm or corporation employing the use of K-9 patrol dogs or attack-trained dogs in the City of Westwego shall post a sign both on the gate and building entrance indicating that said location is protected by K-9 patrol dogs and/or attack-trained dogs and give the telephone number and address of the person who can control said dog in the event it is necessary to make an emergency entrance into said enclosure or building. (b) Any person, firm or corporation employing the use of K-9 patrol dogs or attack-trained dogs in the City of Westwego shall notify both the police and fire departments of the location using said K-9 patrol dogs or attack-trained dogs and provide a telephone number where a person may be reached in the event of an emergency who can control said dog or dogs; said notification shall either be by appearing in person at each said office, or by notice sent by registered mail to the respective departments. Sec. 4: Reserved. Provided that a majority of the City of Westwego Council have voted in favor of this ordinance, this ordinance shall have the full force and effect of law at midnight on the tenth day following the Clerk s presentment of the same to the Mayor, in accordance with Louisiana Revised Statutes 33:406(C)(2) unless the Mayor returns the same, unsigned, to the Clerk during that ten-day period.
