2 Welcome Letter May 14, 2009 Dear Friends and Neighbors, The Staggs and the Kauffman s welcome you to Farms, Heritage Cattle Company, and our first Beefmaster & E6 Production Sale we call The Promise. You may not know that our whole operation began way back in A then-teenaged boy promised his 15- year-old sweetheart that one day they would own a farm where they could rear a family and raise a hundred head of the finest, hardest-working cattle this region had to offer. In 1983, we started out with a few acres that most others would reject, a mish-mash of solid rock, soggy marsh, and ravines that just held the world together. We and our two toddler daughters straightened ancient fences, picked up rocks, and made make-shift gaps of rusty barbed wire to hold the small herd of ten cross-bred cows. That winter, we learned hard lessons in veterinary medicine, relying on the knowledge and skill of a friend from high school who happened to be the town s newest and youngest vet. We furthered our education by observing the viability and marketability of breeds like Santa Gertrudis, Angus, Jersey, Charolais, Brangus, and black baldies. Working the cattle with horses and a few brave friends and neighbors, we started to see the inherent safety feature ready-made in polled cattle as we worked in the close quarters of a make-shift corral and a rusty old squeeze chute. In time, a cousin named Uncle Fox led us to study a South Texas breed of cattle called Beefmasters in a publication called The Beefmaster Cowman magazine. We were sold on the six essentials highlighted by the breeders organization conformation, milking ability, fertility, disposition, hardiness and weight - not bred for color of hide, but for quality lean beef. Packed into a VW Rabbit, we two couples drove all over South Texas and finally bought a dozen old mama cows we affectionately call the Twelve Apostles from a legend among breeders named Jack Dunn. And of course you can t have mama cows without a good bull to breed em. So the search began in earnest for The Bull, a polled and correctly-made Beefmaster bull. Now back then, in this part of the country, red and polled sold best. So our search for The Bull narrowed further and finally ended in Kaufman, Texas, at the ranch of another legend, Frank Gordon. Mr. Gordon had the biggest, prettiest and gentlest cattle we d ever seen, so we found a young red, polled bull that was hotterthan a-pistol, called him Quincy, and carted that 1800-pound calf home in a horse trailer on a bumper hitch! Every time he shifted his weight, the whole truck swerved! Quincy and the twelve apostles gave us some good polled calves. Under the Gordon s tutelage, we learned to inspect, feed and breed cows that were mostly polled and mostly red, two qualities that sold well here in central Arkansas. We picked up a few more mama cows from Layton and Correne Adams of Beeville, Texas, and learned more about breeding cattle, along with the importance of record-keeping, and the help that breeders can receive from the breeders organization, then Beefmaster Breeders Universal. The Adams easy-keeper cattle with strong maternal traits and consistent femininity added depth to our Arkansas herd. A body can t go very far into Beefmaster territory without running into a piano-playing cowboy by the name of John Newburn. Sent out as a BBU field man at the ranch-owner s request, this guy traveled more than Rod Stewart on tour! John came to our Arkansans -excuse-for-a-ranch to inspect and classify animals, and to offer advice with the intent of certifying that only those animals exhibiting the best of the six essentials were being perpetuated in the breed. Through the years, John, Jerry Hemphill and others looked at our growing herd, and we learned not only which animals did and did not fit into the breed s standards, but also the reasons behind

3 those standards. The consistent guidance provided by our organization, as well as by some of our fellow breeders, like Rose and Royce Witte, and Charlie Jones, has proven to be without price in our education and continuing enthusiasm for this impressive breed of cattle. In more recent years, our friends Anthony Mihalski, Dan Waddoups, Mike Green and Bruce Robbins have helped us locate and procure the kind of cattle that retain the predictable maternal genetics of our breed. Our herd maintains a strong emphasis on the 6/2 and 293 maternal lines, blended with modern herd sires to help produce efficient and marketable cattle that will work in anyone s cow herd. This state has always had a lot of Angus cattle. We have been knocked out by the improvements that Beefmaster bulls can make on red and black Angus mama cows. In an effort to show this to local ranchers, the son God gave us, Chris Kauffman (Kauffman Farms), and David have joined forces to create Heritage Cattle Company, raising both purebred and E6 replacement females for local ranchers and growers. The E6 heifers out of these pairings are generally more adaptable to the warmer climate we re seeing now. They stretch out more, weigh more, have no trouble calving, and they raise heavier calves for more money across the scales. And the purebred Beefmasters from Heritage speak for themselves. 