Coopers Beach Longer Comments regarding date and time restrictions of dogs on beaches: Even though the restricted times are mentioned at Coopers Beach on the sign for "on leash" times, a very large number of dog owners do not adhere to this rule. I feel also writing on the sign that owners can be fined (and list the amount) if they are found to be breaching this rule. Do you agree with the proposed Special Character restrictions? I also feel that dog owners should have a licence to own a dog as well as to be responsible for the registration and micro chipping. Page 2

As I have mentioned above due to dogs fouling on beaches and irresponsible dog owners Do you have any other comments to make about the proposed District-Wide rules? Nuisance Section and 14.4 plus Section 15 and 15.1 plus offences and penalties Dog Control Act 1996 and local Government Act My concerns have been ongoing for the past 3 years and have been recorded under RFS and numerous other RFS prior to this. As ratepayers we do not have the same rights as dog owners. We live in Coopers Beach and for the past 3 years have been subjected to relentless nuisance barking dogs. The dog owners seem not care about the noise affects on other residents. Where is the justification when someone who holds a noisy party and someone complains, that the party house can be shut down by the law. However on the other hand dog owners who allow their dogs to bark all through the day and night seem to have free reign. As mentioned, for over 3 years both myself and other concerned and annoyed neighbors in our street have come up against a brick wall. I have complained to the FNDC, Housing Corp and Dog Control and I am aware my concerned neighbors have done the same. It had got to the stage where I had to sleep in another location in our home, also wearing earplugs to try to elevate the sounds of numerous barking dogs and to try to sleep over the noise. It certainly has affected my health and well being - not only myself, but also my husband and other visitors who have stayed and tried to sleep over the barking dog noises. This major issue needs to be able to addressed more seriously and the irresponsible dog owners should be penalized and barking collars should be worn by the offending dogs. If they continue to be a nuisance by continued barking they should be able to be removed from the owner by the Council for the benefit of all others. Please ref to Section and I would like to know WHAT ACTION will be taken to alleviate these ongoing issues under your new Dog Management Policy and Bylaw Additional Supporting Information Page 3

5 1. Please see attached photo showing dog faeces on the rocks at the entrance onto the popular walking and swimming, Coopers Beach. 2. Also, on this same day, during my walk along Coopers Beach, some dog owner had at least collected his dog s faeces and placed them in a plastic bag, however, has inconsiderately just left them behind on the steps entrance to the Beach Lodge Motels. 3. Several days earlier, during my walk along State Highway 10 by the Coopers Beach playground, at the entrance to the bridge, three separate very large piles of dog droppings were left along the well used footpath. I had to scrape them off the footpath as two piles had been trodden on. Page 4

Provided dog owners play by the rules and have their dogs off the beach between 9am and 6 pm I see no reason to single Taupo Bay out. The status quo has worked well for decades. Better signage of the rules would help behavioural issues. Clear signage of rules at all beach entry points are needed - particularly in the interest of bird protection - this is not presently the situation at Taupo Bay, hence the issues there. You need to consider ownership as against people who board or look after well-behaved dogs for limited times. eg Dog kennels, doggie home stays, who walk the dogs. Also SPCA. 20 Taupo Bay Dogs Owners Group Submission The Taupo Bay Dogs Owners Group (Taupo Bay DOGs) is a group of 85 families who either live in Taupo Bay, own a holiday bach or are frequent visitors to Taupo Bay. All of the members of the group currently own a dog, or love dogs, and regularly exercise their dogs on Taupo Bay beach. This group is constantly growing as more people hear about the proposed dog rules for the beach. Taupo Bay is a small seaside community in the Far rth. Whilst it is primarily made up of holiday baches, there is a steady year round community of permanent residents as well. The Taupo Bay DOGs represent the majority of the population of the Taupo Bay Community. All members of the Taupo Bay DOGs have requested to become members of the group (and not simply had their details added as has been suggested in the past). The purpose of the Taupo Bay DOGs is to ensure that our dogs have off leash access to the beach all year around. In the absence of any other area in Taupo Bay to exercise our dogs, we need to be able to give them a run on the beach. Our supporters provide operational and non - operational support to assist our local community on Governments Landcare based Pest Control Programme, Pest Free New Zealand by This involves trapping possums, stoats, weasels, feral cats and rats, in partnership with Department of Conservation and Regional Council. Already into our second year we can see signs of recovery of the natural vegetation and we are optimistic that the small population of resident kiwi will also flourish. Ngaire Tyson of Kiwi Coast reports that in areas where there is sustained pest control there is anywhere between 5 60% increase in the survival of kiwi chicks (through to juvenile stage, where they can largely fend for themselves). This will only be confirmed when call counts are carried out 1 Page 19

