4 AMENDMENT TO THE ENGINEER S REPORT FOR THE DEVINE MUNICIPAL DRAIN January 21, INTRODUCTION The City of Ottawa appointed Stantec Consulting Ltd. on June 12 th 2013 to prepare an amendment to the Engineer s Report and Improvement the Devine Municipal Drain the Township of Cumberland 1973 herein called the original report. This amendment is being prepared under Section 78 of the Drainage Act. 1.1 ON-SITE MEETING An on-site meeting of the affected landowners and concerned parties was held on August 22, PURPOSE OF THE AMENDMENT REPORT This report will accommodate the land use and drainage changes within the Village of Vars and tributary to the Devine Municipal Drain watershed, i.e. from a rural use to urban usage, including the provision of a storm water management pond and the abandonment of part of the Branch Drain. 2.1 MODIFICATIONS The Devine Municipal Drain profile grade and location shall be in accordance with the original 1973 report. Modifications to the design include A 15 metre no touch zone for the housing development to the west of the Drain on the E1/2 at Lot 25 Concession 6. The profile drawings show the design profile grade and the top of bank elevation, the existing bottom elevation was excluded from the drawing superfluous to the maintenance requirements. Adjustments to the watershed boundaries as determined from the available plans and a field review. There is an existing Storm Water Management pond that is tributary to the Branch Drain of the Devine Municipal Drain. The developer s Engineer has confirmed that the pond operates in accordance with an approved 1996 Master Drainage Plan for the Village of Vars Expansion Area and controls peak water levels and release rates to the design targets. 5 AMENDMENT TO THE ENGINEER S REPORT FOR THE DEVINE MUNICIPAL DRAIN January 21, 2015 Based on the above verification that the SWM is functioning as intended in the Master Drainage Plan, there is no reason to recommend increases to the downstream culvert capacities or the design cross section of the drain, and the original report design will provide sufficient outlet capacity for agricultural flow. 2.2 BRANCH DRAIN MODIFICATIONS Abandonment Under previous development work, a portion of the Branch Drain was abandoned to allow for placement of a storm water management pond that outlets into the Branch Drain. Future Potential Culvert for 2123 Devine Road It is recognized that the 2123 Devine Road is severed by the Branch Drain. This report provides for a potential access for 2123 Devine Road as follows: Location Minimum Size Length Gauge 2123 Devine Road 1200mm installed per OPSD to 9 meters 12 or thicker The contractor for this culvert installation shall supply and install a minimum of 400mm of place rip rap for the full ditch section, at both ends. 2.3 ASSESSMENTS The assessments for future maintenance have been revised from the original report, to include block assessments for the Village of Vars, updating of properties names, areas, roll numbers and percentage of cost. The future maintenance assessments are provided in Schedules A, B and C (Appendix B) for the Main Drain from Devine Road to its outlet, for the Main drain from its commencement to Devine Road, and for the Branch Drain respectively. The total cost of the potential private culvert installation on 2123 Devine Road shall be assessed 50% to the owner of 2123 Devine Road and 50% to the City Roads. 3.0 EXISTING CONDITIONS With the exception of the upper section of the Branch Drain, part of which is to be relocated, the Drain location including plan and profile remains as defined in the original Engineers Report. 6 AMENDMENT TO THE ENGINEER S REPORT FOR THE DEVINE MUNICIPAL DRAIN January 21, 2015 The existing condition of the drain was rewritten and updated herein. 3.1 EXTENT OF DRAIN The Main Drain commences at a point located 365meters± east of the road allowance between Concession VI and Concession VII of the Township of Cumberland and 90meters north of the lot line between Lot 23, and Lot 24, Concession VI, run easterly for 674 metres through Lot 23 then southerly for 930 metres though Lot 24 and Lot 25, then run westerly for 33 metres, then southerly for 2219meters through Lots 25, 26,27 and 28 Concession VI crossing road allowance between Lot 25 and Lot 26 Concession VI and the railway allowance, then run easterly for 36.5 metres, then southeasterly for 460meters crossing Provincial Highway #417 and terminating with sufficient outlet at Station in Lot 22 Concession VI of the Township of Russell. With the abandonments in place to the Branch Drain; the Branch Drain commences at the outlet of the Storm Water Management Pond at a point located approximately 80meters north of the north limit of the road allowance between Lot 25 and 26, Concession VI (Devine Road), of the Township of Cumberland and approximately 145 metres east of the Trudeau Avenue Right of Way. From this point the drain runs south for 10 meters then turning 45 degrees east and flowing southeasterly for a distance of 100 metres. Then crossing the Devine Road, Right of Way via an 18 metre long 920mm diameter culvert where it then turn east and runs easterly along the road allowance for 36 metres, terminating with sufficient outlet into the Main Drain. The Main Drain is 4.35km long and drains approximately 243 hectares. The Branch Drain is approximately 165 metres long and drains the Storm Water Management Facility and its tributary area of approximately 57 ha. 3.2 PLANS AND PROFILES Updated plans and profiles for this drain are provided in Appendix A of this report Plan A revised plan has been prepared showing the boundary limits of the watershed by a shaded dashed line. The general course and extent of the proposed work is shown by means of a heavy line. The Block Assessment areas and roll numbers of the individually assessed landowners are shown as written text. 9 AMENDMENT TO THE ENGINEER S REPORT FOR THE DEVINE MUNICIPAL DRAIN January 21, DESIGN CONSIDERATIONS The land uses and drainage system within the watershed, upstream of Devine Road, has been modified by development. These land use and drainage modifications have been approved by the City of Ottawa, Ministry of Environment and the South Nation River Conservation Authority through the development application process. 5.0 CONSTRUCTION Construction of the Branch Drain and the Main Drain has been previously completed under the original report. Future maintenance will be in accordance with this report. 6.0 ASSESSMENTS The Drainage Act requires that the total costs of constructed and future maintenance be assessed against the affected lands and roads. 6.1 INITIAL COSTS The owners of the Shea Subdivision in Vars Part of Lots 25, Concession 6, City of Ottawa (Geographic Township of Cumberland) is the only benefitting owner and has agreed to pay all of the costs associated with this report amendment. As such, there is no distribution of initial costs to other landowners. 6.2 FUTURE MAINTENANCE COSTS The cost of any future maintenance is to be distributed to all landowners within the drainage area. Assessment schedules have been developed for the Devine Municipal Drain and Branch Drain that reflect a fair and equitable distribution of costs for future maintenance. These schedules are provided in Schedule A, B and C (Appendix B). The assessment percentages factor tributary area, current land use, location and length of drain. The maintenance schedule herein was compared against the original report, to ensure uniformity between reports. 6.3 BLOCK ASSESSMENT Lands that are located in the Village of Vars as indicated in the Drawings 1 and 2 (Appendix A) are charged as a Block Assessment. (1) The council of the local municipality may direct the engineer to assess as a block, a built-up area designated by the council, and the sum assessed therefore may be levied against all the rateable properties in the designated area.proportionately on the basis of the assessed value of the land and buildings. R.S.O. 1990, c. D. 17, s. 25 (1). Assessment to be charged against public roads (2) Where the engineer makes a block assessment under subsection (1), the engineer shall designate the proportion of the assessment to be charged against the public roads in the designated area. R.S.O. 1990, c. D. 17, s. 25 (2). 7.0 WORKING SPACE - FUTURE MAINTENANCE The working space shall be 15 metres from top of bank, on the east side from Station to and on either side for the remaining length of the drain. The designated working space shall be deemed to include access roads for fuel, service and material haul routes as approved by the Drainage Superintendent or Engineer or the property owner if lands are required outside of the designated width..