5 Dear Beefmaster Breeders, The and Heritage breeding program is a symbol of historic value in the Beefmaster breed. Though there are some breeders who have been in the business longer, few have an entry date dating back to the late seventies. Doc and Mrs. Beverly have one of the most complete collections of the Beefmaster Cowman magazine you will ever see, to include several issues pre dating E.C Larkin. The relationship between the Staggs family and Chris Kauffman also goes clear back to Chris s childhood when he attended school in Searcy and lived with the Staggs family. For many years Chris ran the program and eventually he and the Staggs formed the Heritage partnership in addition to the program. The base herd focused on red, polled, Beefmaster genetics paying strict attention to an industry acceptable phenotype and performance. You can still find these genetics in many of the cattle today. Like all progressive breeders, and Heritage has evolved with the times. The modern day program now includes some of the most popular cow families in the breed, while still maintaining a strict protocol for phenotype and performance. You will notice marketing is also a very important part of the operation, hence the E6 program. In an effort to demonstrate how well a Beefmaster bull works on red and black Angus cattle, Doc and Chris established a herd of red and black Angus females to produce E6 s out of. 7 GeneSTAR s represent a new DNA era for genetic improvement in beef cattle. Incorporating a 56-marker panel for three economically important traits, GeneSTAR s are the most useful DNA-marker tools for genetic improvement to date. The product provides Molecular Value Predictions for the core traits of feed efficiency, marbling 1 and tenderness. Molecular Value Predictions (s) GeneSTAR s are by definition a molecular breeding value based on the effects of the specific markers in the current panel. Thus, they represent a portion of the expected underlying genes affecting the traits. By definition, an is similar to an estimated breeding value (EBV) from a genetic evaluation in how it is expressed. The difference is that an EBV is based on phenotypic records of the animal and its relatives, whereas an is derived from an animal s genotype only. From Stars to s The reporting format of GeneSTAR s has evolved from the original star-based system. The star system reported a result based on the number of favourable alleles present for a particular trait, with a maximum of eight stars for each of the three traits reported. GeneSTAR Traits The GeneSTAR platform currently produces s for the traits of feed efficiency, marbling and tenderness. As GeneSTAR s are reported in trait units, it is important to understand how each of the traits assessed is defined and measured. (See table below.) Feed efficiency is predicted on the basis of net feed intake (NFI), which measures the difference between an animal s actual and expected feed intake based on its body weight and growth rate. The GeneSTAR for feed efficiency is reported in kilograms of feed consumed per day compared to the predicted required feed intake in kilograms with a negative feed efficiency value being favourable (i.e., more feed efficient). Marbling is a visual assessment of the degree of intramuscular fatness in the longissimus dorsi (ribeye) muscle and is a predictor of overall eating quality. The GeneSTAR for marbling is reported as AUS-MEAT Marble Score with a positive marbling value being favourable (i.e., higher marbling score). Range* Min: Max: 1.08 Min: Max: 1.11 Tenderness is predicted on the basis of the peak force required to shear cooked steak after 14 days of postmortem aging. The GeneSTAR for tenderness is reported in kilograms of Warner-Bratzler shear force with a negative tenderness value being favourable (i.e., more tender). 