21 next winter. Traps are also laid adjacent to the beach fore dune area to provide predator protection for our Dotterels. We applaud the effort of everyone involved managing and supporting this project. The Taupo Bay DOGs have been lobbying the FNDC since October 2017 to ensure that our dogs have off leash access to the beach in the dog bylaw/policy review. It is with dismay that we read in the proposed bylaw/policy that there is to be no off leash time on Taupo Bay beach at all. DOG EXERCISE RULINGS There are 3 specific areas to the Taupo Bay Beach. 1. Southern Marlin Drive beach entrance to the bluff. This is a dotterel nesting and breeding ground. The Taupo Bay DOGs have been working Bay Bush Action to identify the best area to be specified as a wildlife protection zone and all this information has been passed onto the council for inclusion in the bylaw. We are pleased to see this has been covered under the Special Character Rules as a dog prohibited zone. The Taupo Bay DOGs will work hard with the local community and visitors to ensure all dog owners are aware of this area and the importance of keeping their dogs away. The Taupo Bay DOGs agree with this dotterel protection area. 2. rth of the southern Marlin Drive beach entrance, toward the boat ramp. This has been included in the section of Exceptional Rules for Beaches being that these beaches are popular with visitors and holiday makers. Taupo Bay is a popular holiday and day trip destination during the summer holidays (December January) and many of these visitors bring their dogs with them to the beach. We appreciate that it is not desirable to have dogs off leash during the day when the beach is busy with visitors, however early in the morning and late afternoon when the beach is quiet is when people need to be able to walk their dogs off leash. The beach is busy during the summer school holiday period (December January) with a few visitors in February then the beach is quiet again. The summer period needs to be ideally from December to January but certainly not until the end of March. 2 Page 20

22 Taupo Bay beach 7 th January (notice lack of people on beach) After February the beach is often deserted and this is when the locals and bach owners get to appreciate and enjoy the beach with their dogs. There is absolutely no merit to have this section of the beach as on-leash throughout the off peak visitor season (April vember). A local family and members of the Taupo Bay DOGs wanting to run their dog off leash on the beach. Despite repeated requests we have been unable to get an answer from the FNDC on why Taupo Bay is the only beach in the Far rth under the Exceptional Rules for Beaches to be on leash during the winter season. On what basis was this decision made? Where are the visitor numbers that support this decision? Remember that the Exceptional Rules for Beaches is for tourist beaches and not wildlife protection which is covered under the Special Character Rules. Visitor numbers actually fall sharply at the end of January when school Term 1 commences and many people return to work. The Taupo Bay Holiday Camp Manager confirms that well over 90% of campers depart by the end of January each year. 3 Page 21

23 Taupo Bay DOGs is a large organised group and we are committed to promoting responsible dog management. Around 4 out of every 10 properties during the summer visitor season has at least one dog, and,as an organised group, we have planned a number of simple initiatives that will maintain and further improve Taupo Bay for the enjoyment of permanent residents, bach owners, book a bach type renters, day visitors and dog owners alike. Programmes such as promoting and advising visiting dog owners about the by Laws through to producing and circulating a locally developed brochure about the Taupo Bay Dotterels, along with supporting Council with improved signage, will have immediate positive affects for everyone. The Taupo Bay DOGs would like to see the following rules applied to this section of the beach: 1 December 31 January: on leash 9.00am 5.00pm, otherwise off leash 1 February 30 vember: off leash Taupo Bay beach May t another person on the beach. 3. rth of the boat ramp There is no mention of what the rules are after the boat ramp. This beach area to around 100m from the rocks is mainly used for parking tractors over the summer and is unused by tourists. Our proposed off leash area is comparatively small and at high tide the beach is virtually unusable for public purposes. In addition it doesn t get any sun in the afternoons as it is in the shadow of a coastal hill. This confined space could be easily managed by dog owners and self-imposed or Council rules could be set. The Taupo Bay DOGs would like to see this area as an all year round off leash area. 4 Page 22

24 4. Signage There needs to be very clear signage of these 3 distinct areas so there is no confusion in the local community or with day visitors. COMMUNITY SUPPORT FOR SUPPORTING DOG RULES We ask that Council review the beach rules for Taupo Bay and make the changes as detailed in this Taupo Bay DOGs submission, as we represent the majority of the Taupo Bay community. If our dogs are given off leash access to the sections of the beach 2 & 3 as described above, we will commit to on going education of rules to visitors and the local community and support FNDC in ensuring rules are adhered to. Our group recognises that district wide compliance for Council is a big job and a significant call on it s resources. We believe that buy working in partnership with Council, implementation of our community lead compliance programme will have a major effect in achieving desired rates of compliance, by gaining the acceptance by dog owners, residents and visitors alike. We propose a range of very simple but effective measures. These will be lead by our Yellow Card imitative and our strategic monitoring programme. Council will be familiar with these initiatives from our earlier submissions. In addition, we propose a local flyer which will be distributed through our local book a bach organiser, and to other visitors to the Bay by direct marketing as required. We will ensure that our actions will be nonthreatening, positive and helpful, as opposed to promoting an enforcement role. The approach is not new and has proved very successful in a number of other settings. 2 DOG LIMIT We have concerns about the 2 dog limit rule. Many of the people in Taupo Bay DOGs have one or two dogs. They then often have other family members visit who also bring a dog with them which would exceed the limit of 2 dogs being on a property. There needs to be an inclusion that allows dogs to visit on a temporary basis for a period up to 3 weeks. Taupo Bay DOGs do not support the 2 dog limit without further information and would like a ruling that allows for extra dogs to be able to visit, temporarily. 29 Critical Analysis 8 Key Points Relating to Final Submission Possible Risk / Concerns Discussion Management Actions / Imperatives Taupo Bay Dotterels Nesting times are when Taupo Bay Dotterels are at their most vulnerable. We are working with DoC Kaitaia who are at the leading edge of Dotterel management; aimed at increasing bird survival rates. Our experience is that people pose more of a risk to Dotterels than do dogs. Our programme will support the use of FNDC professional signs. With our improved nesting response times we will erect cordons and shelters for fledgling protection to ensure that better survival rates are achieved. Currently a proliferation of home built signs appearing on the beach, cause confusion and appear to do more harm than good. Some donations have already been received to fund this work. We will also undertake work to safeguard fledglings from predation by Black Backed Gulls. We will educate and train local Dotterel enthusiasts on correct management practices if they are willing to undertake this work. Our members will continue to provide direct operational and non operational support to the T B Pest Control Group who work on a Landcare type project, (Governments Pest Free by 2050 initiative), controlling a range of pests, some of which affect Dotterels and Kiwi. Our shore bird researcher will complete a brief update of the dotterels and of their habitat and will produce a brochure for locals and visitors. 30 brochure will provide a measure of ownership to assist in our work. There are no By Law signs posted at access points for the southern one third to one quarter of the beach. The bylaw sign posted on the access way to the central area of the beach is incorrect. This will need to be addtressed. We will work in partnership with Council to erect and maintain standard Council signs, consistent with other access points. The health of the Taupo Bay stream which flows out at the end of the dotterel nesting area is being maintained, in partnership with Regional Council staff. Secure funding and engage former DoC shore bird researcher In partnership with Council post appropriate signs Kiwi Thankfully at Taupo Bay, in the last 25 years or so there has never been a kiwi dog kill, but this may happen in the future, but our intension is to absolutely minimise the chances of this happening. Recently Kiwi deaths have been, 5 Road Kills on the hill road out of Taupo Bay and 1 washed up on the beach. This bird was sent to DoC Kerikeri for examination and it was found to have no injuries. The death may have been the result of a flooded burrow during heavy rains and the kiwi washed into a stream and out the sea, although we can t be sure. In recent times the wider Taupo Bay catchment area is being intensively trapped for possums, mustelids, feral cats and rats, to improve the area flora and fauna, and in particular, to improve kiwi habitat. Of note, if any dead kiwi found during these operations were to be found showing signs consistent with dog attach, we Continue to work with Regional Council to maintain gains already achieved Continue to work with the Pest Control Group to improve conditions for the few Kiwi we have in the greater Taupo Bay catchment area. 42 Dotterel Nesting Times TAUPO BAY Dog Owners Group Breeding New Zealand dotterels breed in monogamous pairs, and vigorously defend territories against other dotterels. The nests of northern New Zealand dotterels are simple scrapes in the substrate, sometimes sparsely lined or decorated, often with a marker of driftwood or vegetation. Three eggs are laid, usually from August or September, and are replaced if lost. Incubation usually takes days; the fledging period is variable, but averages about 6 weeks. Double-brooding has been recorded but is not common. In both subspecies, female-female pairs occasionally form and lay combined clutches numbering 4-6 eggs. Nests of southern New Zealand dotterels are usually hollows in cushion plants or between rocks; they are extensively lined, commonly with tussock tillers. They typically nest later then northern birds, from October. Incubation and fledging times not well known; limited data suggest these are similar to those of the northern subspecies. Page 41