8 GeneSTAR Range and % Reliability Described Range % Reliability Feed Efficiency (kgs) % Marbling (0 9) % Tenderness (kgs) % GeneSTAR Applications GeneSTAR s are a prediction of phenotypic performance of the animal tested, based on the genetic potential that can be expressed by that animal in the production environment. s quantify an animal s ability to perform for a particular trait. As such, they provide the background genetic profile information that can be employed to make breeding decisions or decisions about how the animal should be managed and what specific supply-chain endpoints will maximise the animal s ultimate value. GeneSTAR s are powerful tools for making genetic improvement in both seedstock and commercial cow-calf operations through improved bull selection. Additionally, by having GeneSTAR s available on the cow herd, producers can make improvements in the reliability of their selection of replacement females. GeneSTAR s are also ideally suited to sorting animals based on their s into feeding regimens to more consistently achieve end-product specifications more efficiently. Additionally, application of tenderness and marbling s has high value within supply chains seeking to differentiate product based on eating quality. GeneSTAR Reliability Value Reliability value is the standard for assessing the accuracy and predictive power of the for a trait. Reliability is based on the correlation between the and the animal s genetic breeding value if all information were known. The reliability value is expressed as a percentage of the maximum accuracy attainable and is a useful indication of how much additional information may be added in the future as greater numbers of markers are added to the panels used to calculate the. GeneSTAR Summary Statistics A new inclusion to the GeneSTAR reporting and results system is the generation of breed-specific percentile ranks. Every animal tested in the GeneSTAR system is benchmarked against all other animals tested for its respective breed and assigned a percentile ranking. Animals are ranked from 1 percent to 100 percent, with 1 percent being the best possible rank and 100 percent being the worst. A summary table is also included on the final page of the report showing maximum, minimum and average and reliability values for each of the traits. A breakdown of how the s for the group of animals tested are distributed across the breed is also provided in the form of a breed quartile summary table for each of the three traits. 10 TERMS AND CONDITIONS OF SALE ADOPTED BY BEEFMASTER BREEDERS UNITED 1. BIDDING: Each animal will be sold to the highest bidder without reserve. 2. BIDDING DISPUTE: The Auctioneer in charge will settle any dispute as to bids, and his decision on such matters shall be final. 3. TERMS: Terms of the sale are cash due upon sale, unless prior credit arrangements for the sale have been agreed upon in writing between the Buyer and Seller, in which event, the terms of the written credit arrangement between Buyer and Seller for the sale shall prevail. The failure of a member buyer to pay the appropriate party the sale amounts when due may constitute a cause for exclusion from BBU pursuant to Article I, section 9 of the By Laws of BBU. 4. PURCHASER S RISK: Each animal becomes the risk of the purchaser as soon as the auctioneer declares it sold. 5. CERTIFICATE OF BREEDING AND/OR TRANSFERS: All required paperwork will be transferred to the buyer at the seller s expense, upon settlement. 6. HEALTH: All animals will have appropriate certificates of veterinary inspection for travel to the sale site and will to the best of the seller s knowledge be eligible for interstate shipment, however, buyers need to be aware of their individual resident states requirements for shipment of cattle. Any and all testing will have been completed within thirty (30) days of the sale date. 7. ANNOUNCEMENTS: Any changes in information of any kind will be announced from the auction box and such announcements shall take precedence. 8. BREEDING GUARANTEES: FEMALES: OPEN AND/OR EXPOSED FEMALES: Females younger than twenty-four (24) months of age can be sold as open. Open females are so guaranteed. Any female is considered a breeder if she is certified to be pregnant by a licensed veterinarian at the time of sale and/or has a nursing calf at side. Cows (including donor cows) with calves at side six (6) months or older must be certified to be pregnant by a licensed veterinarian. SAFE IN CALF FEMALES have been examined by a competent veterinarian and are so guaranteed. BULLS: Bulls eighteen (18) months or older are guaranteed to have passed a Bull Breeding Soundness Evaluation (BSE) and to have been confirmed a satisfactory potential breeder by a licensed veterinarian within forty-five (45) days prior to sale date. The results of the Breeding Soundness Evaluation (BSE) must be reported on a fully completed official form used by members of the Society of Theriogenology and attached to the health papers required for the sale. 9. If known to the seller, there must be a disclosure in the current sale