I think it is important to remember that our native birds have been here for thousands if not millions of years, and now the coastline is crawling with carnivorous mammals who's mere presence could stop a whole colony from breeding for a year or more. People choose to own dogs, and it should be a privilege not a right. Native threatened animals rights should be a priority as should other peoples' enjoyment of beaches and parks, and only after that should dog owners' and dogs' rights be heard. If dogs are to be excluded from any area for the protection of wildlife, there should be reliable scientific data supporting that ban. 2. Council staff need to meet with locals in each area, and work out local solutions with Iwi, dog lovers and wildlife specialists. I support the submissions from the Taupo Bay DOGS, Mary Woodworth from Tauranga Bay, and the Hihi Beach community submission. 3. Council must consult effectively with Iwi on this bylaw and policy, over time, meeting face to face. 4. In every town in Te Tai Tokerau, there need to be places for dogs to run off-lead - parks, reserves, and beaches - within walking distance of people's homes. 5. All parks and reserves should be off leash and under control unless there is logic/a rationale for that not to be the case. Some key areas to include, where there are very limited dog walking options, are Lindvaart Park and the Showgrounds in Kaikohe, and the Domain in Kerikeri. 6. All Reserve Management Plans need to open the door for off leash access, should the community so wish. 7. Council wants to limit dogs on beaches for cultural, wildlife and tourism reasons. Do not prohibit dogs from running off lead under the control of their owner on every other beach in rthland, for no good reason. The default rule, for most beaches, must be off leash. 8. Walking our dogs on the beach, on a lead, harms no one. It is unleashed, out of control, or wandering dogs that are a danger. Do not prohibit us from beaches in tourist areas if our dogs are leashed. 9. The only properties with limits on the number of dogs should be those where there has been a problem with dogs in the past. Don't limit us all for no reason. r should the number of hunting dogs or working dogs be limited, they are tools of the job. 10. Hunting dogs ARE working dogs. Don't change this rule, they put kai on our tables. 11. Add sections on solving the problem of wandering dogs, neutering programmes, education in our communities, and teaching kids about dog safety and dog welfare. 12. 62 I am also a member of the Whakaangi Land Care trust which manages trapping, poisoning and the conservation of kiwi at both ends of the Hihi peninsula. We have developed a good relationship with residents in Hihi and do not want to see any further restrictions placed on Hihi dog owners. It is not our wish to close the beaches to dogs or prevent dogs from running lead-less on the beaches provided they are under control. Each year we sponsor kiwi aversion therapy for residents, farmers and pig dog owners in the vicinity and this is well received and patronised by local dog owners. Dogs are not the problem in Hihi that the knee-jerk reactions of council would indicate. Further council restrictions by council will alienate the community and lead responsible dog owners to stop registering their animals - which are not a problem in the first place. Hihi is a mixture of farms, baches and permanent residents. According to a Civil Defence census there are over 200 dwellings in the area, 115 permanent residents 98 batches and over 20 farms and empty sections. Last summer I learnt the names of 50 dxifferent dogs -either permanent residents or holiday makers. In high summer we walk our dogs before 9am and after 6pm when there are no crowds on the beaches. w council wants to remove that right and prevent dogs from running or swimming anywhere in our area. It is simply not a good idea - and those who are currently registering their dogs will have no further incentive to register their animals. Page 61

I am concerned that responsible dog owners are being targeted by people reviewing the dog by laws due to an over active and some time unreliable conservation information. I am an active conservationist and dog owner. I believe a realistic management is essential. Conservation needs to include predator control as well as dog bylaws. Education a signage. I live full time at Taupo Bay and most times look to see a completely dog /person free beach. To punish a full time responsible, law abiding, predator trapping dog owner is unfair. An alternative to Special Character protection would be default rules prohibiting dogs from specified habitat types, as has been put in place for wetlands and estuaries around some of the Auckland coastline. We also suggest that council consider changing the name for these areas to something that more clearly communicates the purpose for which they have been set aside. There is no policy specific to wildlife protection, the special character rules apply to only a handful of popular beaches and the policy is silent on the importance of dog owner education and awareness. To address our concerns we request that council consider a default district wide rule requiring dogs be on leash in coastal area Page 79