catalog or from the box of any circumcision or other surgical alteration of any underline of any male or female and of any single egg or super-ovulation flush of any female sold in a BBU Approved Sale. 10. INHERITED DEFORMITIES GUARANTEE: All bred females are guaranteed not to produce a calf with an inherited deformity occurring in Bovine for a period of nine months following date of sale. 11. GUARANTEES: All guarantees, if any, shall be such as agreed upon between the seller and the buyer and are not those of BBU. Any representations made in Sale Catalogs, which are not expressly assured by these Terms and Conditions of Sale or the BBU Voluntary Approved Sales Agreements are those of the seller only and are not assured in any way by BBU. 12. RIGHTS AND OBLIGATIONS: The above terms and conditions of sale shall constitute a contract between buyer and seller of each animal and shall be equally binding upon both. Each sale or resale of an animal constitutes a separate transaction. Neither BBU, the sale manager nor any other person connected with the management of the sale assumes any liability, legal or otherwise, for any subsequent resale of an animal. 7/10/06 BEEFMASTER BREEDERS UNITED VOLUNTARY APPROVED SALE AGREEMENT 1. BBU Terms and Conditions of Sale will be strictly adhered to by buyer and seller. 2. All cattle to be sold shall be represented by the seller as properly identified with permanent identification number. All identification numbers and holding brands, branded or tattooed on an animal, and the description must match identically the identification numbers, holding brands and description listed on the Certificate of Breeding. 3. The designated BBU official responsible for implementing the above regulations will be at the sale site in ample time to inspect cattle and the accompanying records. All inspections will be carried out with utmost discretion. 4. All cattle, regardless of any classification carried, will be examined to determine that they meet the minimum standards set forth in the BBU Standard of Excellence. All cattle exhibiting any genetic defect that, at that time, in the opinion of the designated BBU official would be a detriment to the breed, and any cattle that, at that time, in the opinion of the BBU official would classify X under the BBU Voluntary Classification Program will be removed from the sale offering and the Certification of Breeding will be surrendered for cancellation. Any animal at that time, that, in the opinion of the BBU official, would classify an underline score of 4 and/or a conformation score of 4 according to the BBU Voluntary Classification Program, shall be immediately removed from the sale offering. Additionally, in BBU approved sales, no semen shall be sold from any bull not already classified or inspected for semen sales if, in the opinion of the BBU official, the animal would classify a 4 on the underline score and/or a 4 on the conformation score according to the BBU Voluntary Classification Program. 5. All cattle sold (with the exception of First and Second Cross calves under fourteen (14) months of age and the embryo recipients) must have BBU Certificates of Breeding. (All First and Second Cross calves under fourteen (14) months of age must be accompanied by a properly completed and executed Application for Certificate of Breeding.) The sale management or seller must present all Certificates of Breeding (or applications when applicable) to the BBU office fourteen (14) days prior to sale date. Substitute animals will be accepted provided the Certificates of Breeding (or applications) are in compliance with all applicable requirements upon arrival at the sale site. 6. On any lot requiring blood typing and/or DNA genotyping, the results of the blood typing and/or DNA genotyping must be received in the BBU office prior to the date of the approved sale or that lot of cattle will not be allowed to sell on the date of the approved sale. BBU approved sale catalogs must include the blood type case number and DNA genotype case number of all animals selling that have been typed; and include the blood type case number and DNA genotype case number of the sire and dam (if typed) of all animals selling. In the event the Board of Directors institute an investigation of the propriety of the certification of any animal or cause it to be carried out by a special appointed committee, the Board MAY, pending the decision of the investigating parties, suspend the registration of the animal in question and any further registrations of progeny of such animal, and BBU recognized sales or transfers of progeny, semen, embryos, flushes or pregnancies of such animal must involve notice by seller to the buyer or transferee of such investigation. BBU may require written proof of such notice unless it occurs in an Approved Sale. The Executive Vice-President shall notify the membership by direct mail or announcement in the official publication of BBU of the suspension of registrations of such progeny and of the notice requirements in reference to sales or transfers of such progeny or semen, embryos, flushes or pregnancies of such animal. Should such an investigation reveal that an animal did not qualify under the By-Laws or Rules of BBU in effect at the time it received its certificate to have received the category of certificate or the pedigree shown on same, the Board of Directors MAY take such actions as it deems appropriate to assist in parentage verifications and maintenance of breed purity including, but not limited to, the suspension or revocation of the certification of the animal in question. From lab reports and/or other accepted, credible evidence and the totality of the circumstances, the Board of Directors may determine the disqualification of the animal in question and will not, after such determination, register additional progeny of such animal which are born after 350 days after the date of a letter from the Executive Vice-President to the membership advising them of such determination. Unless fraud or intentional wrongdoing is reasonably proven by credible evidence to the satisfaction of the Board of Directors, all progeny registered to the animal prior to the notice of disqualification will be left in the registry, but owners of same will be notified of the disqualification and the date it was determined. Additionally, unless fraud or intentional wrongdoing is reasonably proven by credible evidence to the satisfaction of the Board of Directors, all progeny of such animal born prior to or within 350 days after the date

11 of such letter from the Executive Vice-President to the membership advising them of such determination may be registered, but their certificates will disclose the respective parental disqualification. Sales or transfers of such registered progeny, or progeny which may be so registered, in BBU Approved Sales or otherwise will be recognized by BBU provided the buyer or transferee is by the seller given notice of such disqualification prior to incurring any obligation for same. BBU may require written proof of such notice unless it occurs in a BBU Approved Sale. BBU will not in a BBU Approved Sale or otherwise recognize sales or transfers of suspended or disqualified animals, nor of semen, embryos, flushes or pregnancies from a disqualified parent which occur after such a notice of determination of disqualification. The respective owners must disclose any suspensions and revocations of the certificates of any animal in the pedigree of any animal consigned to a BBU Approved Sale and must provide any notices resulting under the above rules in reference to any lot sold in an Approved Sale by listing them in the sale catalogue under the information for that animal s lot number. If any such suspensions, revocations or notice requirements arise after the sale catalogue has been printed, the respective owners of the lots involved must have announcements made from the box in reference to such resulting suspensions, revocations or notices prior to those animals being sold. The provisions of the Approved Sale Agreement and of the Terms and Conditions of Sale for BBU Approved Sales shall not alter any relevant agreements existing between BBU and any of its members as of October 26, All semen sold at a BBU Approved Sale must have a completed BBU Semen Bill of Sale provided at the time of the sale. The BBU Semen Bill of Sale shall include, if applicable, the blood case number and DNA genotype case number of the bull whose semen is sold. If an animal is classified, such classification must be reflected in the catalog, as provided for below or on the pen card if applicable or announced from the box. 12 9. Fees for all services rendered in BBU Approved Sales are: a.) $1,250 or $10 per head inspected, whichever is greater. b.) All transfer fees on all cattle for which the seller has received full payment must be paid to BBU within thirty (30) days after date of sale. Failure to comply with this transfer fee payment policy will result in the transfer fee doubling, after thirty (30) days from the date of sale. c.) If full payment of the inspection and transfer fee is not received by BBU within sixty (60) days from the date of sale, the member or members will be in violation of this agreement. d.) A $500 non-refundable, non-transferable deposit is required from any member(s) to secure/schedule an Approved Sale date on the official BBU sale calendar.