81 Do you have any other comments you would like us to consider as part of this consultation? A detailed submission has been provided and should be read in full. To address our concerns we request that council consider the following amendments. - Coastal areas that are suitable for off leash dog exercise should be specifically identified in the policy. An effort should be made to identify enough suitable areas to satisfy the exercise needs of dogs and owners living in various parts of the District. Consideration should also be given to identifying appropriate year-round offleash dog exercise areas in the coastal environment. - The policy and/or bylaw needs to be amended to define â œbeachâ. We understand through a council response via that â œbeachâ is interpreted as â œthe foreshore and any adjacent area that can reasonably be considered part of the beach environment including areas of sand, pebbles, shingle, dunes or coastal vegetation. This does include estuaries and the flat parts (not cliffs) of rocky shorelines.â It is unclear where this definition has been sourced from (it doesn't appear in the Dog Control Act) and it needs to be included to avoid confusion and make clear the effect of proposed coastal controls. - While not within the purview of this review, vehicles (and to some extent people) will also need to be excluded from Special Character Areas / dog exclusion areas if they are to be effective. Consideration should be given to designing / identifying areas so that further exclusions can be put in place where necessary. - More targeted rules to protect kiwi. These rules should include compulsory kiwi aversion training and radio tracking collars for hunting dogs, and additional controls on dog ownership and management in areas adjacent to critical kiwi habitat. These additional controls could include limits on the number of dogs allowed per household and a requirement for dogs to be kept in strict confinement during night time hours. These measures should be backed up by targeted education and awareness campaigns, and prompt enforcement action where there are indications that the rules are not being complied with. - Further guidance on dog owner responsibilities. The proposed policy needs to be amended to include further explanations as to how key dog owner responsibilities set out in the Dog Control Act will be interpreted and applied. Of particular concern is confusion around controls required on private property. Many dog owners think it is ok to let their dogs roam in unfenced areas while they are home (which is inconsistent with s52a(2) of the Act) and do not comply with night time confinement rules (s 20(1)(g)). This puts any nearby vulnerable wildlife (and people and property) at risk. This could be addressed by including similar text box notes to that included in Schedule 1 about accessing shared spaces. The text could, for example, specify that â œwhen on private property dogs are either required to be under direct control (i.e. you are outside with your dog and they are in sight) or have them confined so they cannot leave the property by means of a fence, leash, run or electronic fence.â We support the inclusion of a prescriptive definition of â œcontrolâ, but are concerned that the direction included in the operative bylaw that a dog should be within sight and approximately 10 meters distant has been removed. While these specifications might not be practical or enforceable in all contexts their inclusion is appropriate as a general guideline. The policy should be amended to include commitments by the council to ensure that: a. Dog owner education programmes, including native wildlife awareness and wildlife aversion training, are promoted and properly funded; b. Dog control operations and enforcement are properly staffed and funded; c. Adequate signage is erected and maintained to ensure visitors are aware of applicable controls; and d. Community conservation initiatives are supported, including signage and appropriate dog controls around their areas of operation. Regarding enforcement, FNDC should consider options to increase the ease with which public are able to report infringements of the bylaw. Commitment to support for wildlife protection awareness and aversion training is justified by evidence that dogs pose a major threat to a number of threatened indigenous bird species. Regarding support for community conservation initiatives, operational support would include establishing Special Character Areas around management areas, providing signage, establishing strong lines of communication to report issues and infringements and, where possible and appropriate, appointing volunteer dog control officers from within the membership. Appointing voluntary officers with some level of authority would assist in reducing monitoring costs for the FNDC. Page 80

The main purpose of Forest & Bird is the preservation and protection of the indigenous flora and fauna and the natural features of New Zealand. It is a not-for-profit organisation and receives no funding from the government. 2. The purpose of this letter is to provide feedback from the Far rth Branch of Forest & Bird on the Far rth District Council ( FNDC ) Statement of Proposal for the Dog Management Policy and Bylaw The Far rth Branch provided feedback on the FNDC Draft Dog Control Policy and Bylaw 2016, including attendance at hearings in Kerikeri and Kaitaia, and at key stakeholder meetings in Kerikeri and Paihia in Forest & Bird has an interest in ensuring that native wildlife (particularly birds that feed, roost, and nest on the ground) are protected from disturbance and predation by dogs. The essence of our feedback is that the proposed policy and bylaw do not go far enough to protect threatened native birds like kiwi from one of their biggest threats. With the alarming spread of kauri dieback disease in rthland we also need to ensure dogs do not go off tracks in kauri areas. 4.
